1 MINUTES OF MARCH 26, 2018 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order at 1:00 p.m. GENERAL RELIEF HEARINGS Motion by Baker, seconded by Klein, carried unanimously, to enter executive session with General Assistance Caseworkers Doug Slaats and Nick Agan regarding case W Upon returning to regular session motion by Baker, seconded by Klein, carried unanimously, to approve $440 rental assistance Motion by Klein, seconded by Baker, carried unanimously, to enter executive session with General Assistance Caseworkers Doug Slaats and Nick Agan regarding case J Upon returning to regular session motion by Klein, seconded by Baker, approved with Wickham voting nay. Motion by Wickham, seconded by Klein, carried unanimously, to deny case B and case L-5-21 due to not showing up for the hearing. Motion by Klein, seconded by Baker, carried unanimously, to recess at 1:30 p.m. WORKSESSION WITH SUNNYCREST MANOR REPRESENTATIVES Upon reconvening at 2:45 p.m., the Board met with Sunnycrest Administrator Cris Kirsch, Sunnycrest Finance Director Emily Gosche, Acting Budget Director Denise Dolan. Gosche amended the FY15/16 cost report and found the ICF/ID Assessment payments were not being paid. Penalties total sixty thousand dollars. Motion by Wickham, seconded by Baker, carried unanimously, to recess at 3:25 p.m. WORKSESSION WITH FACILITIES MAINTENANCE SUPERINTENDENT REGARDING STAFFING Upon reconvening at 3:40 p.m. the Board met with Facilities Maintenance Superintendent Chris Soeder to discuss a retirement and hiring a replacement. He would like to hire someone right away. Consensus of the Board is the new hire can wait to start April 30 th. 122 (March 26)

2 Motion by Klein, seconded by Baker, carried unanimously, to recess at 3:50 p.m. WORKSESSION WITH COUNTY ENGINEER Upon reconvening at 4:30 p.m., the Board met with Engineer Anthony Bardgett and ECIA Transportation Planning Director Chandra Ravada. They discussed the traffic flow around the John Deere Manufacturing Plant. Scott Reising, of Black Hills Energy, explained about the gas lines in the County right of way. Jason Hooks, from Tri-State Truck, was questioned about not being able to meet deadlines when bidding on county trucks. Motion by Klein, seconded by Baker, carried unanimously, to recess at 5:25 p.m. PROCLAMATION - APRIL SEXUAL ASSAULT AWARENESS MONTH Now therefore, we the Board of Supervisors in and for Dubuque County, on behalf of all staff and citizens of Dubuque County, do hereby proclaim the month of April 2018 as Sexual Assault Awareness Month in Dubuque County, Iowa and encourage all citizens to learn more about preventing sexual violence. Motion by Klein, seconded by Baker, carried unanimously, to approve the Proclamation. Chair Wickham presented the Sexual Assault Awareness Month Proclamation to Riverview Center Advocate Tanya Engling. CONSENT ITEMS Receipt of MMP-Allan Schieltz, MMP-Robert Fangman, MMP-Ryan Brothers, Class LC liquor license-fillmore Bar & Grill, Class BB beer permit-massey Marina, Class BW beer permit-dubuque County Firefighters Association, Class LC liquor license - Eric Munson Baseball, Class LC liquor license- El Burritos House, and Fireworks permit - J&M Displays, Inc Motion by Baker, seconded by Klein, carried unanimously, to approve the above-mentioned consent items. 123 (March 26)

3 PROOF OF PUBLICATION - PUBLIC HEARINGS Motion by Klein, seconded by Baker, carried unanimously, to receive and file the proofs of publication. PUBLIC HEARING - AMENDMENT OF CURRENT COUNTY BUDGET - FY18 AMENDMENT #2 Budget Director Dolan explained that this amendment will make the current budget and appropriations equal to the re-estimated amounts decided on during the recent budget worksessions.. Chair Wickham opened the public hearing. There were no questions or speakers, motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. PUBLIC HEARING - DECREASE IN DEPARTMENTAL APPROPRIATIONS Acting Budget Director Denise Dolan explained when a departmental budget decreases by 5% or $5,000, whichever is greater, a public hearing is prior to implementing the decrease. Chair Wickham opened the public hearing. There were no questions or speakers, motion by Baker, seconded by Klein, carried unanimously, to close the public hearing. ADOPTION OF FY18 BUDGET AMENDMENT #2 Motion by Klein, seconded by Baker, carried unanimously, to adopt the budget amendment. RESOLUTION APPROVING FY18 APPROPRIATIONS AMENDMENT #2 WHEREAS, the Board of Supervisors of Dubuque County has amended the Budget for Fiscal Year 2018 on March 26, 2018, and WHEREAS, the Code of Iowa, Section (6) specifies that the Board of Supervisors shall, by resolution, appropriate amounts for each of the county officers and departments; and, 124 (March 26)

That the above described final plat be and is hereby approved and the Chairperson of the Board of Supervisors is authorized and directed to endorse the approval of Dubuque County, Iowa upon said final plat. NOW, THEREFORE BE IT RESOLVED the Dubuque County Board of Supervisors approves and adopts the amended Sunnycrest Manor Admission of Residents Policy as presented. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION AMENDED BYLAWS OF THE SUNNYCREST MANOR ADVISORY BOARD OF DIRECTORS WHEREAS, Dubuque County has been presented with a proposed amendment to the Sunnycrest Manor Advisory Board of Directors Bylaws; and WHEREAS, the Sunnycrest Manor Advisory Board of Directors has taken formal action to recommend the proposed amendment to the Board of Supervisors for approval and adoption. WHEREAS, the related change is related to Article V - Membership, Section 1 (1). NOW, THEREFORE BE IT RESOLVED the Dubuque County Board of Supervisors approves and adopts the amended Sunnycrest Manor Advisory Board of Directors Bylaws. Motion by Baker, seconded by Wickham, carried with Baker and Wickham voting aye and Klein voting nay, to approve and authorize the Chair to sign Resolution (March 26)

15 RESOLUTION AMENDED RESOLUTION ADDING ONE ADDITIONAL DEPUTY TOT HE SHERIFF S OFFICE WHEREAS, on June 26, 2017, the Board of Supervisors approved deputies in the offices of the County Attorney, Auditor, Recorder, Sheriff and Treasurer for the fiscal year 2018; and WHEREAS, one additional deputy has been designated by County Sheriff Joe Kennedy. NOW THEREFORE BE IT RESOLVED that this resolution will amend Resolution Number to add the following deputy to the office of the Dubuque County Sheriff: Jon Kaufman effective on or about April 3, Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION BID FOR AUDIT SERVICES FOR FISCAL YEARS 2018, 2019, AND 2020 WHEREAS, the County s current audit firm, Eide Bailly, has presented a quote for audit services for fiscal years 2018, 2019 and NOW THEREFORE be it resolved that the Dubuque County Board of Supervisors hereby accepts and approves the quote for audit services in FY18 of $ 62,650, FY19 of $64,000 and FY20 of $ 65,500 and authorizes the Chair to sign the acceptance. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION - LAW ENFORCEMENT AGREEMENT BETWEEN THE CITY OF HOLY CROSS AND THE DUBUQUE COUNTY SHERIFF S OFFICE Motion by Klein, seconded by Baker, carried unanimously, to table the resolution. RESOLUTION NECESSARY DOCUMENTS WITH K CONSTRUCTION, INC. FOR THE CULVERT REPLACEMENT ON PITZ ROAD, PROJECT L-C19(03) WHEREAS, bids were received on March 12, 2018 for the culvert replacement on Pitz Road Project L-C19(03) , and K Construction Inc. of Elkader, Iowa submitted the low bid of $114,889.11, and 136 (March 26)

16 WHEREAS, the Dubuque County Engineer has reviewed the bids and recommends accepting the bid submitted by K Construction Inc., THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the necessary contract documents with K Construction Inc. for the culvert replacement on Pitz Road in the amount of $114, Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION NECESSARY DOCUMENTS WITH MATHY CONSTRUCTION D/B/A RIVER CITY PAVING FOR THE RESURFACING AND CULVERT REPLACEMENT ON DERBY GRANGE ROAD, THUNDER ROAD, AND SPODEN ROAD, PROJECT LOST-19(01) WHEREAS, bids were received on March 12, 2018 for the HMA resurfacing and culvert replacement on Derby Grange Road, Thunder Road, and Spoden Road, Project LOST- 19(01) , and Mathy Construction D/B/A River City Paving of Dubuque, Iowa submitted the low bid of $2,511,708.08, and WHEREAS, the Dubuque County Engineer has reviewed the bids and recommends accepting the bid submitted by Mathy Construction D/B/A River City Paving, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the necessary contract documents with Mathy Construction D/B/A River City Paving for the HMA resurfacing and culvert replacement on Derby Grange Road, Thunder Road, and Spoden Road in the amount of $ 2,511, Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION PLANS AND SPECIFICATIONS FO THE CULVERT REPLACEMENT ON BREHM LANE, PROJECT L-C19(04) WHEREAS, plans and specifications have been prepared by Dubuque County and approved by the Dubuque County Engineer for the railroad tank car culvert replacement on Brehm Lane, Project L-C19(04) , and WHEREAS, this project will be let locally by Dubuque County, subject to the Dubuque County Board of Supervisors approval and signature on the plans. 137 (March 26)
