1 MINUTES OF FEBRUARY 26 & 27, 2018 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order at 11:00 a.m. QUARTERLY ELECTED OFFICIAL AND DEPARTMENT HEAD STAFF MEETING The Board met with Conservation Executive Director Brian Preston, Facilities Maintenance Superintendent Chris Soeder, IT Superintendent Nathan Gilmore, Zoning Administrator Anna O Shea, Director of Dubuque Veterans Affairs Commission Randy Rennison, Executive Library Director Michael Wright, Health Director Patrice Lambert, Emergency Management Director Tom Berger, GIS Project Manager Jeff Miller, Sunnycrest Administrator Cris Kirsch, County Assessor Dave Kubick, City Assessor Rick Engelken, County Recorder John Murphy, MHDS Regional Coordinator Jody Jansen, and Sheriff Joe Kennedy. Chair Wickham started with a short presentation about the Secondary Roads new building. He also told about the interviews being conducted for the HR/Personnel Director and the Budget Director positions. Baker talked about the signature rubber stamps some department heads are using and asked everyone to stop as of now. LEGISLATIVE UPDATE Chair Wickham gave a Legislation update. The County has contributed funds for Dubuque Night in DesMoines and asks all Dept Heads for input of concerns they would like representatives to discuss. Executive Director Brian Preston said one thing he would like them to ask to continue funding is the REAP program. Motion by Wickham, seconded by Baker, carried unanimously to recess at 12:15 p.m. GENERAL ASSISTANCE HEARINGS Upon reconvening at 1:00 p.m. motion by Klein, seconded by Baker, carried unanimously, to enter executive session with General Assistance Caseworker Nick Agan regarding case F Upon returning to regular session motion by Klein, seconded by Baker, carried unanimously, to assist case F-4-43 with $520 for rent. 78 (February 26 & 27)
2 Motion by Klein, seconded by Baker, carried unanimously, to recess at 1:20 p.m. WORKSESSION WITH FEH, KLAUER CONSTRUCTION, GIESE ROOFING AND FRED JACKSON TUCKPOINTING REGARDING COURTHOUSE ROOF PROJECT Upon reconvening at 2:00 p.m. the Board met with Randy Klauer of Klauer Construction, Kelly Jackson and Travis Jackson both from Jackson Tuckpointing, Kevin Eipperle and Kristy Monk from Design Engineers FEH, and Dan Leibfried from Giese Roofing. All are involved in the removal and repair of the statuary from the roof of the courthouse and the re-roofing project. Motion by Klein, seconded by Baker, carried unanimously, to recess at 3:05 p.m. WORKSESSION WITH HERITAGE WORKS REGARDING FINANCIAL CAMPAIGN FOR THE COURTHOUSE ROOF STATUARY PROJECT Upon reconvening at 3:20 p.m. the Board met with Duwayne and Nathaniel Kapraun of Heritage Works. They will do a fundraiser as a 501(c)(3) then give a check to the County. Motion by Klein, seconded by Baker, carried unanimously, to recess at 3:50 p.m. ENTRANCE PERMIT Upon reconvening at 4:00 p.m. the Board met with Zoning Administrator Anna O Shea and Keith and Jane Bahl to discuss the entrance they would like to a new home. Motion by Klein, seconded by Baker, carried unanimously, to approve the entrance. The Board met with Steve Rauen th Ave Farley and Dennis Rauen 508 Tahoe Court Motion by Baker, seconded by Klein, carried unanimously, to approve the new entrance. The Board met with Tim Ehlinger Bally More Lane to discuss adding an entrance. Motion by Klein, seconded by Baker, carried unanimously, to approve the new entrance with the removal of one entrance to the North. The Board met with Tyler Barton who would like to build a house near Richard & Judy Brimeyer. 79 (February 26 & 27)
3 Motion by Klein, seconded by Baker, carried unanimously, to approve with keeping it close to the property line to the south. WORKSESSION WITH COUNTY ENGINEER The Board met with Engineer Anthony Bardgett, Todd Horsfield 502 Tahoe Court Farley, and Mike Weber Surveyor th Bernard. They discussed a development that is being discussed on Cox Springs Road. Bardgett has access to purchase flat car decks and tank shells for upcoming road projects. Motion by Klein, seconded by Baker, carried unanimously, to recess at 5:15 p.m. APPROVAL OF THE MINUTES OF JANUARY 22, 23, 24, 25, 30, FEBRUARY 5 & 7, 2018 APPROVAL OF THE MINUTES OF FEBRUARY 12, 20, & 21, 2018 Upon reconvening at 5:30 p.m. motion by Klein, seconded by Baker, carried unanimously, to approve the minutes. CONSENT ITEMS Manure Management Plan annual update for Steve Hoeger- Hog Site -Home Farm Motion by Baker, seconded by Klein, carried unanimously, to approve the above-mentioned consent item. CONTINUED PUBLIC HEARING Chair Wickham continued the public hearing from the previous meeting. VandenBerge is asking 1.95 acres be rezoned so he can build a house. Wayne Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. Motion by Klein, seconded by Baker, carried unanimously, to approve with rezoning conditional 1.95 acres only. The following amendment to the Dubuque County Zoning Ordinance is proposed. 80 (February 26 & 27)
4 ZC# Doug & Sarah Warthan & Wayne & Jill Vanden Berge A-1 Agricultural to R-1 Rural Residential The applicants are requesting to rezone from A-1 Agricultural to R-1 Rural Residential 21 acres more or less, to allow for the buyer to build a single family home. The property, located adjacent to the City of Sageville along Rolling Hills Drive, is legally described as Lot 2 Brimeyer Place Section 11, (T89N-R2E) and Rolling Hills Estates No. 2-Balance of Lot 2 (outside Sageville Corp Line) Section 10, (T89N-R2E) all in Dubuque Township, Dubuque County, Iowa. 1. That the new home must follow the Erosion & Sediment Control and Stormwater Ordinance for a site with 2 acres or more of disturbed area, even if the site does not meet that requirement. 2. That only one home will be allowed and any future home(s) will need to be rezoned for that use. 3. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on Monday January 22, 2018, February 12, 2018 and February 26, 2018 Motion by Klein, seconded by Baker, carried unanimously, to approve the rezoning with the conditions. Motion by Klein, seconded by Baker, carried unanimously, that the amendment be adopted and that the zoning administrator be directed to enter the appropriate changes on the official zoning map and that the Auditor be directed to arrange for the publication of the amendment and portion of the official zoning map as amended in the official county newspapers as required by law. NOW THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors hereby approves the releases of the mortgages and authorizes the Chair to sign the releases. 9 RESOLUTION APPROVE THE FUNDING AGREEMENT WITH THE CITY OF EPWORTH FOR THE BOBCAT ROAD PAVING PROJECT WHEREAS, Dubuque County and the City of Epworth have agreed to partner on the paving of a portion of Bobcat Road from the US 20 overpass south approximately 1,165 feet, and WHEREAS, it is necessary for Dubuque County and the City of Epworth to enter into a 28E Agreement detailing the responsibilities and funding obligations of each entity regarding said project, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the 28E Agreement with the City of Epworth for the Bobcat Road paving project. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE NECESSARY RIGHT OF WAY DOCUMENTS FOR THE HMA RESURFACING AND CULVERT REPLACEMENT PROJECT ON DERBY GRANGE ROAD, THUNDER ROAD, AND SPODEN ROAD, PROJECT LOST-19(01) WHEREAS, it is necessary to secure additional right-of-way for the culvert replacements on Derby Grange Road and Spoden Road, Project LOST-19(01) THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa, hereby approve and direct the Chair to sign the necessary right-of-way documents with property owners for the Prairie Creek Road culvert replacement project. 11 Whereas, the Dubuque County Emergency Management Commission establishes bylaws to govern the operation of the Dubuque County Emergency Management Agency; and Whereas, these bylaws are adopted by the Dubuque County Emergency Management Commission under Chapter 29C, Code of Iowa; and Whereas, the Iowa Administrative Code (29C) states the bylaws, as adopted, shall be signed each member of the commission; and Whereas, the Commission requires updates to the bylaws be approved by each municipality in Dubuque County as evidenced by official vote of the municipality and/or by resolution. NOW THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors hereby approves the bylaws of the Dubuque County Emergency Management Commission and authorizes the Chair to sign them. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE AMENDED DUBUQUE COUNTY TRAINING AND TRAVEL REIMBURSEMENT POLICY WHEREAS, Dubuque County has been presented an amended Dubuque County Training and Travel Reimbursement Policy; and WHEREAS, the amendment include changes in Section G (1), Transportation, Section H (1) (2) (8), Section I (1) Meals and IRS Regulations and new language in Section K. NOW, THEREFORE BE IT RESOLVED the Dubuque County Board of Supervisors approve the amended Dubuque County Training and Travel Reimbursement Policy. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE IOWA CERTIFIED LOCAL GOVERNMENT 2017 ANNUAL REPORT WHEREAS, Dubuque County has been presented with the 2017 Iowa Certified Local Government Annual Report prepared by the Dubuque County Historic Preservation Commission; and 88 (February 26 & 27)
12 WHEREAS, the report certifies the commission and qualifies Dubuque County for state funding through the State Historical Society of Iowa. NOW, THEREFORE BE IT RESOLVED the Dubuque County Board of Supervisors approve and authorize the Chairperson to sign the 2017 Iowa Certified Local Government Annual Report prepared by the Dubuque County Historic Preservation Commission. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE FEMA FLOOD BUYOUT APPLICATION FOR WILLIAM AND AMIE DEAN PROPERTY AT PARADISE VALLEY ROAD Motion by Wickham, seconded by Baker, to table the resolution with Klein voting nay. RESOLUTION APPROVE A FIRE LOAN AGREEMENT WITH DUBUQUE COUNTY FIREFIGHTERS ASSOCIATION FOR $30,000 REVOLVING LOAN BE IT RESOLVED, that the Dubuque County Board of Supervisors approves and authorizes the Chairperson to sign a Fire Loan Agreement with Dubuque County Fire Firefighters Association the amount of $30,000 to be repaid over five (5) years, for the purchase of a 2018 Eagle Breathing Air Compressor Trailer. PUBLIC COMMENTS 89 (February 26 & 27)
13 The North East Action Trailriders (N.E.A.T.) addressed the Board with a model ordinance allowing ATV/UTV s on all Dubuque County roads. A letter for consideration along with 1873 signatures of county residents supporting such an ordinance was given to the Board. Justin Rath, Brimeyer Lane, Sherrill spoke in favor of adopting an ordinance. Safety of the riders is the #1 concern. Riders must be 16 years of age with a valid driver s license, riders 16 & 17 must have a valid DNR ATV safety certificate and have proof of insurance. Sheriff Joe Kennedy spoke against allowing ATV s on County roads. Motion by Klein, seconded by Baker, carried unanimously, to recess at 6:53 p.m. PERSONNEL DELIBERATIONS Upon reconvening at 3:04 p.m. on Tuesday, February 27, 2018 the Board of Supervisors were joined by Executive Director for Dubuque Area Labor Management Council Kelly Cooper, HR Director for the Dubuque Community Schools Phil Kramer, Executive US Bank Mike Donohue, Honkamp Krueger Representatives Gary Churnovic, and Lori Stewart. Motion by Klein, seconded by Baker, carried unanimously, to enter executive session per Iowa Code 21.5(1)(i) Motion by Klein, seconded by Baker, carried unanimously, to resume regular session. Motion by Klein, seconded by Baker, carried unanimously, to direct Honkamp Krueger to proceed as directed. RESOLUTION APPROVE CHANGE ORDER #1 FOR THE COURTHOUSE STATUTORY REPAIRS WHEREAS, Dubuque County has contracted with Klauer Construction Company for a project to re-roof the Dubuque County Court House; and WHEREAS, Change Order # 1 has been presented for removing and repairing the exterior statues, time and material not to exceed $ 125,917.50; and 90 (February 26 & 27)
14 NOW, THEREFORE, BE IT RESOLVED that the Dubuque County Board of Supervisors approves Change Order # 1 and authorizes the Chair to sign and accept the document.
