1 Board of Supervisors Proceedings Regular Session, at 9:00 a.m. The Board met in regular session on, at 9:00 a.m. in meeting room #2, 3rd Floor, northeast corner of the courthouse. All members present. Zoning Resolution--Second Reading of Proposed Amendment No to Ordinance No. 3-Zoning on Request of Jack L. Stansberry and Public Hearing-- Whereas, after recommendation from the Marshall County Zoning Commission, the Marshall County Board of Supervisors is considering the adoption of Amendment No to Ordinance No. 3-Zoning of Marshall County. Now, Therefore, Be It Resolved, by the Marshall County Board of Supervisors that this be considered the second reading of the following proposed amendment: The request from Jack L. Stansberry to change the zoning classification from A-1 (Agricultural) to R-2 (Residential) on the following described property as follows: Lot 11, Hessenius Subdivision of the Southeast Quarter of the Northeast Quarter of Section 21, Township 84 North, Range 17 West of the 5th P.M., Marshall County. Be It Further Resolved that such amendment shall not be effective until a public hearing is held at 9:00 a.m. on the 18th day of January 2000, and the Board adopts the third reading of the proposed Amendment and the Amendment or a summary thereof is published. Notice of the public hearing was published in the Marshalltown Times- Republican and the State Center Enterprise-Record on December 30, Motion by Goecke, second by Soorholtz to adopt the second reading of the amendment to Ordinance No. 3-Zoning, and waive the rule requiring the reading of the ordinance on three separate days. There were no written comments presented and no individuals presented oral comments or questions at the hearing. Motion by Soorholtz, second by Goecke that this constitutes the third reading and the adoption of the Amendment No to Ordinance No. 3-Zoning. Item 2 is deleted. Item 4 only applies to the non-complying portion of the installation. Item 5H does not include seeding. Item 5J "in 6 inch lifts" is deleted. 90º corners are not required at culverts and bridges. 7. Request for Utility Permit--#0002 from Central Iowa Water Association for a permit to bury a water line along the 2400 mile of Iowa Ave. in Section 16, T-83-N, R-18W, Timber Creek Township. Item 2 is deleted. Item 4 only applies to the non-complying portion of the installation. Item 5H does not include seeding. Item 5J "in 6 inch lifts" is deleted. 90º corners are not required at culverts and bridges. 8. Approve Transfer of Funds--quarterly transfers to be made for the quarter ending December 31, 1999 Transfer #681 from General Basic to Sec. Rd. Fund $ 47, (Includes $4, corrective transfer from FY1999) Transfer #682 from Rural Serv. Basic to Sec. Rd. Fund $ 361, (Includes $54, corrective transfer from FY1999) Transfer #683 from General Basic to Conservation Land Acquisition Trust $ Transfer #684 from General Basic to Capital Projects $1,200, Approve Claims--as audited and authorize the County Auditor to issue warrants in payment of same. The listing of claims paid at this meeting will be included with all claims paid for the month of January; the January list of claims will be a part of the first meeting in February. Motion by Goecke, second by Soorholtz to adopt the consent agenda as printed above. CPC--Contract for Mental Health/Substance Abuse Services with Broadlawns Medical Center--Contract between the Marshall County Board of Supervisors and Broadlawns Medical Center for mental health/substance abuse services. This contract supersedes all other contracts and agreements and may be terminated by either Marshall County or Broadlawns Medical Center upon giving 30 days written notice and shall be automatically renewed annually unless notice of termination is given. Motion by Soorholtz, second by Goecke to approve the Contract. 3

Motion by Goecke, second by Soorholtz to accept the report submitted by the County Zoning Administrator. Member Vice-Chrm. Chairman Secondary Road-Certificates of Completion--discussion and possible action on the following Certificates of Completion: 1. Project 1999 Granular Resurfacing Division 2, the Granular Resurfacing on roads in Eden, Logan, Jefferson, Green Castle, Washington, Timber Creek and LeGrand townships completed on May 20, 1999, original contract $190,772.45, final cost $190, Project 1999 Granular Resurfacing Division 3, the Granular Resurfacing on roads in Bangor, Liberty, State Center, Minerva, Liscomb, Taylor, Iowa, Marietta, Washington, Eden, Timber Creek and Logan townships, completed on June 17, 1999, original contract $213,983.70, final cost $214, Project 1999 Granular Resurfacing Division 1 and 4, the Granular Resurfacing on roads in Vienna, Liscomb, Iowa, LeGrand, Marion, Eden, State Center, Minerva, Timber Creek, Liberty, Marietta, Bangor and Taylor townships, completed on May 27, 1999, original contract $39,279.80, final cost $39, Project STP-S-64(50) , ACC Resurfacing and Cold-in-place Recycling of 4.52 miles of 190th St. from Hopkins Ave to Marsh Ave, completed on October 8, 1999, oroginal contract $359,496.15, final cost $383, Project FM-64(49) , ACC Resurfacing and Cold-in-place Recycling 3.49 miles of 190th St. from Eastman Ave to Hopkins Ave, completed on October 8, 1999, original contract $271,818.79, final cost $273, Project L-E23(98) , construction of a 112'-6" X 24' continuous concrete slab bridge located over Linn Creek in the 1500 mile of Main Street Road, completed on November 16, 1999, original contract $172,905.29, final cost $175, Project L-MAR08(98) , construction of a 12' X 6 X 42' reinforced concrete box culvert located in the 1700 mile of 170th Street, completed on April 15, 1999, original contract $41,415.66, final cost $41, Project L-C15(03) Construction of a Twin 8' X 6' X 78' reinforced concrete box culvert at the intersection of 148th Street and Knapp Ave, completed on August 6, 1999, original contract $63,889.91, final cost $63, Motion by Soorholtz, second by Goecke to approve the Certificates of Completion and to authorize the Chairman to sign these Certificates of Completion subject to the final audit. 4

5 Secondary Road-Fiscal Year 2000 Marshall County Iowa DOT Budget-Amendment and Program Supplement #1--discussion and possible action on the approval of the Amendment to the Iowa DOT Budget for FY2000 and Supplement #1 to the FY2000 Iowa DOT Construction Program. Motion by Goecke, second by Soorholtz to approve the Amendment to the Iowa DOT Budget for FY 2000 and Supplement #1 to the Iowa DOT Construction Program. Secondary Road-Agreement Between Marshall County and the Iowa DOT-- discussion and possible action on the Agreement between Marshall County and the Iowa DOT regarding Project NHS-30-5(136) and NHSX-30-5(166)-3H-64, county agreement no C-097. Motion by Soorholtz, second by Goecke to approve the agreement. County Attorney's Office--The County Attorney's Office will be closed on January 17, 2000, in observance of Martin Luther King's Birthday and will be open on February 21, 2000, President's Day. Their holidays are being switched to coincide with the Court System. Motion by Goecke, second by Soorholtz to approve switching the holidays for the County Attorney's Office to coincide with the Court System. New Jail-Update--report and discussion on the progress of the new jail. Adjournment--There being no further business to come before the Board, the meeting is adjourned. The next regular meeting is February 1, 2000, 9:00 a.m. All business to be acted upon at that session should be submitted to the County Auditor s Office or the Board of Supervisors Office by January 27, 2000, at 1:00 p. m. 5
