1 Board of Supervisors Proceedings Regular Session, at 9:00 a.m. The Board met in regular session on, at 9:00 a.m. in meeting room #2, 3rd Floor, northeast corner of the courthouse. All members present. Public Hearing on Marshall County Ordinance No. 21 To Establish Election Precincts in Marshall County, Outside Marshalltown-- At the public hearing, any resident may present objections to or arguments in favor of, any part of Marshall County Ordinance No. 21. There were no written comments, questions, or objections on file in the County Auditor s office. Of the five individuals attending the public hearing, no individuals presented oral comments, questions or objections. Motion by Soorholtz, second by Goecke to close the hearing. Reading of Marshall County Ordinance No. 21 To Establish Election Precincts in Marshall County, Outside Marshalltown AN ORDINANCE ESTABLISHING THE VARIOUS VOTING PRECINCTS IN MARSHALL COUNTY, IOWA, OUTSIDE THE CITY OF MARSHALLTOWN AND DEFINING THE BOUNDARIES AND LISTING THE POPULATIONS THEREOF PURSUANT TO CODE OF IOWA, CHAPTER 49, BE IT ORDAINED BY THE MARSHALL COUNTY BOARD OF SUPERVISORS, AS FOLLOWS: Section 1. PURPOSE. The purpose of this ordinance is to establish new voting precincts in Marshall County, due to the required reprecincting following the 2000 decennial census. The Marshall County Board of Supervisors shall establish new election precincts following census block lines, comprised of one or more whole townships and contained wholly within an existing legislative district that will best serve the convenience of the voters while promoting electoral efficiency pursuant to the Code of Iowa, Chapter 49, Section 2. PRECINCTS. Marshall County, Iowa, is hereby divided into 11 voting precincts and are described as follows: 1. BANGOR/LIBERTY/MINERVA, population 938: Bangor Township, Liberty Township including part of the incorporated city of St. Anthony and Minerva Township including the incorporated city of Clemons and part of the incorporated city of St. Anthony, Marshall County, Iowa. 2. EDEN/LOGAN, population 1684: Eden Township including the incorporated city of Rhodes and Logan Township including the incorporated city of Melbourne, Marshall County, Iowa. 1

2 3. GREEN CASTLE, population 1154: Green Castle Township including the incorporated cities of Ferguson and Gilman, Marshall County, Iowa. Board Meeting of 4. IOWA/TAYLOR, population 1279: Iowa Township including the incorporated city of Albion and Taylor Township, Marshall County, Iowa. 5. JEFFERSON, population 872: Jefferson Township including the incorporated cities of Haverhill and Laurel, Marshall County, Iowa. 6. LEGRAND, population 1559: LeGrand Township including the incorporated city of LeGrand, Marshall County, Iowa. 7. LISCOMB, population 546: Liscomb Township including the incorporated city of Liscomb, Marshall County, Iowa. 8. MARIETTA/WASHINGTON, population 975: Marietta Township and Washington Township, Marshall County, Iowa. 9. MARION/VIENNA, population 1242: Marion Township and Vienna Township, Marshall County, Iowa. 10. STATE CENTER, population 1753: State Center Township including the incorporated city of State Center, Marshall County, Iowa. 11. TIMBER CREEK, population 1300: Timber Creek Township, Marshall County, Iowa. Section 3. EFFECTIVE DATE. This ordinance shall be in full force and effect on January 15, 2002 after its final passage, approval and publication as provided by law. Dated at Marshalltown, Iowa, this 9thday of October, 2001 Motion by Goecke, second by Soorholtz to adopt that the statutory rule requiring said ordinance to be considered and voted on for passage at two board meetings prior to the meeting at which it is to be finally passed be suspended. Motion by Soorholtz, second by Goecke that the ordinance now be put upon its final passage and adoption. Motion by Goecke, second by Soorholtz that the Ordinance be adopted. Approve Minutes--from Regular Session of September 25, Approve Personnel Actions: a) Promote Brian Deeter, Secondary Road Department, from Truck Driver 1 at $13.86/hr., to Truck Driver 2 at $14.16/hr., effective October 1, b) Promote Eric Purvis, Secondary Road Department, from Truck Driver 1 at $13.86/hr., to Truck Driver 2 at $14.16/hr., effective October 1, c) Promote Jerry Landt, Secondary Road Department, from Truck Driver 1 at $13.86/hr., to Truck Driver 2 at $14.16/hr., effective October 1, d) Hire Carrie Huffaker as a full time Program Assistant in the Child Support Recovery Unit, at $25,000.00, effective September 28, File District Court Report--September, 2001 General Supplemental Fund 10% Surcharge - $ Approve Claims--as audited and authorize the County Auditor to issue warrants in payment of same. The listing of claims paid at this meeting will be included with all claims paid for the month of October; the October list of claims will be a part of the first meeting in November. Motion by Soorholtz, second by Goecke to adopt the consent agenda as printed above. Secondary Road-Certificates of Completion--on the following resurfacing and culvert projects: Project FM-CO64(62)-55-64, Our contract with Cessford Construction Company of LeGrand for the construction of ACC Resurfacing with cold-in-place recycling on Knapp Avenue from 240th St. north to LaMoille between Sections 2 & 3 and 10 & 11, T-83N, R-19W, Washington Township was completed on September 17, Original Contract $154, Final Cost $150, Project STP-S-CO64(61)-5E-64, Our contract with Cessford Construction Company of LeGrand for the construction of ACC Resurfacing with cold-in-place recycling on 190th St. from Arney Avenue to Eastman Avenue between Sections 15, 16, 17, 18 and 19, 20, 21, 22, T-84N, R-20W, Minerva Township was completed on September 17, Original Contract $352, Final Cost $358, Project L-ACC , Our contract with Cessford Construction Company of LeGrand for the construction of ACC Resurfacing with cold-in-place recycling on Durham Avenue south of 190th St., on Eastman Avenue south of 235th St. and on Jessup Avenue south of 235th St. in Section 22, T-84N, R-20W, Minerva Township, between Sections 10 & 11, T-83N, R-20W, State Center Township and between Sections 9 & 10, T-83N, R-19W, Washington Township were completed on September 17, Original Contract $193, Final Cost $177, Project FM-CO64(60)-55-64, Our contract with Iowa Culvert Builders of Sigourney for the construction of a reinforced concrete box culvert at the intersection of 190th St. and 3

4 Canfield Avenue between Sections 16, 17, 20 & 21, T-84N, R-20W, Minerva Township was completed on September 4, Original Contract $202, Final Cost $196, Motion by Goecke, second by Soorholtz to accept the Certificates of Completion. Secondary Road-Tourist Oriented Directional Signing for the Harvester Golf Course--application requesting the installation of Tourist directional signing located at the intersection of 295th St. and Cooper Av., in the City of Rhodes, for the Harvester Golf Course. Motion by Soorholtz, second by Goecke to approve this request. Secondary Road-Bridge Inspection Costs--On August 16, 1999 Marshall County entered into a continuing contract with Calhoun-Burns and Associates, Inc. for bridge inspection. As part of the contract, each year a cost estimate is to be furnished for the fiscal years proposed inspections. The estimate for the inspection of 147 structures is $15,780.00; an average of $ per bridge. The cost was $ per bridge. Motion by Goecke, second by Soorholtz to approve the contract. Secondary Road-Bridge Posting Resolution-- Whereas, Marshall County semi-annually completes an inspection of all bridges on the Secondary Road System of Marshall County, and Whereas, part of this inspection involves the recalculation of the safe load capacity of any structure showing remarkable deterioration of the structural components of that structure, and Whereas, that structural evaluation has resulted in the recommendation to reduce the safe load capacity that can be supported by certain structures. Now, Therefore Be It Resolved by the Marshall County Board of Supervisors on this 9th day of October 2001 as provided in Sections , and , Code of Iowa, to erect and/or maintain weight limit signs in advance of the following bridges located on the Federal Aid, Farm to Market, and Local Secondary Road Systems as follows: County Bridge No. Location (Sec. Gordie Johnson Board of Supervisors, Chairman Attest: Jeffrey Heil Marshall County Auditor Marshall County Job Classification and Pay Plan--discussion and action on the proposed pay ranges effective July 1, Motion by Goecke, second by Soorholtz to increase the pay ranges three percent each year for two years in the new job classification and pay plan and publish in the Marshall County Personnel Policy. Supplemental Insurance Plan for County Employees through AFLAC--discussion and action on allowing Marshall County employees to purchase supplemental insurance through AFLAC. Participation is voluntary and at the employees expense. Motion by Soorholtz, second by Goecke to allow employees to participate at their own expense. Personal Property Tax Replacement Allocations to Marshall County--discussion and action on crediting the personal property tax replacement allocation. Marshall County receives from the State of Iowa an allocation for personal property tax replacement. According to the Code of Iowa, Chapter 405A.4, the allocation of a county may be credited to the general, rural services, secondary road, or other special revenue fund of the county and shall not be credited to the county s mental health fund. 5

6 Motion by Goecke, second by Soorholtz to credit the portion of the allocation titled county assistance to the county s rural services basic fund and the portion-titled personal property to the general basic fund. Public Heath Discussion--John Kunc presented information on bio-terrorists threats and on the presence of the West Nile virus as a mosquito born disease in the State of Iowa. Washington School House-Request for Funds--Catherine Noble, Director of the State Center Main Street project, has requested that the Board of Supervisors consider contributing $2, as part of the 50 percent match required for a grant from the Iowa Department of Cultural Affairs. The grant would be in the amount of $5, and would be used to move the Washington School House from 2497 Jessup Av., to the town of State Center, near the Gutekinst Public Library. Motion by Soorholtz, second by Goecke to approve $2, match for the grant. Proclamation--The Marshall County Board of Supervisors hereby proclaims October 11, 2001, as a day of recognition to: respect the colors, unite in hope, stand united for America, and respect the pursuit of freedom. Adjournment--The next regular meeting is October 23, 2001, 9:00 a.m. All business to be acted upon at that session should be submitted to the County Auditor s Office or the Board of Supervisors Office by October 18, 2001, at 1:00 p. m.
