1 COMMISSIONERS COURT MEETING MINUTES BE IT REMEMBERED that on this 4 th day of October, 2004, the Commissioners Court of Kaufman County, Texas met in regular session with the following members present to wit: Wayne Gent, County Judge; Rhea Fox, Commissioner Precinct No. 1;Absent, Ken Leonard, Commissioner Precinct No. 2; Ivan Johnson, Commissioner Precinct No. 3; Jim Deller, Commissioner Precinct No. 4; and Laura Hughes, County Clerk. MOTION TO ACCEPT REPORT There came on to be considered a motion to accept the Kaufman County Library Report for August 2004 and September A motion was made by Commissioner Ivan Johnson and seconded by Commissioner Jim Deller. MOTION TO ACCEPT BOARD MEMBER There came on to be considered a motion to accept Dr. Bruce Wood as a Kaufman County Library Board Member. A motion was made by Commissioner Ken Leonard and seconded by Commissioner Ivan Johnson. MOTION TO APPROVE MINUTES There came on to be considered a motion to approve the minutes for the meetings of September 27, MOTION TO WITHDRAW OPPOSITION There came on to be considered a motion to withdraw opposition to the creation of Lake Vista Ranch Municipal Utility District No. 3., Precinct 2. MOTION TO ACCEPT REPORT There came on to be considered a motion to accept Dallas Crown, Inc. 2 MOTION TO APPROVE APPOINTMENTS There came on to be considered a motion to appoint Harry Girourard, Chuck Cade, Odessa More, Mike Trojacek and Floyd Smith as Board Members of Kaufman County Rural Emergency Services District #7. MOTION TO APPROVE RESOLUTION There came on to be considered a motion to approve Resolution adopting a Hazard Mitigation Action Plan. MOTION TO APPROVE ESTIMATE There came on to be considered a motion to approve estimate for patching of roads for City of Rosser, Precinct 4, Kaufman Co. MOTION TO APPROVE AGREEMENTS There came on to be considered a motion to approve Software License Agreement, Professional Services Purchase Agreement, Client Support and Software Update Services Agreement and Microsoft Software Assurance for SQL Database Agreement between Kaufman County and The Software Group. A motion was made by Commissioner Ken Leonard and seconded by Commissioner Ivan Johnson. MOTION TO APPROVE SPEED LIMIT There came on to be considered a motion to approve setting the speed limit on CR 331 at 30 mph, Precinct 3. 3 MOTION TO APPROVE REQUEST There came on to be considered a motion to approve request from Sprint Telephone Company to install buried communications cable upon and along the right-of-way of County Rd. 148, Kaufman County, Precinct 1. MOTION TO TABLE OPENING OF SEALED BIDS There came on to be considered a motion to table the opening of sealed bids for asphalt overlaying on existing roads in all road & bridge precincts for Fiscal Year MOTION TO APPROVE OPENING OF SEALED BIDS There came on to be considered a motion to approve the opening of sealed bids for Road Oil, Road Base Material and Steel Culverts for all road & bridge precincts. See Bids: Attachment A, B &C MOTION TO APPROVE AWARDING OF BID There came on to be considered a motion to approve awarding of bid for sealed bids for Road Oil for all road & bridge precincts. Bid awarded to Blazer Resources. A motion was made by Commissioner Jim Deller and seconded by Commissioner Ken Leonard. COMM COURT Page 3 of 6 10/10/2005

4 MOTION TO APPROVE AWARDING OF BID There came on to be considered a motion to approve awarding of bid for sealed bids for Road Base Material for all road & bridge precincts. Bid awarded to Rock Solid Stone Inc for $5.75 per ton, and if they are unable to supply at the date, time needed or the condition of material needed according to the bid receipt then alternative bids awarded to Armor Material for $5.90 per ton and Cook County Stone at $4.50 per ton. A motion was made by Commissioner Ken Leonard and seconded by Commissioner Ivan Johnson MOTION TO APPROVE AWARDING OF BID There came on to be considered a motion to approve awarding of bid for sealed bids for Steel Culverts for all road & bridge precincts. Bid awarded to Wilson Culverts, Inc. MOTION TO TABLE OPENING OF SEALED BIDS There came on to be considered a motion to table the opening of sealed bids for Hot Mix Cold Laid Asphaltic Concrete and Hot Asphalt Concrete for all road & bridge precincts. MOTION TO APPROVE OPENING OF SEALED BIDS There came on to be considered a motion to approve the opening of sealed bids for Flex Base Crushed Concrete and Asphalt Mixed rushed Concrete for all road & bridge precincts. 5 MOTION TO APPROVE AWARDING OF BID There came on to be considered a motion to approve awarding of bid for Flex Base Crushed Concrete and Asphalt Mixed crushed Concrete for all road & bridge precincts. Bid awarded to Recycled Aggregates, LP. MOTION TO APPROVE LINE ITEM TRANSFERS There came on to be considered a motion to approve line-item transfers. MOTION TO APPROVE CLAIMS FOR PAYMENT There came on to be considered a motion to approve claims for payment. MOTION TO ADJOURN There came on to be considered a motion to adjourn regular meeting.
