O'NEILL. Proclamation Confirming the Director of Emergency Services' Proclamation of the Existence of a Local Emergency. AGENDA SECTION: REGULAR AGENDA BACKGROUND/SUMMARY: At 12:00 P.M. on January 12, 2017, in the absence of the Director of Emergency Services and while the Board of Supervisors was not in session the Deputy Director of Emergency Services in response to major flooding in the North portion of San Benito County and rain damage/flooding throughout San Benito County, proclaimed a local emergency effective January 6, Per Ordinance No. 833, the Board of Supervisors must ratify any Proclamation issued by the Director or Deputy Director within 7 days. Due to the recent Pacheco Creek Flooding and the effects heavy rainfall throughout San Benito County and the financial impact this event has had on the residents of the County and the County itself, the Deputy Director requested the Governor to Proclaim a State of Emergency for San Benito County. This Proclamation applies to entire County of San Benito. 7

8 The attached Proclamation confirms the Proclamation issued by the Deputy Director and continues the state of local emergency in San Benito County. Adopt Proclamation confirming and ratifying the Proclamation issued by the Deputy Director of Emergency Services and continuing the local emergency in San Benito County. 9 Proclamation Confirming the Deputy Director of Emergency Services' Proclamation of the Existence of a Local Emergency WHEREAS, Ordinance No. 833 of the County of San Benito empowers the Deputy Director of Emergency Services (County Administrative Officer) of the County of San Benito to proclaim the existence or threatened existence of a local emergency when said County is affected or likely to be affected by a public calamity and when the Board of Supervisors is not in session, subject to ratification by the Board of Supervisors within seven (7) days; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within said County in that commencing on or about 12:00 p.m.; on January 6, 2017 the following conditions exist: Month, Day, Year Flooding in parts of the County due to heavy rainfall There is a potential health concern to the residents of the flood effected area due to possible contaminated water There is damage and potential damage to county owned infrastructure including bridges and roads Conditions in various Creeks and River in San Benito County may require emergency flood fight activities and repairs WHEREAS, said Board of Supervisors does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency; WHEREAS, the Deputy Director of Emergency Services of the County of San Benito, acting for the Director of Emergency Services, did proclaim the existence of a local emergency within said county on the 12 th day of January, WHEREAS, the effects of the storm are beyond the capabilities of the County of San Benito therefore the County is requesting that the Governor of the State of California Proclaim a State of Emergency for the County of San Benito and requests assistance including but not limited to California Disaster Assistance Act (CDAA), Federal Individual Assistance Act, and US Small Business Administration disaster declaration. NOW, THEREFORE, IT IS HEREBY PROCLAIMED AND ORDERED that the Proclamation of Existence of a Local Emergency, as issued by the Deputy Director of Emergency Services, is hereby ratified and confirmed by the Board of Supervisors of the County of San Benito; and IT IS FURTHER PROCLAIMED AND ORDERED that said emergency shall be deemed to continue to exist until its termination is proclaimed by the Board of Supervisors of the County of San Benito, State of California. 9
