If applicable, materials related to an item on this agenda submitted to the Council after distribution of the agenda packet are available for public inspection in the City Clerk s office during normal business hours. Any person having any question concerning any agenda item may call the City Clerk to make inquiry concerning the item. Any item removed from the Consent Agenda will be considered immediately following the motion to approve the Consent Agenda. PUBLIC COMMENTS FOR ITEMS ON CONSENT AGENDA Speakers shall be provided up to 3 minutes to speak regarding all topics on the Consent Agenda. 1. Waive Further Reading Recommendation: After the City Attorney has read the title, waive full reading of ordinances considered on this agenda for introduction on first reading or adoption on second reading. 2. Draft City Council Action Minutes March 27, 2018 Special Meeting Recommendation: Review and Approve. 3. Demands of May 22, 2018 Recommendation: Approve payment of Motions #1 and #2. a. Motion #1 Payroll Warrant of May 18, 2018 b. Motion #2 Warrant Register of May 22, Monthly Investment Transaction Report April 30, 2018 Recommendation: Receive and File. 5. Overview of Palos Verdes Estates Investment Strategy Recommendation: Receive and File. 6. Special Event Application for the Lunada Bay Homeowners Association s Summer Concerts in the Park on June 3, June 24, July 8, July 22, August 12 and August 26 at Lunada Bay Park 2

3 Recommendation: It is recommended that the City Council consider the Special Event Application and request to post signs for the annual Summer Concerts in the Park at Lunada Bay Park on Sundays, June 3rd, June 24th, July 8th, July 22nd, August 12th and August 26th, 2018, and provide direction to staff. 7. Consideration of Traffic Safety Committee Recommendations of May 2, 2018 Recommendation: It is recommended that City Council review and approve the Traffic Safety Committee recommendation for installation of parking restrictions on Via Acalones, and receive and file the information regarding the E&TS. 8. Consideration of Parklands Committee Recommendations of May 10, 2018 Recommendation: Review and Approve. a. PC ; Application to remove 2 Canary Island pine trees located in the parkway adjacent to 1609 Via Zurita Yelena and Boris Gelman 1608 Via Zurita Recommended approval of PC with conditions as follows: 1. Require the Standard Conditions for tree removal approvals. 2. Require payment of $1,000 to the Tree Bank. 3. Require removal of the stumps. 4. Prior to issuance of any permit for a tree removal, the applicant shall submit a survey to determine the location of the two Canary Island pine trees located adjacent to 1609 Via Zurita. 5. Such survey shall be reviewed by the City to determine that the subject tree trunks are located within the public right-of-way and are properly characterized as public trees. 6. If in the sole determination of the City, the tree trunks are determined to be partially located on private property, the City shall require the applicant to obtain authorization for the tree removals through the Palos Verdes Homes Association pursuant to adopted guidelines and established procedures for implementing the view restoration consistent with the enabling covenants, conditions and restrictions. Issuance of any permit for a tree removal shall be contingent upon any and all requirements of the Palos Verdes Homes Association having been satisfied, including but not limited to any legal proceedings by Alternate Dispute Resolution and a court action. (3-0-2 in favor, Wade and Rubincam absent). b. PC ; Application to remove 2 Eucalyptus trees located in the parkway adjacent to 2601 Via Olivera 3

4 Francis Kupieu 2560 Via Olivera Recommended approval of PC Recommend removal of the smaller Eucalyptus and approval to trim the Silver Dollar Eucalyptus to lower and thin the density to improve the view and maintain the health of the tree. Authorization to remove one tree is according to the Standard Conditions for Tree Removal Approvals. Payment of $500 to the Tree Bank and removal of the stump are required. (3-0-2 in favor, Wade and Rubincam absent). c. PC ; Application to remove 1 Canary Island Date palm located on the Nogales Path adjacent to 941 Via Nogales Norman MacKnight 405 Via Chico #11 Recommended denial of PC Recommend approval to trim the Canary Island palm to remove the lower fronds to a configuration of 9 and 3 on the face of a clock. (3-0-2 in favor, Wade and Rubincam absent). d. PC ; Application to remove 1 Eucalyptus tree located in the parkway adjacent to 1641 Via Lazo Dwight Streit 1641 Via Lazo Recommended approval of PC according to the Standard Conditions for Tree Removal Approvals. Payment of $500 to the Tree Bank and removal of the stump are required. (3-0-2 in favor, Wade and Rubincam absent). e. PC ; Application to remove 1 Stone pine tree located in the parkway adjacent to 2546 Palos Verdes Drive West and trim or remove 2 Ficus trees and 1 Aleppo pine tree located in the center median between Avenida Mirola and Via Zumaya Robert Green 2537 Via Rivera Recommended denial of PC Approve trimming of the trees on a regular schedule by the applicant with a permit from the City. (3-0-2 in favor, Wade and Rubincam absent). f. PC ; Application to remove 1 Canary Island Date palm tree located in the parkway adjacent to 868 Via Del Monte 4

Require $500 payment to the Tree Bank and surface grinding of the stump only. Provide a new tree to be planted by the City subject to approval by the Urban Forester. PC ; Application to remove 2 Red Iron Bark Eucalyptus trees located in the parkways adjacent to 736 and 741 Cloyden Road Irv Miller 745 Cloyden Road Recommended approval of PC according to the Standard Conditions for Tree Removal Approvals. Payment of $1,000 to the Tree Bank and removal of the stumps are required. (3-0-2 in favor, Wade and Rubincam absent). h. PC ; Application to remove 1 Canary Island Date palm tree and 1 Eucalyptus tree located in the parkway adjacent to 2548 Via Carrillo Vicki Hulbert 1040 Via Palestra Recommended approval of PC , with modification, to deny removal of the Eucalyptus tree and authorize removal of the Canary Island Date palm tree according to the Standard Conditions for Tree Removal Approvals. Payment of $1,000 to the Tree Bank and removal of the stumps are required. (3-0-2 in favor, Wade and Rubincam absent). COMMUNICATIONS FROM THE PUBLIC This portion of the agenda is reserved for comments from the public on items which are NOT on the agenda. Due to State law, no action can be taken by the Council this evening on matters presented under this section. If the Council determines action is warranted, the item may be referred to staff or placed on a future Council agenda. Introduction on First Reading of Ordinance , an Ordinance to Amend Palos Verdes Estates Municipal Code Amending Title 15 (Building and Construction) 5

6 NEW BUSINESS Establishing a Requirement of a Homeowners Association Approval as a Precondition to Receiving City Permit Approval Recommendation: It is recommended that the City Council introduce upon first reading Ordinance adding Section of Chapter of Title 15 to establish requiring applicants for residential and commercial building permits to certify compliance with applicable declarations of covenants, conditions and restrictions (CC&Rs). 10. Review and Approval of Palos Verdes Stables FY Operating and Capital Budgets and Discussion of Potential Extension of Amended and Restated Concession Agreement Recommendation: It is recommended that the City Council approve the FY Palos Verdes Stables budget, including proposed capital expenditures and provide direction in reference to an extension to the existing concession agreement with HGS. 11. Consideration of a Joint Meeting of the Palos Verdes Estates City Council with the Parklands Committee Recommendation: It is recommended that the City Council schedule and establish discussion topics for a joint meeting with the Parklands Committee.
