Sugar Lane from R1 Residential District to B-1, G2 Business and Commercial District. b) Recommendation from the Legislative and Judiciary Committee - consideration of application for Liquor, Beer & Wine License expansion of the premises filed by Pick n Save 6969 N. Port Washington Rd. c) Recommendation from the Legislative and Judiciary Committee - consideration of license for In-Bounds Training Center 2920 W. Vera Avenue. d) Proclamation Declaring October 2018 as Pregnancy and Infant Loss Awareness Month and October 15, 2018 as Pregnancy and Infant Loss Awareness Day in the City of Glendale, Wisconsin. 7. 2 CITY OF GLENDALE COMMON COUNCIL September 24, 2018 Regular meeting of the Common Council of the City of Glendale held in the David Hobbs Honda for the People Community Room, located at Richard E. Maslowski Park, 2200 West Bender Road, Glendale, Wisconsin. The meeting was called to order by Mayor Kennedy at 5:00 p.m. Roll Call: Present: Ald. Tomika Vukovic (arrived at 5:33 p.m.), John C. Gelhard, Richard Wiese, Steve Schmelzling and JoAnn Shaw. Absent: Jim Daugherty. Other Officials Present: City Administrator Rachel Reiss; City Attorney John Fuchs; Interim Police Chief Mark Ferguson, and City Clerk Miranda Etzel. PLEDGE OF ALLEGIANCE. The members of the Common Council, City staff and all those present pledged allegiance to the flag of the United States of America. OPEN MEETING NOTICE. Administrator Reiss advised that in accordance with the Open Meeting Law, the local news media was advised on Thursday, September 20, 2018, of the date of this meeting; that the agenda was posted on the official bulletin board of City Hall, the Glendale Police Department, and the North Shore Library; that copies of the agenda were made available to the general public in the Municipal Building and the Police Department, and those persons who requested, were sent copies of the agenda. ADOPTION OF COUNCIL MINUTES. Motion was made by Ald. Wiese, seconded by Ald. Schmelzling to approve the minutes of the meeting held on September 10, Ayes: Ald. Gelhard, Wiese, Schmelzling and Shaw. Noes: None. Abstain: None. Absent: Ald. Vukovic, Daugherty. Motion carried unanimously. PUBLIC COMMENT. UNFINISHED BUSINESS. No public comments were made. I. File No Layover from the September 20, 2018 Intergovernmental Cooperation Agreement with Nicolet High School District

3 Mort Grodsky of 559 West Luebbe Lane, Member of the Nicolet High School District School Board, expressed concern that he thought the deal was done, that the field is not currently being used. He stated Nicolet is able to complete the deal, that the money is available, and he doesn t know why we re all here. Ald. Gelhard stated that he received responses from City Attorney Fuchs today pertaining to the July 1, 2020 date to commence, and questioned whether the City has the right to back out of the Intergovernmental Agreement is the deadline was not met by Nicolet. City Attorney Fuchs stated that fundraising is anticipated, and that like agreements in the past, some are amended; if fundraising is not as expected, the Agreement will be amended. City Attorney Fuchs stated that July 1, 2020 is the target date, and is comfortable that MSOE will start. Motion was made by Ald. Wiese, seconded by Ald. Schmelzling to approve the Intergovernmental Cooperation Agreement with Nicolet High School District. On Roll Call Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, Daugherty. Motion carried unanimously. II. File No Traffic Safety Program Intersection Safety Screening Study and Grant Application Process. Administrator Reiss explained the top intersections for potential grand funding, as listed below: 1. Hwy 57 (Green Bay Avenue) and Hwy PP (Good Hope Road) 2. Hwy 57 (Green Bay Avenue) and Silver Spring Drive 3. City Wide Street Lighting Improvements 4. Hwy PP (Good Hope Road) and Range Line Rd 5. Hwy W (Port Washington Road and Green Tree Road 6. Silver Spring Road and Bridgewood Rood 7. Port Washington Road and Silver Spring Drive Administrator Reiss recommended that at a minimum, the City work toward 3 grants in 2019 for the following projects: Grant 1: Hwy 57 (Green Bay Avenue) and Silver Spring Drive City Wide Street Lighting Improvements Silver Spring Road and Bridgewood Rood (this would be the City intersections grant application) 14865

4 Grant 2: Hwy 57 (Green Bay Avenue) and Hwy PP (Good Hope Road) (this intersection is highly traveled by pedestrians) Grant 3: Port Washington Road and Silver Spring Drive (begin the process of the traffic study and apply for the grant in April of 2018) Based upon the recommendation of Administrator Reiss, motion was made by Ald. Gelhard, seconded by Ald. Shaw to approve the Grant application process as presented. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously. NEW BUSINESS. III. File No Ordinance Repealing Title 11, Chapter 2, Section 8(g)(1)d of the Glendale Code pertaining to Panhandling. City Attorney Fuchs recommended a Motion repealing of Title 11, Chapter 2, Section 8(g)(1)d, based on case law. Based upon the recommendation of City Attorney Fuchs, motion was made by Ald. Gelhard, seconded by Ald. Shaw to repeal Title 11, Chapter 2, Section 8(g)(1)d. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously. IV. File No Resolution Designating the David Hobbs Honda for the People Community Room Located at Richard E. Maslowski Community Park as the Common Polling Location for District Six in the City of Glendale for the November 6, 2018 General Election. Administrator Reiss recommended the adoption of David Hobbs Honda for the People Community Room Located at Richard E. Maslowski Community Park as the Common Polling Location for District Six in the City of Glendale for the November 6, 2018 General Election. Based on the recommendation of Administrator Reiss, motion was made by Ald. Shaw, seconded by Ald. Wiese to approve Resolution Designating the David Hobbs Honda for the People Community Room Located at Richard E. Maslowski Community Park as the Common Polling Location for District Six in the City of Glendale for the November 6, 2018 General Election. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously

5 V. File No Resolution Designating Three (3) Polling Locations in the City of Glendale for the February 19, 2019 Spring Primary Election and the April 2, 2019 Spring Election. Administrator Reiss recommended a Motion to adopt the designation of three (3) polling locations in the City of Glendale for the February 19, 2019 Spring Primary Election and the April 2, 2019 Spring Election to the following locations: District 1 and District 3 Cardinal Stritch University District 2 and District 6 City Hall (or Community Room at Richard E. Maslowski Park) District 4 and District 5 Good Hope School Based on the recommendation of Administrator Reiss, motion was made by Ald. Wiese, seconded by Ald. Schmelzling to approve Resolution Designating Three (3) Polling Locations in the City of Glendale for the February 19, 2019 Spring Primary Election and the April 2, 2019 Spring Election. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously. VI. File No Resolution Authoring An Exception To The Levy Limits For Charges For The North Shore Fire Department Pursuant To 2005 Wisconsin Act 484. Administrator Reiss recommended a Motion to adopt the Resolution Authoring An Exception To The Levy Limits For Charges For The North Shore Fire Department Pursuant To 2005 Wisconsin Act 484. Mayor Kennedy stated that all seven (7) municipalities must approve a resolution in order for this to pass. Ald. Gelhard inquired as to whether all seven (7) municipalities authored an exception to the levy limits last year, and if only four (4) municipalities used the exception. Administrator Reiss answered yes, and that this Resolution must be passed annually. Based on the recommendation of Administrator Reiss, motion was made by Ald. Gelhard, seconded by Ald. Shaw to approve Resolution Authoring An Exception To The Levy Limits For Charges For The North Shore Fire Department Pursuant To 2005 Wisconsin Act 484. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously. VII. File No 2019 Proposed Annual Program Budget. Administrator Reiss proposed a Special Meeting on Monday, October 15, at 6:00 p.m., specifically for the 2019 Proposed Annual Program Budget. Administrator Reiss stated that Monday, November 12, 2018 will be the public hearing for the review of the 2019 Proposed Annual Program Budget

6 Mayor Kennedy recommended adding a separate meeting specifically for the 2019 Proposed Annual Program Budget. Administrator Reiss stated that approximately two (2) hours would be needed. Based on the recommendation of Administrator Reiss, motion was made by Mayor Kennedy for a separate meeting to review the 2019 Proposed Annual Program Budget on Monday, October 15, 2018, at 6:00 p.m., and the Public Hearing of the 2019 Proposed Annual Program Budget to be held on Monday, November 12, 2018, at 6:00 p.m. Motion was made by Ald. Shaw, seconded by Ald. Schmelzling to approve a separate meeting to review the 2019 Proposed Annual Program Budget on Monday, October 15, 2018, at 6:00 p.m., and the Public Hearing of the 2019 Proposed Annual Program Budget to be held on Monday, November 12, 2018, at 6:00 p.m.. Ayes: Ald. Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Vukovic, and Daugherty. Motion carried unanimously. RECEIPT OF MONTHLY DEPARTMENTAL REPORTS. A motion was made by Ald. Wiese, seconded by Ald. Shaw, to place the monthly departmental reports on file. Ayes: Ald. Vukovic, Gelhard, Wiese, Schmelzling and Shaw. Noes: None. Absent: Ald. Daugherty. Motion carried unanimously. COMMISSION, COMMITTEE AND BOARD REPORTS. There were several updates from Council members, on the activities of the various Commissions, Committees and Boards on which they serve. Susan Draeger-Anderson of the North Shore Library updated the Council on the process for designing the renovation of the North Shore Library. CLOSED SESSION. Mayor Kennedy suggested a Motion to Convene into Closed Session be made. Motion was made by Ald. Wiese, seconded by Ald. Schmelzling to convene in Closed Session at 5:36 p.m. per Section 19.85(1)(e) of the Wisconsin Statutes, deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons required a closed session (Consolidated North Shore Library). Ayes: Ald. Vukovic, Gelhard, Wiese, Schmelzling and Shaw. Noes: None. Absent: Ald. Daugherty. Motion carried unanimously. A closed session of approximately 23 minutes was held in which the Council discussed consolidated North Shore Library. A motion was made by Ald. Schmelzling, seconded by Ald. Gelhard, to reconvene to open session and regular order of business. Ayes: Ald. Vukovic, Gelhard, Wiese, Schmelzling and Shaw. Noes: None. Absent: Ald. Daugherty. Motion carried

7 ADJOURNMENT. There being no further business, motion was made by Ald. Gelhard, seconded by Ald. Vukovic, to adjourn the meeting. Ayes: Ald. Vukovic, Daugherty, Gelhard, Wiese, Schmelzling, and Shaw. Noes: None. Absent: Ald. Daugherty.
