Baird to appear). d) Resolution Authorizing the Issuance and Sale of $4,300,000 General Obligation Promissory Notes. e) Ordinance Creating Title 6, Chapter 8, Sections 1 through 5 of the Code of Ordinances of the City of Glendale Pertaining to the Application and Sale of Coal Tar Sealant Products. 7. Receipt of Monthly Departmental Reports. 8. Commission, Committee, and Board Reports: (This is an Opportunity for Council Members to Report on their Respective Committees, Commissions, and Boards of which they serve as a Member.) 9. 3 CITY OF GLENDALE -- COMMON COUNCIL March 13, 2017 Regular meeting of the Common Council of the City of Glendale held in the Municipal Building, 5909 North Milwaukee River Parkway. The meeting was called to order by Mayor Bryan Kennedy at 6:00 p.m. Roll Call: Present: Ald. James Daugherty, John Gelhard, Richard Wiese, Izzy Goldberg and JoAnn Shaw. Absent: Ald. Whitaker. Other Officials Present: Rachel Reiss, City Administrator; John Fuchs, City Attorney, Thomas Czarnyszka, Police Chief and Karen Couillard, City Clerk. PLEDGE OF ALLEGIANCE. The members of the Common Council, City staff and all those present pledged allegiance to the flag of the United States of America. OPEN MEETING NOTICE. The City Administrator advised that in accordance with the Open Meeting Law, the local news media was advised on Thursday, March 9, 2016, of the date of this meeting; that the agenda was posted on the official bulletin board of City Hall, the Glendale Police Department, and the North Shore Library; that copies of the agenda were made available to the general public in the Municipal Building and the Police Department, and those persons who requested, were sent copies of the agenda. ADOPTION OF COUNCIL MINUTES. Motion was made by Ald. Daugherty, seconded by Ald. Goldberg, approving the minutes of the meeting held on February 27, Ayes: Ald. Daugherty, Gelhard, Wiese, Goldberg and Shaw. Noes: None. Absent: Ald. Whitaker. Motion carried unanimously. PUBLIC COMMENT: Robert Cronwell, 7530 N. Applewood Lane, asked that the Police Report be updated on the City website. Police Chief Czarnyszka stated that the reports are available every month in the Council packets and the Police report is now part of the City report as a whole. COMMUNICATIONS, APPLICATIONS AND PETITIONS: I. File No Communication from City Administrator, Rachel Reiss; re: Resident Electronic Recycling. The City Administrator stated that many communities offer a location for residents to drop off electronics for recycling. In the North Shore, the Villages of Bayside and Shorewood offer this service to their residents. With the exception of CRT monitors and television sets, the 14586

4 service from the communities is free. Legacy Recycling, a Wisconsin based electronic recycling company offers this service and the City of Glendale has an opportunity to work with Legacy Recycling to offer a free service to residents to collect small electronics. The City Services building would be a designated site for residents to recycle their electronic material. The City can choose to offer a completely free service which would exclude the collection of CRT monitors or television sets. If the Council would like to add those items, staff recommends passing the fee on to the resident. Council asked what the fee would be for television sets and CRT monitors. City Administrator Reiss stated that surrounding communities charge $40.00 for the disposal of televisions sets and CRT monitors. Discussion ensued about the possibility of items being dropped off after hours and the burden it may place on staff. It was agreed that the City would accept television sets and CRT monitors for the fee of $40.00 and that this agreement would be reviewed every 6 months. Based upon the recommendation of the City Administrator, motion was made by Ald. Daugherty, seconded by Ald. Goldberg, to authorize staff to contract with Legacy Recycling to offer residents an electronic recycling drop off location at the City Services building, with a resident charge of $40.00 for any television set or CRT monitor and an update to the Council after 6 months of the program. Ayes: Ald. Daugherty, Gelhard, Wiese, Goldberg and Shaw. Noes: None. Absent: Ald. Whitaker. Motion carried unanimously. II. File No Communication from Administrator Rachel Reiss, re: Glendale s first annual Root Beer Bash. City Administrator Reiss stated that at a recent Visitor and Convention Bureau meeting, it was suggested that the City have a new festival. In January, Orthopedic Hospital of Wisconsin withdrew sponsorship for the Police Department s annual run/walk. Staff has been working with Sprecher Brewing Co, Inc. to present Glendale Root Beer Bash. The date for the event is August 26 and will be held at the Richard E. Maslowski Community Park. The event would include a run/walk to benefit the Police Department, a corn hole tournament, family friendly games, and the potential for Glendale to attempt to be in the Guinness Book of World Records for the largest root beer float and/or most root beer floats served in one day. A budget has not been determined for the event. It is anticipated that there would be minimal funds necessary. The funds would come from the Room Tax Fund. NEW BUSINESS. For informational purposes only, no motion made. III. File No Ordinance Creating Title 15, Chapter 1, Section 25 of the Code of Ordinances of the City of Glendale Pertaining to Failure to Schedule Inspections. In November 2016, the permit fees and forms ordinances were amended. Some parts of the ordinances were removed from Title 15 and incorporated by reference in the permit and fees schedule, including the penalties for failure to schedule an inspection. Without this section there is no way of directly referencing the ordinance or associated penalties when issuing a Notice of Violation. The proposed addition to the ordinances is meant to address this oversight 14587

5 and provide a reference to the penalties for the failure to schedule an inspection. Motion was made by Ald. Weise, seconded by Ald. Gelhard, to adopt the Ordinance Creating Title 15, Chapter 1, Section 25 of the Code of Ordinances of the City of Glendale Pertaining to Failure to Schedule Inspections. Ayes: Ald. Daugherty, Gelhard, Wiese, Goldberg and Shaw. Noes: None. Absent: Ald. Whitaker. Motion carried unanimously. IV. File No Ordinance Amending Section (a)(1) and (2) of the Code of Ordinances of the City of Glendale Pertaining to General Penalty. The City of Glendale Code establishes a range of penalties for non-traffic offenses. For a first offense the current range is not less than $25.00 nor more than $1, For a second offense the range is not less than $50.00 nor more $2, At the suggestion of Judge Lipscomb, and the approval from the City Attorney, it is recommended that Council approves to raise the potential maximum fine. There would be no change to the minimum fine, because there are some extraordinarily minor offenses, or per diem fines in which the lower end range makes sense. The ordinance would increase the current maximum penalty for non-traffic first offense from $1, to $3, and second offense maximum penalty from non-traffic violations from $2, to $5, Judge Lipscomb stated that the maximum possible fine has not been raised since 1989 and as more and more potentially criminal matters are deferred by the Office of the District Attorney back to the Municipal Court system, a higher fine potential is appropriate. Robert Cronwell voiced his opposition to this change in the ordinance, stating that the default amount could be excessive for minor offenses. City Attorney Fuchs stated that the ordinance is not written in such a way that a minor offense would result in an excessive fine. Motion was made by Ald. Weise, seconded by Ald. Gelhard, to adopt the Ordinance Amending Section (a)(1) AND (2) of the Code of Ordinances of the City of Glendale Pertaining to General Penalty, to be published the last week of April. Ayes: Ald. Daugherty, Gelhard, Wiese, Goldberg and Shaw. Noes: None. Absent: Ald. Whitaker. Motion carried unanimously. V. Gelhard, to approve the accounts payable register dated March 9, 2017 for check numbers to totaling $346, and for prepaid checks, numbers 1081 to 1103 and to totaling $18,820, On Roll Call: Ayes: Ald. Daugherty, Gelhard, Wiese, Goldberg and Shaw. Noes: None. Absent: Ald. Whitaker. Motion carried unanimously. COMMISSION, COMMITTEE AND BOARD REPORTS. Several Council members briefly reported on the activities of the various Commissions, Committees and Boards they serve on. ADJOURNMENT. There being no further business, motion was made by Ald.
