1 MINUTES OF NOVEMBER 27 & DECEMBER 5, 2017 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order at 10:15 a.m. COUNTY RECORDER STAFFING County Recorder John Murphy met with the Board to discuss staffing in his office. With a deputy retiring he would like to hire another full-time person plus one. Klein said someone from the recorder s office comes every year asking for an additional person. He would like more reason as to why he needs to maintain two deputies. Murphy said the Recorder s office has busier times of the year and annually record from 13,000-25,000 documents. Klein suggested hiring a clerk to see how it goes before hiring a deputy. Motion by Wickham, seconded by Baker, carried unanimously, to recess at 10:55 a.m. for five minutes. ELECTED OFFICIALS AND DEPARTMENT HEADS Upon reconvening at 11:00 a.m. Supervisor Baker asked United Way Representatives Sondra Briese and Danielle Peterson to attend a Board meeting. Baker and County Sheriff Joe Kennedy are heading up the Dubuque County Employee donation contributions for the United Way. Soeder asked how much of the donation stays in the Dubuque area. Danielle said 83 cents on the dollar stays here. In attendance were Maintenance Superintendent Chris Soeder, IT Superintendent Nathan Gillmore, Sheriff Joe Kennedy, Library Director Michael Wright, Emergency Management Director Tom Berger, Sunnycrest Manor Administrator Cris Kirsch, County Recorder John Murphy, City Assessor Rick Engelken, County Assessor Dave Kubik, Conservation Board Executive Director Brian Preston, Deputy to the Conservation Director Nate Sisler, County Auditor Denise Dolan, Budget Director Michelle Patzner, Intern Ryan McCaffery MHDS Regional Coordinator Jody Jansen, Zoning Administrator Anna O Shea, and Health Director Patrice Lambert, and Administrative Assistant Mary Ann Specht. Soeder is bringing in an environmental specialist from Milwaukee to test the air from the new heating units. The manufacturer is here working on the HVAC. Kubik said we do have a department of attorneys. The department heads gave their reports. Chair Wickham announced Budget Director Michelle Patzner has turned in her resignation 463 (November 27 & December 5)
2 effective December 8, He thanked her for her five plus years of service and wished her well. Motion by Baker, seconded by Klein, carried unanimously, to recess at 12:05 p.m. for five minutes. BOARD OF SUPERVISOR S 2018 MEETING SCHEDULE Administrative Assistant Mary Ann Specht asked the Board if they would like to keep the meeting days as is or move them. January 3, 2018 is the first business day of the year, therefore required to hold a meeting. Baker asked about moving the meetings a few times a year to different locations within the County. Consensus is it would be confusing to the public to be moving it so the meetings will remain the second Monday of the month at 9:00 a.m. and the fourth Monday at 5:30 p.m. Motion by Klein, seconded by Baker, carried unanimously, to recess at 12:30 p.m. GENERAL ASSISTANCE DIRECTOR REGARDING THE FY18 BUDGET AND RELATED FUNERAL EXPENSES The Board reconvened at 12:17 p.m. with General Assistance Director Randy Rennison, Budget Director Michelle Patzner and Intern Ryan McCaffery. Annual budgeting is starting soon so Rennison would like to have some direction in where to go with his figures. He had a hand out showing the first five months of this fiscal year that was discussed. GENERAL ASSISTANCE HEARINGS Motion by Klein, seconded by Baker, carried unanimously, to enter executive session with General Assistance Caseworker Doug Slaats regarding case H Upon returning to a regular session, motion by Klein, seconded by Baker, carried unanimously, to assist case H-9-42 with $225 if she can come up with the rest. Motion by Klein, seconded by Baker, carried unanimously, to enter executive session with General Assistance Caseworker Dough Slaats regarding case H Upon returning to regular session, motion by Klein, seconded by Baker, carried unanimously, to deny assistance to case H (November 27 & December 5)

Motion by Klein, seconded by Wickham, carried unanimously, to recess at 1:50 p.m. CITY OF DUBUQUE/DUBUQUE COUNTY COST SHARING AGREEMENTS Upon reconvening at 2:03 p.m. the Board met with Sheriff Joe Kennedy and Chief Deputy Sheriff Dave Riniker. They discussed the agreements on the Federal Building and the jail. This will be discussed more in January. GENERAL DISCUSSION REGARDING THE COUNTY BUDGETING PROCESS The Board asked Budget Director Michelle Patzner about a job description for her position. Patzner stated she does not think she is involved enough with accounting on the day-to-day basis making it difficult for forecasting what is needed. County Auditor Denise Dolan was asked if she would lead the budget process for the coming cycle. She said she would consider it. Motion by Klein, seconded by Baker, carried unanimously, to recess at 3:26 p.m. REVIEW OF TRAVEL AND TRAINING REIMBURSEMENT POLICY Upon reconvening at 3:37 p.m. the Board went through the travel and training reimbursement policy. Klein would like to see the $5 per day for incidentals go away. The Board will be using more scrutiny when looking at the claims. If there is something questionable the claim will be denied. It has probably been awhile since employees who travel have actually read the policy. There will be a few changes made in the wording then sent with a letter of explanation to the department heads. 465 (November 27 & December 5)
4 Motion by Wickham, seconded by Baker, carried unanimously, to recess at 4:30 p.m. WORKSESSION WITH ZONING ADMINISTRATOR ENTRANCE PERMIT Upon reconvening at 4:45 p.m. the Board met with Zoning Administrator Anna O Shea and Tom Schmitt regarding the Kathleen Schmitt Trust. They would like to build a second home on the farm which will require the existing field entrance to be upgraded to residential and then place a new field entrance. Motion by Klein, seconded by Baker, carried unanimously, to allow entrance A to be 40' and not do B. WORKSESSION WITH COUNTY ENGINEER The Board met with County Engineer Anthony Bardgett. He gave an update of road projects being done and almost done. He was asked about putting a street light at an intersection on John Deere Road but the accident history does not warrant a light. Baker mentioned Cinnamon Road where at the end is a dirt and rock berm where water pools and goes into a yard but the concern is it could be ruining the road. If the berm is open it will run down to the next neighbor making them upset. Bardgett will look into it. Motion by Klein, seconded by Baker, carried unanimously, to recess at 5:25 p.m. APPROVAL OF MINUTES OF NOVEMBER 13 & 14, 2017 Upon reconvening at 5:30 p.m. motion by Baker, seconded by Klein, carried unanimously, to approve the minutes. CONSENT ITEMS Class WCN native wine permit for Barrel Head Winery and IDNR Manure Management Plan for Dale Rolwes. 5 PROOF OF PUBLICATION - PUBLIC HEARING Motion by Baker, seconded by Klein, carried unanimously, to receive and file the proof of publication for the Notice of Public Hearing for the proposed vacation of county road right of way. PUBLIC HEARING - PROPOSED VACATION OF COUNTY ROAD RIGHT OF WAY Chair Wickham opened the public hearing. County Engineer Anthony Bardgett explained the purpose of vacating the right of way located on Pape Road and on Fulmer Road. Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. NOTICE OF PUBLIC HEARING - AMENDMENT OF ZONING ORDINANCE - ZC# ANN LOES GRANEY AND SCOTT & REBECCA ZIMMERMAN A-1 AGRICULTURAL TO A-2 AGRICULTURAL RESIDENTIAL Motion by Klein, seconded by Baker, carried unanimously, to advertise for a public hearing to be held on Monday, December 11, 2017 at 9:00 a.m. for the above-mentioned Amendment to Zoning Ordinance. 9 Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION APPROVE ANNUAL URBAN RENEWAL REPORT FOR FY17 WHEREAS, the County is required to file an annual Urban Renewal report with the Department of Management by December 1 st of each year; and WHEREAS, the report for Fiscal Year 2017 has been prepared. NOW, THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors hereby approves the FY17 annual Urban Renewal report. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION VACATING A PORTION OF RIGHT OF WAY ON PAPE ROAD WHEREAS, the Dubuque County Board of Supervisors received a request to vacate a portion of right of way on Pape Road, in Section 22, New Wine Township, T89N-R2W, and WHEREAS, a public hearing, with all proceedings in accordance with Iowa Code Chapter 306, was held on November 27th, 2017, in the Board of Supervisors Chambers at the Dubuque County Courthouse for the purpose of vacating a portion of this right of way, and WHEREAS, the Board of Supervisors, on November 27th, 2017, did by motion, approve the vacation, subject to the right of utilities to continue in possession of any easement existing at the time of the vacation, of the portion of Pape Road described as: That portion of Pape Road located in the SW1/4 NW1/4 of Section 22, T89N, R2W of the 5 th P.M., Dubuque County, Iowa. The Board of Supervisors finds no additional damages are to be paid to any claimants on this vacation. 11 RESOLUTION FEDERAL-AID AGREEMENT #6-17-HBPS-25 FOR PROJECT BROS- C31(89)-5F-31, BRIDGE REPLACEMENT ON BUDD ROAD WHEREAS, the Iowa Department of Transportation has presented Dubuque County with a Federal-aid Agreement for a County Highway Bridge Program Project, Iowa DOT Agreement No HBPS-25 for Project No. BROS-C031(89)--5F-31 on Budd Road, and WHEREAS, Dubuque County was approved for partial funding through the Surface Transportation Program (STP) fund with the portion of project costs reimbursed with STP funds limited to a maximum of either 80% of eligible costs (other than those reimbursed with Federal funds) or the amount stipulated in the approved Statewide Transportation Improvement Program (STIP), whichever is less, and the remaining balance funded by the Farm to Market program, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign said agreement with the Iowa Department of Transportation. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION SNOW AND ICE REMOVAL 28E AGREEMENT WITH THE CITY OF BALLTOWN FOR THE WINTER WHEREAS, the Dubuque County Secondary Road Department agrees to perform ice and snow removal maintenance from November 1, 2017 through May 1, 2018 for the following city: Balltown 0.44 Paved Miles $ WHEREAS, it is necessary that Dubuque County enter into a 28E agreement with each city regarding this maintenance, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the 28E agreement for ice and snow removal maintenance with the City of Balltown. 12 RESOLUTION PLANS AND SPECIFICATIONS FOR THE BRIDGE REPLACEMENT ON CLEAR CREEK ROAD, PROJECT L-B19(01) WHEREAS, plans and specifications have been prepared by Dubuque County and approved by the Dubuque County Engineer for the bridge replacement project on Clear Creek Road, Project L-B19(01) , and WHEREAS, this project will be let locally by Dubuque County, subject to the Dubuque County Board of Supervisors approval and signature on the plans, THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve the plans and specifications for said project. Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION IOWA ECONOMIC DEVELOPMENT AUTHORITY CONTRACT NO. 08-DRH-004 AMENDMENT NO. 19 WHEREAS, Dubuque County has been presented with an Iowa Economic Development Authority Amendment #19 for Contract Number 08-DRH-004; and WHEREAS, Amendment #19 amends each Article in the Contract that refers to Attachment A, Program Description and Budget to Attachment A, Program Description and Budget, as amended ; and WHEREAS, Amendment #19 amends the award amount from $7,762,047 to $7,749,847. NOW, THEREFORE BE IT RESOLVED to approve and authorize the Chairperson of the Dubuque County Board of Supervisors to sign Iowa Economic Development Authority Amendment #19 for Contract Number 08-DRH-004. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION ELECTION TO PARTICIPATE AND RELEASE FORM RELATED TO THE TWO RIVERS INSURANCE O. (MUTUAL MED INSURANCE SERVICE, INC.) SETTLEMENT THROUGH THE STATE OF IOWA INSURANCE COMMISSIONER WHEREAS, Dubuque County has been presented with an Iowa Insurance Commission Election to Participate and Release Form, Case # 95687; and 474 (November 27 & December 5)
13 WHEREAS, this form is related to Dubuque County s receipt of additional settlement dollars related to the Two Rivers Insurance Co. investigation and subsequent investigation of Mutual Med Insurance Services, LLC. NOW, THEREFORE BE IT RESOLVED Dubuque County accepts this amount as recommended by the Dubuque County Attorney and authorizes the chairperson to sign the Iowa Insurance Commission Election to Participate and Release Form, Case #95687 Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the Chair to sign Resolution APPOINTMENTS Several applications have been received for various committees but need to be posted a second time. Motion by Baker, seconded by Klein, carried unanimously, to receive and file. PERSONNEL REQUISITIONS Administrative Assistance Mary Ann Specht wrote a job description for her position. HK, consultants, prepared a job description of what the job should be. Then they wrote a revision that was not received until just before the meeting. Wickham stated he would like more changes to be made and the Board should have more time. Klein said he was confused to what is going on, the county is paying HK and now we want to make dramatic changes. Wickham said they just got the revision and he did not have time to look at it. Motion by Baker to receive and table until the December 5 th meeting. Klein stated he would like to get this going and get the job posted to get someone in here to train. Baker said when someone leaves employment that is the time to revisit the job description. This is an important position and they should have time to go over it. The HK revised description came at 9:45 this morning and the Board has been in meetings all day so have not had a chance to read it. Wickham seconded the motion to table. Motion carried with Baker and Wickham voting aye and Klein voting nay. County Recorder John Murphy discussed the retirement of his Deputy and what options he has to hire in his department. There are times they are very busy and get behind. He would like to hire a Clerk 2 and Clerk 3 not a deputy. Klein stated Ms. Gavin has been here a long time doing an outstanding job and will be missed but will it take two people to replace her? 475 (November 27 & December 5)
14 Murphy stated he was elected the same as the three Board members and doesn t believe elected officials need to be micro managed. The roads department doesn t wait for two-feet of snow on the ground to hire, you have your person in place to run when needed. Baker said when a veteran employee leaves is a good time to review operations and what changes are needed. PUBLIC COMMENTS Randy Vannorsdel, Vice President of Tri-State Mountain Bike Riders (TMBR) gave a slide presentation explaining mountain bike riding and the benefit to the community. TMBR has funding in place to develop a mountain bike trail in the Interstate Power Preserve. The Dubuque County Conservation Board would remain the owners of the property and any improvements. Vannorsdel is asking the Board to be supportive of this endeavor moving forward to promote off-road cycling as an outdoor recreation and fitness activity. Motion by Klein, seconded by Baker, carried unanimously, to recess at 6:40 p.m. until 12:00 noon on Tuesday, December 5, The Board reconvened at 12:00 noon on Tuesday, December 5, RESOLUTION AUTHORIZING NECESSARY DOCUMENTATION FOR THE THREE- YEAR MICROSOFT AGREEMENT WHEREAS, bids were received at the Dubuque County Auditor s Office until 3:00 p.m. November 22, 2017 for bid opening at 3:15 p.m. for the IT Department to purchase a threeyear Microsoft Enterprise Agreement and CDW Government LLC was the only bidder, therefore, the low bid of $135,488.95, and WHEREAS, CDW Government LLC have submitted the necessary contract documents, and THEREFORE BE IT RESOLVED that the Board of Supervisors of Dubuque County, Iowa hereby approve and direct the Chair to sign the necessary contract documents for said project Motion by Klein, seconded by Baker, carried unanimously, to approve and authorize the 476 (November 27 & December 5)
15 Chair to sign Resolution WORKSESSION WITH IT SUPERINTENDENT The Board met with IT Superintendent Nathan Gilmore regarding an upcoming Firewall request. Gilmore explained to the Board what a firewall is and how it protects the information on the computers. This was budgeted for in the current fiscal year. He wanted the Board to be aware this will be coming soon. The consensus of the Board is to move forward with the protection. WORKSESSION REGARDING THE 2018 BUDGET PROCESS The Board met with Budget Director Michelle Patzner, Intern Ryan McCaffery, County Auditor Denise Dolan, and Maintenance Superintendent Chris Soeder. Patzner has completed the budget packets and has sent them to the department heads. The packets are due back December 20 th. The Board asked Dolan to have a proposal for the next meeting as to the compensation she would like to lead the upcoming budget process. The Board also talked to McCaffery to see if he would like to remain with the county through the entire grant. He stated he would like to stay. DUBUQUE COUNTY TRAINING AND TRAVEL REIMBURSEMENT POLICY REVIEW In looking at the policy there were simple mistakes made that will be corrected and placed on the next agenda. REVIEW ISAC COMMUNICATION REGARDING OPIOID EPIDEMIC LITIGATION State Representative Chuck Isenhart met with the Board to discuss the opioid epidemic in the State. The Iowa State Association of Counties (ISAC) had a draft resolution for the Board. Not being clear with what they are asking Administrative Assistant Mary Ann Specht will forward it to the County Attorney for direction. Motion by Klein, seconded by Baker, carried unanimously, to recess at 1:30 p.m. REVIEW OF PROPOSED JOB DESCRIPTIONS TO REPLACE THE DUBUQUE COUNTY PERSONNEL DIRECTOR/ADMINISTRATIVE ASSISTANT TO THE BOARD 477 (November 27 & December 5)
16 Upon reconvening at 1:50 p.m. the Board met with Honkamp Krueger representative Laurie Stewart. Baker asked if the Board has to come up with just one job description. Stewart said one description because if you make changes you are not being an equal opportunity employer and the Board would have to start over. Klein stated this process is not what the Board signed up for. Honkamp Krueger was hired to spearhead the process not one board member who hi-jacked this without authorizing by the Board. Wickham pointed out at couple meetings it was motioned and moved to change the job description. Baker said when someone leaves you review the position and you look at their title. Honkamp can not move forward without a title and job description. Wickham said sample three does not have any administrative duties related to the Board. Michelle Patzner said the budget should be held by accounting which is the Auditor s office. She said the Iowa Code states the Administrator does the budget so her position really is not needed. Klein asked by changing the job description to sample three what are they trying to fix? Laurie Stewart thought with this job description the total compensation should be 85K to 120K. The title of the job was discussed. The Board talked about compensation and the wage should be just the wage not including the benefit package. Klein asked about starting at a lower wage like 70K. Stewart said she doesn t know what it is but the $80,000 figure just works better. Research of the market work demand is 79-82K. Motion by Wickham to approve the Dubuque County HR Administrator job description listed as #3 as received on with the changes of: 1. Supervisory responsibilities over directors and superintendents of facilities, IT, budgeting, zoning, and general assistance that language was included in his That has the language liason for all board of supervisors meetings and 3. The salary only range for salary only 80K-110K. Seconded by Baker. Carried with Wickham and Baker voting aye and Klein voting nay.
