1 MINUTES OF APRIL 23 rd & MAY 8, 2018 DUBUQUE COUNTY BOARD OF SUPERVISORS Present: Jay Wickham, Daryl Klein and Dave Baker Chair Wickham called the meeting to order at 9:00 a.m. WORKSESSION WITH STATE REPRESENTATIVE CHUCK ISENHART AND THE DUBUQUE EATS WELL COALITION REGARDING THE DUBUQUE COUNTY FOOD POLICY COUNCIL The Board met with State Representative Chuck Isenhart, Assistant Health Director Bonnie Brimeyer, Medical Examiner Gwen Hall-Driscoll, and Dubuque Eats Well Coalition Co- Chair Michaela Freiburger. Dubuque Eats Well Coalition and the Dubuque County Food Policy Council are two separate entities. The Coalition will have its own set of bi-laws and commission members. The Board of Health will sort through the applicants then do a worksession with the Board of Supervisors. Motion by Klein, seconded by Baker, carried unanimously, to recess at 9:47 a.m. WORKSESSION WITH COUNTY MAINTENANCE SUPERINTENDENT REGARDING COURTHOUSE EXTERIOR PAINTING Upon reconvening at 10:15 a.m. the Board met with Maintenance Superintendent Chris Soeder and FEH Representative Christy Monk. They discussed the paint choices and what would be aesthetically better. The grant Soeder was planning to apply for the work cannot be started until after a letter of award is received. Wickham asked why he had not applied two months ago. The price of the roof does not include painting of the lower band. Soeder said he can do the grant application next year for this project if one cannot be submitted this year. WORKSESSION WITH HUMAN RESOURCES ADMINISTRATOR REGARDING THE BUDGET DIRECTOR POSITION The Board met with HR Administrator Dawn Sherman to discuss the vacant budget director position. The previous pay range was $70,816-$86,078 but the Board reduced it to $62,000- $76,000. Sherman s research shows a higher rate for a comparable position so she would like to recommend going back to the previous scale. Several were interviewed for said position however; position was not filled. Sherman 165 (April 23 & May 8)

2 believes with this pay rate the person previously interviewed may accept the position. If not, the position will be reposted until filled. The Board gave Sherman the authority to negotiate at the higher scale. Motion by Baker, seconded by Klein, carried unanimously, to recess at 11:05 a.m. GENERAL ASSISTANCE HEARINGS Upon reconvening at 1:07 p.m. motion by Klein, seconded by Baker, carried unanimously, to enter executive session with General Assistance Caseworkers Nick Agan and Doug Slaats regarding Case O Upon returning to regular session, motion by Klein, seconded by Baker, carried unanimously, to deny assistance to Case O Motion by Wickham, seconded by Baker, carried unanimously, to deny assistance to Case E-2-41, and S-12-7 due to not showing up for the hearing. Motion by Baker, seconded by Klein, carried unanimously, to recess at 1:30 p.m. WORKSESSION REGARDING FY17 AUDIT WITH EIDE BAILLY Upon reconvening at 2:05 p.m. the Board met with Brian Unsen of Eide Bailly to discuss the FY17 audit his office performed. GASB is now requiring a tax abatement disclosure statement. The City of Dubuque abated $672,000 in taxes that means the County does not collect. Motion by Klein, seconded by Baker, carried unanimously, to recess at 2:35 p.m. WORKSESSION WITH ZONING ADMINISTRATOR ENTRANCE PERMITS Upon reconvening at 4:00 p.m. the Board met with Zoning Administrator Anna O Shea and Jerome Riniker to discuss the hog lot he would like to build on Clear Creek Road property so he is out of the flood way. Motion by Klein, seconded by Baker, carried unanimously, to approve the variance. 166 (April 23 & May 8)

3 The Board met with Zoning Administrator Anna O Shea and Justin Licht asking for a new residential entrance so Justin can build a new home. Motion by Baker, seconded by Klein, carried unanimously, to approve the entrance. The Board met with Zoning Administrator Anna O Shea and Jeff Kintzle regarding a year old entrance permit. Kintzle previously requested to install two new field entrances and wanted them wider than allowed. They were allowed one but not both. He is now requesting the second one again. Motion by Baker, seconded by Klein, carried unanimously, to approve the entrance with removal of two entrances. WORKSESSION WITH COUNTY ENGINEER The Board met with Assistant County Engineer Russell Weber. Weber gave a progress report on the seven various projects being done throughout the County. Motion by Klein, seconded by Baker, carried unanimously, to recess at 5:08 p.m. CONSENT ITEMS The Board reconvened at 5:30 p.m. Quarterly report of the County Recorder, fireworks permit for Thunder Hills Country Club, IDNR Manure Management Plan for Jeff Schmitt, and Class C Liquor License for the Dubuque County Fair and Dubuque County Torque Fest. Motion by Baker, seconded by Klein, carried unanimously, to approve the abovementioned consent items. CONTINUANCE OF PUBLIC HEARING - ZC# O ROURKE FARMS LLC AND IOWA DEPARTMENT OF TRANSPORTATION C-1 AND R-2 TO A-1 Chair Wickham reminded everyone this is a continuation of the public hearing that had been opened at the April 9, 2018 meeting. Zoning Administrator Anna O Shea and Administrator of Storm Water and Erosion Control Ordinance Eric Schmeichel addressed concerns of the Board. 167 (April 23 & May 8)

4 Motion by Klein, seconded by Baker, carried unanimously, to close the public hearing. AMENDMENT TO ZONING ORDINANCE - ZC# O ROURKE FARMS LLC AND IOWA DEPARTMENT OF TRANSPORTATION C-1 AND R-2 TO A-1 The following amendment to the Dubuque County Zoning Ordinance is proposed. ZC# O Rourke Farms LLC and Iowa Department of Transportation C-1 Conservancy and R-2 Single Family Residential to A-1 Agricultural The applicants are requesting to rezone from C-1, Conservancy, and R-2, Single Family Residential to A-1, Agricultural acres more or less, to allow for an Iowa Department of Transportation Maintenance Garage Facility. The property, located adjacent to the City of Dubuque at the corner of US Highway 61 and Olde Davenport Road, is legally described as Part of Lot 3 of the SW ¼ of the NW ¼, Part of the SE ¼ of the NW ¼, Part of Lot 1 of the NW ¼ of the SW ¼, and Part of Lot 1 of the E ½ of the SW ¼ all in Section 13, (T88N- R2E) Table Mound Township, Dubuque County, Iowa. 1. That a buffer of native prairie be planted between the facility and the creek. 2. That a bio swale or similar structure be constructed to capture storm water runoff from the proposed facility. 3. That the site must follow all regulations of the Erosion & Sediment Control and Storm water Ordinance for Dubuque County to address erosion and storm water runoff, including for the salt runoff from the site. A report on the proposed amendment has been received from the Dubuque County Zoning Commission; notice of the public hearing has been published as required by law; and a public hearing has been held on Monday April 9, 2018 and Monday April 23, Motion by Klein, seconded by Baker, carried unanimously, to approve the rezoning. Motion by Klein, seconded by Baker, carried unanimously, to suspend the requirement that this amendment be considered and voted on for passage at two prior meetings. Motion by Klein, seconded by Baker, carried unanimously, that the amendment be adopted and that the zoning administrator be directed to enter the appropriate changes on the official zoning map and that the Auditor be directed to arrange for the publication of the amendment and portion of the official zoning map as amended in the official county newspapers as required by law. 12 WHEREAS, Dubuque County is the fiduciary agent for Jumpstart Federal Housing rehabilitation program #08-DRH-204; and WHEREAS, the East Central Intergovernmental Association has disbursed funds in the amount of $ 3,333. NOW THEREFORE BE IT RESOLVED that the Dubuque County Board of Supervisors hereby approves the Request for Payment Report # 108 in the amount of $3,333 to be submitted to the Iowa Department of Economic Development. ECIA will remit the fund to the Iowa Economic Development Authority. Motion by Baker, seconded by Klein, carried unanimously, to approve and authorize the Chair to sign Resolution RESOLUTION SETTING THE DATE FOR SALE OF GENERAL OBLIGATION URBAN RENEWAL BONDS, SERIES 2018A AND AUTHORIZING THE USE OF A PRELIMINARY OFFICIAL STATEMNT IN CONNECTION THEREWITH WHEREAS, the Board of Supervisors (the Board ) of Dubuque County, Iowa (the County ) heretofore proposed to enter into a General Obligation Loan Agreement (the Essential Purpose Loan Agreement ) and to borrow money thereunder in a principal amount not to exceed $1,100,000, pursuant to the provisions of Section of the Code of Iowa, for the purpose of paying the cost, to that extent, of constructing improvements to County park shelter buildings ($60,000); constructing flooring and lighting improvements to and providing equipment for the County Courthouse ($520,000); installing HVAC improvements at the Law Enforcement Center ($275,000); demolishing and restoring dangerous and dilapidated bridges ($170,000); improving and equipping a County public works facility ($75,000), and has published notice of the proposed action and has held a hearing thereon on March 12, 2018; and WHEREAS, the County also proposed to enter into a General Obligation Loan Agreement (the General Purpose Loan Agreement #1 ) and to borrow money thereunder in a principal amount not to exceed $105,000 pursuant to the provisions of Section of the Code of Iowa for the purpose of paying the cost, to that extent, of acquiring and installing fencing on public grounds; acquiring mowers and related equipment; constructing and installing improvements at a County campground; and acquiring and equipping a vehicle for the County Public Works Department, and in lieu of calling an election upon such proposal, has published notice of the proposed action and has held a hearing thereon, and as of March 12, 2018, no petition had been filed with the County asking that the question of entering into the General Purpose Loan Agreement #1 be submitted to the registered voters of the County; and WHEREAS, the County also proposed to enter into a General Obligation Loan Agreement (the General Purpose Loan Agreement #2 ) and to borrow money thereunder in a principal amount not to exceed $180,000 pursuant to the provisions of Section of the Code of Iowa 176 (April 23 & May 8)

13 for the purpose of paying the cost, to that extent, of acquiring the Fiscal Year 2020 squad car replacements for the Sheriff s Department, and in lieu of calling an election upon such proposal, has published notice of the proposed action and has held a hearing thereon, and as of March 12, 2018, no petition had been filed with the County asking that the question of entering into the General Purpose Loan Agreement #2 be submitted to the registered voters of the County; and WHEREAS, the County also proposed to enter into a General Obligation Loan Agreement (the General Purpose Loan Agreement #3 ) and to borrow money thereunder in a principal amount not to exceed $185,000 pursuant to the provisions of Section of the Code of Iowa for the purpose of paying the cost, to that extent, of acquiring the Fiscal Year 2021 squad car replacements for the Sheriff s Department, and in lieu of calling an election upon such proposal, has published notice of the proposed action and has held a hearing thereon, and as of March 12, 2018, no petition had been filed with the County asking that the question of entering into the General Purpose Loan Agreement #3 be submitted to the registered voters of the County; and WHEREAS, the County also proposed to enter into a General Obligation Loan Agreement (the Urban Renewal Loan Agreement and, collectively with the Essential Purpose Loan Agreement, the General Purpose Loan Agreement #1, the General Purpose Loan Agreement #2, and the General Purpose Loan Agreement #3 are hereinafter sometimes referred to as the Loan Agreements) and to borrow money thereunder in a principal amount not to exceed $1,430,000 pursuant to the provisions of Section and Section (2)(b)(14) of the Code of Iowa for the purpose of paying the cost, to that extent, of undertaking an urban renewal project in the Greater Dubuque Downtown Urban Renewal Area consisting of constructing exterior renovations and roofing repairs to the Dubuque County Courthouse, and in lieu of calling an election upon such proposal, has published notice of the proposed action and has held a hearing thereon, and as of March 12, 2018, no petition had been filed with the County asking that the question of entering into the Urban Renewal Loan Agreement #1 be submitted to the registered voters of the County; and WHEREAS, the County previously combined the Loan Agreements into a single loan agreement (the Loan Agreement ); and WHEREAS, the County has determined to divide its authority to borrow under the Loan Agreement into multiple credit facilities, one of which will be the Urban Renewal Loan Agreement; and WHEREAS, a Preliminary Official Statement (the P.O.S. ) has been prepared to facilitate the sale of $1,430,000 General Obligation Urban Renewal Bonds, Series 2018A (the Series 2018A Bonds ) to be issued in evidence of the obligation of the County under the Urban Renewal Loan Agreement, and it is now necessary to make provision for the approval of the P.O.S. and to authorize its use by D.A. 14 NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Dubuque County, as follows: Section 1. It is hereby determined that the County shall divide its authority to borrow under the Loan Agreement by initially entering into the Urban Renewal Loan Agreement. Section 2. The County Auditor is hereby authorized to take such action as shall be deemed necessary and appropriate with the assistance of the Financial Advisor and Dorsey & Whitney LLP, as the County s disclosure counsel, to prepare the P.O.S. describing the Bonds and providing for the terms and conditions of their sale, and all action heretofore taken in this regard is hereby ratified and approved. Section 3. The use by the Financial Advisor of the P.O.S. relating to the Bonds in substantially the form as has been presented to and considered by the County is hereby approved, and the Financial Advisor together with Disclosure Counsel, are hereby authorized to prepare and use a final Official Statement for the Bonds substantially in the form of the P.O.S. but with such changes therein as are required to conform the same to the terms of the Bonds and the resolution, when adopted, providing for the sale and issuance of the Bonds, and the County Auditor is hereby authorized and directed to execute a final Official Statement for the Bonds, if requested. The P.O.S. as of its date is deemed final by the County within the meaning of Rule 15(c)(2)-12 of the Securities and Exchange Commission. Section 4. 16 The Securities and Exchange Commission (the SEC ) has promulgated certain amendments to Rule 15c2-12 under the Securities Exchange Act of 1934 (17 C.F.R c2-12) (the Rule ) that make it unlawful for an underwriter to participate in the primary offering of municipal securities in a principal amount of $1,000,000 or more unless, before submitting a bid or entering into a purchase contract for such securities, it has reasonably determined that the issuer or an obligated person has undertaken in writing for the benefit of the holders of such securities to provide certain disclosure information to prescribed information repositories on a continuing basis so long as such securities are outstanding. On the date of issuance and delivery of the Series 2018A Bonds, the County will execute and deliver a Continuing Disclosure Certificate pursuant to which the County will undertake to comply with the Rule. The County will covenant and agree to comply with and carry out the provisions of the Continuing Disclosure Certificate. All of the Supervisors of the County will be authorized and directed to take any and all actions as may be necessary to comply with the Rule and the Continuing Disclosure Certificate. Bidders should be aware that the official terms of offering to be published in the Official Statement (the Official Statement ) for the Series 2018A Bonds contain additional bidding terms and information relative to the Series 2018A Bonds. In the event of a variance between statements in this Notice of Sale (except with respect to the time and place of the sale of the Series 2018A Bonds and the principal amount offered for sale) and said official terms of offering, the provisions of the latter shall control. In order to establish the issue price of the Series 2018A Bonds for federal income tax purposes, the County requires bidders to agree to the following, and by submitting a bid, each bidder agrees to the following. 17 If the County advises the Purchaser that the requirements for a competitive sale have been satisfied and that the competitive sale rule applies, the Purchaser will be required to deliver to the County at or prior to closing an Issue Price Certificate, in a form reasonably acceptable to bond counsel, as to the reasonably expected initial offering price as of the award date. If the County advises the Purchaser that the requirements for a competitive sale have not been satisfied and that the hold-the-offering price rule applies, the Purchaser shall (1) upon the request of the County confirm that the underwriters did not offer or sell any maturity of the Series 2018A Bonds to any person at a price higher than the initial offering price of that maturity during the period starting on the award date and ending on the earlier of (a) the close of the fifth business day after the sale date or (b) the date on which the underwriters have sold at least 10% of that maturity to the public at or below the initial offering price; and (2) at or prior to closing, deliver to the County a certification to such matters, in a form reasonably acceptable to bond counsel, together with a copy of the pricing wire. Sheriff Kennedy discussed funds available from this fiscal year s budget. He would like to purchase take home squad vehicles. The Board asked him to gather more information with a breakdown of costs and savings. WORKSESSION WITH N.E.A.T. REGARDING UTV ROAD ROUTES The Board met with the North East Iowa Action Trail Riders Club to discuss an ATV/UTV ordinance for all the county roads. President of the Club Ron Switzer and Ron Mc Carthy discussed requirements of the ordinance. Jackson County Deputy Terry Roling talked about the safety aspects of having an ordinance. Without one there is nothing to enforce. With one, tickets can be written and drivers have to be tested and qualified. Wayne Demmer, 9018 Lone Pine Road, Epworth asked about the liabilities to the County. With big farm equipment traveling on narrow gravel roads and an ATV comes over a hill that farmer is responsible if there is an accident. Harley Pothoff spoke with someone from Tennyson Wisconsin who said it was really good at first. Not groups such as N.E.A.T. but other individuals who come in with coolers of beer, gas cans, and their own food. This doesn t bring the expected revenue to the county. It is getting bigger and bigger and so does the mess and more issues. Sheriff Kennedy talked about the misunderstanding of revenue. The County receives $1.50 per ATV/UTV. Not hardly enough with these vehicles on the country roads and the 187 (April 23 & May 8)
