1 PROCEEDINGS OF THE PLATTE COUNTY BOARD OF SUPERVISORS Columbus, Nebraska June 26, 2018 Tuesday, A.M. Pursuant to adjournment the Platte County Board of Supervisors met in session beginning at 9:10 a.m. Diane C. Pinger, County Clerk, Jerry Engdahl, Chairman Roll Call and the following members present: Supervisors Martens, Micek, Olk, Pfeifer, Scow and Chairman Engdahl The Chairman informed the public of the posting of the open meeting laws. The Affidavits of Publication were presented. The meeting notice was published in the Columbus Telegram on June 19, 2018 and the Humphrey Democrat on June 20, Chairman Engdahl stated that the agenda be approved as written. Chairman Engdahl stated that the minutes for June 12, 2018 be approved as written. Jill Goedeken, Extension Educator requested permission from the County Board to refill the position that will be vacated by Jody Wendt on July 31, Motion, Supervisor Olk, seconded Supervisor Micek, to authorize the Extension Service to advertise for replacing the position that Jody Wendt filled, and vote was as follows: Voting Ayes: Supervisors Olk, Pfeifer, Scow, Martens, Micek, and Chairman Engdahl Jill introduced new employee Megan Taylor, to the County Board, who will work with cropping and water systems. Her objective is to maintain and establish a non-biased and research based agronomic resource for Platte County residents that will include area farmers, youth and the general public. Motion, Supervisor Micek, seconded Supervisor Pfeifer, to remove from the table the Veterans Service proposed budget to include employee wages and to approve the addendum to the Platte/Colfax Veterans Office Interlocal Agreement, and vote was as follows: Voting Ayes: Supervisors Micek, Olk, Pfeifer, Scow, Martens and Chairman Engdahl Eric Mullally discussed with the County Board the Veterans Office proposed budget to include employee s wages. Motion, Supervisors Olk, seconded Supervisor Martens, that the Veterans Service Officer salary increases $3.00 effective January 1, 2019 and the Veterans Service Office clerical increases $1.00 effective January 1, 2019 and vote was as follows: Voting Ayes: Supervisors Olk, Martens and Chairman Engdahl Voting Nays: Supervisors Micek, Pfeifer and Scow Whereupon the Chairman declared the motion failed. Motion, Supervisor Pfeifer, seconded Supervisor Scow, to accept the recommendation of the board and increase the salary $2.00 for Eric and $1.00 for the assistant, and vote was as follows:

2 Motion, Pfeifer, seconded Supervisor Micek, to approve the addendum and have the Chairman sign the Platte /Colfax Veterans Office Interlocal Agreement, and vote was as follows: The County Board discussed the vacation or abandonment of a portion of Jostes Road No Deputy Attorney Lay reported she received an from Attorney Maul requesting a continuance to July 10, 2018 to do more research. Motion, Supervisor Scow, to table to July 10, 2018, motion died due to lack of a second. Motion, Supervisor Olk, seconded Supervisor Micek, to choose not abandon a portion of Jostes Road No. 492 as we previously had our hearing on, and vote was as follows: Voting Ayes: Supervisors Olk, Pfeifer, Scow, Martens, Micek and Chairman Scow The County Board discussed the Consolidated Communications Center Interlocal Cooperation Agreement. Motion, Supervisor Scow, seconded Supervisor Micek, to accept the Consolidated Communications Center Interlocal Cooperation Agreement between Platte County and the City of Columbus, and vote was as follows: Voting Ayes: Supervisors Scow, Martens, Micek, Olk, Pfeifer and Chairman Engdahl The County Board discussed the Garratt-Callahan Service Agreement to provide the water treatment chemical program. Motion, Supervisor Martens, seconded Supervisor Micek, to extend the contract for another year, and vote was as follows: Voting Ayes: Supervisors Martens, Micek, Olk, Pfeifer, Scow and Chairman Engdahl Deputy Attorney Lay discussed the NIRMA Insurance claim with the County Board. Motion, Supervisor Micek, seconded Supervisor Pfeifer, to grant the request to work and submit the claim to our insurance company on the theft in Platte County, and vote was as follows: Voting Ayes: Supervisors Micek, Olk, Pfeifer, Scow, Martens and Chairman Engdahl The County Board discussed the proposed LEAP Lifestyle Enhancement Action Program employee incentive benefit. Motion, Supervisor Olk, seconded Supervisor Martens, to increase the prize for accomplishing your goal to $ and everyone who signed up except the winners receive $50.00 as long as they meet the required criteria, and vote was as follows: Voting Ayes: Supervisors Olk, Scow and Martens

3 Voting Nays: Supervisors Micek, Pfeifer and Chairman Engdahl Whereupon the Chairman declared the motion failed. Motion, Supervisor Pfeifer, seconded Supervisor Scow, to approve and authorize the Chairman to the Haul Route Agreement between Platte County and TransCanada Keystone Pipeline governing the use of County Roads during the construction of the pipeline, and vote was as follows: Motion, Supervisor Pfeifer, seconded Supervisor Scow, to authorize the Chairman to sign the utility applications for Frontier Communications, Cornhusker Public Power District and TransCanada Pipelines, LTD for crude oil pipeline, and vote was as follows: The County Board discussed the bids opened on June 20, 2018 for material bids on projects C- 71 (788) Humphrey North, C-71 (792) Creston Southwest, C-71 (797) Monroe Northwest and C-71 (798) Monroe Northwest and authorize the Chairman to sign a contract for materials for said projects. Motion, Supervisor Scow, seconded Supervisor Pfeifer, to accept the low bid from Midwest Service & Sales for $126, and authorize the Chairman to execute the contract for materials only, and vote was as follows: Voting Ayes: Supervisors Scow, Micek, Olk, Pfeifer and Chairman Engdahl Absent: Supervisors Lloyd and Martens The County Board discussed the culvert material bids received by Madison County for projects C-71 (806) and C-71 (687) as part of a multi-county bridge replacement for the NDOT County Bridge Match Program and authorize the Chairman to sign a contract for materials. Motion, Supervisor Scow, seconded Supervisor Pfeifer, that Platte County concur with Madison County for those projects and authorize the Chairman to sign the contract for materials, and vote was as follows: Voting Ayes: Supervisors Scow, Martens, Micek, Olk, Pfeifer and Chairman Engdahl The following resolution was presented: RESOLUTION SIGNING OF THE PROJECT PROGRAM AGREEMENT 2018 FRACTURE CRITICAL BRIDGE INSPECTION Platte County Resolution No Whereas: the Nebraska Department of Transportation (NDOT) is developing a transportation project, on the behalf of the county, for which it intends to obtain Federal funds:

4 Whereas: Platte County as a sub-recipient of Federal-Aid funding a charged with the responsibility of expending said in accordance with Federal, State and local laws, rules, regulations, policies and guidelines applicable to the funding of the Federal-aid projects; Whereas: Platte County and the NDOT wish to enter into a Program Agreement provide for fracture critical bridge inspection and load re-rating (if necessary) services for the Federal-aid project. Be It Resolved: by the Board of Supervisors of Platte County that: Chair of the Platte County Board of Supervisors is hereby authorized to sign the attached Project Program Agreement between the Platte County and the NDOT. Platte County is committed to providing local funds for the project as required by the Project Program Agreement. Pinger County Clerk Motion, Supervisor Pfeifer, seconded Supervisor Scow, to adopt Resolution No and authorize the Chairman to sign an agreement with NDOT for 2018 Fracture Critical Bridge Inspections, and vote was as follows: Todd Laudenklos presented a petition to the County Board for vacation or abandonment of a road. Steve Lloyd came before the County Board regarding the petition for vacation or abandonment of a county road. We purchased the property in February knowing it was an open county road, so in effect if the road it will land lock us and on the petition it said has been no county maintenance, I know that when Todd s day Harry was working for the county, I know he was caught down there multiple times with the county maintainer. I ve seen a township maintainer down there this spring moving snow. Chairman Engdahl stated when the Highway Superintendent checks it out you will be advised the date and time. Also Mr. Laudenklos advised Cornhusker if you approve the permit for Cornhusker to put power down thereon the right-of-way, Laudenklos s advised Cornhusker not to put in so they stopped because they said they re going to close the road. Also there fence is on the county right- ofway and so my attorney s asked them to remove the fence from the county s right-of-way so Cornhusker can put the poles in. Motion, Supervisor Pfeifer, seconded Supervisor Micek, to instruct the Highway Superintendent to do the study on the vacation and abandonment of this particular road, and vote was as follows:

5 Motion, Supervisor Micek, seconded Supervisor Scow, to file the following correspondence and credit the proper accounts: monthly fee reports, County Assessor list of properties exempted by the Board of Equalization for 2018, cancel the following warrants: Road Fund (2) # for $ has six month warranty, # for $1, was not charged for application fee with Union Pacific Railroad and Law Enforcement Fund lost warrant # for $24.97 commissary expense, letter from Tim Knott, Wachiska Audubon Society, Nebraska Emergency Management Agency modification of five year program deadlines for local emergency operation plans, Columbus Library directors report, State of Nebraska District #5 Probation final budget fiscal year and County Treasurer receipts for $171,483.74, City of Columbus-letters and maps on the 33 rd Avenue & U.S. Highway 30 Development Plan and the Redevelopment Plan for the Downtown Redevelopment Area, LLPS Labor law posters refund General Fund $ Countryview Estates Loan payment Federal Grant Fund I State of Nebraska State inmate housing General Fund 61, Electrical Eng Equip Refund- wrong vendor Law Enforcement Fund Platte County Insurance premiums Self Fund Ins Fund 96, Encartele Inmate phone General Fund 2, Colfax County Inmate housing General Fund 5, NIRMA Reimburse Deductible General Fund City of Columbus Salary reimbursement General Fund 2, Total $171, and vote was as follows: Voting Ayes: Supervisors Micek, Olk, Pfeifer, Scow, Martens and Chairman Engdahl The following resolution was presented: RESOLUTION NO WHERERAS, the Platte County Treasurer has for a number of years co-mingled funds from various governmental bodies for the purpose of meeting the minimum investment requirements necessary to receive higher interest rates on the investment of such funds pursuant to law; and WHEREAS, the Platte County Treasurer has been distributing the interest received from such investments to such various bodies proportionate to each body s respective contribution to the principal amount of such investment; and WHEREAS, the Platte County Treasurer desires that this practice be ratified and approved by the County Board of Supervisors. NOW, THEREFORE, BE IT RESOVED, that to the full extent permission under law, the practice of the Platte County Treasurer of co-mingling funds from various governmental bodies for the purposes of meeting the minimum investment requirements necessary to receive higher interest rates and the distribution of such funds in proportion to the respective body s share of the investment be ratified, approved and authorized. 6 Motion, Supervisor Pfeifer, seconded Supervisor Micek, to adopt Resolution No to allow the County Treasurer to co-mingle funds, and vote was as follows: The following resolution was presented: RESOLUTION NO WHEREAS, the Platte County Treasurer may by and with the consent of the Platte County Board of Supervisors invest surplus funds, and WHEREAS, it is in the best interest of the County of Platte that any surplus county be invested. NOW, THEREFORE, BE IT RESOLVED, that the County Board of Platte County, Nebraska, shall and does hereby give its consent to the Platte County Treasurer to invest in United States government bonds, bonds and debentures issued either singly or collectively by any of the twelve federal land banks, under the supervision of the Farm Credit Administration, United States Treasury Notes, from the date of purchase, or in certificates of deposit. The interest received from investments shall be credited to the County General Fund of Platte County Fiscal Year Approved this 26 th day of June, Attest: /a/diane C. Pinger County Clerk /s/jerry Engdahl Chairman, Platte County Board of Supervisors Motion, Supervisor Pfeifer, seconded Supervisor Micek, to adopt Resolution No to invest surplus fund interest received from such funds to be credited to the General Fund for fiscal year , and vote was as follows: The following resolution was presented: RESOLUTION NO WHEREAS, there exists an emergency in the County certain departments operating within the County General Fund which has been created by necessary unanticipated expenses arising therein. WHEREAS, it appears that the departments immediately following will be overdrawn when the June 26, 2018 claims are allowed in the sum of $420,068.75; County Board $ 1, Assessor County Court 97, Extension 6, Emergency Manager and WHEREAS, such an additional appropriations needs to be made to meet such emergency expense.

7 NOW, THEREFORE, BE IT RESOLVED, that in accordance with Section Revised Statutes of Nebraska, that an additional $106, be appropriated out of the unexpended General Fund items of the County Budget to meet such emergency for the several departments. Pinger, County Clerk Motion, Supervisor Pfeifer, seconded Supervisor Micek, to adopt Resolution No for overextended budgets in the General Fund, General Fund has balance to pay the same, and vote was as follows: Committee Reports: Supervisor Martens report on a couple of things, the Assessor s Office their new cooling system was put in and operating, they were out for a couple of weeks, we got that and hopefully it will last a long time, the east steps are now replaced, Scow-congratulations they look very nice. Martens it was as a process, we ran into a problem on the demolition when they were demoing the old steps you know they had these stone walls on side of the steps, well some of the stones came loose and came out, so they had to stop a little bit, the city had to make a decision on what to do when they to their refill or replace stones best they could or tear the whole thing out that would be another $50, or so, we opted to repair than replace for $1, or $2,000. With the steps back in they look good, hopefully last a long time, steps are not easy it s a process to do, they did a good job, when the east side is done will do the south side in another week when they re done. Micek did we ask them about maintaining those steps during the winter time as far as putting chemicals on those. Martens I didn t personally, that s something we can talk to Gary about, get to them about what their recommendation is, I think you have to wait as year. Micek that s what I was wondering because the only reason I brought that up is because that was what I ve been told, that you don t want to put chemicals on there so come winter time you got ice or something I didn t if you or Gary asked that. Martens we ll have to talk to Gary and have conversation with the contractors and find out what we can and cannot do, that s a good point. Micek I d hate to spend this money and then all of a sudden it deteriorates. Supervisor Olk reported we did send out to all the employees that we re kind of putting together information on quitting smoking or using nicotine products to far we ve haven t had any participants take us up on getting the information be we still have it available. Supervisor Pfeifer reported the finance committee will be meeting with Ag Park next week to discuss budget a little bit, at some point in time here I would like to talk about insurance a little bit, made a call to Todd with a question basically addressing the supplement plan for people who are 65 or older to help reduce insurance. Supervisor Micek ran into Daryl from BD Construction he brought up the problem about the trucks going through the residential area, they are really trying to get an alternative route out of there and one person who he thought he had an agreement with after Daryl explained to me

8 what this person wanted the could have paved all of 8 th street and then some so that agreement did not go, and they re trying to get something worked out, they have instructed the people going through there are going through as slow as they possible can and they are well aware of the residential area and soon but it s also a county road and it s the only way they have to get in and out where they are going and one other comment was I don t know the people aren t talking to the person about the property because he was there and knew what they were going to do, on the Juvenile Detention last Friday the numbers are about where they should be about 20 or 25 we have in there and we are actually losing money, the expenses are exceeding the income at this point, not a great amount but it is going that direction. Public Comments: Carrie Rodriguez and Jeff Banholzer wanted to talk to you about probation because they couldn t come to the budget workshop we were required to be Lincoln to we just thought we d give you a brief overview and answer any questions you have.
