1 133 OFFICIAL PROCEEDINGS OF THE COUNTY BOARD WASHINGTON COUNTY, MINNESOTA JUNE 19, 2018 WASHINGTON COUNTY BOARD OF COMMISSIONERS CONVENES The Washington County Board of Commissioners met in regular session at 9:00 a.m. in the Washington County Government Center, County Board Room. Present were Commissioners Weik, Lavold, Kriesel, Karwoski, and Miron. Board Chair Kriesel presided. Also present were Molly O Rourke, County Administrator; Kevin Corbid, Deputy County Administrator; Brent Wartner, First Assistant County Attorney; Stephanie Kammerud, Board Clerk; residents, and county staff. The Board recited the Pledge of Allegiance. COMMENTS FROM THE PUBLIC The Board Chair asked for comments from the public; Bill Sumner from Newport addressed the board. Mr. Sumner shared information about Stone Soup Thrift Shop in St. Paul Park. CONSENT CALENDAR Commissioner Weik moved, seconded by Commissioner Karwoski, to adopt the following Consent Calendar: 1. Approval of the June 5, 2018, County Board meeting minutes. 2. Approval of county comment letter on the draft City of Hugo Comprehensive Plan. 3. Approval of county comment letter on the draft City of Lakeland Shores Comprehensive Plan. 4. Approval of Resolution No as follows: PROCLAMATION TO HONOR THE AMERICAN LEGION S 100 TH NATIONAL CONVENTION WHEREAS, Minnesota veterans have been sacrificing their time, their skills, their service and their lives of defending liberty and country since the Civil War; and WHEREAS, The American Legion, Department of Minnesota, the state s largest veterans organization, is nearing a century of service to our veterans, our youth and our communities; and

2 134 WHEREAS, Over 100 years, the Legion has developed such programs as Boys State, Girls State, Legion Baseball, Legionville Safety Patrol Camp, and three ongoing research chairs at the University of Minnesota; and WHEREAS, The first national convention of the American Legion was held in Minneapolis in November 1919; and WHEREAS, The 100 th national convention of the American Legion will be held in Minneapolis in August 2018; and WHEREAS, The American Legion, Department of Minnesota, and its members have put millions of volunteer hours plus their talent and treasure into projects that have made this state, county and city a better place to live; NOW, THEREFORE BE IT RESOLVED, That the Washington County Board of Commissioners declares August 24, 2018, as American Legion Day in Washington County, and BE IT FURTHER RESOLVED, That the Washington County Board of Commissioners congratulates the American Legion, Department of Minnesota, on its proud record of service, and its commitment to another 100 years of helping veterans, guiding our youth, and lifting up our communities. 5. Approval for a 1.0 Full-Time Equivalent (FTE) Policy Analyst within the Planning and Performance Management Division of Community Services. 6. Approval of an application for a temporary on-sale liquor license from VFW Post 323 for a special event at the Washington County Fairgrounds, August 1-5, Approval of Resolution No as follows: APPLICATION TO CONDUCT OFF-SITE GAMBLING WHEREAS, the VFW Post 323 Auxiliary has made an application to conduct off-site gambling according to requirements contained in M.S The event will be held August 1 through August 5, 2018, at the Washington County Fairgrounds, located at th Street, Baytown Township, Minnesota, during the Washington County Fair. NOW, THEREFORE, BE IT RESOLVED, the Washington County Board of Commissioners approves the application as submitted. 8. Approval of Resolution No as follows: APPLICATION TO CONDUCT EXCLUDED BINGO WHEREAS, the St Paul East Parks Lions has submitted an application to conduct excluded bingo according to the requirements contained in M.S The event will be held August 1 through August 5, 2018, at the Washington County Fairgrounds, located at th Street, Baytown Township, Minnesota, during the Washington County Fair. NOW, THEREFORE, BE IT RESOLVED, the Washington County Board of Commissioners approves the application as submitted.

3 Approval of Cooperative Agreement between the Township of Baytown, the City of Lake Elmo, and Washington County for maintenance of the traffic signal system at the intersection of County State Aid Highway (CSAH) 15 (Stillwater Boulevard) and Stillwater Way North. 10. Approval of Resolution No as follows: RESOLUTION TO ACQUIRE RIGHT OF WAY FOR RECONSTRUCTION ON COUNTY STATE AID HIGHWAY (CSAH) 12 BE IT RESOLVED THAT Washington County proceed to purchase the permanent right of way, permanent road easements, permanent drainage and utility easements, and temporary easements necessary to improve County State Aid Highway 12 in the Cities of Mahtomedi and Willernie as shown on the attached map; located in Washington County, Minnesota. BE IT FURTHER RESOLVED THAT the officers of said County, including the County Engineer, the County Administrator and the County Attorney, shall proceed and are hereby authorized to proceed to acquire, by negotiations and purchase and if necessary, the exercise of eminent domain; right-of-way to establish said permanent right of way, permanent easements, and temporary construction easements. Such officers are specifically authorized to take such action and execute such instruments and plats if any be necessary, to acquire said right of way and associated easements. 11. Approval of Resolution No as follows: RESOLUTION TO TRANSFER PERMANENT RIGHT OF WAY FROM WASHINGTON COUNTY TO JOHN E. HOFFMAN AND JAMIE R. HOFFMAN WHEREAS, Washington County Public Works acquired right of way for the County State Aid Highway (CSAH) 4 Improvement Project in Marine on St. Croix; and WHEREAS, Washington County Public Works made certain improvements to County State Aid Highway 4 in 2017; and WHEREAS, permanent right of way and easements were acquired as a part of the project for said improvements including the total acquisition of the parcel on the southwest corner of CSAH 4 and Hwy 95; and WHEREAS, a drainage facility was included within the above described parcel as a part of the CSAH 4 Improvement Project; and WHEREAS, with the drainage facility now constructed on this parcel, a portion of the described parcel is now excess right of way; and WHEREAS, the adjacent property to the west is owned by John E. Hoffman and Jamie R. Hoffman, and said property owners executed a temporary easement for the CSAH 4 Improvement Project at no cost to the County; and WHEREAS, in exchange for the temporary easement at no cost, John E. Hoffman and Jamie R. Hoffman requested ownership of a sliver of said excess right of way adjacent to their property.

4 136 NOW, THEREFORE, BE IT RESOLVED, Washington County will execute a Quit Claim Deed to transfer said excess right-of-way to John E. Hoffman and Jamie R. Hoffman described on the attached Exhibit A and depicted on the attached Exhibit B. BE IT FURTHER RESOLVED, County Board Chair and County Administrator to execute all necessary documents to effect the transfer. The motion was adopted 5-0 with a Roll Call vote as follows: Ayes, Commissioners Weik, Lavold, Kriesel, Karwoski, and Miron; Nays, none. PUBLIC WORKS Commissioner Karwoski moved to adopt Resolution No as follows: AUTHORIZING SUBMITTAL OF APPLICATIONS TO THE METROPOLITAN COUNCIL FOR FUNDING UNDER THE METROPLITAN COUNCIL REGIONAL SOLICITATION WHEREAS, the Regional Solicitation process started with the passage of the Intermodal Surface Transportation Efficiency Act (ISTEA) in 1991; and WHEREAS, as authorized by the most recent federal surface transportation funding act, FAST ACT, projects will be selected for funding as part of three federal programs: Surface Transportation Program (STP), Congestion Mitigation and Air Quality Improvement (CMAQ) Program, and Transportation Alternatives Program (TAP); and WHEREAS, pursuant to the Regional Solicitation and the regulations promulgated there under, eligible project sponsors wishing to receive federal grants for a project shall submit an application first with the appropriate metropolitan planning organization (MPO) for review and inclusion in the MPO s Transportation Improvement Program (TIP); and WHEREAS, the Metropolitan Council and the Transportation Advisory Board (TAB) act as the MPO for the seven county Twin Cities region and have released the Regional Solicitation for federal transportation funds for 2022 and 2023; and WHEREAS, Washington County is an eligible project sponsor for Regional Solicitation funds; and WHEREAS, Washington County is proposing to submit grant applications for the following projects to the Metropolitan Council as part of the 2018 Regional Solicitation: 1. Trail segment implementation of the Central Greenway Regional Trail along County State Aid Highway (CSAH) 19 (Woodbury Drive) between 80 th Street and the entrance of Cottage Grove Ravine Regional Park and the segment along CSAH 19 at Dale Road extending 3000 feet south in the City of Cottage Grove; and 2. Trail improvements and ADA compliant enhancement along CSAH 12 (75 th Street North) from CSAH 29 (Hilton Trail) to CSAH 15 (Manning Avenue) existing trails in the Cities of Grant and Mahtomedi; and

5 Trail implementation along CSAH 38 from the pedestrian bridge crossing TH (Trunk Highway) 61 to the Wakota Bridge in the City of Newport; and 4. Construction of a roundabout at CSAH 19 (Keats Avenue) and CSAH 10 (10 th Street) in the City of Lake Elmo; and 5. Construction of the roadway lanes of the Helmo-Bielenberg bridge over I-94 in collaboration with the Gold Line Bus Rapid Transit (BRT) guideway in the Cities of Oakdale and Woodbury; and WHEREAS, the projects will be of mutual benefit to Metropolitan Council, Washington County, and the Cities of Cottage Grove, Grant, Mahtomedi, Oakdale, Lake Elmo and Woodbury; and WHEREAS, Washington County is committed to providing the county share of the costs if the projects are selected as part of the 2018 Regional Solicitation; and WHEREAS, Washington County is committed to completing the project, if selected, and funding is provided as part of the 2018 Regional Solicitation; NOW, THEREFORE, BE IT RESOLVED, that Washington County is requesting funding from the federal government through the Metropolitan Council s 2018 Regional Solicitation and the county is committed to completing the projects identified above and providing the county share of funding. Commissioner Weik seconded the motion and it was adopted 5-0 with a Roll Call vote as follows: Ayes, Commissioners Weik, Lavold, Karwoski, Miron, and Kriesel; Nays, none. Approval of Cooperative Agreement between Ramsey County and Washington County for Century Avenue Traffic Signal Upgrades Commissioner Karwoski moved to approve Cooperative Agreement No between Ramsey County and Washington County for Century Avenue (County State Aid Highway (CSAH) 25, also known as Ramsey County CSAH 72) traffic signal improvement. Commissioner Weik seconded the motion and it was adopted unanimously. Approval of Contract with Valley Paving, Inc. for the County State Aid Highway (CSAH) 6 Reconstruction Project Commissioner Karwoski moved to approve Contract No in the amount of $2,052, with Valley Paving, Inc. for the CSAH 6 reconstruction project. Commissioner Miron seconded the motion and it was adopted unanimously.

6 138 Approval of Cooperative Agreements between the City of Oakdale and Washington County for the CSAH 6 Reconstruction Project Commissioner Karwoski moved to approve Cooperative Agreements No and between the City of Oakdale and Washington County for the CSAH 6 reconstruction project. Commissioner Lavold seconded the motion and it was adopted unanimously. GENERAL ADMINISTRATION Approval to Participate in the 2018 Performance Measurement Program Commissioner Lavold moved to adopt Resolution No as follows: PARTICIPATION IN THE 2018 PERFORMANCE MEASUREMENT PROGRAM WHEREAS, the Legislature created the Council on Local Results and Innovation in 2010, outlined in MS 6.91; and WHEREAS, the Council on Local Results and Innovation released a standard set of performance measures for counties that will aid residents, taxpayers, and state and local elected officials in determining the efficacy of counties in providing services and measure residents opinions of those services; and WHEREAS, in 2011, the County Board began its participation in the voluntary standard measures program by adopting resolution # ; and WHEREAS, a county that elects to participate in the standard measures program for 2018 may be eligible for a reimbursement of $0.14 per capita in county government aid, not to exceed $25,000; and WHEREAS, counties must file a report with the Office of the State Auditor by July 1, 2018 consisting of a declaration adopting and implementing performance measures developed by the Council on Local Results and Innovation; and WHEREAS, the county has a longstanding commitment to performance measurement and improvement that focuses on outcome goals and performance results; and WHEREAS, the county has implemented a local performance measurement system including the use of measurement and reporting to help plan, budget, manage, and evaluate programs and processes; and WHEREAS, the county is implementing an internal quality improvement plan to provide a framework for countywide quality improvement efforts which includes setting targets, measuring progress, reporting on progress, and making improvements; and WHEREAS, the county will report the results of the 11 adopted measures from this program to residents by posting the results on the county s website; and

7 139 WHEREAS, the county will continue to communicate the results of our performance measurement and improvement program with our residents through the use of public meetings, news releases, and an annual report to the County Board and our residents. NOW, THEREFORE, BE IT RESOLVED that the Washington County Board of Commissioners adopts 11 Model Performance Measures for Counties and authorizes the County Administrator to file the declaration to participate in the 2018 Performance Measurement Program and to file the Performance Measurement Review with the Office of the State Auditor by July 1, Commissioner Weik seconded the motion and it was adopted 5-0 with a Roll Call vote as follows: Ayes, Commissioners Weik, Lavold, Karwoski, Miron, and Kriesel; Nays, none. National Association of Counties Voting Delegate Commissioner Lavold moved to appoint Commissioner Weik as voting delegate for the 2018 National Association of Counties Annual Conference. Commissioner Miron seconded the motion and it was adopted unanimously. Library Update Molly O Rourke, County Administrator, asked Library Director Keith Ryskoski to update the County Board on the summer library activities. Mr. Ryskoski announced the library summer reading program, Summer Adventure at Your Library runs from June 9 to August 11, This summer s program includes three components: Kids Summer Reading for youth; Tic-Tac-Teen for teens; and 10,000 Experiences at Your Library for adults. Also, the Oakdale Library is hosting a new, summer evening storytime. COMMISSIONER REPORTS COMMENTS QUESTIONS Commissioners reported on meetings and other events that they attended. ADJOURNMENT There being no further business to come before the Board, Commissioner Weik moved to adjourn, seconded by Commissioner Miron, and it was adopted unanimously. The County Board meeting adjourned at 10:03 a.m.
