The Board of Commissioners of Kandiyohi County met at 10:00 A.M., April 18, 2017, pursuant to adjournment. All members were present. A motion by Madsen 2 nd Nissen to approve the payment of claims being $288, from Revenue Fund, $ from Regional Treatment Center Fund, $76, from Road and Bridge Fund, $11, from County Building Fund, $27, from Ditch Fund, $6, from Library Fund, $26, from Health & Human Services Building Fund, $5, from Recorder s Technology Fund, $ from Eagle Lake Sewer Fund, $43, from Water & Sewer Fund, $1, from Water & Sewer Bond Fund, $ from Computer/Communications Maintenance Fund, $69, from Sanitary Landfill Fund, $85, from SCORE Fund according to the detailed listing of claims as recorded in the Office of the was on vote unanimously adopted. A motion by Nissen 2 nd Butterfield to approve the minutes of the April 4, 2017 board meeting was on vote unanimously adopted. CERTIFICATION OF THE COUNTY BOARD OF COMMISSIONERS In accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U.S. Fish and Wildlife Service, Dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the U.S. Fish and Wildlife Service is requested. Representatives of the U.S. Fish and Wildlife Service met with the Board of Commissioners of Kandiyohi County, State of Minnesota on April 18, 2017, and informed the Commissioners that a Grant of Easement for Wildlife Habitat Protection has been secured from Marybeth I Block, etal on the following described lands: Section 28, parts of the S1/2 NW 1/4, NW 1/4 NW 1/4, NE 1/4 NW 1/4, Township 120 N., Range 34 W., 5th P.M. to be determined by a survey Dated at Willmar, Minnesota this 18th day of April, A motion by Nissen 2nd Butterfield to approve the following Certification of the County Board of Commissioners as follows was on vote unanimously adopted. 3 In accordance with a Procedural Agreement between the Minnesota Department of Natural Resources and the U.S. Fish and Wildlife Service, Dated May 23, 1962, certification by the County Board of Commissioners for acquisition of lands by the U.S. Fish and Wildlife Service is requested. Representatives of the U.S. Fish and Wildlife Service met with the Board of Commissioners of Kandiyohi County, State of Minnesota on April 18, 2017, and informed the Commissioners that a Grant of Easement for Wildlife Habitat Protection has been secured from Marybeth I Block, etal on the following described lands: Section 28, part of the NE1/4 NW1/4, Township 120 N., Range 34 W., 5th P.M. to be determined by a survey Dated at Willmar, Minnesota this 18th day of April, Larry Kleindl, County Administrator, appeared and gave an update on the Broadband Bond. Kleindl explained that CTC is requiring a 50% or about 800 residents to sign up for Broadband before they will begin work in the area. Kleindl said that currently we have approximately 40% signups with CTC, and requested a motion to postpone the bond sale for the Border to Border Kandiyohi County broadband project to a future date to be determined by the County Administrator and our financial advisors from Ehlers. A motion by Nissen 2 nd Ahmann to postpone the bond sale for the Border to Border Kandiyohi County broadband project to a future date to be determined by the County Administrator and our financial advisors from Ehlers was on vote unanimously adopted. A motion by Madsen 2 nd Butterfield to approve Resolution was on vote unanimously adopted. KANDIYOHI COUNTY RESOLUTION IT IS RESOLVED that Kandiyohi County enter into MnDOT Agreement No with the State of Minnesota, Department of Transportation for the following purposes: To provide for payment by the State to the County for the use and maintenance of County State Aid Highway No. (C.S.A.H.) 148 and No. 2 and County Road No. 48 as a detour route during the contract construction to be performed upon, along and adjacent to Trunk Highway No. 71 from 0.5 miles North of T.H. 23 to miles North of T.H. 9 under State Project No (T,H. 71=141).

4 Dated at Willmar, Minnesota this 18th day of April, A motion by Nissen 2 nd Ahmann to approve Resolution was on vote unanimously adopted. RESOLUTION AUTHORIZATION TO EXECUTE MNDOT AGREEMENT NO SP ADVANCE CONSTRUCTION IT IS RESOLVED, that pursuant to Minnesota Stat. Sec , the Commissioner of Transportation be appointed as Agent of Kandiyohi County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. BE IT FURTHER RESOLVED, that the Kandiyohi County Board and the Kandiyohi County Auditor are hereby authorized and directed for and on behalf of the County to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in Minnesota Department of Transportation Agency Agreement No , a copy of which said agreement was before the County Board and which is made a part hereof by reference. Dated at Willmar, Minnesota this 18th day of April, Jeff Bredberg, Director of Environmental Services, appeared concerning four requests for monies from the Water Planning Task Force. Bredberg stated that the Water Plan Task Force had met and considered the four applications for money. The request from the Big Kandi Lake Association for $3, for a fish stick program which will make for a better fish habitat with the recommendation from the Task Force for 50% cost share not to exceed $3, A motion by Butterfield 2 nd Madsen to approve the recommendation from the Task Force was on vote unanimously adopted.

5 The request from the Big Kandi Lake Association for $3, to install an internet landing installed device sensor (I-LIDS) which is a self-contained solar powered system at the County Park 2 boat launch to prevent Aquatic Invasive Species (AIS) through video capture and remote inspections of launching boats/trailers and audio education of boaters using the lake with the recommendation from the Task Force for $3, A motion by Nissen 2 nd Ahmann to approve the recommendation from the Task Force was on vote unanimously adopted. The request from the City of New London for $3, to install riprap at the point on Neer Lake which will eliminate erosion and protect the shoreline, and also re-seed with native grasses with the recommendation from the Task Force for $3, A motion by Madsen 2 nd Nissen to approve the recommendation from the Task Force was on vote unanimously adopted. A motion by Madsen 2 nd Nissen to appoint Ron Halvorson to replace of Alan Eblen on the Water Planning Task Force for a four year term was on vote unanimously adopted. A motion by Nissen 2 nd Madsen to re-appoint Robert Thein, Doug Hanson, Steve Wood, Nick Bjornberg and Ron Dilley to the Water Planning Task Force for a four year term was on vote unanimously adopted. A motion by Butterfield 2 nd Madsen to approve the 2017 State of Minnesota Federal Supplemental Boating Safety Patrol Grant Agreement between the State of Minnesota, acting through its Commissioner of Natural Resources and the Kandiyohi County Sheriff was on vote unanimously adopted. Mel Odens, Public Works Director, appeared and gave an update on the Willmar Wye project, stating that the Master Cooperative Agreement is still in negotiations and listed key negotiating items; County s role in acquiring right of Way acquistion and that the public and private partners are committed to see this project completed. Odens also requested that the board pass a motion to proceed with the Master Coop Agreement negotiations as presented and that the County supports the project as described and approved in the Environmental Assessment. A motion by Madsen 2 nd Butterfield to approve proceeding with the Master Coop Agreement negotiations as presented and that the County supports the project as described and approved in the Environmental Assessment was on vote adopted. Voting yes: Madsen, Butterfield, Ahmann, Imdieke. Voting no: Nissen.

6 A motion by Nissen 2 nd Butterfield to approve Resolution was on vote unanimously adopted. 8 A motion by Madsen 2 nd Nissen to reschedule the July 4, 2017 board meeting to July 5, 2017 and the December 5, 2017 to December 6, 2017 was on vote unanimously adopted. On motion the meeting was adjourned until 10:00 A.M., May 2, 2017.
