3 TODD COUNTY BOARD OF COMMISSIONERS Minutes of the Meeting of the Todd County Board of Commissioners held on November 4, 2014 Call to Order The Todd County Board of Commissioners met in the Commissioner s Board Room in the City of Long Prairie, MN on the 4 th day of November, 2014 at 9:00 AM. The meeting was called to order by Chairperson Kneisl. The meeting was opened with the Pledge of Allegiance. All Commissioners were present. Approval of Agenda On motion by Neumann and second by Erickson, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented. Routine Business On motion by Becker and second by Kircher, the following motion was introduced and adopted by unanimous vote: To approve the October 21, 2014 Commissioner Board Meeting Minutes as read. On motion by Erickson and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the actions of HHS Committee Meeting held October 28, 2014 in accordance with the minutes on file in the Todd County Administration Office. On motion by Becker and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number thru in the amount of $91, On motion by Kircher and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve purchase of a 2012 Impala from Gessell Auto in the amount of $12, for the Todd County Vehicle Fleet. On motion by Becker and second by Neumann, the following resolution was introduced and adopted by roll call vote: Becker, yes; Neumann, yes; Kircher, yes; Erickson, yes; Kneisl, yes. REPURCHASE OF TAX-FORFEITED PROPERTY WHEREAS, Clayton E Saari has submitted an application for repurchase of the following described taxforfeited lands: Parcel , Lots 3 & 4 of Block 2 in Stewart & Bartraw s Addition. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approves the application for repurchase of tax-forfeited lands submitted by Clayton E Saari for Parcel Public Works On motion by Kircher and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the 2017 CSAH Project Eagle Bend Cooperative Agreement. (Complete Agreement on file in the Administration Office). On motion by Kircher and second by Becker, the following motion was introduced and adopted by unanimous vote: To approve Bridge L8934 Replacement Project Cooperative Agreement. 4 TODD COUNTY BOARD OF COMMISSIONERS Solid Waste On motion by Kircher and second by Erickson, the following motion was introduced and adopted by roll call vote: Kircher, yes; Erickson, yes; Neumann, No; Becker, No; Kneisl, yes. A RESOLUTION SETTING SOLID WASTE FEES FOR 2015 WHEREAS, The Todd County Department of Solid Waste has previously submitted a request to the Todd County Board of Commissioners to increase the tipping fees for Municipal Solid Waste and to increase the Solid Waste Service Fee (parcel charge), and; WHEREAS, the Todd County Board of Commissioners held a Public Hearing regarding said fees on Wednesday, September 17, 2014 to hear public comment in regard to the proposal to increase fees, and; WHEREAS, the information provided at the Public Hearing documented the need by the Solid Waste Department to increase revenue to offset expenses of the department, and; WHEREAS, the primary sources of revenue for the Solid Waste Department are Tipping Fees and Service Fees. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approves the increase in the Solid Waste Service Fee to $46 per improved parcel of property effective for the taxes payable year The resolution setting Solid Waste Tipping Fees for 2015 failed for lack of motion. Ditch & Ag Inspector On motion by Becker and second by Neumann, the following resolution was introduced and adopted by unanimous vote: HOLD HARMLESS AGREEMENT FOR DITCH MAINTENANCE COUNTY DITCH 20 WHEREAS, Lonny Killian is requesting to maintain approximately 870 feet of Lateral 2 on CD20. This ditch line is located on his property in Staples Twp section 25 on parcel number The maintenance will be done at Lonny s own expense. A Hold Harmless Agreement has been signed and submitted to the Ditch Authority, and; WHEREAS, an onsite inspection was done October 28, 2014 and a Wetland Application has been submitted to the TEP, and; WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation. Spoil may be side cast and leveled staying within 16 ½ feet of the ditch. NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Lonny Killian to maintain approximately 870 feet of Lateral 2 on CD20. This ditch line is located on his own property and will be done at his own expense. Health & Human Services On motion by Kircher and second by Erickson, the following motion was introduced and adopted by unanimous vote: To accept resignation from Karen Holt effective November 7, On motion by Kircher and second by Erickson, the following resolution was introduced and adopted by unanimous vote: Page 2 of 4 4 of 95

5 TODD COUNTY BOARD OF COMMISSIONERS A RESOLUTION ESTABLISHING SUPPORT FOR SEEKING FUNDING FROM SOUTH COUNTRY HEALTH ALLIANCE FOR PROGRAMMING AT THE REGIONAL WELLNESS CENTER WHEREAS, the South Country Health Alliance (SCHA) is providing community reinvestment funding for initiatives focused on improving the health of South Country members and addressing community social determinants of health, and; WHEREAS, the Regional Wellness Center in Wadena, MN will be providing regional wellness services beginning in December 2014, and; WHEREAS, there is a need to assess, plan and implement programming to benefit SCHA participants including but not limited to families with children and persons with disabilities, and; WHEREAS, the Regional Wellness Center/Maslowski Research Center, City of Wadena, Tri County Health Care System, Wadena County Public Health and additional partners; have committed to support this project and will assist with the assessment, planning, implementation, and sustainability of the programming. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners supports the South Country Health Alliance 2014 Community Reinvestment Program funding application submitted by the City of Wadena to assess, plan, and implement programming at the Regional Wellness Center. Auditor Treasurer Report The Auditor Treasurer office has received 2 applicants for the Sauk River Watershed Manager positions. They will attend the next Board Meeting to meet the Commissioners. Canvasing will take place Friday November 7, 2014 from the election. Commissioners Becker and Erickson will attend. Rainbow Rider meeting on November 5, 2014 in the Commissioner Board Room. Commissioner s Report Kneisl reported on the closed session performance review on Karla Nalezny. Kneisl reported the contract proposals have been received from the Teamsters #320. Neumann reported the playground equipment has been installed at Battle Point Park and public works helped a great deal, now there is parking for vehicles by removing the island in the parking lot. Friday attended 3 County Health Board Meeting supporting Eagle Bend project. Also attended the Invasive Species meeting with Kircher and the area Lake Associations. He also attended the Public Health Advisory meeting the evening of November 3, 2014 on Ebola. Today in Kneisl and Neumann will be attending the JD 2 meeting at 2:00 in Alexandria. Tomorrow Neumann will attend the Water and Soil meeting, the Correction Meeting and the Public Works road meeting. Erickson will not be attending the Road Meeting today Erickson had nothing at this time. Building construction will be available at the next Commissioner Meeting. Punch list has been completed and everything has been paid. Kircher had nothing to report at this time. 48 TODD COUNTY BOARD OF COMMISSIONERS A RESOLUTION PROVIDING FOR THE SALE OF USED ROLL-OFF CONTAINERS WHEREAS, The Todd County Department of Solid Waste has previously requested bids for the sale of 7 used 40 yard closed top roll-off containers, 8 used 20 yard closed top roll-off containers, and 4 used 20 yard open top roll-off containers, and; WHEREAS, the Todd County Department of Solid Waste presented those bids to the Todd County Board of Commissioners at its Tuesday, October 21, 2014 regular meeting, and; WHEREAS, the Todd County Board of Commissioners awarded the sale of 7 used 40 yard closed top roll-off containers, 8 used 20 yard closed top roll-off containers and 1 used 20 yard open top roll-off container based on the high bids, and; WHEREAS, the Todd County Board of Commissioners rejected the sale of 4 used 20 yard open top rolloff containers based on the bids, as received, being less that the scrap value of the roll-off containers, and; WHEREAS, the Todd County Board of Commissioners authorized the Todd County Department of Solid Waste to sell 4 used open top roll-off containers for scrap as presented to the Board, and; WHEREAS, after leaving the October 21, 2014 meeting of the Todd County Board of Commissioners, staff from the Todd County Department of Solid Waste were approached by a Todd County resident present at the meeting and asked if he could purchase two of the remaining three used 20 yard open top roll-off containers for $350 each, and; WHEREAS, staff from the Todd County Department of Solid Waste confirmed the scrap value of said roll-off containers to be $300 per container, and; WHEREAS, staff from the Todd County Department of Solid Waste informed the citizen that sale of the 2 used 20 yard open top roll-off containers would need to be approved by the Todd County Board of Commissioners. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approves the sale of 2 used open top roll-off containers at the rate of $350 per container as such sale would be in the best interest of the residents of Todd County and the Todd County Department of Solid Waste because the quoted price is higher than the $300 scrap value and higher than the $240 rejected bid value. 51 EMPLOYMENT AGREEMENT Agreement by and between County of Todd, State of Minnesota ( Employer ) and the Central Minnesota Chaplaincy David Greaver. Employee The parties mutually agree as follows: 1. Position. Employer agrees to employ David Greaver as Chaplain. Mr. Greaver agrees to serve as chaplain in accordance with the attached position description (which may be amended from time to time). 2. Stipend. This position will have no set schedule nor fringe benefits other than normal payroll deductions for PERA and Social Security. The stipend shall be set at $500 per month. This will also include the use of a vehicle owned by Todd County and fuel and maintenance for that vehicle will be at the discretion of the Sheriff. 3. General Conditions of Employment. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of Mr. Greaver to resign at any time, for any reason, subject only to the provisions of this Agreement. Furthermore, nothing in the Agreement shall prevent, limit or otherwise interfere with the right of the Employer to termination of services of Mr. Greaver at any time, for any reason, subject only to the provisions of this Agreement. 4. Termination Benefits: In the event Mr. Greaver is terminated by the Employer, Employer agrees to pay Mr. Greaver the stipend through the month of termination. If Mr. Greaver voluntarily resigns his position with Employer, Employee agrees to give Employer 30 days advance notice. If Employee voluntarily terminates his position with Employer, the stipend shall be paid through the month of separation of employment. 5. Term: This agreement will continue until terminated pursuant to this Agreement. 6. The Chaplain will report directly to the Sheriff in the performance of his/her duties. The main purpose of this position will be to offer secular, non religious support to Sheriff s Office personnel. This will be done through critical incident stress debriefings; ongoing follow up support for the impacted employee and their families; and in providing counseling and other professional services to the Sheriff s Office personnel. 7. The Chaplain will not engage in unsolicited religious instruction or counseling. The Chaplain is prohibited from proselytizing on behalf of any religion. The Chaplain may not conduct any religious service or ceremony while wearing any uniform or insignia of the Todd County Sheriff s Office or while acting in his official capacity as Chaplain. 8. The Chaplain will also support the citizens of Todd County after traumatic incidents. Duties included in this role will include delivering death notifications; assist citizens in times of crisis with notification of family and any other necessary hospital or funeral preparations; and to provide follow up support after critical incidents to ensure the well being of affected citizen(s). 61 of 95
