12 TODD COUNTY BOARD OF COMMISSIONERS Minutes of the Meeting of the Todd County Board of Commissioners held on July 5, 2016 Public Comment Steven Reynolds of Staples, MN appeared before the County Board to address concerns regarding the installation of a driveway on his property. Call to Order The Todd County Board of Commissioners met in the Commissioner s Board Room in the City of Long Prairie, MN on the 5 th day of July, 2016 at 9:00 AM. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners present. Approval of Agenda On motion by Kneisl and second by Neumann, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented. Routine Business On motion by Kneisl and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Auditor Warrants number through in the amount of $760, On motion by Kircher and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number through in the amount of $84, On motion by Neumann and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the Health & Human Services Warrants number through in the amount of $93, and through in the amount of $73, On a motion by Kircher and second by Erickson, the following resolution was adopted by unanimous vote: TRANSFER OF FUNDS FROM GENERAL FUND TO COMMUNITY CORRECTIONS FUND WHEREAS, The 2016 Budget for Todd County s participation in the Todd-Wadena Community Corrections system has been approved at $290,869; and WHEREAS, a letter was received asking for the appropriation of funds from the General Fund. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners hereby approve the transfer of the funds in the amount of $290,869 from the General Fund to Community Corrections Fund. Public Works On a motion by Erickson and second by Kneisl, the following resolution was adopted by unanimous vote: FINAL PAYMENT AUTHORIZATION 2016 PAVEMENT STRIPING CONTRACT WHEREAS, the contract with Traffic Marking Services, Inc. for the 2016 Pavement Striping Contract known as CP located along various Todd County Highways, has in all things been completed, and; Page 1 of 5 12 of 139

13 TODD COUNTY BOARD OF COMMISSIONERS WHEREAS, construction work on this contract was scheduled and completed in 2016 with the value of the total work certified being $60,290.41, and; WHEREAS, partial payments amounting to $57, have been previously been made to the contractor as work progressed, and; WHEREAS, it has been determined that $3, still remains to be paid to Traffic Marking Services, Inc. NOW, THEREFORE BE IT RESOLVED, that the Board of Commissioners does here accept said completed project for and in behalf of the County of Todd and authorize final payment as specified. Ditch Inspector On a motion by Kneisl and second by Kircher, the following resolution was adopted by unanimous vote: HOLD HARMLESS AGREEMENT FOR DITCH MAINTENANCE COUNTY DITCH 25 WHEREAS, Henry Theisen is requesting to maintain 1 mile of CD25 located on his property in Germania Township, sections 24 and 25. ½ mile of ditch is part of Ditch A Lateral 1 on parcels & , and ½ mile of ditch is part of Main Ditch B on parcels & The maintenance will be done at his own expense, and; WHEREAS, a Hold Harmless Agreement has been submitted to the Ditch Authority and a Wetland Application has been submitted to the TEP. An onsite inspection was done May 18, 2016, and; WHEREAS, applicant is allowed to maintain the drainage ditch to the original width, depth and grade. An improvement by lowering or widening the ditch bottom is not allowed. Sediment and vegetation can only be removed to the extent of the original ditch bottom elevation. Spoil may be side cast and leveled, staying within 16 ½ feet of the ditch. NOW, THEREFORE BE IT RESOLVED, the Todd County Ditch Authority gives permission to Henry Theisen to maintain 1/2 mile of Ditch A Lateral 1 and ½ mile of Main Ditch B of CD25 located on his own property, at his own expense. Sheriff s Office On motion by Erickson and second by Kneisl, the following motion was introduced and adopted by unanimous vote: To hire Ethan Korfe as a Seasonal Recreational Assistant at the current minimum wage, of $9.50 per hour, with an effective date of July 10 th, 2016 pending the passing of a background check. MIS On motion by Kircher and second by Kneisl, the following motion was introduced and adopted by unanimous vote: To approve the Pictometry Contract and complete flyover in On motion by Kircher and second by Erickson, the following motion was introduced and adopted by unanimous vote: To approve the use of Compliance Funds for Pictometry Flyover in 2017, in the amount of $90,752.50, with the remaining amount covered by the participating cities. Health & Human Services On motion by Kircher and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Purchase of Service Agreement between Todd County Health & Human Services and Holistic Family Education Services for the period of July 1, 2016 through December 31, 2017 at a rate of $39.00 per hour. 17 TODD COUNTY BOARD OF COMMISSIONERS Minutes of the Meeting of the Todd County Board of Commissioners held on July 19, 2016 Call to Order The Todd County Board of Commissioners met in the Commissioner s Board Room in the City of Long Prairie, MN on the 19 th day of July, 2016 at 9:00 AM. The meeting was called to order by Chairperson Becker. The meeting was opened with the Pledge of Allegiance. All Commissioners present. Approval of Agenda On motion by Erickson and second by Kneisl, the following motion was introduced and adopted by unanimous vote. To approve the agenda as presented. Routine Business On motion by Neumann and second by Kircher, the following motion was introduced and adopted by unanimous vote: To approve the Commissioner Warrants number through in the amount of $116, On motion by Erickson and second by Neumann, the following motion was introduced and adopted by unanimous vote: To approve the Health & Human Services Warrants number through in the amount of $130, On a motion by Kneisl and second by Kircher, the following resolution was adopted by unanimous vote: TRANSFER OF FUNDS FROM COUNTY DITCH FUND TO GENERAL REVENUE FUND WHEREAS, The County Ditch Authority has approved to have the hours worked by the County Ditch Inspector charged back to that ditch, and; WHEREAS, the calculations have been made for the County Ditch Inspector s time for the period of July 1, 2015 through June 30, 2016 per attached copy; NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve the transfer of $6, from the County Ditch Fund to the General Revenue Fund per the attached list. On a motion by Neumann and second by Kneisl, the following resolution was adopted by unanimous vote: TRANSFER OF FUNDS FROM GENERAL REVENUE FUND TO SOLID WASTE ENTERPRISE FUND WHEREAS, per County Board Resolution a loan in the amount of $300,000 was established from the Solid Waste Enterprise Fund to aid in funding the Health & Human Services Building Project, and; WHEREAS, the 2014 & 2015 installments have been repaid in the amount of $60,000 altogether, and; WHEREAS, the balance as of January 1, 2016 on this loan is $240,000, and; WHEREAS, by recommendation of the Finance Committee along with the County Board of Commissioners in planning the 2016 budget has authorized the loan be fully repaid in place of the yearly installment. NOW, THEREFORE BE IT RESOLVED, that the Todd County Board of Commissioners approve the transfer of $240,000 from the General Revenue Fund to the Solid Waste Enterprise Fund. Page 1 of 7 17 of 139

18 TODD COUNTY BOARD OF COMMISSIONERS Community Corrections On a motion by Kircher and second by Erickson, the following resolution was adopted by unanimous vote: JOINT POWERS AGREEMENT BETWEEN TODD AND WADENA COUNTIES FOR TODD-WADENA COMMUNITY CORRECTIONS Article 1: Enabling authority This Joint Powers Agreement is entered into this 19th day of July, 2016 by and between the Counties of Todd and Wadena as follows: WHEREAS, the State of Minnesota enacted legislation which encourages the development of community corrections programs and allows counties to cooperate in said programs through a Joint Powers Agreement pursuant to Minnesota Statute , and WHEREAS, the Boards of Commissioners of Todd and Wadena Counties, in accordance with the provisions of Minnesota Statutes Chapter 401, established a joint community corrections agency in 1976 to form Todd-Wadena Community Corrections (hereinafter referred to as TWCC), and WHEREAS, the Boards of Commissioners of Todd and Wadena Counties find that it continues to be necessary, desirable and in the best interests of the citizens of said counties that there be maintained and operated a community-based corrections program in the two counties, jointly, and consistent with the provisions of Minnesota Statutes Chapter 401. WHEREAS, Todd and Wadena Counties wish to reaffirm their continued commitment to providing community corrections in their respective counties through TWCC. NOW THEREFORE, the Counties of Todd and Wadena, being governmental subdivisions of the State of Minnesota, agree to exercise their joint and mutual powers as follows: Article 2: Purpose General Purpose: The counties shall cooperate for the purpose of administrating, budgeting, staffing and operating community correctional services in Todd and Wadena Counties. Article 3: Name Name: The Counties did establish Todd-Wadena Community Corrections (TWCC) in 1976 and hereby reaffirm and maintain TWCC as the entity/agency through which community corrections services will be provided, including the administration of aid/grant funding, in the counties. Article 4: Governance 4.1 Joint Powers Board: The Todd-Wadena Community Corrections Executive Committee shall serve as the Joint Powers Board of Todd-Wadena Community Corrections. Membership of the Executive Committee shall be appointed by the member Counties. 4.2 Executive Committee: An Executive Committee shall have the responsibility for overseeing and conducting the operations of Todd-Wadena Community Corrections. Membership shall consist of two County Commissioners from each County as appointed annually by the Board of Commissioners in each respective County; one District Court Judge, chambered in one of the member Counties, appointed by the Chief Judge of the Seventh Judicial District; and the Chair and Vice-Chair of the Advisory Board appointed annually by the Advisory Board. The Executive Committee may select its own officers. The Chair shall rotate between the two Counties on an annual basis. The Executive Committee shall have the direct authority to: a. Determine the establishment, continuation, modification and termination of correctional services and programs. b. Develop and recommend budget to each member County. c. Ensure compliance with the annual Comprehensive Plan and budget. d. Enter into grants and contracts. e. Develop and implement policies and procedures. f. Select and direct personnel. Obtain liability, property and auto insurance and may obtain such other insurance it deems necessary to indemnify the Joint Powers Board and TWCC s members for actions of the Joint Powers Board and members arising out of this agreement. 4.3 Advisory Board: The member counties shall appoint an Advisory Board whose membership, per Minnesota Statutes Chapter 401, shall be representative of law enforcement, prosecution, the judiciary, education, corrections, ethnic minorities, social services, and a lay citizen. The primary purpose of the Advisory Board is to actively participate in the formulation of the Comprehensive Plan for the development, implementation and operation of correctional programming and services offered by TWCC. In addition, the Advisory Board serves to advise TWCC of community correctional needs within the two Counties and suggest new programs to enhance correctional services. 4.4 By-laws: The Executive Committee may adopt by-laws to govern its operation and the operation of the Advisory Board. Such by-laws shall be consistent with the Agreement and applicable statutes. 4.5 Per Diems: Executive Committee members and Advisory Board members may receive per diems and travel expenses as determined by the Executive Committee and consistent with the laws of the State of Minnesota. 4.6 Open Meeting Laws: The Executive Committee and Advisory Board shall comply with Minnesota Statutes Chapter 13D (Open Meeting Law.) 4.7 Fiscal Host: The member counties shall designate the fiscal host of TWCC. The fiscal host will provide a strict accountability of all funds and report of all receipts and disbursements shall be provided for in accordance with MS Article 5: Withdrawal and Termination 5.1 Withdrawal: Either participating County may withdraw from this agreement by serving a copy of a Resolution of Withdrawal of its Board of Commissioners upon the other participating County not less than six (6) months prior to the commencement of the following calendar year, and shall be effective as of the first day of the calendar year following the year in which the Resolution of Withdrawal was served. 5.2 Financial Obligations: In the event of the termination of this Agreement, all of the assets of TWCC shall be sold and the proceeds shall be applied towards any outstanding debts and obligations of TWCC at the time of the sale. Any deficiencies owing shall be contributed by the member Counties based upon the percentage of the total County contribution amount which each member County is responsible for at the time of termination of this Agreement. 5.3 Property: In the event of the termination of this Agreement, any surplus property/assets shall be shared by the member Counties based upon the percentage of the total county contribution amount which each member County is responsible for at the time of the termination of this agreement. 5.4 Records: Upon termination of this Agreement the Fiscal Host at the time of the termination of this Agreement shall have the responsibility for keeping and maintaining such files and records of TWCC for so long as the maintenance of such records is required by law. Article 6: Indemnification and Hold Harmless 6.1 Applicability: Todd-Wadena Community Corrections shall be considered a separate and distinct public entity to which the member Counties have transferred all responsibility and control for actions taken pursuant to this agreement. Todd-Wadena Community Corrections shall comply with all laws and rules that govern a public entity in the State of Minnesota and shall be entitled to the protection of Minnesota Statutes, Chapter Indemnification and Hold Harmless: Todd-Wadena Community Corrections shall fully defend, indemnify and hold harmless the member Counties against all claims, losses, liability, suits, judgments, costs and expenses by reason of the action or inaction of the Executive Committee and/or employees and/or the agents of TWCC. This agreement to indemnify and hold harmless does not constitute a waiver by any participant of limitations on liability provided under Minnesota Statute Page 3 of 7 19 of 139

20 TODD COUNTY BOARD OF COMMISSIONERS To the full extent permitted by law, actions by the Parties pursuant to this Agreement are intended to be and shall be construed as a cooperative activity and it is the intent of the Parties that they shall be deemed a single governmental unit for the purpose of liability, as set forth in Minnesota Statute , subdivision 1a(a); provided further that for purposes of that statute, each Party to this Agreement expressly declines responsibility for the acts or omissions of the other Party. The Parties of this Agreement are not liable for the acts of omissions of the other participants to this Agreement except to the extent to which they have agreed in writing to be responsible for acts or omissions of the other Parties. Article 7: Ratification Ratification: Except as herein expressly amended, modified, or revised, all other prior Joint Powers Agreements are hereby ratified and affirmed. 27 Introduction Nothing must interfere with the right of voters to vote free of undue delay or inconvenience. The purpose of this election emergency plan is to ensure that, in the event of an emergency impacting the election, the essential functions of an election continue. The goal is to minimize the impact on the public, and to maintain the integrity and accuracy of elections in the event of an emergency. This elections emergency plan applies to all staff within the Todd County Election s Division, and should be used as a guide by all jurisdictions conducting elections within Todd County This plan should be distributed to all municipalities within Todd County that are responsible for election operations. This plan should operate in conjunction, but does not supersede, Todd County s or the encompassed municipalities governing Continuity of Operations Plan. County and Municipal Election Leads Order of Succession In the event an incumbent elections administrator is incapable or unavailable to fulfill essential duties, successors have been identified to ensure there is no lapse in essential decision-making authority. The Todd County Elections Division has identified successors for key election officials within Todd County. The Todd County Auditor-Treasurer and Deputy Auditor Treasurer (certified in Election Administration) are responsible for the Elections Emergency Plan. If an event occurs that may warrant the use of the Elections Emergency Plan, it is the duty of the elections staff at the County and at the municipal level to communicate with the Todd County Auditor-Treasurer. 38 Alternative Worksite for County Offices If an emergency impacts the Todd County Historic Courthouse on Election Day or during the absentee voting period, all reasonable efforts will be made to restore the functionality of the facility. The Todd County Auditor-Treasurer will assess the functionality and, if it is determined that the facility cannot be restored to functionality in a reasonable time period, will move County elections operations to the Main Street Government Center 347 Central Avenue, Long Prairie, MN. If County in-person absentee voting is moved to the alternative facility, the County will: Follow the notification procedures for polling place relocation, described below; Notify the Secretary of State of the new static IP address for the purposes of connecting to SVRS; Work with county IT staff to re-direct phone, , and fax communications to the alternative facility; and Work with USPS, UPS, FedEx, and other package delivery services to ensure delivery of absentee materials to the alternative facility or arrange for collection of absentee materials. Polling Place Relocation Prior to Election Day If an emergency makes a polling place inoperable prior to election day, the governing election official must determine if the polling place can be made operable by election day. All reasonable efforts must be made to restore the originally designated polling place. If the governing election official determines that the originally designated polling location cannot be restored, the governing election official may change or consolidate the polling location. 45 Election Judge Polling Place Emergency Procedures Emergency Evacuation of the Polling Location If a fire, a weather emergency, power outage, or another type of emergency occurs during voting hours, take steps to protect yourself and the other people in the polling place. Familiarize yourself with evacuation plans for the polling place. Do not worry about election supplies until after everyone in the polling place is safe. If the polling place must be left unattended due to a catastrophic emergency (tornado, fire, bomb threat, other situations when Election Judges may be ordered to leave premises), use the following procedures. STAY CALM If time permits, and your safety is not jeopardized, follow these steps before you leave the polling place: 1. Choose a location to meet outside; designate Election Judges to assist voters exiting the poll. 2. Record the public count from the Ballot Counter and the time on the cover of the polling place Roster. 3. Remove the memory stick from the Ballot Counter if Ballot Counter is unable to be removed from location. 4. Secure blank, non-voted ballots in the Black Supply Box case. 5. Remove voted ballots from tabulator ballot box and place voted ballots in the Blue Ballot Box and lock secure 6. Use any available return envelope (i.e. Duplicate Ballot Envelope, Election Day Registration Envelope) for any uncounted ballots found in the auxiliary compartment. 7. If possible, take the following items with you: a. Polling place Rosters (Registered Voters Roster and New Registrants Roster) b. Completed Voter Registration Applications c. Ballot Counter machine or memory stick from machine if unable to remove machine. d. Exit the polling place and account for all members of your election team of 139

46 e. As soon as you are in a secure location, call your local election official for further instructions about the voting process. If The Polling Place Can Be Reopened: 1. Resume voting by using the auxiliary compartment of the Ballot Counter. 2. Call your local election official to advise that the polling place has reopened. 3. Support staff will be sent to re-install the memory stick and assist in reestablishing normal operations. 4. DO NOT KEEP VOTERS WAITING while you restore the functionality of the ballot counter. a. Immediately open the auxiliary compartment slot of the ballot box. This slot lets voters drop their ballot into the locked ballot box without being counted by the machine. b. If needed, explain to voters that once the ballot counter is operating election judges will process them through the ballot counter. c. Voters may use the ballot marking device to verify their ballot has no voter errors before placing it in the auxiliary compartment. d. After the machine is operating again, two judges should remove the ballots from the auxiliary compartment and feed them into the ballot counter. 5. Record events on the Incident Log. If The Polling Place Cannot Be Reopened: Contact your local election official if your polling place is unusable. Your local election official will help you determine if you need to move to a new polling place, and will assist in identifying a new polling place location. Follow the local election official s instructions regarding moving polling places and notification that must be posted to inform voters of the change in polling locations. Emergencies Requiring Police, Fire, or Medical Response (911) Call 911 for any problem or situation requiring a response from police, fire, or medical personnel. If you are using facility phones, verify ahead of time whether an access code is necessary to connect to an outside phone line. During October, Hands of Hope is working towards increasing public awareness of the violence that is happening in homes right here in Todd County. To date in 2016, Hands of Hope staff in Todd County has worked with 88 new female victims, 17 male victims and 104 new child victims under the age of 18, along with more than 100 repeat victim/survivors returning from prior years for ongoing services. These numbers express the direct victim, however, many others are affected by this violence, including friends, family, employers, and often times whole communities. 60 Request for Subordination of Todd County Mortgage on Reichert Place Apartments The Central Minnesota Housing Partnership respectfully requests the subordination of the Todd County Mortgage (recorded document #398753) on Reichert Place Apartments. The subordination is being requested in conjunction with a proposed refinancing of the current first mortgage on the property. The following scenarios are possible, depending on the board of commissioner s approval or denial of the subordination request: 1. Approval of Subordination: If approved, Reichert Place Apartments will be able to refinance its first mortgage, decreasing the interest rate from 8.82% to 4.11%. The interest reduction is important to the overall property cash flow, especially since the Tax Increment Financing ends in December The refinance will also allow ownership to address many needed rehabilitation items, including roofing, resurfacing of parking lots, new common area flooring, concrete and exterior painting. The Todd County mortgage would stay in its current lien position (3 rd position) and be due and payable, including accrued interest, on September 1, 2031 as stated in the current mortgage document and promissory note. 2. Denial of Subordination: If denied, Reichert Place Apartments will not be able to move forward with the refinance of its current first mortgage.
