1 YUBA COUNTY, CALIFORNIA BOARD OF SUPERVISORS APRIL 18, 2000 The Honorable Board of Supervisors of the County of Yuba met in regular session on the above date, commencing at 9:30 a.m., in the Courthouse, Marysville, California, with a quorum being present as follows: Supervisors Al Amaro, Bill Simmons, Brent Hastey, Donald Schrader, and Hal Stocker. Also present were County Counsel Daniel Montgomery, Clerk of the Board of Supervisors Terry A. Hansen, and Assistant County Administrator Greg Iturria. Chairman Hastey presided. SPECIAL PRESENTATIONS 1. California State Fair 1999: Airport Manager Mary Hansen introduced Ms. Quinn Mendez and student representatives from South Lindhurst Future Farmers of America. Ms. Quinn and students presented the Chair with a plaque and Silver Award for the 1999 Yuba County State Fair Exhibit. Chairman Hastey accepted on behalf of the Board of Supervisors and thanked the students and Ms. Quinn for their excellent exhibit preparation for the County. RECEIVE AWARD 2. PUBLIC COMMUNICATIONS CONSENT AGENDA Upon motion of Supervisor Schrader, seconded by Supervisor Simmons, and unanimously carried, the Board took the following actions: 2. Administrative Services (1) Authorized Budget Transfer in the amount of $11,000 from Account No to various line items for engineering services for North Annex parking and site survey for replacement storage. (b) Authorized Contingency Fund Transfer in the amount of $5,000 from Account No (General Contingency) to Account No (Buildings and Grounds/Professional Services) for bat remediation at Courthouse. 2. Board of Supervisors (2) Appointed Kathy Joksch to the Mountain Valley Library System Advisory Board for a term to expire on October 26, (b) Appointed Audrey Ohlson Smith to the Yuba County Library Advisory Commission for the Fifth District for a term to expire on December 31, BUDGET TRANSFER CONTIN. Community Development (a) Authorized the expenditure of $2,800 from Account No (Board of Supervisors - Special/Demolition and Abatement) for abatement of a mobile home and trash located on Assessor s Parcel No (5817 Garden Avenue.) (b) Authorized the expenditure of $2,800 from Account No (HUD Grant) for abatement of a mobile home on Assessor s Parcel No (3260 Feather River Boulevard.) 4. Emergency Services: Adopted Resolution No , which is on file in Yuba County Resolution Book No. 31, and which is entitled: RESOLUTION PROCLAIMING APRIL AS EARTHQUAKE PREPAREDNESS MONTH. 5. Public Works: Authorized the reallocation of Fixed Assets Budget to allow the purchase of an All-Wheel Drive Grader. BOARD OF SUPERVISORS Sacramento Area Commerce and Trade Organization Annual Scholarship: Upon motion of Supervisor Simmons, seconded by Supervisor Stocker, and unanimously carried, the Board nominated Jennifer Nicolette Howard to receive the Sacramento Area Commerce and Trade Organization Annual $1,000 Scholarship award. ORDINANCES AND PUBLIC HEARINGS Chairman Hastey announced the public hearing to consider adoption of a negative declaration for Storm Water Conveyance and Outfall Structure along Forty Mile Road at Best Slough has been withdrawn. ITEM OF PUBLIC INTEREST Base Flood Plain Elevation Variance: Upon motion of Supervisor Hastey, seconded by Supervisor Simmons, and unanimously carried, the Board approved a Base Flood Plain Elevation Variance at 60 feet for a garage construction at 1798 Beverly Avenue, Olivehurst, (Daisy Reis Shelton.) 4 CORRESPONDENCE A. Letter to Governor Gray Davis from County of Madera Board of Supervisors, dated March 30, 2000, regarding appointment of Director of Office of Planning and Research. No action. B. Bulletin from United States Department of Agriculture/Forest Services, dated April 2000 regarding schedule of proposed actions considered for Tahoe National Forest. No action. BOARD AND STAFF MEMBERS REPORTS Supervisor Stocker requested proclamations for foothill citizens recently involved in a lifesaving effort. Supervisor Stocker also requested memorial adjournments in memory of Rose Souza and Leslie Fabian. Supervisor Stocker further reported on his recent Cap-To-Cap trip to Washington, D.C. and stressed the importance of participation in these events by as many Board members as possible. Supervisor Amaro reported on efforts to amend the County s Animal Control ordinance, NACo alert associated with internet taxes, high tech levee inspection through NASA, and advised of a scheduled meeting to address means to lower flood insurance rates for local residents. Supervisor Simmons advised the ad hoc committee has prepared a draft memorandum of understanding associated with river access and requested Board consideration. Chairman Hastey directed Counsel review and schedule for May 2 evening meeting of the Board of Supervisors. CLOSED SESSION DIRECT STAFF The Board retired into closed session at 10:02 a.m. to discuss the following: 1. Threatened litigation pursuant to Government Code (b) - One Claim. 2. 5 4. Pending litigation pursuant to Government Code (a) - South Yuba Concerned Citizens, Gerald Norene and Charles Slade vs County of Yuba. The Board returned at 11:23 a.m. with all staff and Board members present as indicated above. County Counsel Daniel Montgomery reported the following: In the matter of Pacific Bell s claim against the County, your Board unanimously chose to deny that claim. In the matter of SYCC (South Yuba Concerned Citizens) vs Yuba County, and others, your Board unanimously authorized the Office of County Counsel to defend that matter. There is no further announcement.
