6 CITY OF PASADENA PUBLIC SAFETY COMMITTEE MINUTES PASADENA CITY HALL 100 NORTH GARFIELD AVENUE CITY HALL COUNCIL CHAMBER S249 FEBRUARY 15, 2017 REGULAR MEETING OPENING ROLL CALL: Staff: STATEMENT FROM THE CITY MANAGER PUBLIC COMMENT The Chair called the regular meeting of the Public Safety Committee to order at 6:08 p.m. Councilmember John J. Kennedy (Chair) Councilmember Tyron Hampton Councilmember Steve Madison (Absent) Steve Mermell, City Manager Javan Rad, Chief Assistant City Attorney Phillip Sanchez, Police Chief Michael Johnson, Director of Public Health Department Rachel Lange Janbek, Environmental Health Specialist Valerie Flores, Recording Secretary Steve Mermell, City Manager, spoke regarding the Memorandum of Understanding (MOU) between the City (Pasadena Police Department) and Homeland Security/Immigration Customs Enforcement (ICE), highlighted the City Charter as it relates to contracts, and clarified that the MOU/contract was not executed by him and is not effective. He noted that the Legislative Policy Committee recently reviewed the City s State and Federal Legislative Platforms, which included the subject item immigration, stated that a recommendation to modify its language is forthcoming to the full City Council in the near future, as well as a possible consideration of the proposed adoption of the Immigration Status and Bias-Free Policing Policy for the Pasadena Police Department, and noted that it would be inappropriate to execute an MOU with ICE at this time given the aforementioned information. Following discussion, the following individuals provided comments and questions related to the Memorandum of Understanding between the City and Immigration Customs Enforcement (ICE): Dale Gronemeier, National Day Laborer Organizing Network (NDLON) Ed Washatka, Pasadena Organization for Progress (POP) Akina Cox, Pasadena resident Kris Ockershauser, Coalition for Increased Civilian Oversight of the Pasadena Police (CICOPP) Rita Moreno, Pasadena resident Pablo Alvarado, Pasadena resident Robert Cameron, Pasadena resident, distributed material and spoke on his personal experiences with the Pasadena Police Department. Councilmember Hampton requested that the City Manager follow-up with the public speaker, Robert Cameron /15/2017

7 Stephanie Ballard, White People for Racial Justice, spoke on behalf of Jazmine Richards Abdullah, and expressed concerns regarding matters related to the Pasadena Police Department. Councilmember Hampton noted that he was unaware of the MOU, and requested a review of all MOU s implemented by the Pasadena Police Department. In response to Councilmember Hampton, Mr. Mermell indicated that he has asked the Police Chief to identify other Operating Agreements/MOU s between the City and other law enforcement agencies, noted that the Internal Auditor staff will review all City MOU s and contracts to ensure compliance, and stated that he will promulgate the information once the review is complete. NEW BUSINESS UPDATE ON RECENT CRITICAL INCIDENTS AND VIOLENCE REDUCTION EFFORTS Phillip Sanchez, Police Chief, provided an oral update on recent critical incidents and violence reduction efforts, and responded to questions. Following discussion, Councilmember Hampton requested the Police Chief to provide information on the 18 individuals that he noted were arrested, specifically how many are repeat offenders, and stressed the need for better outreach efforts in terms of informing individuals about the various programs and services offered by the City. In response to Councilmember Hampton, Steve Mermell, City Manager, stated that existing City programs/services are being reviewed in an attempt to refocus efforts to address violence prevention. Chief Sanchez suggested that the Police Department include as part of its outreach efforts, distributing material on available City funded programs/services to inmates upon their discharge, and to make the list available to the Flintridge Center and to active community members. On order of the Chair, and by consensus of the Committee, the information was received and filed. AUTHORIZATION TO ENTER INTO A CONTRACT WITH THE FLINTRIDGE CENTER FOR PAROLE REINTEGRATION SERVICES Steve Mermell, City Manager, summarized the agenda report as part of a PowerPoint presentation, and responded to questions. Dale Gronemeier, Eagle Rock, CA, spoke in support for the work of the Flintridge Center, and urged the City to approve the contract with the Center for parole reintegration services. Councilmember Hampton requested information on other organizations that offer the same type of programs and services as the Flintridge Center, and expressed concern with approving the contract without going through a competitive bidding process /15/2017

8 The Chair stated his support for the Flintridge Center, highlighted the success of the Flintridge Center s Reintegration Program and the Apprenticeship Preparation Program (APP), as well as the positive testimonials at a recent APP graduation that he attended. Daniel Torres and Chris Finley, representatives of the Flintridge Center, responded to questions regarding the Flintridge Center s Reintegration Program, as well as other services provided by the Center. Dominick Correy, a District Representative for Senator Anthony Portantino, spoke on his personal experience with the Flintridge Center, and expressed his support for a contract with the Center for Parole Reintegration Services. In response to Councilmember Hampton s concerns, Mr. Mermell stated that it is anticipated that the Flintridge Center and the City will be successful in obtaining new grant funds from Proposition 47, and if not, he noted that staff will reevaluate ongoing funding and determine if it is appropriate to undertake a competitive bidding process. Following discussion, on order of the Chair, and by consensus of the Committee, the item was forwarded to the full City Council without a recommendation. INFORMATION ITEMS SUICIDE DATA UPDATE The above agenda item was held for discussion at future Committee meeting. MENTAL HEALTH SERVICES IN PASADENA Michael Johnson, Director of Public Health Department, provided a PowerPoint presentation on various mental health services offered by the Public Health Department. On order of the Chair, and by consensus of the Committee, the information was received and filed. MOBILE FOOD VENDING Michael Johnson, Director of Public Health Department, provided a PowerPoint presentation reviewing the agenda item, and responded to questions. Councilmember Hampton expressed concerns regarding mobile food vending, recommended that food trucks operate under the same regulations as ice cream trucks, specifically as it relates to hours of operation and the distance requirement from schools (no less than 300 feet), suggested that there be a requirement for vendors to provide healthier food options as part of the City s health initiative, and asked staff to consider revising the ordinance to reduce the time 03 02/15/2017

9 permitted in public parks for pushcart food vendors from 4 to 2 hours. In response to Councilmember Hampton s concerns regarding illegal food vendors, Rachel Lange Janbek, Environmental Health Specialist, Public Health Department, stated that she can include his identified areas of concern in the City s illegal vending sweep. Following discussion, Steve Mermell, City Manager, stated that staff will perform a comprehensive review of the ordinance pertaining to food trucks and mobile vending/pushcarts. On order of the Chair, and by consensus of the Committee, the information was received and filed. COUNCIL COMMENTS ADJOURNMENT Councilmember Hampton requested that the Committee agendize for a future discussion a report on dangerous intersections locally, and how the City plans to address the issue. Kennedy (Chair) Councilmember Tyron Hampton Councilmember Steve Madison (Absent) Steve Mermell, City Manager Javan Rad, Chief Assistant City Attorney Phillip Sanchez, Police Chief Eric Duyshart, Economic Development Manager Valerie Flores, Recording Secretary No one appeared for public comment. It was moved by Councilmember Hampton, seconded by Chair Kennedy, to approve the minutes of March 23, 2016 (Special meeting), August 15, 2016 (Regular meeting), October 17, 2016 (Special meeting), November 21, 2016 (Regular meeting), December 19, 2016 (Cancelled meeting), January 16, 2017 (Cancelled meeting), January 26, 2017 (Special meeting) as submitted. (Motion unanimously carried) (Absent: Councilmember Madison). NEW BUSINESS POLICY CONSIDERATION FOR UNMANNED AIRCRAFT SYSTEMS Steve Mermell, City Manager, introduced the agenda item, and Eric Duyshart, Economic Development Manager, provided a PowerPoint presentation on the item, and responded to questions. Following discussion, Councilmember Hampton commented on issues concerning drones and privacy, and requested staff to provide information on the Federal Aviation Administration s (FAA) drone registration requirements. The Chair requested staff to provide information on the use of commercial drones for the delivery of consumer goods, on the distinctions between recreational and commercial drone use, as well as information on other jurisdictions and their experiences/regulations on drone use. Following discussion, Philip Sanchez, Pasadena Police Chief, spoke on safety matters, privacy, and the challenges faced by the Police Department in regulating the use of drones, and responded to questions /15/2017

12 Councilmember Kennedy expressed concerns regarding public safety and the potential for intentional reckless operation by a drone user. Following additional discussion, it was moved by Councilmember Hampton, seconded by Chair Kennedy, to approve staff s recommendation, and forward the item to the full City Council for consideration. (Motion unanimously carried) (Absent: Councilmember Madison) INFORMATION ITEMS SUICIDE DATA UPDATE Steve Mermell, City Manager, introduced the agenda item, and Michael Johnson, Director of Public Health Department, provided a PowerPoint presentation on the agenda item, and responded to questions. Sonia Yates, Pasadena resident, cited concerns regarding the safety of Desiderio Park users and residents in the area, and requested that City officials meet with the Suicide Prevention Task Force to take proactive measures in addressing the matter. Councilmember Hampton expressed concerns with the number of local suicides, requested staff to obtain any available data on suicide attempts, suggested to revisit the idea of installing safety netting around the bridge and to strengthen/continue the work on suicide prevention awareness. Following discussion, Chair Kennedy expressed his sympathy to those present in the audience who may have lost a loved one to suicide, and commended police officers for their work in preventing suicides. Following additional discussion, the Committee stressed the need for better outreach efforts in terms of informing individuals about City programs and organizations that provide crisis intervention and grief counseling services during critical incidents, and requested that staff make available a comprehensive list of such programs/organizations. The Chair asked staff to review what measures other cities have taken to address the matter, and to report the findings to the Committee to ensure that best practices are being used. On the order of the Chair, and by consensus of the Committee, the information was received and filed USE OF FORCE OVERVIEW Steve Mermell, City Manager, introduced the agenda item, and responded to questions. Philip Sanchez, Pasadena Police Chief, introduced John Perez, the newly appointed Deputy Police Chief, Chris Kirby and Susan Gomez, as Internal Affairs Investigators. Police Chief Sanchez provided a PowerPoint presentation on the agenda item, and responded to questions /15/2017

13 Chair Kennedy commented on issues involving the Pasadena Police Department, commended the entire Department for its level of professionalism, and expressed his support for ongoing training of Police Officers on the use of force. Following discussion, on the order of the Chair, and by consensus of the Committee, the information was received and filed DISCIPLINE OVERVIEW Philip Sanchez, Pasadena Police Chief, provided a PowerPoint presentation on the agenda item, and responded to questions. Following discussion, Councilmember Hampton inquired about the number of police officers with multiple offenses, and requested staff to include the aforementioned information as part of the next Discipline Overview. In response, Javan Rad, Chief Assistant City Attorney, noted that it would be appropriate to provide statistical data on the matter. Following additional discussion, on the order of the Chair, and by consensus of the Committee, the information was received and filed. COUNCIL COMMENTS Councilmember Hampton requested an update from the Fire Department, with the City Manager noting that he will work with the Chair and the Fire Chief to decide on appropriate items to bring forward to the Committee, and recommended that a discussion on disaster preparedness be included as one of the items. In response to Councilmember Hampton, the City Manager indicated that staff will report to the Committee with information highlighting the more dangerous intersections in the city. Chair Kennedy and Councilmember Hampton requested staff to provide information regarding efforts to recruit locally for entry level jobs in the Pasadena Police and Fire Departments, including any limitations, past/current measures taken, and local employment data collected. ADJOURNMENT On order of the Chair, the regular meeting of the Public Safety Committee adjourned at 7:56 p.m. in memory of John Van de Kamp, former California Attorney General and a well-respected longtime Pasadena resident, and Vernon B. 18 Background CITY MANAGER DEPARTMENT On March 8, 2010, the City Council approved the selection of the Flintridge Center as the Institutional Home and approved funding of the project. The role of the Institutional Home has been to convene, coordinate and facilitate the collaboration of a broad coalition of local providers addressing violence prevention and intervention in the community with a particular focus on high-risk, high need youth and young adults. From 2010 to 2017 the Flintridge Center has provided the following services to address prevention and intervention: Pasadena Altadena Apprenticeship Preparation Program - Training for apprenticeships with the construction trade unions. Pasadena /Altadena Community Violence Intervention Prevention Institute and Network the Institute provides 36 hours community violence intervention-prevention education and community outreach training. Pasadena/Altadena Reintegration Council- A coalition of 47 organizations working to provide a safety net of effective and comprehensive services and resources to community members who are released from state and county correctional facilities. Skillz Summer School - Students in high risk, high-need circumstances with the opportunity to earn elective units for life-skills and academic recovery classes in Algebra and English. Youth of Promise Mentoring Program - Middle School students who are in high need, high risk circumstances are paired with volunteer mentors. Clergy Coalition Community Intervention Team-Pastors receive training as skilled interventionists 2

19 Vision Statement CITY MANAGER DEPARTMENT The Prevention and Intervention Steering Committee created a vision statement: The Committee is committed to providing a plan that focuses on the age group of 11 to 24 years of age for both individuals that are at risk as well as those who are involved in criminal activity and gangs. This effort will ensure an efficient and effective delivery of resources to youth and young adults and will provide a sustainable plan that meets the needs of the community. 3

20 Steering Committee Meetings CITY MANAGER DEPARTMENT March 2, 2017 A planning meeting with City staff and the Flintridge Center to review the previous efforts of the 20/20 Vision plan for violence prevention and intervention; March 16, 2017 Staff discussed which organizations to invite to participate on the Steering Committee to assist in creating the plan; April 13, 2017 Convened the first Steering Committee meeting which included 11 organizations. The City Manager shared the purpose for creating the plan. The organizations discussed their expertise in the areas of youth development, prevention and intervention services. April 27, The Steering Committee members will present their recommendations based on the selection of specific content strategies to complete. 4
