1 MINUTES OF A REGULAR MEETING OF THE LACEY CITY COUNCIL HELD THURSDAY, JUNE 12, 2014, IN LACEY COUNCIL CHAMBERS. CALL TO ORDER: Mayor Ryder called the meeting to order at 7:00 p.m. PLEDGE OF ALLEGIANCE: Mayor Ryder led the pledge of allegiance. COUNCIL PRESENT: A. Ryder, V. Clarkson, J. Hearn, J. Gadman, L. Seymour APPROVAL OF AGENDA AND CONSENT AGENDA: Consent Agenda Items: (a) Worksession Minutes of May 15, 2014 (b) Council Minutes of May 22, 2014 (c) Motion to approve payment of claims, wages and transfers from May 10 through May 30, (d) Final Plat of Campus Peak, Project #11-76 Mayor Ryder requested an amendment to the agenda to remove Agenda Item 3-A: America s Classic Jazz Festival Presentation. COUNCILMEMBER CLARKSON MOVED TO APPROVE THE CONSENT AGENDA AND AMENDED AGENDA. COUNCILMEMBER GREENSTEIN SECONDED. MOTION CARRIED. PUBLIC RECOGNITION: Pat Bucknell, on behalf of the Lacey Sunrise Lion Club, presented the Civic Plaza Wood Carving to the City of Lacey. In addition, Mr. Bucknell presented a commemorative flag to the City Manager and Police Page 1 of 7
2 Chief in honor of the fallen heroes at the World Trade Center on September 11, Council expressed their appreciation to all Lion Club members for their support of the community and displaying 500 street flags on patriotic holidays. Troy Woo, Finance Director, announced the City recently received the 2012 Government Finance Officers Association Certificate of Achievement for Excellence in Financial Reporting. Mr. Woo recognized Pam Meredith, Chun Saul and Teri Schnitzer for their participation and support during the CAFR process. Erin Quinn Valcho, Museum Curator, announced that Richard Jones, who served on the first Lacey City Council, has been selected as the Lacey Historian of the Year. Mr. Jones drafted the City s first traffic code, and the City has benefited from his experiences and preservation of Lacey history. Mr. Jones thanked the Historical Commission and Council for the recognition and encouraged people to work with those you respect and what is of interest to you. Mayor Ryder requested an amendment to the order of the agenda to move proclamations to the public recognition part of the meeting. COUNCILMEMBER GADMAN MOVED TO AMEND THE AGENDA TO READ A PROCLAMATION DURING PUBLIC RECOGNITION THAT DECLARES LACEY HISTORY MONTH. COUNCILMEMBER GREENSTEIN SECONDED. MOTION CARRIED. PROCLAMATION: The Lacey City Council declared June as Lacey History Month. Erin Quinn Valcho and Kimberly Bauman accepted the proclamation on behalf of the Historical Commission. The Lacey City Council issued a proclamation recognizing the outstanding efforts of the Lacey Sunrise Lions Club. Nick and Sugar Murphy and Sharon Sikes accepted the certificate on behalf of the organization. Don Hayden, Lacey Sunrise Lions Page 2 of 7
3 President, announced a dedication will be made to Nick Murphy as a long-time flag captain of the organization. During the past 28 years, 56,000 flags have been displayed in the City of Lacey. In 2014, the Lions Club achieved their goal of displaying 500 flags. PUBLIC COMMENTS: Ron Nesbitt, former Olympia Police Officer, expressed his concerns with police departments locally and throughout the State of Washington, and their treatment of minorities. He described himself as a black militant nationalist and someone who promotes separatism. He requested that Council hold open public meeting forums with opportunities for direct dialog with Councilmembers. Councilmember Clarkson offered to meet with Mr. Nesbitt to discuss his concerns. Mayor Ryder recognized Rebecca Lee, Planning Commission member. Jenny Winslow, Education First, invited Council and the public to participate in the EF Home Stay Program to host a student from China during July 16 August 3, The 2 ½ week visit provides an opportunity to break down the barriers of language and culture while creating lifelong friendships. John Bowser, a member of Turning Point Church, addressed the Council with a concern about the permitting of a recreational marijuana retailer at 3601 Marvin Road. He stated the facility is less than 100 feet from the church and would be incompatible with the activities of the church. He requested Council to pass a moratorium on vetting and permitting retail marijuana in the city. Rick Walk, Community Development Director, stated the license for this business has not been issued yet. The State Liquor Control Board would review the license, and the city would review the land use for site development. Council requested this issue be added to an upcoming worksession for further discussion and review. Page 3 of 7
4 REFERRAL FROM HEARINGS EXAMINER: Samra Seymour, Associate Planner, presented Council with a request to consider approval of the Puget Meadows East Preliminary Subdivision Project #13-83, submitted by Puget Western, Inc. to subdivide a 5.5 acre parcel of Moderate Density zoned land into 37 lots for detached single family development. The parcel is located within the Meridian Campus Planned Community. The proposed average lot size is approximately 4,560 square feet. The site is located at st Ave NE. The Assessor s parcel number is The public hearing was conducted on April 29, No members of the public attended the hearing. No written comments were received. Written comments were received from reviewing agencies as part of the notice of application. A recommendation from the Hearings Examiner was received on May 13, The conditions of approval recommended to the City Council for the project are as suggested by staff. COUNCILMEMBER GREENSTEIN MOVED TO APPROVE THE PUGET MEADOWS EAST PRELIMINARY SUBDIVISION PROJECT # COUNCILMEMBER GADMAN SECONDED. MOTION CARRIED. ORDINANCE: Ordinance No amends LMC to define firearms, power equipment, electronics, jewelry, precious metals and items identified through a serial number as those items requiring notification to the Lacey police department. At its November 15, 2013, meeting, the General Government & Public Safety Committee recommended full City Council approval to amend LMC COUNCILMEMBER GREENSTEIN MOVED TO ADOPT ORDINANCE NO TO AMEND LMC PAWNBROKER AND SECOND HAND Page 4 of 7
5 DEALERS. COUNCILMEMBER HEARN SECONDED. MOTION CARRIED. MAYORS REPORT: Mayor Ryder presented the Council with a request to appoint Stephanie Hemphill and Andrew Shin to unexpired terms on the Lodging Tax Advisory Committee. COUNCILMEMBER RYDER MOVED TO APPOINT STEPHANIE HEMPHILL AND ANDREW SHIN TO UNEXPIRED TERMS ON THE LODGING TAX ADVISORY COMMITTEE. COUNCILMEMBER GREENSTEIN SECONDED. MOTION CARRIED. CITY MANAGER S REPORT: Scott Egger, Public Works Director, and Monty Bryant, City Surveyor, presented Council with a request to authorize the City Manager to sign an Interlocal Agreement between the City of Lacey and Thurston County for sharing GIS data with the Thurston GeoData Center. At its May 12, 2014, meeting, the General Government & Public Safety Committee recommended full City Council approval of the Interlocal Agreement for sharing GIS data. COUNCILMEMBER GADMAN MOVED TO AUTHORIZE THE CITY MANAGER TO SIGN AN INTERLOCAL AGREEMENT WITH THURSTON COUNTY FOR SHARING GIS DATA. COUNCILMEMBER GREENSTEIN SECONDED. MOTION CARRIED. Scott Spence, City Manager, invited the public to participate in the Children s Entertainment Series, Lacey in Tune Concert Series, and the first Historic Lacey Walking Tour. Page 5 of 7
6 STANDING GENERAL COMMITTEES: General Government & Public Safety Committee Councilmember Gadman reported the Committee met on May 12, 2014, to discuss the Wayfinding Signage Program, revisions to the Council Policies and Procedures, and an IGA with Thurston County for GIS Data Sharing. Transportation Committee Councilmember Hearn reported the Committee met on May 28, 2014, to discuss an amendment to onstreet parking, updating the reauthorization of federal transportation funds, and the Six-Year Transportation Improvement Program and Traffic Mitigation list. BOARDS & COMMISSIONS: Intercity Transit Councilmember Gadman reported a public hearing was held for the Intercity Transportation Improvement Plan. No public comment was received. In other business, appointments were made to the Citizen Advisory Committee. JASCOM Councilmember Gadman announced the annual Bow Wow Boogie will be held on August 29, In other news, the Board is reviewing revisions to the dangerous dog ordinance. LOTT Councilmember Gadman announced the Board approved contracts for upgrades to the polymer system, replacing the boiler system at the LOTT plant, and authorizing an ILA with the City of Lacey for mutual aid. Olympic Clean Air Agency Councilmember Steadman announced the 2015 Budget has been approved, excluding comparables for salary increases. SWAC Councilmember Steadman reported the Board is reviewing its five-year budget, focusing on capital Page 6 of 7
7 facilities projects, maintenance schedules, and reserves. TPB Mayor Ryder reported the Board received a briefing from WSDOT on a new economic division. In other business, updates will be made to the Transportation Plan, goals and policies, and regional coordination activities will be planned with JBLM. TRPC Councilmember Clarkson reported the Board discussed Agricultural 101 in the county, and will appoint members to develop a legislative package to advance its issues with local legislators. TCOMM911 Councilmember Greenstein reported the Board reviewed options for financial reporting. The next generation 911 system has been installed and will go live on July 8, Mayor Ryder announced that Deputy Mayor Pratt is excused from the meeting, because of her attendance at NLC meetings.
