Gisi, et al., Yuba County Superior Court Case Regular Meeting Council Chambers The City of Yuba City City Council meeting was called to order by Mayor Cleveland at 6:04 p.m. Roll Call Present: Absent: Councilmembers Bcukland, Cardoza, Didbal, Harris and Mayor Cleveland None Invocation Mayor Cleveland gave the invocation. Pledge of Allegiance to the Flag Eagle Scouts Rhys Graham and Kindlelon Respicio led the Pledge of Allegiance. Presentations & Proclamations 1. Introduction of John Benoit, LAFCo Executive Director New LAFCo Executive Director John Benoit introduced himself to the City Council and Community. Mr. Benoit brings 30 years of experience to the Sutter County Local Agency Formation Commission.

Eagle Scout Recognition Jason Pruitt, Rhys Graham and Kindlelon Respicio Mayor Cleveland provided certificates of recognition to Eagle Scouts Rhys Graham, Kindlelon Respicio, and Jason Pruitt in honor of their achievements. Eagle Scout Pruitt was unable to attend. 3. Swearing in of five Yuba City Police Officers Gregory Anderson, Andrew Eberley, Jacob Ernst, Zachary Hedgepeth and Nicole Gibson Police Chief Rob Landon swore in new Yuba City Police Officers Gregory Anderson, Andrew Eberley, Jacob Ernst, Zachary Hedgepeth, and Nicole Gibson. Each new Officer was pinned with their new badge by their loved ones. Public Communication 4. Written Requests One request was received for Item No Appearance of Interested Citizens - None Public Hearing 6. Proposed Levy of the 2017 Annual Assessment of the Downtown Yuba City Business Improvement District Mayor Cleveland opened the public hearing, the following person spoke: Cindy Paine, Downtown Business Association Councilmember Buckland moved to adopt Resolution No confirming the Annual Report for the Yuba City Downtown Business Association and levying the assessment for the Downtown Business Improvement District for calendar year Councilmember Didbal seconded the motion that passed with a unanimous vote. 7. FY Edward Byrne Memorial Justice Assistance Grant in the Amount of $17,181 Bid Opening Mayor Cleveland opened the public hearing, hearing no comment, he closed the public hearing. Councilmember Buckland moved to: A) adopt Resolution No authorizing the Chief of Police to accept the FY Edward Byrne Memorial Justice Assistance Grant in the amount of $17,181 and approve expenditure recommendations; B) Authorize the Mayor to execute the associated memorandum of understanding with Sutter County on behalf of the City, following approval by the City Attorney; and C) Authorize the Chief Financial Officer to make budget adjustments as necessary. Councilmember Cardoza seconded the motion that passed with a unanimous vote. 8. Purchase of five Police Traffic Motorcycles and related buyback agreement Councilmember Buckland moved to: A) Award the purchase of (5) five Harley Davidson FLHTP to Yuba City Harley Davidson of Yuba City, CA, in the amount of $88,337 by finding that it is in the best interest of the City; and approval of related buyback agreements; B) Award the purchase of (5) Bluetooth Wireless microphone kits to PVP Communications of Torrance, CA, in the amount of $8,889 by finding it is in the best

3 interest of the City; and C) approve a supplemental appropriation from the Vehicle Replacement Fund to account # in the amount of $97,226. Councilmember Didbal seconded the motion that passed with a unanimous vote. 9. Purchase of Body-Worn Cameras and Upgraded Equipment for Patrol Car Camera Systems Ordinance Councilmember Didbal moved to: A) Authorize the purchase of Body-Worn Cameras and Upgrade Equipment to Broadcast Microwave Services / Data911 Products (Data911) of Poway, CA, in the amount of $131, by finding that it is in the best interest of the City; B) Approve the installation of the In-Car Equipment upgrade to Cop Shop Installations of Yuba City, CA, in the amount of $14,750 by finding that it is in the best interest of the City; and C) Approve supplemental appropriations from the Technology Replacement Fund in the amount of $68,900. Councilmember Cardoza seconded the motion that passed with a unanimous vote. 10. Adoption of the 2015 Edition of the International Fire Code and Fire Prevention Ordinance Councilmember Buckland moved to introduce an Ordinance Repealing and Reenacting Chapter 5 of Title 4 of the Yuba City Municipal Code Entitled Fire Prevention, and waive the first reading, and provide direction to staff to meet with Laughlin and Spence regarding their concerns. If there are any adjustments needed to Ordinance, it will need to be introduced again at the next City Council Meeting. Councilmember Didbal seconded the motion that passed with a unanimous vote. 11. Adoption of the 2016 Edition of the California Building Standards Code and Building Regulations Ordinance Councilmember Harris moved to introduce an Ordinance repealing and reenacting Title 7 and appropriate chapters of the Yuba City Municipal Code titled Building Regulations which provides regulations to implement the 2016 edition of the California Building Standards Code, and waive the first reading. Councilmember Harris seconded the motion that passed with a unanimous vote. Consent Calendar Item number 16 was requested by Staff to be pulled from the Consent Calendar for further discussion. Councilmember Didbal moved to approve Items and on the Consent Calendar. Councilmember Cardoza seconded the motion that passed with a unanimous vote. 12. Minutes of November 1, November 2, and December 6, 2016 Approved the City Council Meeting Minutes of November 1, November 2, and December 6, Fiscal Year Waste Tire Enforcement Grant Application Adopted Resolution No authorizing Yuba County, as the Lead Agency of the Yuba-Sutter Local Enforcement Agency, to perform Waste Tire Enforcement activities on behalf of the City of Yuba City and submit a Collaborative Application for the Waste Tire Enforcement Grant to CalRecycle for Fiscal Year

Submission of Recertification Application for Tree City USA Designation Adopted Resolution No authorizing the City to submit an application for recertification to the National Arbor Day Foundation for consideration of the City continuing its designation as a Tree City USA community. 15. Development Impact Fees Annual Report Accepted the AB1600 Annual Report and adopted Resolution No finding that there is a reasonable relationship between current needs for the fees and the purposes for which they were originally collected. 17. OSPR Oil Spill Response Equipment Grant Program Accepted funding in the amount of $35,000 from the Department of Fish & Wildlife/Office of Spill Prevention and Response (OSPR) and authorize appropriate modification to the Fire Department s budget 18. Purchase of 911 Bridge Street for the future widening of Bridge Street Authorized the City Manager to execute a Purchase and Sale Agreement, on behalf of the City and as the Redevelopment Housing Successor Agency, and execute and accept a Grant Deed for the purchase and sale of Real Property located at 911 Bridge Street (APN ) for $165, Alternative Groundwater Sustainability Plan submittal for the Sutter Sub-basin Approved the submission of the Alternative Groundwater Sustainability Plan to the California Department of Water Resources on the City s behalf and authorized the Public Works Director to provide a letter of support to Sutter County for the submittal of the plan. 16. Implement the New California Minimum Wage rate effective January 1, 2017 City Manager Steve Kroeger noted that there was an error in the staff report that was published and a corrected staff report has been provided. Councilmember Buckland moved to adopt Resolution No approve the adjustment to the City s salary schedule to comply with the new California wage requirements effective January 1, Councilmember Didbal seconded the motion that passed with a unanimous vote. General Items 20. Final Financial Report for Fiscal Year Ending June 30, 2016 Noted and Filed the Final Financial Report for the Fiscal Year Ending June 30, Comprehensive Annual Financial Report (CAFR) and Related Audit Reports for Fiscal Year Ended June 30, 2016 Councilmember Didbal moved to accept the Comprehensive Annual Financial Report (CAFR) and Related Audit Reports for Fiscal Year Ended June 30, Councilmember Harris seconded the motion that passes with a unanimous vote.

Traffic Signal Maintenance Contract Extension Councilmember Buckland moved to approve the Traffic Signal Maintenance Contract extension to St. Francis Electric, Inc. of San Leandro, CA in the amount of $62,864 with the finding that it is in the best interest of the City, and authorize the Public Works Director to execute up to three contract extensions for the current traffic signal maintenance contract on behalf of the City. Councilmember Didbal seconded the motion that passed with a unanimous vote. 23. Underground Utility Districts Councilmember Buckland moved to approve the priority list for Underground Utility Districts provided by staff. Councilmember Cardoza seconded the motion that passed with a unanimous vote. 24. Professional Service Agreement with Melton Design Group for the preparation of a Landscape Corridor and Wayfinding Signage Concept Plan for the State Route 20 Corridor from State Route 99 to the 10 th Street Bridge The following person spoke: Pat Miller, Sutter County Tax Payer s Association Councilmember Cardoza moved to award a professional services agreement to Melton Design Group for the preparation of a Landscape Corridor and Wayfinding Signage Concept Plan for the State Route 20 corridor in the amount of $84,700 plus $10,000 contingency with the finding that it is in the best interest of the City. Councilmember Didbal seconded the motion that passed with a unanimous vote. 25. Marijuana Ordinance Overlay District for South Yuba City Annexation Area The following person spoke: Bob Renton, Live Oak Councilmember Buckland moved adopt Resolution No authorizing staff to enforce the adopted Sutter County Marijuana Cultivation Ordinance for all properties located within the South Yuba City Annexation Area if the Annexation is approved. Councilmember Harris seconded the motion that passed with a unanimous vote. Business from the City Council 26.
