1 DRAFT REGULAR MEETING OF THE MARIN COUNTY BOARD OF SUPERVISORS HELD TUESDAY, JULY 21, 2015, AT 10:36 A.M. Roll Call Present: Supervisor Arnold; Supervisor Kinsey; Supervisor Connolly; Supervisor Sears; Supervisor Rice The Board convened as the Marin County Housing Authority Board of Commissioners at 8:39 a.m. and convened as the Board of Supervisors at 10:36 a.m. All Supervisors were present. 2. BOARD OF SUPERVISORS MATTERS Marin Transportation Commission ("MTC") Supervisor Kinsey commented briefly on a MTC meeting he attended on June 24, 2015, including discussions regarding considerations for a possible MTC-ABAG merger. Association of Bay Area Governments ("ABAG") Supervisor Connolly commented briefly on an ABAG meeting he attended recently. Supervisors Kinsey and Connolly discussed MTC-ABAG merger concerns. Pueblo Park Supervisor Connolly commented on a community mosaic project event at Pueblo Park this Saturday. Consent Calendar Item CA-1d Supervisor Rice briefly commented on Item CA-1d, a resolution recognizing the 25th Anniversary of the Americans with Disabilities Act ("ADA"). 3. ADMINISTRATOR S REPORT Policy Agenda Item 8 Assistant County Administrator Dan Eilerman commented on Agenda Item CONSENT CALENDAR A (ITEMS CA-1 THROUGH CA-9) ("Consent Calendar A" reflects those agenda items that have prior policy approval from the Board.) M/s Supervisor Arnold - Supervisor Sears to approve Consent Calendar A as presented. CA-1. Board of Supervisors: a. No in memoriam adjournments were requested by the Board. b. Approval of minutes of the meeting of July 14, c. Appointments: Request to schedule the following appointments: i. Children and Families Commission (First 5 Marin) Scheduled appointment for August 4, 2015 for one vacancy representing Marin County Health and Human Services due to the retirement of Sparkie Spaeth. 2 ii. Retirement Board Scheduled appointment for October 20, 2015 for one vacancy due to the resignation of Jeffrey Bartfeld. d. Request from Supervisor Rice to adopt resolution recognizing the 25th Anniversary of the Americans with Disabilities Act ("ADA") and affirming the County s commitment to maximize accessibility at the County of Marin. CA-2. CA-3. CA-4. CA-5. Community Development Agency: a. Authorize President to execute, subject to County Counsel approval, (i) HOME Investment Partnerships Program agreement, in substantially the form presented, with the Marin Housing Authority, in the amount of $450,573, for the rehabilitation of the Vest Pocket Community; and (ii) related documents, including subordination agreements, that may be required by other sources of financing for this project. b. Authorize President to execute, subject to County Counsel approval, amendment to HOME Investment Partnerships Program agreement with Marin Housing for Handicapped, Inc. I, to increase budget for rehabilitation of the Del Ganado Apartments from $89,303 to $180,416. c. Authorize President to execute, subject to County Counsel approval, modifications to ground leases between City of Novato and Hamilton Continuum Partners I, L.P., and between City of Novato and Hamilton Continuum Partners II, L.P., to remove 24-month occupancy limits so that the Hamilton Transitional Housing may operate as permanent supportive housing. d. Authorize President to execute the FY addendum to agreement with Ballard and Watkins Construction Services, increasing the contract by $125,000 for a new maximum amount not to exceed $175,000, to provide overflow building inspections on an as-needed basis to assist regular staff in meeting building inspection requests within 48 hours or better. Farm Advisor: Authorize President to execute Salary Reimbursement Agreement with the University of California, in the amount of $72,307, to reimburse the University of California for payroll and related expenses of a staff associate for the sustainable agriculture program in Marin County. Finance: a. Request to receive monthly report of County, Schools and District Investments as of May 31, b. Request to adopt Resolution No authorizing temporary transfer of funds, in an amount not to exceed $5,624,762, to the Kentfield School District. c. Request to adopt Resolution No authorizing temporary transfer of funds, in an amount not to exceed $1,757,060, to the Bolinas Stinson Union School District. Health and Human Services: NOTE: Agreement in item CA-5a is a renewal of an existing agreement that was included in and funded in the FY budget. a. Authorize President to execute FY Title III and Title VII Area Plan Agreement (AP ), in the amount of $1,076,248, with the California Department of Aging for older adult services. b. Authorize President to execute amendment (A02) to agreement ( ) and related documents with the California Department of Public Health Office of AIDS, to provide HIV-related services. Authorize President to execute multi-year agreements with Bon Air Surgery Center and Greenbrae Surgery Center for use of their shared facility in the event of a public health emergency or disaster. d. Request to adopt Resolution No naming HHS Director as Signatory Authority for Workforce Innovation and Opportunity Act ("WIOA") plans, modifications, adjustments, grants, grant applications, subgrant agreements or other documents with or required by the State of California Employment Development Department, the United States Department of Labor, or any other state or federal agency. CA-6. CA-7. CA-8. CA-9. Human Resources: Request to adjust salary range for the Director of Human Resources, in preparation for an open recruitment. Parks: Request to authorize President to execute Notice of Completion for the Homestead Valley Community Center Renovation project. Public Works: a. Authorize President to execute first amendment to agreement with David Ford Consulting Engineers, Inc., to extend the agreement to June 30, 2017, for on-call hydrologic and hydraulic modeling services for the Southern Marin Watershed Program. b. Approve amendment to lease for space leased to Marin Community Clinics at the Marin Health and Wellness Campus, as detailed in staff report dated July 21, c. Request to approve the following actions related to the Redwood Highway Frontage Road/US 101 (De Silva Island Drive) Intersection Improvements Project: (i) reject bid proposal; and (ii) direct Clerk to re-advertise the Notice to Contractors (County Project No /Federal-Aid Project No. HSIPL-5927(090)). Sheriff: Request to add 1.0 FTE Technology Systems Specialist II positon, fully funded by Auto Fingerprint (Cal-ID) Sheriff's Trust Account No , superseding a request for a threeyear fixed term Technology Systems Specialist II position approved by the Board on April 28, CONSENT CALENDAR B (ITEMS CB-1 THROUGH CB-3) ("Consent Calendar B" reflects those agenda items requiring 4/5 vote of available members relating to budgetary matters) M/s Supervisor Sears - Supervisor Kinsey to approve Consent Calendar B as presented. CB-1. District Attorney: Request to approve budget increase in the Underserved Victim Advocacy and Outreach Program, in the amount of $4,300, representing the projected operating costs for the period of July 1, 2015 to September 30, 2015 CB-2. Health and Human Services: Request to (i) appropriate $193,795 in year one Intergovernmental Transfer Funds from Partnership HealthPlan of California to provide dental services to Medi-Cal beneficiaries and other underserved populations; (ii) effective July 19, 2015, approve related cost neutral personnel adjustments; and (iii) approve related budget actions as detailed in staff report dated July 21, Marin County BOS Minutes 3 7/21/2015

Library: Request to accept contribution in the amount of $10,000 from the Friends of the Civic Center Library, to be used to add a counter for laptop use and personal device charging station at the Civic Center Library. 6. OPEN TIME Labor Agreements Three Children and Family Services employees addressed the Board. The Executive Director of the Marin Association of Public Employees ("MAPE") addressed the Board regarding an article in the Marin Independent Journal last week. 7. REQUEST FROM SUPERVISORS ARNOLD AND RICE TO ADOPT A RESOLUTION SUPPORTING STRONG STARTS FOR OF MARIN S CHILDREN M/s Supervisor Arnold - Supervisor Kinsey to adopt a resolution supporting the efforts of the Marin Strong Start Coalition to develop a dedicated funding stream for essential programs for all of Marin's children. 8. This item was removed from the agenda. 9. REQUEST FROM THE COMMUNITY DEVELOPMENT AGENCY TO TAKE ACTIONS RELATED TO PROPERTY ASSESSED CLEAN ENERGY ("PACE") Representatives of Marin Clean Energy ("MCE"), California First PACE Financing Program, and the HERO Program addressed the Board. M/s Supervisor Sears - Supervisor Connolly to (a) authorize the Director to execute agreements for Collaborative Services for PACE Financing Marketplace with approved Program Providers; and (b) adopt Resolutions , , , , , and , as detailed in staff report dated July 21, 2015, allowing property owners in the unincorporated areas of Marin County to participate in additional PACE financing programs as outlined in staff report. The Board of Supervisors recessed at 11:30 a.m. to meet as the Marin County Flood Control and Water Conservation District and reconvened at 11:56 a.m. All Supervisors were present. 11. REQUEST FROM MARIN COUNTY PARKS TO CONDUCT A PUBLIC INFORMATION MEETING REGARDING THE CONTINUATION OF THE RUSH CREEK LIGHTING AND LANDSCAPING DISTRICT The public information meeting was declared open for public comment. No members of the public were present to address this item. 5 12. Appointments: a. Personnel Commission Up to two vacancies for Alternate members. At the June 2, 2015 Board of Supervisors meeting, the Board nominated Linda Abernathey, James Finkelstein, and Steven Voss to be interviewed. Ms. Abernathey withdrew her application. The Board conducted interviews of James Finkelstein and Steven Voss. M/s Supervisor Kinsey - Supervisor Arnold to appoint James Finkelstein and Steven Voss as Alternates on the Personnel Commission. b. Human Rights Commission Seven appointments, one from each supervisorial district and two At-Large. Twentyeight applications were received as follows: Jesus Jesse Alvarez, Robert Begley, Stephen Bingham, Ken Casey, Jonathan Frieman, Gina Fromer, Carla Halyard, Michael Hartnett, Glen Hayashi, Linda Jackson, Nancy Johnson, Rebecca Jones-Torre, Douglas Kahn, Brad Lakritz, Christina Leimer, Christian Martinez, Kristin Nash, William Palmini, Rocky Pierson, Lori Randell, Walter Shank, Lloyd Silverman, Katy Spence, Richard (Van) Swearingen, Susan Tracy, Randy Warren, Kathy Williams, and Brandy Wilson. Supervisor Rice recommended that the terms be staggered pursuant to Ordinance No. 3629; and initial terms for the District 1, District 2, and one At-Large seat be set for two years, with the terms for the remainder of the seats for four years. Board members agreed. M/s Supervisor Arnold - Supervisor Kinsey to appoint Kenneth Casey as the District 5 M/s Supervisor Kinsey - Supervisor Arnold to appoint Christian Martinez as the District 4 M/s Supervisor Sears - Supervisor Arnold to appoint Nancy Johnson as the District 3 M/s Supervisor Connolly - Supervisor Arnold to appoint Gina Fromer as the District 1 M/s Supervisor Sears - Supervisor Arnold to appoint Kristin Nash as the District 2 After discussion by the Board, the following applicants were nominated to be interviewed for the two At-Large seats: Jesus "Jesse" Alvarez, Linda Jackson, Rebecca Jones- Torre, Christina Leimer, Lori Randell, and Kathy Williams. 6 13. CLOSED SESSION: The Board met in closed session at 12:30 p.m. to discuss the following: a. Instructions to labor negotiator (Deputy Human Resources Director) regarding negotiations with International Alliance of Theatrical Stage Employees and Moving Picture Machine Operators ("IATSE"), Sheriff s Staff Officers Association ("SSOA"), Teamsters Local 865 Deputy District Attorneys ("DDAs"), Marin County Association of Public Employees ("MAPE") General Unit, Marin County Association of Public Employees ("MAPE") Health and Human Services, and Marin County Management Employees Association ("MCMEA") pursuant to California Government Code Section (a). b. Conference with real property negotiators pursuant to California Government Code Section on the matter as follows: Real Property Address: 7335 Point Reyes- Petaluma Road, Hicks Valley, Petaluma (APN: ); Property Negotiators: County of Marin/Negotiators: David Speer and Christy Voyles; Property Owner Representative/Negotiator: Sean Payne, Pacific Union International and Christie s International Real Estate. Under Negotiation: price and terms of payment. The Board reconvened in open session at 1:39 p.m. All Supervisors were present. The President advised that the Board met in closed session and provided direction to labor negotiators. 14. HEARING: CONSIDERATION OF PLANNING COMMISSION RECOMMENDATIONS FOR AMENDMENTS TO DEVELOPMENT CODE CHAPTER REGARDING THE AFFORDABLE HOUSING ("AH") COMBINING DISTRICT Community Development Agency Director Brian Crawford and Principal Planner Leelee Thomas provided background on the matter before the Board, and summarized the Planning Commission's considerations and recommendations regarding the Affordable Housing ("AH") Combining District. Staff responded to comments from the Board on issues including default densities and the impact of AB 1537, which changed Marin's classification for the current Housing Element planning period of from 30 units per acre to 20 units per acre. The hearing was opened to receive public comment. Over twenty speakers, including representatives of St. Vincent's, Sustainable TamAlmonte, the Seminary Neighborhood Association, the Marin Environmental Housing Collaborative, Coalition for a Livable Marin, and the League of Women Voters addressed the Board. The speakers individually expressed their views regarding rezoning the assigned density from 30 units per acre to 20 units per acres on the sites within the Affordable Housing ("AH") Combining District. Seeing no one else present who wished to speak, the hearing was closed. Mr. Crawford briefly responded to comments made by previous speakers. Board members individually expressed their views regarding proposed amendments to the Development Code related to the AH Combining District and the application of AB Marin County BOS Minutes 6 7/21/2015
7 Thereafter, Board members reviewed specific changes proposed to be made to the ordinance and corresponding Attachment A to change the assigned density from 30 units per acre to 20 units per acre on the three AH Combining District sites.
