1 CITY COUNCIL MINUTES City of Campbell, 70 North First Street, Campbell, California REGULAR MEETING OF THE CAMPBELL CITY COUNCIL Tuesday, March 21, :30 p.m. Council Chamber 70 N. First Street This City Council meeting was duly noticed pursuant to open meeting requirements of the Ralph M. Brown Act (G.C. Section 54956). This meeting was recorded and can be viewed in its entirety at CALL TO ORDER The City Council of the City of Campbell convened this day in the regular meeting place, the Council Chamber of City Hall, 70 N. First Street, Campbell, California. ROLL CALL: Present: Councilmembers: Waterman, Cristina, Landry, Resnikoff, Gibbons Absent: Councilmembers: None PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by the Archbishop Mitty High School Interact Club. Mayor Gibbons thanked them for leading the pledge and presented them with a certificate of appreciation. SPECIAL PRESENTATIONS AND PROCLAMATIONS 1. Recognition for Archbishop Mitty High School Interact Club Recommended Action: Recognize the Archbishop Mitty High School Interact Club for their involvement in the City of Campbell sponsored projects and events. Public Works Director Capurso gave recognition to the Archbishop Mitty Interact Club and thanked them for their numerous community service efforts within the City of Campbell. 2. Proclamation declaring the Month of March as American Red Cross Month in the City of Campbell Recommended Action: Proclaim the Month of March as American Red Cross Month in the City of Campbell.

2 Mayor Gibbons proclaimed March as American Red Cross Month in the City of Campbell. Local Chapter, Disaster Chair, Ann Herosy and Jim Mollerus accepted the proclamation on behalf of the American Red Cross. 3. Proclamation declaring the Month of March as Women s History Month in the City of Campbell Recommended Action: Proclaim the Month of March as Women s History Month in the City of Campbell Mayor Gibbons proclaimed March as Women s History Month in the City of Campbell. President of the Southwest Santa Clara County Chapter, Hana Itani, accepted the proclamation on behalf of the League of Woman Voters. COMMUNICATIONS AND PETITIONS There were no communications and petitions. ORAL REQUESTS NOTE: This portion of the meeting is reserved for persons wishing to address the City Council on any matter not on the agenda. Persons wishing to address the Council are requested, but not required to complete a Speaker s Card. Speakers are limited to two (2) minutes. The law generally prohibits the Council from discussion or taking action on such items. However, the Council may instruct staff accordingly regarding Oral Requests. Elaine Urban, spoke of her efforts to stabilize the cat colony along the Los Gatos Creek Trail and would like the City s support. Carl Swenson, spoke of his involvement with the cats along the Los Gatos Creek Trail and gave examples of how the City could support his efforts. Debbie Bone, Campbell resident, spoke of her efforts with the community cats along the Los Gatos Creek Trail and would like the City s support. Steven Saunders, spoke about concerns with the City s analysis of revenue impacts for ballot measures A and C and submitted a document for the record. COUNCIL ANNOUNCEMENTS Silicon Valley Clean Energy (SVCE) is a new non-profit, public agency which will source clean electricity in two phases beginning in April. There will be a community meeting in Room Q-80 at the Campbell Community Center on Wednesday, March 22 from 6:30 7:30 pm with SVCE staff to answer questions and provide information about the program. SVCE is going to roll out in two phases, 20% of the citizens and all of the businesses will be enrolled as of April 1, Everyone else will be brought in as of July 1, More information is available on their website: Please come to the meeting tomorrow night. For more information please visit the city s website at On Friday, March 24, History Happy Hour at the Ainsley House Museum presents the fascinating history of the Mount Umunhum Almaden Air Force Station. Enjoy a slide show of amazing historic photos of this Cold War radar station when it was in operation between 1958 and Also learn about the future of the historic landmark radar tower atop the mountain. For more information about this and other History Happy Hour events, please visit the City s website at For those that are interested in teas, the Art of the Tea exhibit will be opening on April 1, with a celebration between 12:00-2:00 pm at the Museum s Carriage House. Free income tax preparation at Campbell Library through April 15. Volunteers trained by the IRS will be available for people who make $60,000 single or ($85,000 married) or less who are age 60 and older. For more information about this service please visit The City of Campbell is hosting the Stand Up for Kids Food Drive through Second Harvest Food Bank. In Silicon Valley, one in three kids may not be getting enough to eat. Donation barrels are located in the lobby of City Hall, the Police Department and the Recreation Office at the Community Center. The Voter Information guide came in the mail today. There is a special election in Campbell on April 25, CONSENT CALENDAR NOTE: All matters listed under consent calendar are considered by the City Council to be routine and will be enacted by one motion. There will be no separate discussion of these items unless a request is made by a member of City Council, City staff, or a member of the public. Any person wishing to speak on any item on the consent calendar should ask to have the item removed from the consent calendar prior to the time the Council votes to approve. If removed, the item will be discussed in the order in which it appears. Mayor Gibbons asked if any Councilmember or anyone in the audience wished to remove any item from the Consent Calendar. Applicants/Appellants and their representatives may be allotted up to a total of five (5) minutes for opening statements and up to a total of three (3) minutes maximum for closing statements. Items requested/recommended for continuance are subject to Council s consent at the meeting. 9. Public Hearing to Consider the Application of Robert and Jeanne Moore for a Planned Development Permit (PLN ) to Allow the Construction of Two Single-Family Residences and a Tree Removal Permit (PLN ) to Allow the Associated Removal of Protected On-Site Trees on Property Located at 96 E. Rincon Avenue. (Resolutions/Roll Call Vote) Recommended Action: Adopt a resolution approving a Planned Development Permit (PLN ) to allow construction of two single-family residences; and adopt a resolution approving a Tree Removal Permit (PLN ), to allow the removal of on-site protected trees. Senior Planner Fama presented staff report dated March 21, Mayor Gibbons opened the public hearing and asked if there was anyone who wished to speak. There being no one wishing to speak Mayor Gibbons closed the public hearing. Public Hearing to Consider the Planning Commission s Recommendation that the City Adopt a Zoning Text Amendment (PLN ) to Amend Minutes of March 21, 2017 City Council Meeting Page 5

6 Campbell Municipal Code Sec (Site and Architectural Review Permit Required) to Add an Exception to the Site and Architectural Review Process for Minor Additions to Existing Single-Family Residences in the R- 1-8 (Single-Family Residential) Zoning District That are Located Outside of the San Tomas Area Neighborhood Plan. (Introduction of Ordinance/Roll Call Vote) Recommended Action: Take first reading and introduce an ordinance amending Campbell Municipal Code Sec (Site and Architectural Review Permit Required) to add an exception to the site and architectural review process for minor additions to existing single-family residences in the R-1-8 (Single-Family Residential) zoning district that are located outside of the San Tomas Neighborhood Plan. Councilmember Landry stated that she would need to recuse herself from this item because she lives in the Campbell Village Area and has been a past participant in the neighborhood association. Councilmember Landry left the Council Chamber. This is the time and place for a public hearing to take first reading and introduce an ordinance amending Campbell Municipal Code Sec (Site and Architectural Review Permit Required) to add an exception to the site and architectural review process for minor additions to existing single-family residences in the R-1-8 (Single-Family Residential) zoning district that are located outside of the San Tomas Neighborhood Plan. Associate Planner Rose presented staff report dated March 21, Mayor Gibbons opened the public hearing and asked if there was anyone who wished to speak. Marty Sexton, Campbell resident, requested that his neighborhood fall under the R-1-6 permit approval process. Lisa Harmer, Campbell resident, stated opposition to the three-tier Zoning-Text Amendment and submitted her comments for the record. Tina Keller, Campbell resident, requested that the Zoning-Text Amendment be referred back to the Planning Commission to support a single-tier approach for residential home additions. Chris Whitaker, Campbell resident, stated support of the single-tier permit process. Chris Zuleeg, Campbell resident, stated that he would like to preserve the look of his neighborhood. Kristen Johansen, Campbell resident, stated opposition to the three-tier approach and would like to preserve the look of her neighborhood. Minutes of March 21, 2017 City Council Meeting Page 6

7 Maggie Ostrowski, Campbell resident, stated support for a two-tier approach and would like her neighborhood to retain its diversity. Thomas Peterson, Campbell resident, requested his neighborhood to be treated like the R-1-6 neighborhoods and stated support for a ministerial review up to 1000 square feet. There being no one else wishing to speak Mayor Gibbons closed the public hearing. Council discussed a two-tier process and options for square foot criteria. M/S: Waterman/Resnikoff continue this item until the April 4, 2017 City Council meeting and redefine the R-1-8 Zoning district located outside of the San Tomas Area Neighborhood Plan with a two-tier solution; a ministerial review for additions up to 1000 square feet and an Administrative Site and Architectural review subject to appeal by the Planning Commission for additions over 1000 square feet. City Attorney Seligmann advised Council that the ordinance would need to be revised and the Public Hearing would need to be re-opened to continue this item to the next meeting. Mayor Gibbons re-opened the Public Hearing to continue to the next meeting. NEW BUSINESS 11. Live Entertainment Permit AFN Services LLC dba The Social Light, 368 E. Campbell Avenue (Resolution/Roll Call Vote) Recommended Action: Adopt a resolution approving a Live Entertainment Permit for AFN Services LLC dba The Socialight at 368 E. Campbell Avenue with live entertainment being allowed Sunday through Saturday from 5:30 p.m. to 10:00 p.m. Sergeant Dan Livingston presented staff report dated March 21, Council discussed concerns with ADA compliance and additional bar seating issues. 8 M/S: Waterman/Landry adopt resolution denying a Live Entertainment Permit for AFN Services LLC dba The Socialight at 368 E. Campbell Avenue based on the following findings: insufficient information was provided to properly define the location of the musicians; Americans with Disabilities Act (ADA) compatibility has not been defined; the emergency exiting requirements does not appear to be met; the handicap access requirement does not appear to be met; the seating capacity at the bar exceeds previous approvals. City Councilmember Reports/Updates on Committee Assignments Recommended Action: Report on committee assignments and general comments. ADJOURN --Vice Mayor Resnikoff attended the West Valley Sanitation District board meeting; Celebrate Campbell. --Councilmember Landry attended the Association of Bay Area Governments (ABAG) meeting. --Mayor Gibbons attended Assembly Member Low s celebration of Women s History Month; Silicon Valley Clean Energy Board; a showing of the new Heritage Theatre lights; spoke at the American Association of Retired Persons (AARP) meeting; Housing Community Development Authority Committee (HCDAC). Councilmember Landry asked to add an item to a future agenda. City Manager Loventhal stated that for complicated items that a Councilmember would like discussed on a future agenda, a written statement of the requested topic should be provided to him a week in advance.
