1 MINUTES OF THE RESCHEDULED CITY MEETING OF THE CITY OF GROSSE POINTE WOODS HELD ON MONDAY, APRIL 13, 2015, IN THE -COURT ROOM OF THE MUNICIPAL BUILDING, MACK PLAZA, GROSSE POINTE WOODS, MICHIGAN. The meeting was called to order at 7:32 p.m. by Mayor Novitke. The following Commission member was in attendance: Debbie McCarthy, Beautification Advisory Commission Motion by Granger, seconded by Bryant, that all items on tonight's agenda be received, placed on file, and taken in order of appearance. 1

2 Hearing no objections, Item 7B K-9 Division was taken out of order. Motion by Shetler, seconded by Granger, regarding K-9 Division, that the City Council concur with the recommendation of the Committee-of-the-Whole at their meeting on March 23, 2015, and incorporate a K-9 program as outlined by the City Administrator in his memo dated March 16, Board Members from the K-9 Safety Partners of the Grosse Pointes, Officer Dan Schewe, and his canine, Xander, were in attendance at tonight s meeting. A $25, donation check from the K-9 Safety Partners was presented to City Council, and a certificate of appreciation was also presented to the K-9 Board including Jay Fitzgerald-Vice President, Andrew Richner-Legal Counsel, Al Fincham, Mayor Greg Theokas, and James Fox- Retired Director of Public Safety-City of Grosse Pointe. Motion by Bryant, seconded by Shetler, that the following minutes be approved as submitted: 1. City Council Minutes dated March 16, 2015, and March 30,

3 Motion by Granger, seconded by Shetler, that the following minutes be approved as submitted: 1. Committee-of-the-Whole minutes dated March 16, 2015, and March 23, Motion by Bryant, seconded by Granger, regarding rates of pay, that the City Council concur with the Election Commission at their meeting on March 12, 2015, and increase the rate of pay for the seasonal, part-time absent voter office staff to $12.00 per hour. Motion by Bryant, seconded by Granger, regarding Certification of Election Inspectors and Receiving Board, that the City Council concur with the recommendation of the Election Commission at their meeting on March 26, 2015, and approve the rates of pay as presented. Motion by Shetler, seconded by McConaghy, regarding Leisure Interest Survey, that the City Council concur with the recommendation of the Senior Citizens Commission at their meeting on March 17, 2015, and approve the Leisure Interest Survey as amended, and to authorize an amount not to exceed $1, for printing and mailing, funds to be taken from Account No

4 The meeting was thereupon opened at 7:52 p.m. for a Public Hearing to hear the application of Richard Browski, 1766 Littlestone, Grosse Pointe Woods, who is requesting to install a generator in the east side-yard area of the residence at 1766 Littlestone, which request is noncompliant with Section of the City Code. A variance is therefore required. The Building Official provided an overview. Motion by Bryant, seconded by Shetler, that for purposes of the public hearing the following items be received and placed on file: 1. Building Permit Application 03/27/15 2. Letter 03/27/15 R. Motion by Bryant, seconded by Shetler, that the public hearing be closed at 8:00 p.m. PASSED UNANIMOUSLY. Motion by Granger, seconded by Shetler, regarding Generator Variance: Richard Browski, 1766 Littlestone, who is requesting to install a generator in the side yard of his property, that the Council grant a variance to Richard Browski, and approve installation of a permanent 11 kw generator in the east side yard of his property at 1766 Littlestone, in accordance with the survey dated August 5, 1996, contingent upon suitable screening being maintained, based upon the following findings of fact: 1. The subject property is a corner lot and the nearest neighbor would be more than 60 away from the proposed generator; 2. An existing 4 wood fence will provide screening for the generator; 3. Windows, a door, and an existing patio preclude the applicant from installing the generator in conformance with code; 4. The proposed location will have no impact on surrounding residences. The meeting was thereupon opened at 8:04 p.m. for a Public Hearing to hear the application of Ken Honn, 598 Heather Lane, Grosse Pointe Woods, who is requesting to install a generator in the east side-yard area of the residence at 598 Heather Lane, which request is noncompliant with Section of the City Code. Motion by Bryant, seconded by Shetler, that the public hearing be closed at 8:09 p.m. PASSED UNANIMOUSLY. Motion by Granger, seconded by Shetler, regarding Generator Variance - Ken Honn, 598 Heather Lane, that the City Council grant a variance to Ken Honn, and approve installation of a permanent generator in the east side yard of his property at 598 Heather Lane, contingent upon suitable screening being maintained, based upon the following facts: 1. Existing shrubs will provide screening for the generator; 2. Windows, a door, and an existing patio preclude the applicant from installing the generator in conformance with code; 6

7 3. An air conditioning compressor is currently in the side east yard; 4. The proposed location will have no impact on surrounding residences Motion by Bryant, seconded by Shetler, regarding Application for Permit/License Solicitor, that the City Council approve the application of John Case from Edward Jones for a Permit/License to Solicit. Motion by Koester, seconded by McConaghy, regarding Application for Permit to Hold a Parade, that the City Council approve the request to hold the annual Little League Parade on Sunday, May 3, 2015, from 12:45-1:30 p.m., contingent upon receipt of appropriate insurance. Rudi Polumbit provided an overview regarding his request to close the alley to trucks behind Mack Avenue. 8 The City Administrator provided a verbal report. There was a consensus of the City Council to postpone this item for six weeks to monitor traffic and obtain additional information. The City Clerk was asked to notify the affected businesses when this item returns to Council. Motion by Granger, seconded by Shetler, regarding Capitalization Policy, that the City Council approve the GASB 34 Capitalization Policy. Motion by McConaghy, seconded by Koester, regarding Proposed FY Budget, that the City Council receive and place on file the 2015/16 Proposed Budget Summary. The Mayor accepted the resignation of Bryan A. Sunisloe from the Senior Citizens Commission with regret and directed that appropriate thanks and recognition be sent to Mr. Sunisloe. Motion by Koester, seconded by McConaghy, regarding 2014 Planning Commission Annual Report, that the City Council receive and place this report on file. 8

9 Motion by Bryant, seconded by Shetler, regarding 2014 Public Safety Annual Report, that the City Council receive and place this report on file. Motion by Bryant, seconded by Shetler, regarding contract: Janitorial Services for Municipal Building, that the City Council approve a contract with Triple F Commercial Cleaning Services to provide janitorial services for the municipal building from July 1, 2015, through June 30, 2016, in a total amount not to exceed $12, Motion by Granger, seconded by Shetler, regarding contract: Pool Opening, that the City Council approve the contract with B & B Pools and Spas for pool opening services in an amount not to exceed $7,250.00, funds to be taken from the Contractual Services Account No

Arbor Day Motion by Bryant, seconded by Shetler, that City Council voice no objections to the issuance of the above three Mayoral proclamations. Motion by Shetler, seconded by Bryant, regarding Second Reading: An Ordinance Amending Chapter 10 Licensing, Article VI. Peddlers, Vendors, Solicitors Sec (f) License Fees and the Number of Licenses Issued, that the City Council approve this proposed ordinance as presented and make it effective 20 days after its enactment. Yes: Bryant, Koester, McConaghy, Novitke, Shetler No: Granger Motion by Bryant, seconded by Shetler, regarding Second Reading: An Ordinance Amending Chapter 2 Administration, Article VIII Municipal Civil Infractions Sec To Increase the Number of City Officials Authorized to Issue Municipal Civil Infractions, that the City Council approve this proposed ordinance as presented and make it effective 20 days after its enactment. 10
