1 Montville Township Committee Regular Meeting Tuesday, May 8, 2018, 7:00 p.m. Montville Township Municipal Building, 195 Changebridge Road, Montville, New Jersey Statement of Open Public Meetings Act Compliance read by Township Clerk Leena Abaza. Roll call Township Committee: Present: Also present: Committeeman Richard Cook Committeeman Frank W. Cooney Committeeman Matthew S. Kayne Committeewoman June Witty Chairman Richard D. Conklin Victor Canning, Township Administrator June Hercek, Assistant Township Administrator Fred Semrau, Esq., Township Attorney Leena Abaza, Township Clerk Resolution authorizing Closed Executive Session to discuss the following matters as permitted pursuant to NJSA 10:4-12: 1. Contract Negotiations: Police; SRO (School Resource Officer). 2. Potential Litigation: Affordable Housing; Montville Township First Aid Squad. 3. Personnel: Police Candidates. Motion by Kayne second by Witty to approve closed session resolution and move into closed session. All in favor. Resolution adopted. At 7:00 p.m. Closed Session. 8:00 p.m. Public Session Statement of Open Public Meetings Act Compliance read by Township Clerk Leena Abaza. Prayer & Pledge of Allegiance Presentation Water Quality Accountability Act Overview by Sophia Heng, P.E. Municipal Engineer. Montville Township Municipal Engineer Sophia Heng P.E., gave a PowerPoint presentation on the Water Quality Accountability Act (N.J.S.A. 58:31-1) that was signed into law on July 21, The effective date of this law was 90 days after October 19, The presentation focused on proactively improving the safety, reliability and administration oversight of water infrastructure. The Governing Body thanked Montville Township Municipal Engineer Sophia Heng for her presentation. Public Hearings on Ordinances for Final Adoption: Ordinance # ordinance of the Township of Montville, Morris County, New Jersey, authorizing a capital expenditure from the open space dedicated trust fund in the amount not to exceed $1,000 Motion by Cooney second by Witty to open public hearing on ordinance. 1
2 Motion by Cooney second by Witty to open public hearing on Ordinance # No comments. Motion by Cooney second by Kayne to close public hearing on Ordinance # Motion by Cooney second by Witty to adopt Ordinance # Reports: 1. ADMINISTRATOR Administrator Victor Canning reported on the following: Road improvement projects for We will be paving the roads. Administration is providing employees with hostile work place/sexual harassment training. After the past two recent storms, the Department of Public Works (DPW) has been diligently working on cleaning up the tree limbs and branches throughout the Township. He commended the DPW for their hard work. The Township received a $15,244 grant for the Drug Awareness-Municipal Alliance Council. Deputy Mayor Cooney questioned how many roads are covered in 2018 roads project? Administrator Victor Canning reported the 2018 road project covers roads. Deputy Mayor Cooney suggested posting the road improvement project on the website with all the details. 2. ATTORNEY S REPORT Township Attorney Fred Semrau reported on the following: At the next meeting he will have four tax appeals for the Governing Body s consideration. He mentioned and explained the new tax laws that Governor Phil Murphy recently signed. 2
3 3. TOWNSHIPCOMMITTEE LIAISON REPORTS AND COMMENTS Chairman Conklin mentioned the Library Board of Trustees is meeting on Monday night. He reported on three Eagle Scouts that were congratulated this Saturday on attaining the Eagle Scout rank. He also mentioned two events the National Day of Prayer and Touch a Truck were very well attended events. Committeeman Kayne- stated he had no official report. Committeewoman Witty-stated she had no official report. Committeeman Cook- he reported on the annual Little League parade had a great turnout. He mentioned Chairman Conklin threw out the first pitch and did a great job. The Historic Preservation Review Commission met and posted a link on their website for the historical houses in the Township. Deputy Mayor Cooney- he reported on Earth Day. It was a very well attended event and the groups cleaned up streets in the Township. He mentioned the Dog Park Advisory Committee meeting and the committee has a list of requests- it will be submitted to the Administrator. He also reported on the Design Review Committee, spoke about a pet hotel that will open on Boonton Avenue. Old Business: 1. Project Status Report New Business: None. Ordinance Introductions: Ordinance # bond ordinance providing for various capital improvements in and by the Township of Montville, in the County of Morris, New Jersey, appropriating $1,328,475 therefor and authorizing the issuance of $975,000 bonds or notes of the Township to finance part of the cost thereof Motion by Cooney second by Cook to introduce Ordinance # and have the public hearing on May 22, Ordinance # an ordinance establishing the 2017 salaries or wages of officials and employees of the Township of Montville in the County of Morris and method of payment of such salaries or wages - unrepresented Motion by Kayne second by Cooney to introduce Ordinance # and have the public hearing on May 22,
4 Barry Marks, 15 Eugene Drive- He had a statement to read. He stated on behalf of the Directors of Pine Brook Jewish Center, we would like to thank Committeewoman June Witty for coming to our meeting and are accepting of your apology and your ideas you have presented to address anti-semitism in the Township of Montville. We as people and Jews will not forget the Holocaust. Steven Letkowski & Dan Lowe (they work for PSE & G) he stated they work for PSE & G and are responsible for the vegetation project. He mentioned the areas that are in Montville Township and spoke of herbicides to control the vegetation. He also mentioned they are here to educate everyone on vegetation and asking for the agreement that was submitted to the Township to be considered. Administrator Victor Canning responded by stating the vegetation agreement is still under attorney review. He also suggested that herbicides should not be used to protect the aquifer. Chairman Conklin requested a scope of work from the PSE & G that includes an action plan submitted to the Township stating what will be used to control vegetation. Steven Letkowski stated this work will be done Mid-June to September. How would you like to receive the action plan? He mentioned the herbicides that are used is a light application that will not even contact the ground or reach the water. Administrator Victor Canning stated he would like everything submitted electronically. Pradipto Bagchi, 14 Nathan Drive- he stated he would like to address Mrs. Witty. His said he feels that Committeewoman Witty should resign. He mentioned that Mrs. Witty decided not to resign and she requested to be judged by her actions after the Facebook posting. He said he was offended by a comment in which she referred to a Democrat as a Democratic Muslim and questioned if she now separates people in the same party by religion. Committeewoman Witty- she stated that she did not indicate a specific religion when mentioning that person in the interview and that comment was added by the writer. Motion by Cook second by Cooney to close public portion of meeting. Resolution Authorizing Consent Agenda No CA10: Resolution # resolution authorizing the refund of a chimney liner permit fee to RNR Corporation for a property located at 3 Eccleston Court, Montville Resolution # resolution authorizing the issuance of one year solicitor s license Renewal by Anderson for Kyle Lewis Resolution # resolution approving request from the tax collector for cancellation of taxes and refund of overpayment Resolution # resolution approving request from tax collector for refund of overpayment Motion by Cooney second by Kayne to approve the above consent agenda resolutions. 4
5 Resolution # resolution authorizing the refund of a chimney liner permit fee to RNR Corporation for a property located at 3 Eccleston Court, Montville WHEREAS, an chimney liner permit fee in the amount of $ was paid for the issuance of a building permit to install a chimney liner for property located at 3 Eccleston Court, Montville, New Jersey; and location; and WHEREAS, the contractor (RNR Corporation) will not be installing a chimney liner at the above WHEREAS, the Construction Official has recommended a refund in the amount of $152.00; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, County of Morris and State of New Jersey, that the chimney liner permit fee submitted by RNR Corporation for property located at 3 Eccleston Court, Montville, New Jersey, shall be refunded in the amount of $ Department. BE IT FURTHER RESOLVED that a copy of this Resolution shall be forwarded to the Finance Resolution # resolution authorizing the issuance of one year solicitor s license Renewal by Anderson for Kyle Lewis WHEREAS, Revised General Ordinance Chapter 281 requires the issuance of a license by the Township of Montville for canvassing, soliciting, or peddling; and WHEREAS, Renewal by Anderson solicitors have filed applications and all necessary fees for solicitors licenses for the duration of one year; and WHEREAS, the applications conform to the requirements of the Township Ordinance and the Police Department has approved the applications; NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Montville, in the County of Morris, and State of New Jersey, that solicitor s licenses for Renewal by Andersen for one year from the date of issuance be issued to the following applicant: Kyle Lewis BE IT FURTHER RESOLVED that Montville Township s No Solicitation List as per Township Code Chapter (E) be issued to each solicitor upon the issuance of their solicitor s permit. Resolution # resolution approving request from the tax collector for cancellation of taxes and refund of overpayment WHEREAS, property taxes for the year of 2017 & 2018 are to be cancelled due to a 100% disabled veteran exemption, AND, WHEREAS, these property taxes have been paid by the property owner, creating an overpayment of tax; 5
6 NOW, THEREFORE, BE IT RESOLVED that the Tax Collector of the Township of Montville be authorized to cancel taxes for the following and that the Treasurer of the Township of Montville be authorized to draw a check in the amount of overpayment to: Desimone, Richard 42 Old Lane Block 21.1 Lot 38.5 Cancel & Refund 4 th Qtr Days $ st Qtr 2018 $2, Total Refund: $3, Cancel Only: 2 nd Qtr 2018 $2, Resolution # resolution approving request from tax collector for refund of overpayment WHEREAS, due to duplicate payments received creating an overpayment of tax for the year 2018 AND, WHEREAS, it is the recommendation of the Tax Collector that these monies are refunded; NOW, THEREFORE, BE IT RESOLVED that the treasurer be authorized to draw a check in the amount of overpayment to: Corelogic Block: 21.1 Lot: Old Ln $2, Block: Lot: Wedgewood Dr $2, TOTAL REFUND $5, Resolution approving the listing of bills and signing of checks for May 8, 2018 Motion by Cook second by Witty to approve the listing and signing of checks for May 8, Review of Meeting Action Items: 1. Administrator 2. Attorney Reach out to the Superintendent of Schools to discuss the SRO (School Resource Officer) contract language. Follow up on CES Litigation item. PSE & G Easements. 3.
