Adoption of the Minutes of the Kalavista Neighbourhood Committee Meeting held Tuesday, September 8,2009 Moved by Mackay, seconded by Anderson, THAT the minutes of the Kalavista Neighbourhood Committee Meeting, held Tuesday, September 8,2009, be adopted as circulated. No. KNC CARRIED 3. BUSINESS ARISING FROM MINUTESa. Update on Input from the RCMP Regarding a Bylaw to Address the Most Serious and Dangerous Practices Occurring at the Kalavista Boat Launch Chair Hladun reported that he would be meeting wuh S.Sgt. Percy at the Kalavista boat launch on October 8, Mayor Garlick requested that Chairjjjadun solicit S.Sgt. Percy's input regarding how the RCMP would enforce tlyf prbffgsed amendment to the Traffic and Highway Bylaw, whicftwas being draftetfto addressee most serious and dangerous practices occurring ahhe Kalavista boaflaunch, including specific tiedown requirements, prohibiting travdmf District roads with passengers aboard a boat, and provision forlticketing for these offences. The Chief Administrative Officer suggested that the Bylaw Enforcement Officer also attend thej meltmg wjth S.Sgt. Percy. He went on to say that the Commissiona&e'liepo^bn summer 2009 activity would be on the agenda of the October 13, 2009 Council meeting. Tl^e Bylaw Enforcement Officer advised that he was gathering information ^'regarding enforcement limitations between municipalities and the police. Councjllp" p "" t ' entered the meeting at 4:37. A b. Neighbourhood Plan for the Kalavista Neighbourhood Area Committee members stated that they are compiling a list of items for consideration at a future Committee meeting.

Response to Those Who Have Written to Council Expressing Concerns Over the Kalavista Boat Launch Moved by Garlick, seconded by Enns, THAT the Kalavista Neighbourhood Committee recommends to Council that Mayor Garlick be authorized to compose a generic letter and respond to those members of the public who had written to Council expressing concerns over the Kalavista boatjia%nch. Anderson, the Chief Admiiiistr ive Officer advised he would request the Operations Superitaiclent to proyuje a report to Council regarding the status of repairs to the bri3g d ncing over'the culvert on Kalavista Drive. 4. NEW BUSINESS *-%$. - a. Water Licence for Diverting Water froj Kalamalka Lake intolhe Kalavista LagtSon Powerpoint slides from Committed member R. Mackay, dated for reference October 5, 2009' \ / "^ R. Mackay beganjbds presentation by citing the Ministry of Environment's policy that water licencesjnpt used for three years were subject to cancellation. He went on to advise flat acotttajhor had informed him that Sicamous, Salmon Arm, Naramafaand A\ ptbafflf had b een successful in retaining their water licences despite^ot^usin^^pe licences for several years, contrary to the Ministry of Err@pnmeht's policy. m -r *Jjhe Buildmjf Official responded that Ministry officials had stated that if the Diltnctavished to proceed with works under the existing water licence which had beerpfjranted for the diversion of water from Coldstream Creek to the lagoon, any vtsfii along that creek diversion would first require a Section 9 application and engineering design. He estimated that if the estimated $10,000 engineering design were included in the 2010 budget, the earliest that the diversion works could proceed would be in 2011.

6 Minutes of a Meeting of the Kalavista Neighbourhood Committee October 5,2009 Page 4 Mayor Garlick noted that whichever option the District proceeds with - pumping from the lake into the lagoon or diverting water from Coldstream Creek into the lagoon - would have to satisfy Interior Health Authority's standards for water quality. Councillor Enns questioned whether the proposed creek diversion could result in further complications based upon the water quality of Coldstream Creek. R. Mackay spoke to his Powerpoint presentation in support of 41v rt ng water from Coldstream Creek into the lagoon versus pumping waterfrom j a}amalka Lake. f^~ The Building Official explained that if the District were to proceed with diverting water from the creek into the channels leading to the lagoon, the properties flanking the diversion channels would be subject to riparjan regulations when applying for building permits. He went on to sugggst atfcjption whereby the property owners along that section of Coldstrearf wejsk arid property owners along the diversion channels could hire a biologist to"em& ct a Streamside Protection and Enhancement Area assessmemywhich he-eltimated might cost in the range of $10,000. Mayor Garlick advised that the residents in that area could petition the District to establish a specified area whereby the costs^ of diversion works would be added to the property taxes of those-jspecific lands pyer a repayment period, i.e., 20 years. In response to an inquiry, theljhjef Administrative Officer clarified that property owners have the right fo^cut dovfnlthe branches of trees hanging over their property. - > f' - N /- S^, The Chief Administrative Officer reiterated the Ministry's specific limit of 60 gallgns per minute (gpm) net flow into the lagoon. He cautioned that although the exilting-water licence entitled the District to divert water from Coldstream CrMiyhe Ministry would not allow inflow greater than 60 gpm, regardless of the -sourclllhe then explained that it would be almost impossible to regulate the flow of waterajctng an open channel as proposed between Coldstream Creek and the la^qp^lf ^ Msiyor Garlick suggested R. Mackay contact Ministry representatives regarding the options discussed at the Committee meeting. The Chief Administrative Officer pointed out that any future stormwater drainage from Middleton Mountain into the lagoon would be engineered to mitigate the impacts on water quality and flow. 4

7 Minutes of a Meeting of the Kalavista Neighbourhood Committee October 5,2009 Page 5 In response to a question regarding the installation of a weir at the outlet channel between the lagoon and the lake, the Building Official noted that a weir had been included in the first report from the consultant Kerr Wood Leidal. Councillor Besso reported that during a presentation she had recently attended regarding underwater currents in Kalamalka Lake, she had learned that clean water flows into the Kalamalka Lake water supply intake pipe during freshet up until mid-june. Councillor Besso suggested that discussions be held with the Ministry of Environment, Interior Health Authority, and Greater Vernon Water's Senior Water Quality Technologist. She went on to advise that the x streamkeepers workshop she had attended advocated retaining and restoring the riatura^environment around waterways. ^ Committee members concurred that the next steps would be for tr em to canvass more of the residents, obtain additional information regarding the closed culvert or open ditch options along the diversion channel, develop a^questioimaire, and investigate funding possibilities. / - ~ 5. 11 To The District of Coldstreani Attention: Mayor & Council Dear Mayor and Council, Re: Kalavista Neighbourhood Committee/ Lagoon restoration October 15,2009_ ^IIISII b vx-'o-i I live at Kalavista Drive. I am writing to you with regards to your proposed diversion of waterfromthe creek to the lagoon. The article in a recent Morning Star newspaper (attached) reported that this is to be done by way of an open ditch in your R/W behind mine and other neighboring properties. I have serious concerns about this as well about the committee wlio supposedly are representing the residents of Kalavista Dr. For your information I have NEVER heardfromthis committee, they have never communicated or had a meeting with the neighbourhood and until I was directed to your website earlier today I had no idea who they were and what are their terms of reference. To say that "all my neighbors...are in agreement" (if Mr. MacKay actually said this) as reported in the paper, is false. It seems to me that the committee was formed mainly to deal with the boat launce, traffic, parking problems and related issues on Kalavista Dr. From what I am reading in the newspaper it now appears that their agenda has shifted to the lagoon? - without any neighbor consultation whatsoever. Suffice to say is that I do not approve of being represented by a committee which I never hearfrom.white I am not opposed to the restoration of the lagoon I am very much opposed j to having water in an open ditch behind my back yard for the two main reasons: j! ZJ DISTRICT OF COLDSTREAM Firstly I am concerned about an open ditch which will undoubtedly become a breeding ground for mosquitoes and other insects with potential sicknesses for the residents around - for example The West Nile virus. I am therefore strongly opposed to this. Furthermore I do not approve of the committee members cleaning the ditches. How are they going to do the cleaning -digging down to the original level whicli is probably 1 to 2 feet below the current one?, cut down trees - some very large ones?, etc. Do they have liability insurance in case they do damage to neighboring properties? I amfranklysurprised that this is even considered. j Secondly I am concerned that if you were to run water in the ditch it would have the potential to { back up into my storm drainage system and potentiallyfloodingmy crawl space as well as I underrnining the footing of my house. For the record I am in the final process of building an j addition and as part of receiving the building permit by your Building Inspector I had to install perimeter and roof drains, dig up my entire back yard so that I could have the drains exiting into ; the ditch.
