Update on Flooding The Chief Administrative Officer confirmed that the District was still at Emergency Operation Centre Level 1 - Monitoring and that he was in daily contact with provincial ministries and the Provincial Regional Emergency Operations Centre in Kamloops with respect to current flooding events and forecasting the resources required as the flood waters recede. 4.c. District Property at Kalamalka Road In response to a question from Councillor Taylor, the Chief Administrative Officer advised he would check Council's previous resolutions regarding work to be done on the District property at Kalamalka Road. 5. 7 District of DISTRICT OF COLDSTREAM Coldstream REPORT/RECOMMENDATION TO COUNCIL FROM: Patricia (Pat) Higgins FILE NO Director of Financial Administration DATE June 6, 2017 SUBJECT: Parks Asset Investment Plan 1. Purpose: To provide the Committee with the 25 Year Parks Asset Investment plan for their review and discussion as previously requested at a Finance meeting held on December 12, Recommendation:.THAT the report from the Director of Financial Administration dated June 6, 2017 regarding the Parks Asset Investment Plan be received for information. AND THAT replacement of Park Assets as scheduled in the Parks Asset Investment Plan be included in the Capital projects report that is brought to Council during the annual budget deliberations. 3. Alternatives & Implications N/A 4. Discussion/ Analysis In 2016, staff compiled an inventory of the assets within each park (attached Appendix "A") and presented it to Council during the 2017 budget meetings. This Asset Investment Plan is a long range planning document that provides the va lue and anticipated useful life of the asset portfolio, and is intended to improve the District's ability to forecast the cost to replace existing assets. It is also a living document that will be updated as assets are replaced or disposed of. A closer look at each classification and sub category is broken down below and identifies assets that are near the end of their useful life EQUIPMENT: While the mowers, tractors and trailers are currently being funded through the Equipment Replacement Reserve, other equipment as noted below are not. Playgrounds Most of the playground equipment within the parks are in relatively good repair with the exception of the equipment at Stenquist Park which is budgeted to be replaced this year. Picnic Tables & Benches There are curre ntly 26 picnic tables and 33 park benches within the District parks. The estimated value of each table is in the $2,500 range and benches are $500 with a useful life in the yea r ran ge, but there is a possibility of damage that can occur due to vandalism. In this rega rd, staff have Page 7 of 26

8 pooled the picnic tables & benches together and have allocated $5,000 annually to replace up to two tables if required. Signage While there are several parks that have small signage and their replacement can be funded through operations, (ie. Morphet Dog Park & the Cemetery), other signage as.identified in the investment plan are of greater value and funds are required to replace the assets within the next years. Marker Bouys There are a total of 40 marker buoys at the District beaches and boat launches with an estimated replacement value of $2,000 each. Staff have pooled the bouys and have allocated $4,000 annually to replace up to 2 bouys if required. BUILDINGS: Included in this asset category are the picnic shelters at Coldstream and lavington Park as well as the washroom facilities at the Coldstream, lavington and Sovereign Parks. It should be noted that the WI Hall, log Cabin and Sovereign House although within the District Parks have been removed from the Parks Asset inventory for this purpose as repairs/upgrades are being funded through the Building Reserve Fund. While there are no immediate needs at either the washroom facilities or picnic shelters, upgrades and/or replacement ofthe buildings will be required within 5-10 years. LAND IMPROVEMENTS: General Included in this asset sub category are any assets where the land has been enhanced or improved. This includes things like the cenotaphs, cemetery improvements, skateboard park, tennis courts, retaining walls and the lavington swimming pool. Staff have assessed that the majority of the assets are in good repair. Parking lots There are only 3 parking lots within the District parks that are paved with asphalt and separate from the main roadway. All remaining lots are either gravel or can be replaced under our Pavement Management Plan (Lisheen, long lake Beach and lavington Park) There are no concerns or major improvements anticipated within the next 20+ years. Boat launch Ramps There are four concrete ramps at various boat launches in the District that have been inventoried with several ramps in need of repair. The Westkal boat launch ramp is in poor condition and is identified to be replaced in the 2017 budget as well as the wharf which is categorized separately. Stairs & Pathways The stairs and pathways within the District parks have been categorized together. It is estimated that the lifespan of these assets is betwee.n years depending on type of construction and usage. There is no immediate action recommended to be taken at this time and while the assets have been scheduled to be replaced over the 25 year plan, staff will assess the necessity to replace at the time of scheduled replacement. Fencing Most of the fencing within the District parks are either chain link or wood posts and rail. Staff have pooled these assets together and have allocated $8,000 annually to replace fencing as required. Page 8 of 26

9 Lighting There are several parks that have lighting and all are in good repair. The estimated life span of the lighting is between years and there is no scheduled replacement of the lights until OTHER: Wharfs Of the wharfs inventoried, staff have identified that the wharf at Westkal boat launch is in need of replacement and is budgeted for replacement this year. Bridges There are two bridges, one each at Coldstream Creek Park and Cenotaph Park. It is anticipated that the lifespan of the bridges is in the range of years. There is no immediate need to replace either bridge at this time. 5. Strategic Objectives Sustainable Infrastructure has been identified as a Council priority. 6. Legislative Authority N/A 7. Financial Implications At the December 12, 2016 Finance Committee meeting, staff advised that to fund the 25 year Parks Asset Investment Plan the annual adjustment required would be $94,625 for a total of $125,700. 13 District of DISTRICT OF COLDSTREAM Coldstream REPORT/RECOMMENDATION TO COUNCIL FROM: SUBJECT: Patricia (Pat) Higgins Director of Financial Administration Parks and Public Spaces Amendment Bylaw FILE NO Bylaw 1700,2017 DATE June 12, Purpose: For the Committee to recommend to Council that District of Coldstream Parks and Public Spaces Regulation Bylaw No. 1651, 2014, Amendment Bylaw No. 1700, 2017, Amendment No.5 be given first three readings. 2. Recommendation: THAT "District of Coldstream Parks and Public Spaces Regulation Bylaw No. 1651, 2014, Amendment Bylaw No. 1700, 2017, Amendment No.5" be read a first, second and third time by title only. 3. Alternatives & Implications There are a number of options for the Committee to consider at this time. Option #1- Increase the Fees & Charges 2.6% Under this option the District would proceed with the 2.6% increase as proposed in the attached bylaw. This is consistent with the process undertaken in previous years. This ensures that the rates within Greater Vernon are consistent through all jurisdictions. Accordingly, this is the recommended option for the 2017 /2018 year. Option #2: Do Nothing Under this option we would leave the current rates as they are and make no adjustments. This option is not preferred as it would create differential rates between jurisdictions and not "keep up" with the cost to operate the parks and facilities. On the positive side, the users would be paying the same rates as they are now. Option #3: Amend the Fees & Charges to some other rate This option would provide flexibility to increase or decrease the rates to some other amount. This option would create a differential rate between jurisdictions in Greater Vernon that could work for or against us. The existing rate structure is based on a well-established formula that considers the cost to provide the service. This option is not recommended for 2017 /2018 year. 4. Discussion/ Analysis On an annual basis the Fees & Charges for Parks and Recreation are reviewed considering three factors: cost analysis, market comparison and local economic conditions. The formula that is used has been in place for many yea rs. Schedule 11 B" attached to this report shows the historical cost increases applied to past Fees and Charges. Page 13 of 26

14 The cost analysis prepared by the City of Vernon incorporates three components: Wages (45%), Utilities (35%) and Materials (20%). The market comparison examines rates charged by similar municipalities and an assessment of the local economy looks at what the market can bear. The analysis has been completed for 2016/2017 and using strictly the formula, shows an estimated 2.24% increase is required. However, when factoring in the other two components an increase of 2.6% is being recommended. The attached bylaw contains the proposed changes in red that would enact a 2.6% increase. There is one fee which has not been adjusted based on previous Council direction and that is the Special Event rate for the full day rental of the Lavington Park. The review of the Fees and Charges has been guided by the previous Policy GVSC 6001 of the Greater Vernon Parks, Recreation & Culture Policy (October 13, 2005). The policy states: 1. All facilities and programs are available to Greater Vernon residents without barrier which discriminate on the basis of sex, race, religion or financial limitations. This is further interpreted that: a. Residents will have some access to all facilities at no direct cost to the user b. Programs for physically challenged individuals will be provided on the basis of demand 2. Tax appropriation will be the primary source of funds for the operations of Greater Vernon Services 3. User fees will supplement the cost of operations on the following basis: a. Adult recreational programs and senior programs will recover all operational costs including overhead cost of the division/facility but excluding general administration cost and capital. b. Children's programs and disabled person's programs will be subsidized to a maximum of 50% in existing facilities, excluding the Multiplex, Performing Arts Centre or other new facilities c. Non-basic services will be charged on the basis of what the market will bear, but at least 100% cost recovery. As the Parks Master Plan has now been adopted, Council will need to establish objectives around fee structure for our parks and recreation infrastructure. We now have some reliable data to assist us in being able to provide options for rate setting on a go forward basis. A complete analysis of the revenues and expenditures for each park will be completed and brought forward to Council prior to the rate setting for the 2018/2019 year. 5. Strategic Objectives Providi_ng parks and open space within the District provides a diverse, high-quality recreational experience that meets the needs of the community. 6. 16 DISTRICT OF COLDSTREAM BYLAW NO. 1700, 2017 A BYLAW TO AMEND SCHEDULE 'B' OF THE PARKS AND PUBLIC SPACES REGULATION BYLAW NO. 1651, 2014 WHEREAS Council for the District of Coldstream wishes to amend the rental rates for the use of parks and public spaces in the District of Coldstream, NOW THEREFORE, the Council of the District of Coldstream ENACTS AS FOLLOWS: TITLE 1 This Bylaw shall be cited as DISTRICT OF COLDSTREAM PARKS AND PUBLIC SPACES REGULATION BYLAW NO. 1651, 2014, AMENDMENT BYLAW NO. 1700, 2017, AMENDMENT NO. 5. INTERPRETATION 2 Unless otherwise provided in this Bylaw, words and phrases used herein have the same meanings as in the Community Charter, Local Government Act and the Interpretation Act as the context and circumstances may require. 3 A reference to an Act in this Bylaw refers to a statute of British Columbia, and a reference to any statute, regulation, bylaw or other enactment refers to that enactment as it may be amended or replaced from time to time. 4 Words in the singular include the plural, and words in the plural include the singular. 5 Headings are for convenience only and must not be construed as defining or limiting the scope or intent of the provisions. SEVERABILITY 6 If any part of this Bylaw is held to be invalid by a court of competent jurisdiction, the invalid part is severed and the remainder of the Bylaw continues to be valid. SCHEDULES 7 Schedule 'B' of Bylaw No. 1651, 2014 is hereby repealed in its entirety and replaced with Schedule 'B' as attached to and forming part of this Bylaw. 8 Proposed rates set out in Schedule B shall come into effect on September 1, Page 16 of 26

18 District of Coldstream Parks and Public Spaces Regulation Bylaw No. 1651, 2014, Amendment Bylaw No. 1700, 2017, Amendment No. 5 Page 3 Interpretation: Schedule B Park Fees It is necessary to define the segments of the population for which the parks fees apply. Youth: Seven to eighteen years of age Adult: Nineteen years of age and over (19+) Family: Disabled: Means members of an immediate family and includes parents, legal guardians or grandparents and dependent children who are under the age of 19. Maximum of two adults and youths who are immediate family members. Means people having a permanent disability which would limit their abilities to fully use the facility without assistance. If the disability is not physically apparent, a doctor s certificate may be required. Support workers are admitted free unless the support worker is paid, then the support worker pays regular fees. Resident Business: A business that is operating within the Greater Vernon boundaries, and with a valid City of Vernon or District of Coldstream business license. General Conditions for Rental of Facilities 1. All rental rates include the standard facility, with normal maintenance staff. 2. Ushers, ticket sellers, security forces, etc. are the responsibility of the Renter (the District reserves the right to provide such services at the Renter s expense). 3. Uses beyond the normal operating hours will require payment of additional labour costs. 4. The District of Coldstream reserves the right to require a Performance Bond and/or Damage Deposit. 5. The Renter is responsible to ensure that the facility is vacated at the end of an event. 6. Entrance to or use of facilities will only be requested and approved on the Rental Agreement. Prior entry for decorating, set up, etc. will be noted on the application form. Page 18 of 26

The Rental Agreement must not exceed the maximum capacity allowed for the facility. 8. The Renter shall be responsible for loss or damage and assume all risk of injury (including death) to any person arising out of the use of the facility. 9. All rentals must carry a liability insurance policy specifically naming as co insured, the District of Coldstream. 10. Facility Use Agreement: Prior to the use of any facilities, the Renter must complete a Facility Use Permit. This document includes a waiver or release which must be read by the participant before signing. Staff must make sure the waiver is read by the participant before signing. If the participant requests an explanation of the meaning of the waiver, the staff shall respond as follows: The document you are asked to sign is a release of liability. It is a legal document and by signing the release you are giving up certain legal rights, including the right to sue should you be injured during the event or activity. Under no circumstances is the document to be signed without drawing the participant s attention to the waiver, and confirming that the proper liability insurance coverage is in place. 11. All occasional/one time renters will also be charged an insurance fee according to the Municipal User Liability Insurance Policy. This applies to renters who do not already have liability insurance through their organization. Page 19 of 26

Recreation Programs 7 to 18 years of age (50% of Adult Rate) 19 years and over (Full Adult Rate) Rates are flexible to accommodate new trial programs and maximize use of facility space. B. School District No. 22 During school hours (8:00 am to 3:30 pm) Outside school hours community youth rates apply (This includes all schools within School District No. 22) C. Community Use I. Adult Local community benefit activities, Winter Carnival events, community concerts, Okanagan Symphony, wedding receptions, closed functions, religious events. This category applies to all local groups, clubs, etc. whose event is closed to their members only. II. III. Youth This category applies to any youth group where 80% of the participants are 18 years of age and under. The rate will be 65% of the Adult Rate. Minor Sports Groups Groups identified below qualify for 50% of the Adult Rate. Local minor sports organizations currently include: Greater Vernon Minor Hockey Vernon Figure Skating Club Vernon Kokanee Swim Club Vernon Minor Lacrosse Greater Vernon Ringette Association Vernon Speed Skating Club Vernon District Minor Baseball North Okanagan Youth Soccer Association Vernon Minor Football Greater Vernon Minor Fastball Page 20 of 26

Resident Business Advertising, sales or promotions by local resident businesses. Must take out a business licence for the event. II. Non Resident Business Advertising, sales or promotions by non resident businesses. Must take out a business licence for the event. E. Private Sponsored Entertainment Public dances, open functions, films, theatre productions, variety shows, political functions. I. Local Entertainment brought to the facility by a local, registered non profit society. II. Out of Town Entertainment brought to the facility by non resident groups. F. Other As per individual group contracts or any other items needing a payment category. G. Setup/Takedown and Conversion Cost for a set up or take down day for event rentals. NOTE: All rental fees are pre tax and all drop in fees include tax. Page 21 of 26

A booking deposit of One Hundred Dollars ($100.00) is required with the Facility Rental Application Form. This fee is fully refundable if the rental is cancelled more than thirty (30) days before the event date. If cancellation is less than thirty (30) days the Booking Deposit is not refundable. 2. Total rental fee is payable thirty (30) days in advance of the event. Credit may be granted to local community groups. Arrangements must be made prior to the date of booking with the District of Coldstream Director of Financial Administration. Such arrangements will be noted on the Facility Rental Application Form. Example: local service clubs 3. If a Performance Bond is requested, the bond (certified cheque or cash) shall be deposited prior to the event. The Performance Bond shall be in the amount of One Thousand Dollars ($1,000.00). However, the District of Coldstream may require additional damage deposits. After completion of the event, the District of Coldstream Director of Financial Administration will authorize a refund of the deposit. Page 22 of 26
