1 DISTRICT OF LILLOOET BYLAW NO. 290 A bylaw to Regulate the use of the Seton Lake Dock and Boat Launch WHEREAS the District of Lillooet has entered into a Licence of Occupation Agreement with Land and Water British Columbia Inc. for the area known as the Seton Lake foreshore, legally described as District Lot 3076 together with all that unsurveyed Crown foreshore being part of the bed of Seton Lake and fronting on road, all of Lillooet District, containing 0.11 hectares, more or less, and as outlined in Licence No ; AND WHEREAS the District of Lillooet has provided a dock and boat launch at this site; AND WHEREAS the Community Charter authorizes Council to regulate, prohibit and impose requirements, NOW THEREFORE, the Council of the District of Lillooet, in open meeting assembled enacts as follows: 1. This bylaw may be cited as Seton Lake Dock and Boat Launch Regulation Bylaw 2007, No INTERPRETATION 2. In this bylaw: Boat Launch means the boat launch provided at the Municipal Dock. "Bylaw Enforcement Officer means a person designated by the District of Lillooet Council to enforce the District of Lillooet s bylaws and for the purpose of administering and enforcing this bylaw Charter Boat means any vessel or watercraft used primarily to transport passengers who have paid a fee for tourism services including, but not limited to, fishing, sightseeing or diving. "Chief Administrative Officer or CAO means the Chief Administrative Officer for the District of Lillooet; Commercial Craft means a vessel used primarily for commercial or industrial undertaking of any kind or nature. "Council" means the District of Lillooet Municipal Council; Length means the horizontal distance measured between perpendiculars erected at the extreme ends of the vessel.

2 Seton Lake Dock and Boat Launch Regulation Bylaw 2007, No. 290 Page 2 Municipal Dock means the facility located on Seton Lake on the License of Occupation area registered under Licence Number , and operated by the District of Lillooet. Oversized Craft means any boat exceeding 26ft. (7.92 metres) in length or 7000lbs ( kilogram) Parking Area means that area provided and regulated by T it q et Administration to provide parking for users of Seton Lake. Pleasure Craft or Recreational Vessel means any watercraft or vessel, other than Oversized Craft, used for recreational purposes. REGULATIONS 3. Pleasure Craft may only moor at the Municipal Dock for the purpose of loading and unloading of persons and/or supplies and shall not be moored for longer than 20 minutes. 4. Charter Boats, Commercial Crafts and Oversized Crafts are prohibited from mooring at the Municipal Dock. 5. No Commercial activity shall be conducted from the Municipal Dock. 6. No repair or service to boats or vehicles shall take place at the Municipal Dock, boat launch or any parking area. 7. No person or persons shall park or leave standing any vehicle on the approach to or on the wharf head, except for the purpose of loading or unloading persons and/or supplies. 8. No person or persons shall park or leave standing any vehicle in such a way as to obstruct traffic. 9. Parking is prohibited other than in the designated parking area provided and regulated by T it q et Administration. 10. No person shall cause any damage, or permit their vehicle or craft to cause damage to the Boat Launch, Municipal Dock or Parking Area. 11. No person shall remove any notice affixed or placed on any vehicle or craft, under authorization of this bylaw, unless he or she is the owner or operator of such vehicle or craft. 12. No person shall remove, alter, deface, cover up or damage any posted signs or notices pursuant to the provisions of this bylaw. LIABILITY FOR DAMAGES AND COSTS 13. In addition to all other penalties herein provided, any person causing damage, or any person being the owner or operator of a vehicle or craft that has caused damage to the boat launch, dock or any parking area, shall be responsible for the cost of repairing such damage.

This bylaw does not apply to: (1) Police, Fire, Ambulance or other emergency personnel responding to an emergency. (2) District of Lillooet Public works department, or agents acting on their behalf, conducting repairs or construction on the docks, boat launch and parking area. 15. Section 3 of this bylaw does not apply to owners or occupiers of residential property along Seton Lake where primary access to their property is by boat and who have made application to and received written approval from the District. Limitations on their use of the dock may apply. MUNCIPAL TICKET INFORMATION PROVISIONS 16. This Bylaw is designated pursuant to Section 264 of the Community Charter, as a bylaw that may be enforced by means of a ticket in the form prescribed 17. For the purpose of this bylaw, the designated Bylaw Enforcement Officer means any of the following: (1) Bylaw Enforcement Officer (2) Director of Public Works (3) Public Works Foreman (4) Chief Administrative Officer (5) Members of the RCMP (6) Peace Officers 18. The words or expressions listed in Schedule A of this bylaw in the Offence column are authorized to be used on a ticket pursuant to section 264(1)(c) of the Community Charter to designate an offence against the respective section of this bylaw appearing opposite in the Section column. The amounts appearing in the Fine column are the fines set pursuant to section 265 of the Community Charter for contravention of the respective section of this Bylaw appearing opposite in the section column. 19. The Bylaw Enforcement Officer shall refer every disputed ticket to the Provincial Court for a hearing.

Every person who violates any provisions of this bylaw, or who suffers or permits any act or thing to be done in contravention of this bylaw is liable on summary conviction to a fine of not more than ten thousand dollars ($10,000.00) and costs (including the costs of committal and conveyance to the place of imprisonment) for each offence, and in default of payment therefore, to imprisonment of a term not exceeding six months in jail. Each day that such violation is permitted to continue shall be a separate offence. SEVERABILITY 21. If any provision of this bylaw is held to be invalid, it shall be severed and the remainder of the bylaw shall remain in effect.
