1 Cedar Highlands Homeowners Association Board Meeting August 28, 2017 The Directors of the Cedar Highlands Homeowners Association (CHHOA) held their monthly board meeting on 08/28/2017 at the Cedar City Library Classroom. Board Members present: Beth Gaines, Linford Nelson, Linda Stetzenbach, and Steve Swann. Susan Allman, Ann Bursi, Julie Brask, Jim Byler, Paula and Glen Crawford, Jay and Cathy Hampton, Peg Hilton, Mark and LynAnn Imlay, Colin and Phyllis Irving, Daylee and Larry Miracle, JoAne Olds, Fran Poole, Robin Day, Ankara Rosser, Janice Swann, and Reggie Tashjian attended as property owners. A representative from Kelley Security was present to ensure decorum during the meeting. 1. Call to Order: The meeting was called to order at 5:30 p.m. 2. Approval of Minutes: The June minutes had been approved via and posted to the web site. 3. President s Report: Steve distributed the agenda for the meeting. He welcomed the guests and outlines the meeting format. 3a. Steve reminded everyone that the Annual Meeting and Potluck lunch is Saturday, September 2 nd at the home of Rod and Darcee Yates, Block 4, Lot 17. Linda will be posting a sign at the corner of the main road (High Cedar Highlands Drive) and High Cedar View to assist property owners in finding the location. 3b. Linda reported that the HOA had purchased the hamburgers and hot dogs, plates, bowls, silverware, napkins, trash bags, and paper towels and that the HOA will also provide condiments, beverages, ice, and buns. Property owners are asked to bring a dish to share such as a dessert, salad, side dish, or appetizer. She asked that volunteers arrive early (e.g., 10:30 am) to assist in setting up tables. Steve also reminded property owners to bring lawn chairs and for some to assist in clean up after the meeting concludes. 3c. Steve said that during the Annual Meeting a vote for incoming HOA board members will be held and during vote tally the candidates for Mayor and City Council will have an opportunity to give a brief statement followed by questions of the candidates by attendees of the meeting. 3d. Steve then announced that Ben Reusch, the HOA attorney, had been served with a lawsuit filed by property owners Bib Bible and Lorin Brown. Ben is reviewing the filing and will advise the HOA Board and attend the annual meeting to provide more information to
2 property owners. Linford Nelson is cited within the filing. Therefore, on advice of the HOA Attorney, he will be censured from HOA Board discussion regarding the lawsuit. Steve said that he would look into potential expenses for the HOA s defense and the HOA insurance policy regarding lawsuits. The HOA Board will retire to an Executive Session at the conclusion of tonight s meeting. 4. Committee Reports: Financial - Dues Beth reported that all 2016 dues have been paid. She also reported that 2017 dues have been collected from 96% of subdivision properties with 10 lots still owing 2017 dues. - Current Balances Beth reported a current balance of $22, in the HOA Money Market Account and $79, in the General Account. Total Cash balance is $101, (see attachment), but that includes $19,000 in refundable construction monies due to homeowners when their construction is completed and all debris removed as noted by the asterisk (*) leaving approx.. $80,000 in available funds. Architectural (ARC) - Linda reported that six (6) residences are currently under construction. - Linda reported that Greg and Leslie Pierce, Block 6, Lot 3, have submitted an application for a dog fence enclosing the area below their west deck. Linda moved that the application be approved and Beth seconded the motion. The motion passed. - Linda also reported that she and her husband have an application for a shed to present. She stated that the exterior will match the existing residence and detached garage. Beth moved that the application be approved and Linford seconded the motion. The motion was approved. - Some property owners near High Juniper and High Cedar View reported that the construction at Block 2, Lot 11 has resulted in trash and construction debris in the area. Steve said that he would contact the responsible parties and have them clean the area. All property owners are reminded of the CC&R requirements when building or making any exterior improvements/changes to their structure(s). CC&Rs and the forms to submit are listed on the HOA website Fire - Linford and Steve both had spoken with John Schmidt (Forestry, Fire and State Lands [FFSL], Southwest Area Office) and reported that he said that there will be chipping in
3 October within the subdivision unless there are fires in the region that require manpower elsewhere. - Linford stressed that property owners should submit the form found on the FIRE tab of the web site for each activity to remove fuels from their property and to include expenses if the work was hired out. These forms are important as the subdivision gets in kind reimbursement for chipping and other FFSL activity within our boundaries. The forms should be sent to: John Schmidt, FFSL Southwest area 646 N. Main Street Cedar City, UT All property owners are reminded to review the Guidelines for Clearing Property and Constructing Piles for Chipping or Burning (see FIRE tab) supplied by the FFSL that included thinning and clearing burnable fuels from their properties and place trimmed pieces on the side of the road for future chipping efforts. Roads Linda and Steve reported that fall road repairs are needed with application of state spec road base, water, and compaction. A bid was submitted by Bulloch Dirt Works totaling $29,905 to work on five areas of greatest concern. Beth made a motion to authorize that amount and Steve added an amendment to additionally authorize up to $5,000 to repair some culverts that span roadways. Linford second the amended motion. Linda expressed some concern for these expenditure due to the recent filing of a lawsuit against the HOA by two property owners (see above) and the likelihood that we may have high snowplowing bills this winter. The motion passed unanimously. 5. Property Owner Questions/Comments: - Larry Miracle expressed concern for the increased traffic and speeding of greater than the 15 mph limit on the main road following the designation of the main road as a BLM ATV trail and the two new hiking/biking trails near the corral. Others agreed that the traffic has increased and is causing higher levels of airborne dust and noise in the subdivision. - Ann Bursi briefly mentioned that the side roads are limit to property owners and guests and Glen Crawford spoke to the historical perspective of the main road and the subdivision. - Regina stated that she has three names to serve as a tally judge for the election. They are Peg Hilton, Teri Saa, and Bob Havens. 6. Next Meeting: The next meeting will be scheduled following the Annual Meeting on Saturday, September 2 at the home of Rob and Darcee Yates (Block 4, Lot 17) as voting then will decide the appointment of two Board members.
4 7. Adjourn: The open meeting was adjourned and Beth, Steve, and Linda remained for the Executive Session. As stated above, Linford was not present on advice of the HOA attorney. The Executive Session was adjourned at 5:30 pm. Respectfully submitted by Linda Stetzenbach.
