1 MINUTES OF THE OTTER TAIL COUNTY BOARD OF COMMISSIONERS Government Services Center, Commissioners Room 515 W. Fir Avenue, Fergus Falls, MN 8:30 a.m. Call to Order The Otter Tail County Board of Commissioners convened at 8:35 a.m. on Tuesday,, at the Government Services Center in Fergus Falls, MN, with Chairman John Lindquist, Vice-Chair Lee Rogness, and Commissioners Doug Huebsch, Wayne Johnson and Roger Froemming present. Approval of Agenda Chairman Lindquist called for approval of the agenda. Motion by Johnson, second by Rogness, and unanimously carried to approve the Board of Commissioners agenda of with the following changes: Report Regarding Use of Public Lands Moratorium on Solid Waste Haulers Licenses Update on Dock Ordinance Canceled Community Services Committee Consent Agenda Motion by Johnson, second by Froemming, and unanimously carried to approve Consent Agenda items as follows: 1. Lakes & Prairie Community Action Amendment for Child Assistance Program to Extend Services to 12/31/15 5. Approve Exempt Permit for Holy Cross Church for an Event on September 13, 2015 Bid Award Skid Steers Recycling Manager Rick Denzel presented bids for Skid Steers for the Recycling Center. Motion by Johnson, second by Huebsch, and unanimously carried to approve the purchase of two Caterpillar 242D Skid Steers from the State Bid at a purchase price of $41, each as recommended by Solid Waste Officials. One Skid Steer was budgeted as a capital expenditure in 2015 ($47,500) and the second Skid Steer will be purchased instead of two budgeted compactors. Solid Waste Haulers License County Attorney David Hauser submitted a copy of a Memorandum of Understanding addressed to Alex Rubbish and Recycling, Inc. of Alexandria, MN. Alex Rubbish and Recycling, Inc. intends to purchase Corrie s Sanitation, an existing licensed hauler in Otter Tail County, and has applied for a solid waste haulers license. Motion by Rogness, second by Froemming, and unanimously carried to approve a solid waste haulers license as requested by Alex Rubbish and Recyling, Inc. subject to the Memorandum of Understanding as presented by the County Attorney. The motion authorizes the appropriate County signatures to execute the agreement.

2 Page 2 Parking for Waterfowl Production Area Commissioner Wayne Johnson spoke about the need for a parking area for the Backstrom Waterfowl Production public land. An easement alongside the bridge has been approved for the water trail access project. A parking area could be created using the public lands in the area to alleviate parking along Highway 28 that occurs so the public can access/use the land for hunting and other recreational purposes. He encouraged the State Department of Natural Resources and the U.S. Fish and Wildlife Service to work together on projects when possible. TA FORFEITED LAND APPLICATION FOR CONDITIONAL USE DEED Otter Tail County Resolution No Upon a motion by Commissioner Froemming, the following resolution was offered: WHEREAS, the City of Henning on Tuesday, June 16, 2015 passed Resolution No requesting acquisition by Conditional Use Deed, the following described property located within the City of Henning: Section 23 Township 133 Range 38 Original Plat Henning Lots 15 and 16 Block 8 WHEREAS, Minnesota Statute Subdivision 1a Paragraphs (e), limits the authorized public uses for Conditional Use Deed to road or right-of-way for a road, trails, transit facilities, public beach or boat launch, public parking, civic recreation or conference facilities, parks, and public service facilities, and WHEREAS, the City of Henning has indicated that the above referenced property will be used as a civic recreation/conference facility and makes the following statement in support of their request to acquire the above reference parcel by Conditional Use Deed: To be used by the general public for concerts, plays, conferences and events. The City of Henning wishes to acquire Parcel Number for public events. The general population will benefit from this in that there is not currently a facility to house civic recreation events such as concerts and plays. A Handicap accessible entrance will be added so that the facility will be available to all members of the community. NOW, THEREFORE, BE IT RESOLVED, that the Otter Tail County Board of Commissioners hereby supports and approves the City of Henning s request to acquire by Conditional Use Deed the following described property within the City of Henning for the authorized public uses as stated above: Section 23 Township 133 Range 38 Original Plat Henning Lots 15 and 16 Block 8 The motion was seconded by Commissioner Rogness and carried, with the members of the Otter Tail County Board of Commissioners voting as follows: Board Members - For Against Absent Doug Huebsch Wayne D. 3 Page 3 Adopted and signed this 14th day of July 2015 Dated: Attest: Larry Krohn, Clerk OTTER TAIL COUNTY BOARD OF COMMISSIONERS By: John Lindquist, Chair Sale of Property to Adjacent Landowners Motion by Johnson, second by Rogness, and unanimously carried to authorize the private sale to adjacent landowners for the following described parcel of tax forfeited land subject to township approval: Part of the Northeast Quarter of the Northwest Quarter (NE1/4 NW1/4) of Section No. Thirty-five (35) in Township No. One Hundred thirty-three (133) North of Range No. Thirty-seven (37) West of the Fifth (5 th ) Principal Meridian, a strip of land along the East line of said forty One (1) road wide east and west and Eighty (80) rods long North and South containing one half acre Otter Tail County Tax Parcel Dog Bite Hearing David Hauser opened a Public Hearing under the Otter Tail County Animal Health Control Ordinance. Mr. Hauser indicated that a report has been made that a German Shepard dog named Tazer owned by Lois & Eugene Bogenreif has caused a dog bite of substantial bodily harm. Ms. Bogenreif agreed that the bite did occur on May 28, 2015 and under state statute caused substantial bodily harm. Public Health Nurse Jessica Metzger provided a recommendation that the dog, Tazer be microchipped, placed in a separate room when visitors are coming to the home, and on a leash when outside. Motion by Huebsch, second by Johnson, and unanimously carried to find that the dog Tazer is a potentially dangerous dog and the owners must abide by the recommendations of the Public Health Department. The County Attorneywill draft an Order of Findings and Fact in the case for approval by the Board at their next regular County Board meeting. Animal Health Control Ordinance Discussion Jessica Metzger spoke briefly about dogs running at large throughout the County, specifically around the lakeshore properties. During the summer tourist season, the population increases and there is a tendency to treat the area as rural and allow dogs to run loose. Gary Garvey and Janice LaPatka spoke about their experiences with dogs running lose from the Henry Farm by Franklin Lake. Lengthy discussion took place regarding animal behavior, dogs biting humans, and dogs biting other dogs. Issues with other animals such as cattle and pigs getting out of their fenced areas and causing damage were discussed. Sheriff Schlueter suggested contracting with townships for animal enforcement. Ms. LaPatka requested something be done regarding the Henry dogs attack on her dog and referred to M.S The County Attorney indicated that the County would need to adopt an Ordinance that included dogs biting other dogs. The County s current Ordinance addresses dogs biting humans. Motion by Johnson, second by Huebsch, and unanimously carried to direct the County Attorney to research what can be done under the law regarding dogs biting other dogs and report back to the County Board. Recess & Reconvene At 10:46 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a short break. The meeting was reconvened at 10:53 a.m.

4 Page 4 Human Services Department Reports Human Services Director Deb Sjostrom briefed the Board regarding the Human Services budget from January 1, 2015 through June 30, Ms. Sjostrom and the Human Services Labor Management Committee (LMC) Co-Chairs submitted documentation regarding the LMC Committee and briefed the Board on topics the committee has addressed which include a Dress Code, Child Care Needs, and the current Internal Posting requirements for open positions. Discussion took place regarding measuring the effectiveness of the committee. Redetermination Hearings Viewer s Reports County Ditch #23: Ditch Inspector Kevin Fellbaum stated that this is a continuation of the Redetermination Hearing for Ditch #23. The Ditch Viewers reviewed some properties upon request from landowners at the Ditch Hearing. One property was re-assessed as no benefit and the total value of the ditch was reported as $13,264, Chairman Lindquist asked for public comments. No one offered comment on Ditch #23. Motion by Rogness, second by Huebsch, and unanimously carried to accept the amended Viewer s Report for the Redetermination of County Ditch #23 as submitted. The County Attorney will prepare an Order and submit to the Board for approval. County Ditches #18 & #37: At the June 8, 2015 Ditch Hearing for redetermination and consolidation of ditches #18 and #37, several landowners requested that their properties be reviewed for the assigned benefits. Mr. Fellbaum provided the list of parcels reviewed and the changes that occurred and reported a total value of $1,738, for the two ditches. Chairman Lindquist asked for public comments. Landowner Mark Schoening spoke in disagreement with the benefit assessed on his ag land as developable lakeshore property because of assessing the property at its highest and best use. His property is assessed at more than 10% of the total value of the ditch. Ditch Viewers explained that highest and best use is how they are instructed to assign benefits. Discussion took place regarding the potential application of the Green Acres law. Motion by Rogness, second by Johnson, and unanimously carried to consolidate County Ditch Systems #18 and #37. The County Attorney will draft an Order for the consolidation of the two ditches. Motion by Froemming and seconded by Johnson to accept the amended Ditch Viewers Report for County Ditch #18/37 as presented. Commissioner Huebsch referred to language contained on the Department of Natural Resources (DNR) website regarding appraisal practices for highest and best application under ditch law. Motion by Rogness and seconded by Huebsch to table the motion to accept the amended Ditch Viewers Report for Ditch #18/37 until the next regular County Board meeting. The County Attorney and County Auditor-Treasurer will research the Green Acres law and the appraisal practices for highest and best use under ditch law. Johnson John Lindquist Roger Froemming Lee Rogness RESOLUTION IN SUPPORT OF COUNTY WIDE HOUSING STUDY Otter Tail County Resolution No WHEREAS, the Minnesota Housing Partnership (MHP) has grant funding available for the purpose of conducting Housing Studies to further the goal of providing affordable housing for Minnesota residents; and WHEREAS, a shortage of housing in Otter Tail County, especially in the Eastern portion of the County has been identified; and

5 Page 5 WHEREAS, each City in Otter Tail County has addressed viable housing sites, infrastructure availability and incentives that may be available in order to attract developers interested in developing housing in the respective cities; and WHEREAS, affordable housing is a key component to job growth throughout the County; and WHEREAS, a County Wide Housing Study may benefit economic growth and community prosperity better if approached cooperatively rather than separately; and WHEREAS, the Otter Tail County Housing & Redevelopment Authority (HRA) has submitted an application to the MHP for grant funding for a County Wide Housing Study. NOW, THEREFORE, BE IT RESOLVED that the Otter Tail County Board of Commissioners strongly supports the Housing Authority s application for a comprehensive County Wide Housing Study to further the goal of affordable housing. Upon the motion of Commissioner Rogness, seconded by Commissioner Froemming, and passed on a 5 0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners. Dated: Attest: Larry Krohn, Clerk OTTER TAIL COUNTY BOARD OF COMMISSIONERS By: John Lindquist, Chair Drainage Systems Ditch #37: Ditch Inspector Kevin Fellbaum reported that an 8 tile that carries water from the wetland east of Underwood stopped functioning the first part of June, Water continues to back up flooding the lawns of the surrounding homes. Mr. Fellbaum stated that the wetland was pumped down and a contractor attempted to push a camera through the tile to determine the problem; however, the camera could only make it 50. Discussion followed regarding the potential to bore the area and push in a tile. Motion by Rogness, second by Johnson, and unanimously carried to authorize the Ditch Inspector to hire a contractor to excavate down to the tile where the plug appears (yellow area on map) to determine the problem. The motion also included authorization for the Ditch Inspector to research the possibility of boring a pipe through this area and requesting quotations from area contractors. Ditch #45: Motion by Froemming, second by Huebsch, and unanimously carried to authorize Glen Kramer to clean sediment out of Ditch #45 in the areas identified in red on the map submitted by the Ditch Inspector. All costs will be covered by Mr. Kramer. As part of this cleanout, 16.5 buffer strips will be established and maintained by Mr. Kramer Ditches to Redetermine Benefits Mr. Fellbaum submitted recommendations for redetermination of benefits for 2015 including County Ditches #70, #30 and #58. The Ditch No. 70 Redetermination will be needed if the petitioners elect to continue with the proposed Improvement project. Motion by Johnson, second by Froemming, and unanimously carried to approve Public Information meetings as follows: County Ditch #30 September 14, 2015, 7:00 p.m. at the Government Services Center in Fergus Falls, MN County Ditch #58 September 21, 2015, 7:00 p.m. in Perham, MN

6 Page 6 Planning Commission Recommendations Conditional Use Permit Randal L. & Ina R. Gowin: Land & Resource Director Bill Kalar stated that this is an after-the-fact Conditional Use Permit request for earth moving. Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit for the revised plan dated July 8, 2015 as presented. The proposal is located in Pt GL 8 & Lot 13 Blk 2 of Pleasure Park, Section 4 of Otter Tail Township; Otter Tail Lake (56-242), GD. Conditional Use Permit Julie & Stephen Weiand: Motion by Johnson, second by Huebsch, and unanimously carried to deny the after-the-fact Conditional Use Permit request of Julie & Stephen Weiand as recommended by the Planning Commission. The motion includes the requirement for the Weiands to work with the Land & Resource Management office regarding a restoration plan for the disturbed area. The project is located on Lot 2 Blk 1 Peterson Point, Section 26 of Dunn Township; Franklin Lake (56-759), RD. Linden Park Resort and Campground: Mr. Kalar provided background information regarding a request for 6 new sites for Linden Park Resort and Campgrounds subject to removal of a cabin on the lake frontage and 2 Recreational Camping Units. The Planning Commission had previously recommended denial of the 6 new RCU sites recommending only 3 due to exceeding the current allowable density under the County s Shoreland Management Ordinance (SMO). The Board of Adjustment approved a variance for 6 new RCUs citing the Commercial Statewide Standards for density as the rationale. Motion by Huebsch, second by Johnson, and unanimously carried to approve a Conditional Use Permit for 6 new RCU sites as presented. The proposal is located in Hurch s First Addition to Linden Park Lots 6 & 7 Blk B & vac alley adj and pt of GL 1 & pt of GL 2, Section 26 of Girard Township; East Battle (56-138), RD. Aquatic Invasive Species (AIS) Funding Motion by Huebsch, second by Rogness, and unanimously carried to authorize release of $30,000 from the AIS Funds to the Otter Tail County Coalition of Lake Associations (COLA) for use in the prevention of the spread of AIS in County lakes. The motion included the requirement for the COLA to document use of the funds. Standards Regarding Docks Mr. Kalar submitted the Minnesota Department of Natural Resources (MNDNR) News Release dated July 13, The news release identifies rules to keep in mind when installing lifts and docks. Recess & Reconvene At 11:51 a.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for lunch break. The meeting was reconvened at 1:02 p.m. Soil & Water Conservation Districts Program Updates WOTSWCD Manager, Brad Mergens and EOTSWCD Manager, Darren Newville presented a document titled Buffer Legislation at a Glance dated June, They briefed the Board regarding exemptions, buffer protection maps, public waters covered by the legislation, compliance, administrative penalties, and timelines. Discussion took place regarding the State timelines and Otter Tail County buffer initiative timelines which are not the same. Mr. Newville reported that 22 projects have been completed through the Shoreland Restoration program with several more scheduled this fall. Funding has been provided through the Clean Water Grants and DNR for a new ag weather website, with eleven radio stations currently participating. The Otter Tail River Watershed analysis is scheduled to begin in CY2016.

7 Page 7 Upcoming Seminar Dates Motion by Lindquist, second by Froemming, and unanimously carried to authorize commissioners to attend the following informational sessions: 4 th Annual Water Issues Forum July 17, 2015, 8 a.m. Noon, Wendell, MN Groundwater: Managing an Invisible Resource July 29, 2015, 4-6 p.m. at Thumper Pond, OT Session for Local Decision Makers October 7, 2015, Parkers Prairie Events Center Conservation Award The Otter Tail County Board was selected by the local Soil & Water Conservation Districts for the 2015 Outstanding Conservationist Award. This nomination will be considered by the Minnesota Association of Soil and Water Conservation Districts (MASWCD). The Conservationist Award recognizes individuals or organizations for outstanding accomplishments with implementing conservation practices and improving Minnesota s natural resources. Geologic Atlas Program SWCD Managers presented information regarding the Geologic Atlas Program. The program develops geologic and hydrologic maps and associated databases essential to managing water. To initiate a geologic atlas, the County must express interest and agree to establish accurate locations for water wells with construction records. Discussion followed. Commissioners requested that the SWCD Managers invite Geologist Dale Setterholm to meet with the Board regarding this program. Recess & Reconvene At 1:54 p.m., Chairman Lindquist recessed the meeting of the Otter Tail County Board of Commissioners for a Public Works Committee meeting. The Board of Commissioners meeting was reconvened at 2:25 p.m. AGENCY AGREEMENT NO FOR FEDERAL PARTICIPATION FOR S.P , M.P. TA 5615(258) Otter Tail County Resolution No BE IT RESOLVED, that pursuant to Minnesota Statutes Section , the Commissioner of Transportation be appointed as Agent of Otter Tail County to accept as its agent, federal aid funds which may be made available for eligible transportation related projects. BE IT FURTHER RESOLVED, the County Board Chair and the County Board Clerk are hereby authorized and directed for and on behalf of the County of Otter Tail to execute and enter into an agreement with the Commissioner of Transportation prescribing the terms and conditions of said federal aid participation as set forth and contained in Minnesota Department of Transportation Agency Agreement No , a copy of which said agreement was before the County Board and which is made a part hereof by reference. Motion by Johnson, second by Huebsch, and unanimously carried to award the Rural Lighting project to Otter Electric LLC of Fergus Falls, MN in the amount of $185, contingent upon the review and approval of the Minnesota Department of Transportation. S.A.P Bridge 56J23: Bids were opened for the Bituminous Surfacing, Culvert and Bridge Removal project on July 8, 2015 at the Government Services Center in Fergus Falls, MN. Motion by Rogness, second by Huebsch, and unanimously carried to award S.A.P to the low bidder, Midwest Contracting, LLC of Marshall, MN at the bid price of $426, Sidewalk Repairs CSAH 5 in Clitherall: Quotations were received for the Sidewalk Repair project on CSAH 5 until July 8, Motion by Froemming, second by Johnson, and unanimously carried to award this project to Robert Nordick Construction LLC of Fergus Falls, MN with the low quote of $14, CSAH 21 Culvert Replacement County Ditch No. 56: Quotations were received for the CSAH 21 Culvert Replacement project until July 8, Motion by Johnson, second by Froemming, and unanimously carried to award the CSAH 21 Culvert Replacement project to DM Enterprises of Wadena, MN at the lump sum low quote of $58, and $14.00 per cubic yard of borrow material.

9 Page 9 CSAH 40 Culvert Replacement: Quotations were received for the CSAH 40 Culvert Replacement project until July 8, Motion by Rogness, second by Huebsch, and unanimously carried to award the CSAH 40 Culvert Replacement project to DM Enterprises of Wadena, MN with the lump sum low quote of $38, and $14.00 per cubic yard of borrow material. Central Lakes Trail Box Culvert Replacement County Ditch No. 43: Quotations were received for the Central Lakes Trail Box Culvert Replacement project until July 8, Motion by Huebsch, second by Froemming, and unanimously carried to award this Box Culvert Replacement project on County Ditch No. 43 to Landwehr Construction, Inc. of St. Cloud, MN with the lump sum low quote of $75, and $18.00 per cubic yard of borrow material, contingent upon the review and approval of the Minnesota Department of Transportation (MnDOT). Engineering Services Agreement Motion by Rogness, second by Johnson, and unanimously carried to authorize the appropriate County Officials signatures to execute an Agreement between the County of Otter Tail and Houston Engineering, Inc. for CSAH 40 Culvert Hydraulic Analysis at the NW¼ NW¼, Section 11, T132N, R36W location. The estimated total cost is $3,700 for the engineering services. LOCAL GOVERNMENT RESOLUTION FOR FLOOD HAZARD MITIGATION GRANT ASSISTANCE LITTLE MCDONALD, KERBS AND PAUL LAKES/DEVILS LAKES OUTLET PROJECT Otter Tail County Resolution No BE IT RESOLVED that Otter Tail County, hereinafter referred to as the Applicant, act as legal sponsor for the project contained in a Flood Damage Reduction Grant Assistance Program Application submitted on April 17, 2015 for the above named project. BE IT FURTHER RESOLVED that Richard West, Otter Tail County Public Works Director/County Engineer is hereby authorized to apply to the Department of Natural Resources for funding of this project on behalf of the Applicant. BE IT FURTHER RESOLVED that the Applicant has the legal authority to apply for financial assistance, and the institutional, administrative, and managerial capability to ensure adequate acquisition, maintenance and protection of the proposed project. BE IT FURTHER RESOLVED that the Applicant hereby pledges to complete the project or phase, if it exceeds the total funding provided by the Department of Natural Resources. BE IT FURTHER RESOLVED that the Applicant has not incurred any costs, and has not entered into any written agreements to purchase property proposed by this project for which it will seek reimbursement. BE IT FURTHER RESOLVED that the Applicant has not violated any Federal, State, or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, the Applicant may enter into an agreement with the State of Minnesota for the above- referenced project, and that the Applicant certifies that it will comply with all applicable laws and regulations as stated in the contract agreement.

10 Page 10 NOW, THEREFORE BE IT RESOLVED that Richard West, Otter Tail County Public Works Director/County Engineer is hereby authorized to execute such agreements as are necessary to implement the project on behalf of the applicant. Upon the motion of Commissioner Huebsch, seconded by Commissioner Johnson, and passed on a 5 0 vote, the above resolution is hereby adopted by the Otter Tail County Board of Commissioners.
