2 PAGE 2 MINUTES OF PREVIOUS MEETING 107. Minutes of the Public Board Meeting held Thursday, April 23, T. Bonham B. Marshall That the Minutes of the Public Board Meeting held Thursday, April 23, 2015 be adopted as circulated. REPORTS FROM THE BOARD CHAIRPERSON OAPSB Zone 4 Meeting - On May 12 th, Vice-Chair Petrowski, Member Stewart, and the Board's Executive Director attended the Ontario Association of Police Services Boards and the Ontario Association of Chiefs of Police quarterly Zone 4 meeting in Woodstock. NRPS Auxiliary Recruit Graduation - On May 12 th, the Service welcomed 20 new auxiliary police recruits to the Niagara Regional Police Service. The graduation ceremony was held at the Canadian Polish Society in St. Catharines. Chair Gale and Members Marshall and Stewart attended the event on behalf of the Board. Chair Gale commented on the valuable contributions of the Police Auxiliary Officers and the great work they do for the Service. It was noted that in 2014, NRPS Auxiliary Officers provided over 13,000 hours of volunteer time to assist police with public safety. CAPG Webinars - On May 19 th, Members Gansel and Stewart participated in a webinar session hosted by the Canadian Association of Police Governance on "The Neuroscience of Leadership". Board Members have also been invited to participate in an upcoming training webinar session on "Cyber Security" being held on May 26 th from 9:00 am to 10:00 am. Interested Board Members were asked to confirm their participation with Board staff. New Toronto Police Chief - Change of Command Ceremony - On May 20 th, the Toronto Police Service celebrated a change of command for its new Police Chief Mark Saunders. The event took place at Toronto Police Headquarters. Chair Gale and Vice-Chair Petrowski attended the event on behalf of the Board. OAPSB 2015 Spring Conference and AGM - The Ontario Association of Police Services Boards 2015 Spring Conference and Annual General Meeting is being held from May 27 th to May 30 th at the Toronto Marriott Downtown Eaton Centre Hotel. The theme of this year s conference is Good Policing through Good Governance and the program features a variety of special guest speakers, learning sessions, Board training and networking opportunities. Chair Gale, Vice Chair Petrowski, Members Gansel, Marshall, Stewart, the Board s Executive Director will be attending this important conference. NRPS Annual Awards Ceremony - On May 31 st, the Police Services Board, the Niagara Regional Police Service, and the Senior Officers' Association, will host its Annual Awards Ceremony at White Oaks Resort in Niagara-on-the-Lake. This important event recognizes outstanding Service Members and fellow citizens who have demonstrated excellence or made invaluable contributions to the Niagara community. The event also recognizes NRPS retirees and long-standing employees for their commitment to the Service. Chair Gale, Members Marshall, Stewart, the Board's Executive Director will be attending the event on behalf of the Board. Licencing Public Consultation Session - The Board will be holding a public consultation session for the taxi, tow truck and vehicles for hire industry, with separate sessions for both the owners and the drivers. The public consultation will take place on June 29 th beginning at 8:30 am in the Niagara Police Services Boardroom. This forum will allow the industry to provide different perspectives into the various issues that should be considered by the Board to ensure the public needs and vehicle for hire service requirements are balanced.
3 PAGE 3 The Board has invited all licencees, businesses, the public and local area council members to share their views as part of the consultation process. This feedback will assist the Board in its by-law review and allow for further input into the annual public meeting which will be held in the Fall of Upcoming PSB Meetings: Next PSB Committee Meetings Thursday, June 11 th, at 8:30 am in the PSB Boardroom. Next Board Meeting Thursday, June 25 th, at 8:30 am in the PSB Boardroom. REPORTS FROM THE CHIEF OF POLICE Newly Promoted Inspectors Chief McGuire introduced Inspectors John Sawicki and Mike Woods who were recently promoted the rank of Inspector and were present at the meeting as Acting Superintendents. Inspector Sawicki has been assigned to oversee Court Services operations and Inspector Woods has been assigned to the Professional Standards Unit. Chief McGuire congratulated each officer on becoming the newest members of the Service's management team. Operational Statistics: For the period April 1 to April 30, 2015: Robberies 7 robberies, 3 cleared. For the period January 1 April 30, 2015: Homicides 2 compared to 3 for the same period in 2014; further compared to 6 in 2013, 3 in 2012 and 2 in Traffic Fatality Statistics 5 collisions with 5 deceased, compared to 1 collision with 2 deceased for 2014, further compared to 2 collisions with 2 deceased for 2013 and 7 collisions with 7 deceased for Three of the five reported facilities have resulted from medical conditions and are not reportable by the Ministry of Transportation. Chief McGuire spoke to the following three (3) motor vehicle collisions: Incident of April 19, Niagara Emergency Medical Services, Niagara Regional Police Service and St. Catharines Fire Services were dispatched for a single motor vehicle collision on Lakeshore Road north of Lakeport Road in St. Catharines. Initial investigation revealed that a 61 year-old male resident of St. Catharines was driving a 1999 Ford motor vehicle northbound on Lakeshore Road when the motor vehicle crossed the southbound lane of traffic, mounted the curb and travelled onto the grass area before striking a tree on the west side of Lakeshore Road. The driver was the only occupant in the vehicle. He was transported to the Niagara Health System St. Catharines site where he was pronounced dead. This incident is deemed non-reportable due to medical reasons. Incident of April 20, The Niagara Emergency Medical Services, Niagara Regional Police Service and St. Catharines Fire Services were dispatched for a motor vehicle collision at the intersection of Bunting Road and Welland Avenue in St. Catharines. Initial investigation revealed that a 45 year-old male was driving a 2004 Chrysler PT Cruiser northbound on Bunting Road and had stopped at the intersection of Welland Avenue waiting to make a left turn to go westbound on Welland Avenue. The traffic lights changed and the driver of the
4 PAGE 4 Chrysler proceeded to clear the intersection when a 55 year-old male driving his 2001 Daewoo Lanos southbound on Bunting Road entered the intersection and collided with the Chrysler. The Daewoo Lanos continued southbound colliding with a traffic signal pole on the southwest corner of the intersection. The driver of the Daewoo Lanos had to be extricated from his vehicle and was transported to the Niagara Health System St. Catharines site by ambulance before being air lifted to the Hamilton Health Sciences General Hospital site. On May 6 th, police investigators received information that the 55 year-old driver of the 2001 Daewoo Lanos had succumbed to his injuries and was pronounced dead at the Hamilton Health Sciences General Hospital site. The second driver did not suffer any injury in the collision. Incident of April 3, Niagara Regional Police Service, Pelham Fire Services and Niagara EMS responded to reports of a collision between a vehicle and pedestrians. Four teenagers were walking westbound on Canboro Road from Church Hill toward Haist Street and had just crossed from the south sidewalk to the north boulevard. At the same time, a 41 year-old Fonthill man was driving his 2005 Toyota Solaras westbound on Canboro Road. The vehicle left the north edge of the roadway, entered the boulevard and struck two of the pedestrians. The vehicle then fled the scene. One of the pedestrians struck, a 17 year-old female, was thrown a significant distance during the collision. She was taken to a local hospital and later transferred to Hamilton Health Sciences hospital where she remains in serious but stable condition. The second pedestrian struck an 18-year-old Fonthill male, was treated and released at the scene. A 41 year-old male has been charged with failing to stop at the scene of an accident while causing bodily harm. St. Catharines Incidents: In March of 2015 the St. Catharines Street Crime Unit commenced an investigation into alleged illegal drugs sales from a St. Catharines residence. The investigation led to drug related arrests of two St. Catharines males and the seizure of $3,200 in heroin, $4,900 in crack cocaine and $700 in cash by police. Since March of this year, members of the St. Catharines Street Crime Unit have been investigating a male for selling prescription medication from his residence. On April 28 th, the male was arrested at which time officers located and seized $3,025 in prescription medication, and $5,010 in cash. On May 1 st, St. Catharines officers were called to an apartment complex after receiving a call to 911 regarding a violent break and enter. As officers arrived on scene, shots were fired at the officers, which fortunately resulted without any harm being brought to any officer. A hand gun was recovered at the scene and after a lengthy investigation; four males from the Toronto area were arrested. Welland Incident: Detectives commenced an investigation on April 18 th into a break and enter at a Wainfleet residence. The investigation led to the arrest of a 38 year-old Welland man on April 22 nd for property related crimes. Approximately $15,000 of stolen property was recovered. Internet Transaction "Safe Zones" Chief McGuire provided an update on the status of identifying internet transaction "safe zones". He referenced a news article regarding a number of Canadian agencies looking further into the option of designating sites for on-line sale transactions at their local police stations. The NRPS is currently continuing with its review and has had discussions with the Region's legal department. Those discussions have identified some liability issues on the part of the Region given that police facilities are owned by the Region. In addition, some logistic challenges have been identified for 1 District (St. Catharines) and 2 District (Niagara Falls) site locations as a result of the lack of parking. The Service is reviewing the options for a pilot process in Welland given the parking availability at the 3 District facility.
5 PAGE 5 Chief McGuire spoke further to the initiative advising that the program is gaining interest from a public safety perspective and designating a police station "safe zone" site location for individuals wishing to purchase products through an on-line process is likely to prove as a deterrent for any preconceived criminal activity. He did however advise that consideration is being given toward moving away from referencing the designated areas as "safe zones" for liability reasons, as this practice may realize legal implications given that police will not necessarily being policing the sites although the locations may be on police grounds. In addition, the terminology of "safe zone" may bring about a false sense of security to individuals attending the designated locations. Chief McGuire anticipated that the review will be finalized by next month and the Service will submit a report to the Board for further consideration. While the matter remains under review, Chair Gale emphasized the importance of the public making arrangements to meet with potential buyers/sellers at public domains to ensure best practice safety measures are in place. Chief McGuire echoed his comments and encouraged highly visible pubic settings for such transactions. New Toronto Police Chief - Change of Command Ceremony Further to Chair Gale's comments on the change of command for Toronto's new Police Chief Mark Saunders, Chief McGuire, who also attended the event, spoke to their past professional relationship advising that Chief Saunders fulfilled his former role as Toronto's Deputy Chief upon him coming to Niagara. He stated that Chief Saunders is well-respected among the rank and file of the Toronto Police Service as well as the community and that Niagara will continue to maintain its working relationship with Chief Saunders who will remain heavily involved in the body worn camera pilot project which is underway in Toronto and other various initiatives as well. OAPSB 2015 Spring Conference and AGM Chief McGuire advised that he will be attending the Ontario Association of Police Services Boards 2015 Spring Conference and Annual General Meeting for participation at the various sessions being offered on May 28 th and 29 th. 55 th Annual Tug-of-War Competition - On May 9 th, the NRPS took part in the International Tug-of- War Competition on the Rainbow Bridge in Niagara Falls. Niagara's police officers put forth a unified effort to gain championship by winning two out of the three pulls. Prescription Drug Drop-Off Initiative - On May 9 th, the Special Investigative Service Unit held a Prescription Drug Drop-Off day at which time 220 pounds of prescription medication was dropped off by members of the public. The program was initiated in Niagara and now operates across the province as a result of its recognized success. Police Week Community BBQs During Police Week, the NRPS hosted community BBQs at its 1 District, St. Catharines, and 2 District, Niagara Falls, locations. A total of $450 was raised for donation to the Heartland Forest and Crime Stoppers of Niagara organizations. NRPS School Resource Officers - Camp Medeba - On May 11 th, the NRPS School Resource Officers and 50 local youth headed to Camp Medeba for a three-day retreat. The youths worked with the officers on a number of events to develop communication, trust, co-operation and team building skills. This event was supported by ProAction Cops and Kids Niagara, which kick-offed earlier this year. PRESENTATIONS 108. Law Enforcement - NRPS Initiatives Developed to Meet the Core Policing Services as set out in the Police Service Act (PSA) The Board considered a presentation on Victims of Crime by Deputy Chief Bryan McCulloch to provide an overview to the Board on the core policing responsibility of law enforcement as set out in the Police Services Act.
6 PAGE 6 Vice-Chair Petrowski questioned the practices of the Service for tracking victim of crime statistics. Chief McGuire advised that the Service is provided with a monthly newsletter and an annual statistical report from the Victim Witness Program and that information is reported back to the Board through the submission of the Victim of Crimes Annual Report, which reflects information pertaining to the number of calls, number of incidents and the assistance that has been provided. Chief McGuire advised that he will confirm when the report is scheduled to come before the Board. Chair Gale spoke to the importance of keeping victims of crime informed of any arrests from these types of incidents. He noted that throughout the past, concerns have been brought to his attention that relate to individuals not being properly informed of any action taken by the police. He suggested that the Chief may want to conduct random assessments to ensure police are notifying victims of the outcome of these incidents. Chief McGuire advised that investigators routinely follow-up with individuals who have been involved in a victimizing incident. He stated that there are many factors that prompt such communications between police and victims after an arrest has been made for reasons that may relate to recovering, identifying and returning stolen property. There is also great added value to officers when being able to advise a victim that a suspect individual has been arrested. He advised that he will review the Service's mandate on this practice and keep the Board apprised on what action is taken to ensure that police are following-up on all victim related crimes. V. Stewart K. Gansel That the presentation be received. DEPUTATIONS NEW BUSINESS 124. Mobile Crisis Rapid Response Team (MCRRT) Pilot Program (The item was moved from its original placement on the Agenda to accommodate guest speaker, Mr. Kurzawa, Executive Director, Canadian Mental Health Association (CMHA), Niagara Branch). The Board considered Service report 143/2015 dated May 12, 2015 providing detailed information on the Service's creation of Niagara's Mobile Crisis Rapid Response Team pilot program that was extended to include Niagara, at no cost to the Niagara Regional Police Service, through a process involving a joint grant proposal by St. Joseph's Healthcare Hamilton and the Canadian Mental Health Association (CMHA) to the Local Health Integration Network (LHIN) advocating for the creation of MCRRT's across the entire LHIN, for the purpose of assisting municipalities with reducing the number of individuals brought to hospital emergency departments and diverting them to an appropriate community agency/resource through partnering police with mental health care workers. Mr. Kurzawa, Executive Director, Canadian Mental Health Association (CMHA), Niagara Branch, spoke briefly to CMHA's involvement in mental health and the justice system at Canadian Mental Health and to the numerous related programs the organization is currently involved in and has been over the past several years.
7 PAGE 7 Programs of this nature have realized great success and are ultimately what prompted LHIN to approach the CMHA for the MCRTT to be expanded from Hamilton to include Niagara and Haldimand Norfolk, which was based on the successes realized by Hamilton Police of an approximate 40% reduction in mental health apprehensions in addition to the efficiencies in officer's time commitments when dealing with mental health sufferers and the resulting dollar amounts contributed to police involvement with mental health related incidents. He further advised that all mental health workers have been hired and that the program is set to launch on June 1, 2015 for the St. Catharines pilot project. Mr. Kurzawa advised that the terminology of the program being a pilot project began when it was offered to Niagara by the LHIN. At that time, it was questioned if funding would be available for the program to be operated throughout the entire Niagara Region and the CMHA was advised that it would only be funded to operate in St. Catharines. The terminology is used loosely as the $320,000 funding amount allotted by the LHIN to hire the required mental health workers and operate the program is considered permanent funding for the City of St. Catharines program which will be operated from 6:00 pm 1:00 am, seven days a week. Discussions continued about program details including the future costs to police should the program be expanded throughout the entire Niagara Region, liability issues of mental health workers accompanying police on routine police calls of various natures and training and equipment required for the mental health workers. Chief McGuire advised that the program is being deemed a pilot project given that it is only being tested in St. Catharines at this time and cannot be operated across the Region. The intent would be that if success is realized and funding is allotted, it will be rolled out to other areas across the Region. He further advised that the Service will submit a Memorandum of Understanding at the June 25 th, 2015 Board meeting with detailed information on the program's operations. He also advised that a status update report would be submitted if/when the program has been operational for a period of time that will allow an assessment. In response to the Board's request, Chief McGuire will report back with additional information on the number of Mental Health Act apprehensions the Service had last year. The Board questioned ride-along opportunities at a later date. Chief McGuire advised there are identified challenges in accommodating this request being that a member would be displaced from the cruiser should any suspect apprehension be required on the tour of duty. However, he advised that the request will be considered for a possible solution and further consideration. A. Petrowski D. Barrick That the information be received. CONSENT AGENDA 109. Bill 8 Application of the Amended Ombudsman Act to Police Services Boards The Board considered a copy of a letter dated April 29, 2015 from Mayor Frank Scarpitti, Chair, York Police Services Board, sent on behalf of the 'Big 12' Police Services Boards to Ontario Premier Kathleen Wynne seeking clarification from the Province on the application of Bill 8 to Police Services Boards and asking the Province to enact a regulation exempting Police Services Boards from the Ombudsman Act. On May 5, 2015, Ontario Premier Wynne responded in a letter advising that she has referred the request to the Honourable Yasir Naqvi, Minister of Community Safety and Correctional Services, for review and response.
8 PAGE Town of Fort Erie Taxi Service Licencing By-law Amendments The Board considered correspondence dated April 28, 2015 from Ms. Laura Bubanko, Manager, Legislative Services/Clerk, Town of Fort Erie, advising the Board of a resolution passed by the Town of Fort Erie Council at its April 27, 2015 meeting, requesting the Board increase the number of taxi licences in Fort Erie and that taxi services be provided 24 hours per day, seven days per week. (The Licencing Committee referred this matter to the public consultation session on June 29, 2015 for consideration.) 111. Town of Pelham - Consolidated Emergency Dispatch Services The Board considered correspondence dated April 13, 2015 from Ms. Nancy Bozzato, Town Clerk, Town of Pelham, advising that at its meeting held April 7, 2015 the Council of the Town of Pelham received the Board's resolution in this matter RMON - Regional Council/Corporate Services Committee - Items Considered April 30 and April 22, 2015 The Board considered a letter dated May 4, 2015 from Ralph Walton, Regional Clerk, Niagara Region, providing notice of the direction taken by Council at its meeting held April 30, 2015 regarding the KPMG Audit Report; Court Security and Prisoner Transportation Funding; the PSB Minutes from the March 26, 2015 meeting; and further notification of two capital budget projects received and approved at the Corporate Services Committee meeting held April 22, Quarterly Report Suspect Apprehension Pursuits October 1 to December 31, 2013 The Board considered Service report 135/2015 dated May 8, 2015 submitted in accordance to the reporting requirements set out in Board By-law Quarterly Report Administration of the Public Complaints System - Reporting Period of January 1 to March 31, 2015 The Board considered Service report 139/2015 dated May 8, 2015 submitted in accordance to the reporting requirements set out in By-law providing information relating to the administration of complaints made by members of the public against Niagara Regional Police and including statistical yearly comparisons. Chief McGuire advised that the Service is continuing to the refine the reporting format to develop a structure that will clearly reflect the statistics being reported for ease to the reader Annual Report Police Action at Labour Disputes January 1 to December 31, 2014 The Board considered Service report 134/2015 dated April 30, 2015 submitted in accordance to the reporting requirements set out in Board By-law 240/ Annual Report Child Pornography - January 1 to December 31, 2014 The Board considered Service report 130/2015 dated April 29, 2015 submitted in accordance to the reporting requirements set out in Board By-law Annual Report Domestic/Family Violence - January 1 to December 31, 2014 The Board considered Service report 131/2015 dated April 13, 2015 submitted in accordance to the reporting requirements set out in Board By-law Annual Report Communicable Diseases January 1 to December 31, 2014 The Board considered Service report 132/2015 dated April 30, 2015 submitted in accordance to the reporting requirements set out in Board By-law Annual Report Elder and Vulnerable Adult Abuse - January 1 to December 31, 2014 The Board considered Service report 129/2015 dated April 14, 2015 submitted in accordance to the reporting requirements set out in Board By-law

NEW BUSINESS Vice-Chair Petrowski assumed the role of Chair for Items 120, 121, and NRPS Financial Variance Overview and Year-End Forecast Reporting Period of January 1 to April 30, 2015 The Board considered Service report 141/2015 dated May 8, 2015 providing the Board with a financial overview and year-end forecast for both the Service and Board based on current indicators. In regard to the fuel budget of $1.4 million, Ms. DiDonato-DeChellis advised that the number is based on Regional guidance. She noted that in the past, police have budgeted lower than the Region however, the Board directed that the Service budget in accordance with the Regional guidance. She further advised that guidance can be changed at the direction of the Board and confirmed that should police realize a surplus at the end of the year, it is at the discretion of the Board, in consultation with the Region, as to how those funds are applied. A. Petrowski K. Gansel That the information be received Budget Timetable and Preparation Approach The Board considered Service report 133/2015 dated April 28, 2015 requesting approval of the Service s 2016 budget process to facilitate preparation of the 2016 Operating and Capital Budgets in a manner that is consistent with the budget strategy for Regional departments, as well as to ensure that the Police Service budgets are delivered to the Region in accordance with Council-approved timelines. The Board directed that the Appendix "B" 2016 Capital Budget Timetable be amended to read "Police Services Board Direction/Guidance June 26", removing the word "final" since the Service is only requesting the Board's budget guidance at that time. With respect to the Business Plan, Member Stewart advised the Board that a consultation strategy is being developed and a full report will be provided at the June 11 th Committee meeting and come before the Board for ratification at its June 25 th meeting. 10 PAGE 10 That the Board approve the following: 1. The timelines for completion and preparation of the Operating and Capital budgets as outlined in the report; 2. The preparation of Operating and Capital budgets for the Police Service utilizing a process that is parallel but separate from that of Regional Departments; and 3. Communicate formally to the Region with regards to the schedule of budget deliberation meetings and the budget preparation approach for the Police Service RIDE Grant Program Application (Schedule E) - Ministry of Community Safety and Correctional Services The Board considered Service report 140/2015 dated May 5, 2015 requesting the Board approve the application to the Ministry of Community Safety and Correctional Services for the Service s participation in the RIDE Grant Program for the fiscal years 2015/ /2017. D. Barrick T. Bonham That the Board authorize the submission of the Grant Application (Schedule E), to the Ministry of Community Safety and Correctional Services for consideration of the Niagara Regional Police Service s participation in the Ministry s RIDE Grant Program for period of April 1, 2015 through March 20, 2016; And further, that the Board Chair be authorized to execute the Grant Application and return same to the Ministry of Community Safety and Correctional Services Records Management System (RMS) Annual Maintenance and Support Renewal The Board considered Service report 125/2015 dated April 20, 2015 requesting the Board approve payment of Versaterm's yearly maintenance and support renewal costs for the Service s Records Management System as included in the 2015 IT Operations System and Applications Operating Budget for the purpose of maintaining an up-to-date RMS system with current software versions that are supported by companies supplying the associated licences.
