1 CITY OF WATFORD CITY CITY COUNCIL MEETING April 03, 2017 Minutes of the regular City Council meeting held on April 3, 2017 at 6:00 p.m. at City Hall. Present were Mayor Justin Voll and Council Members Phil Riely, Aaron Gravos, Bethany Devlin, Matt Beard, Steve Sanford, and Kenny Liebel. Also present were City Administrator Curt Moen, City Auditor Peni Peterson, and Attorney Wyatt Voll. Council Member Gravos moved to approve the minutes of the city council meeting held on March 6, Motion also included approving the agenda. Motion seconded by Council Member Liebel and carried unanimously. Mayor Voll opened the public hearing, as advertised, for Liquor License Applications (Liquor License, Beer License, and Sunday Alcoholic Beverage Permit) submitted by Watford City Park District Rough Rider Center. There were no comments from the public. The public hearing was closed. Council Member Gravos moved to approve the Liquor License Applications submitted by Watford City Park District Rough Rider Center. Motion Seconded by Council Member Riely and carried by the following roll call vote: ayes: Beard, Devlin, Gravos, Sanford, Riely, and Liebel; nays: none. Mayor Voll opened the public hearing, as advertised, for the Annexation Application submitted by City of Watford City for property located at 1002 N. Main Street, acres and ROW. There were no comments from the public. The public hearing was closed. Council Member Sanford moved to approve the Annexation Application submitted by City of Watford City for property located at 1002 N. Main Street. Motion seconded by Council Member Gravos and carried unanimously. Council Member Beard moved to approve the following Enhancement Grants as recommended by the Roughrider Committee: $1,500 Rough Rider Event Center, $2,500 Legendary Adventures New Discoveries, $1,000 Grassy Butte Showdeo, and $2,500 Arnegard Fire Department. Motion seconded by Council Member Sanford and carried by the following roll call vote: ayes: Liebel, Devlin, Sanford, Gravos, Riely, and Beard; nays: none. Brady Bertram, Brosz Engineering, presented change orders and pay applications. Council Member Beard moved to approve Change Order #1 from Lupine Construction (City Shop Site Demolition) in the amount of $350. Motion seconded by Council Member Gravos and carried by the following roll call vote: ayes: Sanford, Beard, Riely, Devlin, Liebel, and Gravos; nays: none. Council Member Gravos moved to approve Pay Application #1 from Lupine Construction (City Shop Site Demolition) in the amount of $32,675. Motion seconded by Council Member Liebel and carried by the following roll call vote: ayes: Devlin, Gravos, Liebel, Beard, Sanford, and Riely; nays: none.

2 Council Member Beard moved to approve the Task Agreement between Owner (City of Watford City) and Engineer (Brosz Engineering, Inc.) for City Shop Site Design Amendment #2. Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Liebel, Sanford, Riely, Gravos, Beard, and Devlin: nays: none. Wayne Olson, Fox Hills Golf Course, gave an update on the golf course, provided financials, budget summary, and requested approval of Task Order #45A from Advanced Engineering (Fox Hills Golf and Country Club Construction Engineering Support Construction Phase) in the amount of $12,140. Council Member Riely moved to approve Task Order #45A from Advanced Engineering in the amount of $12,140. Motion seconded by Council Member Gravos and carried by the following roll call vote: ayes: Riely, Sanford, Gravos, Devlin, Liebel, and Beard; nays: none. Interim Chief Shawn Doble gave an update on the Police Department. Council Member Gravos moved to approve the recommendations from the Planning Commission from their March 27, 2017 meeting with the exception of item number 1 to be voted on separately. Approved the following: Land Use Application Zone Change submitted by Rough Rider Center rezoning property from R2 & R3 to Community Facility; Land Use Application Zone Change submitted by McKenzie County School District #1 WCHS rezoning property from R2 & R3 to Community Facility; Division of Land Application Map of Revision submitted by Lund Oil for property located th Ave NE. Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Riely, Beard, Liebel, Sanford, Devlin, and Gravos; nays: none. Council Member Liebel moved to approve the Land Use Application Conditional Use Permit Review submitted by Rolfson Oil to continue allowing a bulk fuel plant with the recommendations listed in the March 20, 2017 Staff Report and with the additional requirement that all 3 rd party inspection costs will be the responsibility of Rolfson Oil. Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Sanford, Riely, Gravos, Devlin, and Liebel; nays: none. Abstained: Beard. Council Member Riely moved to approve a proposal in the amount of $21, from NRG to rebuild the Police Department Watch Guard server and allow NRG to service going forward. The PD requested a refund from Watch Guard and they agreed to refund the server and waive other fees to transfer their software. Motion seconded by Council Member Beard and carried by the following roll call vote: ayes: Liebel, Beard, Riely, Sanford, Gravos, and Devlin; nays: none. Council Member Riely moved to approve the purchase of Trijicon rifle optics in the amount of $21,028 with the funds to come out of the Police Department Unit Fee fund. Motion seconded by Council Member Liebel and carried by the following roll call vote: ayes: Sanford, Riely, Liebel, Beard, Gravos, and Devlin; nays: none. Council Member Riely moved to reinstate the K9 program and the purchase of a new dog. Motion seconded by Council Member Sanford and carried by the following roll call vote: ayes: Beard, Devlin, Gravos, Riely, Sanford, and Liebel; nays: none.

3 Council Member Riely moved to approve Mayor Voll s appointment of Shaw Doble as Chief of Police effective March 1, Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Liebel, Sanford, Gravos, Riely, Beard, and Devlin; nays: none. Council Member Riely moved to approve promoting Amanda Eisenschenk to Administrative Assistant II position at Category 4, Step 0 effective April 1, Motion seconded by Council Member Beard and carried by the following roll call vote: ayes: Riely, Liebel, Devlin, Sanford, Gravos, and Beard; nays: none. Council Member Riely moved to approve a grade change for the Community Service Officer (CSO) Position from Category 3 to Category 4, effective April 1, Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Devlin, Beard, Riely, Gravos, Liebel, and Sanford; nays: none. Council Member Riely moved to approve sending CSO Stephanie Packer to the full twelve-week state academy in Bismarck. After graduation from the academy, CSO Packer will be recategorized as Police Office (Cat 12- Step 0). Motion seconded by Council Member Gravos and carried by the following roll call vote: ayes: Sanford, Riely, Gravos, Beard, Devlin, and Liebel; nays: none. Council Member Riely moved to approve a grade change for Meg Carter to Category 3, Step 0 effective April 1, Motion seconded by Council Member Gravos and carried by the following roll call vote: ayes: Gravos, Liebel, Sanford, Devlin, Beard, and Riely; nays: none. Council Member Riely moved to approve the following annual step increases: Ken Prentice Category 13, Step 1 effective 5/01/17 and Julianne Blakeman Category 3, Step 1, effective 5/16/17. Motion seconded by Council Member Sanford and carried unanimously. Council Member Beard moved to approve the Homefest Committee s requests for Homefest weekend allowing: Friday, June 23 rd blocking main street off at noon and allowing alcohol on main street from 5:00 p.m. 12:00 a.m., Saturday, June 24 th blocking main street off all day for events and to allow alcohol on main street from 5:00 p.m. 12:00 a.m. Also, allowing the use of the Veteran s Memorial Building as a contingency plan due to inclimate weather. Homefest Committee must provide, prior to the event, a detailed plan of their contingency plan and committee must give the Chief of Police 12 hours notice before moving the event inside. Committee will pay a deposit for the use of the Veteran s Memorial Building and they will provide cleaning of the building after the event. Motion seconded by Council Member Sanford and carried unanimously. Council Member Riely moved to approve $50 per meeting as the compensation amount for City Council members serving on the Governing Authority for the McKenzie County Law Enforcement Center. Motion seconded by Council Member Liebel and carried by the following roll call vote: ayes: Beard, Sanford, Riely, Devlin, Liebel, and Gravos; nays: none. Council Member Gravos moved to approve Raffle Permit # 763 Watford City Baseball Boosters and Raffle Permit #764 Relay for Life Dakota West Credit Union. Motion seconded by Council

4 Member Devlin and carried unanimously. Council Member Gravos moved to approve the Special Liquor Permit Application submitted by D & M s Office for April 29, 2017 from 6:00 p.m. 1:00 a.m. at the Rough Rider Center. Motion seconded by Council Member Riely and carried unanimously. Council Member Liebel moved to accept the $18,000 offer received through Basin Brokers for the sale of the 2012 Friendship mobile home. It is required that the purchaser move the mobile home from the rental lot prior to May 1, 2017 or they will be responsible for the lot rent. Motion seconded by Council Member Beard and carried by the following roll call vote: ayes: Sanford, Riely, Gravos, Beard, Devlin, and Liebel, nays: none. Mayor Voll proclaimed May 5, 2017 as Arbor Day and May 1, 2017 as Red, White, and Blue Day. Council Member Riely moved to approve Mayor Voll s appointment of Kylee Roff to the Tri- County Regional Development Council. Motion seconded by Council Member Devlin and carried unanimously. Council Member Gravos moved to approve Mayor Voll s appointment of Steve Williams as Building Official. Motion seconded by Council Member Liebel and carried unanimously. Council Member Riely moved to approve holding a Public Hearing to hear comment on a Petition to Vacate Sign Easement submitted by Hunter s Run LLC (Chad Merchant and Jason Vedadi) located at the SW corner of Lot 138B Hunter s Run Subdivision correction plat doc# Public Hearing will be held June 5, 2017 at 6:00 p.m. City Engineer Rick Jore requested approval to advertise for bids for water main projects. Council Member Riely moved to approve the request to begin advertising for bids. Motion seconded by Council Member Gravos and carried unanimously. Council Member Beard moved to approve the 3-year service quote in the amount of $1,950 from Nova Fire Protection for inspection of the fire sprinkler system located at the Rough Rider Center. Motion seconded by Council Member Sanford and carried by the following roll call vote: ayes: Liebel, Sanford, Beard, Gravos, Riely, and Devlin; nays: none. City Administrator Moen gave an update on the Wolf Run Village Apartments and requested to use $19,000 that is in an escrow account for ongoing operation and maintenance needed in some of the units and to have the city pay the loan amount of $34,888 from the Police Unit Fee fund. Council Member Gravos moved to use the money in the escrow account for operation and maintenance and to pay the loan payment of $34,888 out of the Police Unit Fee fund. Motion seconded by Council Member Devlin and carried by the following roll call vote: ayes: Beard, Gravos, Liebel, Devlin, Riely, and Sanford; nays: none. It was the consensus of the Council for City Administrator Moen to work with Attorney Voll on the option of gifting the Hunters Run Townhomes owned by the city to Wolf Run Village.

5 Council Member Gravos moved to pay Vanguard Appraisals, Inc in the amount of $3,580 for services they provided at the appraisal informal hearings. Motion seconded by Council Devlin and carried by the following roll call vote: ayes: Sanford, Gravos, Beard, Riely, Devlin, and Liebel; nays: none. Council Member Riely moved to approve the Right-of-Way Easement from McKenzie Electric with the changes recommended by Attorney Voll. Motion seconded by Council Member Beard and carried unanimously. Council Member Riely moved to approve the Purchase Agreement between Stenehjem Development, LLP and the City of Watford City for Lot 1, Block 4, Rolling Hills Estates with a purchase price of $50,000 to be funded by the golf course consturction fund. Motion seconded by Council Member Gravos and carried by the following will call vote: ayes: Liebel, Sanford, Gravos, Beard, Riely, and Devlin; nays: none. Council Member Riely moved to approve the bills as listed. Motion seconded by Council Member Sanford and carried unanimously.
