1 Cowlitz County Board of Commissioners Minutes September 4, 2018 Vol. 555 Joe Gardner, Chairman Dennis P. Weber, Commissioner Arne Mortensen, Commissioner Tiffany Ostreim, Clerk of the Board Commissioner Gardner called the regular meeting to order at 9:00 a.m. Commissioner Weber and Commissioner Mortensen were present. Pledge of Allegiance - Led by Commissioner Gardner. Approval of Minutes of August 28, 2018 and Consent Agenda of September 4, Commissioner Mortensen moved to approve the Minutes of August 28, The motion carried with all voting in favor. Commissioner Weber moved to approve the Consent Agenda of September 4, The motion carried with all voting in favor. Citizen Comments - Rick Von Rock, Kelso; encouraged the Board to increase the Bailiffs pay to $15. Their duties and responsibilities have changed. Chief of Staff stated the Bailiffs are under the Elected Superior Court Judges. The County is currently working on a salary survey which includes an adjustment for the Bailiffs. Resolution No Proclaiming September, 2018 as Recovery Month in Cowlitz County- Commissioner Weber read the proclamation. Commissioner Weber moved to adopt the proclamation. Michelle Waltz, Longview; was present to accept the proclamation. The ih Annual Walk for Recovery will take place at Lake Sacajawea on September 29, The motion carried with Commissioner Gardner and Commissioner Weber in favor and Commissioner Mortensen abstained. Resolution No Proclaiming September, 2018 as Suicide Awareness and Prevention Month - Commissioner Weber read the proclamation. Commissioner Weber moved to adopt the proclamation. Peggy McCarthy and Jan Kell, National Alliance on Mental Illness (NAMI); were present to accept the proclamation. Volunteers have painted rocks and placed around the community. Invited everyone to attend an event September 11, 2018 at the Grove Alliance Church at 7 pm. Commissioner Mortensen asked if suicide rates were increasing and what the root of the issues was. Peggy stated suicide is significantly increasing nationwide. Trying to work at the beginning. Have become very prevalent because of the use of technology and bullying. The motion carried with Commissioner Gardner and Commissioner Weber in favor and Commissioner Mortensen abstained. Public Hearing - Title III Federal Forest Monies under the Secure Rural Schools and Community Self-Determination Act - Proposal received from Cowlitz County Department of Building and Planning- Hearing Continued to October 30, 2018 at 9:30 a.m. Nine-thirty a.m. was the time set for the public hearing. Katrina Harris, Office of Financial Management; and Elaine Placido, Building and Planning; were present. The Cowlitz County Department of Building and Planning is requesting $g,146. Their overarching goal of the Firewise Community Pilot Project is to increase wildfire preparedness and safety in Cowlitz County. The objectives are to: provide wildfire safety education; promote interagency, interdisciplinary and public

Building and Planning is requesting $2,000 in 2018 and the remainder of $7,146 to be reimbursed in Commissioner Gardner opened and closed the public testimony portion of the hearing as no one present spoke for or against. Commissioner Mortensen moved to accept the proposal from the Dept. of Building & Planning; authorize staff to advertise and publicize, as required by the Federal Act, the proposed project for 45 comment period; and continue the public hearing for October 30 at 9:30 a.m. The motion carried with all voting in favor. Approval of Request purchase of anti-malware software upgrade from Malwarebytes, Inc. for a license cost of $34.29 plus tax per computer for a total of 800 licenses; for a total cost of $21, including WA State sales tax - Randy Webster and Aaron Briggs, Information Technology; were present. This includes a discount of %. This adds to our cybersecurity portfolio. Also includes Sheriffs Office data terminals in patrol vehicles. The cost is for one year to protect the county's computers. The system as it sits now has caught over 132,000 exploits which includes malware and spyware. The county has stopped a couple hits from ransom ware. Rick Von Rock, Kelso; asked about the cost. Commissioner Mortensen moved to approve the purchase from Malwarebytes. The motion carried with all voting in favor. Professional Services Agreement with Love Overwhelming to provide a Coordinated Entry & Assessment System to efficiently connect Cowlitz County households experiencing homelessness or who are at risk of becoming homeless with the most appropriate housing options and needed support services. Maximum consideration not to exceed $74,369 during the period of July 1, 2018 through December 31, 2018 funded from Document Recording Fees - Gena James, Health and Human Services; was present. This is specific to coordinated entry for six months. Commissioner Weber moved to approve the Professional Services Agreement. The motion carried with all voting in favor. Professional Services Agreement with Love Overwhelming to prevent and divert households at risk of experiencing homelessness from the homeless system. Maximum consideration not to exceed $28,377 during the period July 1, 2018 through December 31, 2018 funded from Document Recording Fees - Gena James, Health and Human Services; was present. This is specific to prevention and diversion services for six months. CAP, Emergency Support and Community House do a small portion of prevention; a lot of it relies on donations. Commissioner Weber moved to approve the Professional Services Agreement. The motion carried with Commissioner Gardner and Commissioner Weber in favor and Commissioner Mortensen opposed. Consent Agenda Agreements / Contracts/ Bid Awards Perpetual Right-of-Way Easement for County Road Purposes from Gina L. Andrews and Lisa Lynn McDonald, Co-Trustees of the Mark F. Andrews Jr. Marital Trust, for the West Side Highway Slide Repair Project No ERP No Easement area is 1,630 square feet for a cost of $500.

Contract with Thyssenkrupp Elevator for the Elevator Upgrade Project; amount of $376, including WA State sales tax. Board Correspondence Release Bond in Lieu of Retainage to Advanced Excavating Specialists LLC for the Kalama River Road Rock Slide Removal- MP 9.8 to MP Project No Notice from Federal Energy Regulatory Commission regarding PacifiCorp Energy Merwin Hydroelectric Project No ramping rate deviation. Copy of Letter dated August 23, 2018 to Cynthia Brown, Chief of the Section of Administration, Office of Proceedings, Surface Transportation Board; from Louis Gitomer, LLC Attorney for Patriot Woods Railroad LLC with notice they have terminated negotiations with Cowlitz County for interim trail use/rail banking over approximately 21.5 mile rail line between milepost 8.5 at Ostrander Junction and the end of the line at milepost 30. Letter dated August 22, 2018 from Julie Lam, Department of Commerce, Economics and Statistics Administration; regarding preparations for the 2020 Census. Letter dated August 23, 2018 from Chad Hamel, Department of Energy, Bonneville Power Administration; regarding Columbian White-tailed Deer translocation project. Quorum established. Tuesday 9:00 a.m. Regular Public Meeting Commissioners Hearing Room, 207 4th Avenue North, Kelso, 3rd Floor Tuesday 2:00 p.m. Commissioner Conference Commissioners Office, 207 4th Avenue, North, Kelso, 3rd Floor. Present: Joe Gardner, Dennis Weber, Arne Mortensen, Axel Swanson, Traci Jackson, Tiffany Ostreim Agenda Items/Topics: BOCC Schedule - Looking at possible changes. Keep Monday the same, keep regular Tuesday morning, stop Commissioner Conference on Tuesday and Thursday. Wednesday am work session and CC in the afternoon. Regular meetings are posted on the county web with the agenda with the required notice - also put it in a policy or resolution. Work session 1/2-1 hour - staff presents a larger complex issue to the Board. Either staff needs direction or update the Board. Commissioner Conference - the Board drives those agendas. Only time the Board may meet together and publicly to coordinate information. Board is okay with making modifications to the regular calendar. Won't happen tomorrow. Will work on the calendar and update policy and procedures. Will put idea on the next Staff Meeting Agenda. Traci left. Human Resources requests as needed - no items. 2:30 pm Executive Session per RCW (1)(i) Litigation that has been specifically threatened. Present: Joe Gardner, Dennis Weber, Arne Mortensen, Axel Swanson, Tiffany Ostreim. By phone Steve DiJulio, Jay Donovan and Lee Marchisio. The Executive Session was announced for 30 minutes - until 3 pm. At 3 pm the Executive Session was continued for 15 minutes until 3:15 pm. Joe Gardner, Dennis Weber, Arne Mortensen, Axel Swanson, Tiffany Ostreim, Steve DiJulio, Jay Donovan and Lee Marchisio came out of Executive Session. No decisions were made. Axel left. 3:00 pm - Interview - Fair Board - Phyllis Hull (2 positions open) - applicant called this am to reschedule. 3:15 pm - Interview - Stormwater Advisory Committee - Rena Bellika (7 positions open) - Interview was conducted. Put on upcoming Agenda for consideration.

Authorize Chairman to sign a letter to Surface Transportation Board in response to Patriot Woods filing a request to vacate the decision and notice of interim trail use. Cowlitz County has invested resources into the analysis and evaluation. Mt St Helens Institute has a meeting on Wednesday - Request for Joe to attend and miss Wednesday's Work Session. Miscellaneous - Ongoing Projects and Organization Initiatives: Facilities/ Landfill/ 911 Transition/ Shooting Range/ Community Forest Trust/ Rails to Trails/ Event Center Hotel/ Economic Development/ Human Resources Initiatives/ Public Works Projects/ Therapeutic Courts/ Public Records Wednesday 1:30 p.m. Work Session General Meeting Room, 207 4th Avenue North, Kelso, 3rd Floor Present: Dennis Weber, Arne Mortensen, Axel Swanson, Traci Jackson, Cory Balkan, Gallagher; and Tiffany Ostreim County Staff - Jim Zdilar, Sabrina Fraidenburg, Jessica Warren, Gena James, Carole Harrison Agenda Items/Topics: Cory Balkan, Gallagher Insurance - Handouts scanned into Laserfiche, Work Session. Looking at option of transitioning from WCIF platform to administrative services self-funding plat form. Kaiser essentially stays the same and we can partially go self-insured. Currently have defined contribution. Looking for ways to attack that number and further enhance. Went over numbers Employee Benefit Analysis and Recommendations. Potential savings for transitioning. Have 2 completely different carriers and networks. Will continue to look at different alternatives. Determine what can be done. Many bargaining agreements. Decide what direction to go. Also must consider state application piece. A lot goes into implication. Hope to decide end of September. Not sure if 2019 is an option. Have a 90 day notice with WCIF which is the end of September. That deadline is also close to state deadline which is end of October. Labor agreements also has to be considered. Used data from U.S. Department of Housing and Urban Development Went over Prevention and Diversion -10 year plan Goal #2(a); Coordinated Entry- 10 year plan Goal #2; and Permanent Supportive Housing - 10 year plan Goal #3 (c). Would like to identify programs that are successful. Tim, Community House on Broadway; and Chuck Hendrickson, Love Overwhelming; spoke. Would like more data on Coordinated Entry and recidivism. Permanent Support Housing Contract for the period of July 1 through June 30, Commissioner Weber in support of permanent supportive housing- not enough data on which is more successful - group homes or scattered sites. Melissa Taylor, CAP; spoke. Permanent Supportive Housing Contract will be on the Agenda of September 11. Executive Session per RCW as needed- none needed.

A couple District Court Commissioners on the ballot have voice support. Aberdeen Community Court - commissioners have seen great value. Current District Court judges want to get up and running so new judges can pick up and keep going. Would like commitment for the money. There are people who truly cannot help themselves. Great Rivers would like you to say yes and have the current judges start. Commissioner Mortensen reluctant. District Court believes this is the best shot to save money and get people out of the health care system and jail. Commissioner Weber is supportive. Commissioner Gardner is currently contacting others. Would like to hear from other District Court Judges on the ballot. District Court will submit for the September 25 agenda - request for Mental Health Tax. Lisa Farvour will work on cost benefit - what it costs and the outcome. The Executive Session was announced for 20 minutes starting at 11 am. All parties came out of Executive Session at 11:20 am. No decisions were made. At 11:30 am it was announced Executive Session would be continued for 5 minutes. At 11:30 a.m. all parties came out of Executive Session. Mt St Helens institute is utilizing the Coldwater Visitor Center - Institute and Forest Service discussing future of Center. IT Director submitted resignation to go to the State Auditor. Axel left.
