1 Cowlitz County Board of Commissioners Minutes April 25, 2017 Vol. 538 Dennis P. Weber, Commissioner Arne Mortensen, Commissioner Commissioner Gardner called the regular meeting to order at 9:00 a.m. Commissioner Weber and Commissioner Mortensen were present. Pledge of Allegiance Led by Commissioner Gardner. Approval of Minutes of April 18, 2017 and Consent Agenda of April 28, 2017 Commissioner Mortensen moved to approve the Minutes of April 18, The motion carried with all voting in favor. Commissioner Weber moved to approve the Consent Agenda of April 28, The motion carried with all voting in favor. Citizen Comments Jim Hill, 1100 N. 22 nd, Kelso; spoke on behalf of veterans regarding fireworks codes. Veterans have done the work the country has required. PTSD affects many who have fought for this country. Requesting a reduction in the legal use, possession and sale of fireworks primarily to help alleviate some of the problems that our veterans face. Asking to reduce the time period fireworks are legal. Would like mortar shells eliminated. Richard Dreier, th Longview; spoke against limiting fireworks. Many organizations make income from selling fireworks. We should look at all sides of this situation. Gene Frymire, 304 Growlers Gulch, Castle Rock; spoke on combining agencies and issues of illegal immigrants. If an illegal immigrant is incarcerated here, the district office of ICE should be notified of the date of release. Commissioner Gardner noted the Jail does send their booking list to ICE. Jeff Wilson, Longview; stated the syringe exchange report for 2016 is flawed and has failed. Wants data. Bill Josh, Longview; stated there is a lot of missing data in the syringe exchange report. It is not a one for one exchange. Need to look at the program and perform an audit and be held accountable. Chris Bornstedt, 119 N. Maple Street, Kelso; stated there is a data breach which needs to be looked at. Contract completion with Unitec Corporation for the Headquarters Landfill Truck Scales Project No. 8452; total cost $304, Commissioner Mortensen moved to accept the contract as complete with Unitec Corporation for the Headquarters Landfill Truck Scales Project No. 8452; total cost $304, Designed to make delivery of solid waste much more efficient. The motion carried with all voting in favor. Lease Agreement - Non-Residential with Lauri Rowland for lease of office space in the County owned building commonly known as "Courthouse Square" for a period of one year commencing on April 25, 2017 to April 24, 2018; annual rent is $2,400 Commissioner Weber moved to approve the Lease Agreement - Non-Residential with Lauri Rowland

2 Commissioners Minutes Vol. 538 Page 2 for lease of office space in the County owned building commonly known as "Courthouse Square" for a period of one year commencing on April 25, 2017 to April 24, 2018; annual rent is $2,400. The motion carried with all voting in favor. Public Hearing - Ordinance No Regulating franchises in County Road Rightsof-Way; creating Chapter and amending Section of the County Code. Ninethirty a.m. was the time set for the public hearing. Doug Jensen, Prosecuting Attorney s Office; and Patrick Harbison, Public Works; were present. This lays out the process franchisees would go through to utilize county road rights-of-way. It evaluates what is in the best public interest. Commissioner Gardner opened and closed the public testimony portion of the hearing as no one present spoke for or against the ordinance. Commissioner Mortensen moved to adopt the Ordinance related to regulating franchises in County Road Rights-of-Way; creating Chapter and amending Section of the County Code. The motion carried with all voting in favor. Public Hearing - Ordinance No Regulating Utility Installations Upon County Road Rights-of-Way; creating Chapter and amending Section of the County Code. Nine forty-five a.m. was the time set for the public hearing. Doug Jensen, Prosecuting Attorney s Office; and Patrick Harbison, Public Works; were present. This provides the permitting ability. Commissioner Gardner opened the public testimony portion of the hearing. Chris Bornstedt, 119 N. Maple Street, Kelso; asked about costs. Patrick responded no increase in costs for homeowners. Commissioner Gardner closed the public testimony portion of the hearing. Commissioner Weber moved to adopt the Ordinance related to regulating Utility Installations upon County Road Rights-of-Way; creating Chapter and amending Section of the County Code. The motion carried with all voting in favor. Resolution No Setting fees in chapters and of the County Code Doug Jensen, Prosecuting Attorney s Office; and Patrick Harbison, Public Works; were present. The County shall be reimbursed for its costs and expenses. These fees will be billed to the applicant within 30 days. Commissioner Mortensen moved to adopt the resolution setting fees in chapters and of the County Code. The motion carried with all voting in favor. Consent Agenda Call for Bids Call for Bids Countywide Pavement Striping Project No ; Bid Opening to be held May 16, 2017 at 11:00 a.m. Agreements Consolidated Homeless Grant Application 2017/2018; Cowlitz County WA Department of Commerce, Community Services and Housing Division Assistance Unit signed by Chairman Gardner; April 17, 2017.

3 Commissioners Minutes Vol. 538 Page 3 Correspondence Copy of letter dated April 1, 2017 to Governor Jay Inslee from Washington State Association of Counties regarding rural water under the Hirst decision. Letter dated April 18, 2017 to Honorable Brian Blake, Chair, House Agriculture and Natural Resources Committee; from the BOCC regarding Engrossed Second Substitute Senate Bill 5239 regarding water availability. Copy of letter dated April 18, 2017 to Honorable Paul Ryan and Honorable Nancy Pelosi from Congress members Jaime Herrera Beutler, Peter DeFazio, Chris Stewart, and Jared Huffman regarding concerns that the Secure Rural Schools and Community Self-Determination Act was not reauthorized in the 114th Congress. Vouchers Drainage Improvement District No. 1 recommends approval of the February 2017 vouchers in the total amount of $13, The following vouchers/warrants are approved for payment Fund Voucher Numbers Amount Claims $ 21, Claims for Special Purpose Districts , Claims , The Cowlitz County Board of Commissioners adjourned at 10:00 a.m. to meet again Tuesday, May 2, 2017 at 9:00 a.m. /s/ Tiffany Ostreim /s/ Joe Gardner Bid Openings - Conducted by the Clerk of the Board after Board meeting is adjourned Bid Opening - Kalama River Road Guardrail Repair Project No. 5306; FA No. ER 1602(025); Federal Contract No. TA Eleven o clock a.m. was the time set for the bid opening. The four bids received were opened. Bids were received from: Columbia River Contractors, Inc. - $35,400; Coral Construction Company - $77,755; Dirt & Aggregate Interchange, Inc. - $47,777; and Peterson Brothers - $40, The bids were submitted to the Department of Public Works for sufficiency and responsiveness. Bid Opening Countywide Pavement Overlay - Project No Eleven o clock a.m. was the time set for the bid opening. The two bids received were opened. Bids were received from: Lakeside Industries - $710,508.94; and Granite Construction Company - $878, The bids were submitted to the Department of Public Works for sufficiency and responsiveness. Proposal Opening - Prosecutor Case Management System. Eleven o clock was the time set to open the proposals. Proposals were submitted by: Karpel Solutions; LegalEdge Software; and Spartan Technology Solutions, Inc. The Board reconvened on April 25, 2017 at 7:00 p.m. for the continued public hearing regarding the Comprehensive Plan.

4 Commissioners Minutes Vol. 538 Page 4 Continued Public Hearing - Cowlitz County Comprehensive Plan - Follow-up: Parks, Trails and Recreation. New Topic: Transportation and Circulation. Commissioner Gardner called the continued public hearing on the Comprehensive Plan to order at 7:00 p.m. Commissioner Weber and Commissioner Mortensen were present. Commissioner Gardner led the Pledge of Allegiance. Staff present: Elaine Placido, Nick Little, and Greta Holmstrom. Only changes made to Parks and Recreation was to add fly fishing. Supports the goals and policy of the other parks plans listed. Removed Community Planning Areas and associated goals and policies. Added section addressing citizen participation and community outreach. Added/amended goals and policies associated with citizen participation and outreach. Minor grammatical changes throughout. Eliminated large test gaps in draft document. New section - Community Outreach emphasized importance of citizen involvement in local government. Linked citizen participation to outreach efforts by the county. Establish a culture that values education, citizen participation, and information. New Goal increase by exploring opportunities and strategies for citizens to participate in government on both a county-wide level and a smaller more localized level. Policy identify existing communities, crease contacts and partnerships, explore a variety of ways to provide information, and ensure opportunities exist. New Goal establish educational programs to enable early and ongoing citizen involvement in the development of land use regulations, and make every effort to incorporate those comments into the process. Policy foster establishment of citizen groups, outreach, establish education programs, and participate in existing forums. Transportation and circulation Documents existing conditions and provides goals and policies. Themes consistency, demand, context and safety. Alan Engstrom, Longview; spoke on the Parks and Recreation Plan. Wants recreational opportunities explained. Wants included: 31 miles of patriot rail Company s rail line between Longview and the Green Mountain Mill site. Coordinate acquisition planning for Patriot rails proposed rail line abandonment with the various jurisdictions through which the line passes. Partner with public and private organizations to secure funding. Commissioner Weber noted the Parks Department has a very detailed plan. Tom Hickey, Longview; appreciated citizen participation, but didn t feel there was. To hold accountable, there needs to be specific plans. The Parks Department does not have Rails to Trails in their plan. John Keatley, Castle Rock; spoke in support of an annual plan update. Suggest there not be a fee to update the plan annually. Requested a section on water availability. Alan Engstrom, Longview; doesn t suggest a county owned recreational opportunity with the rail line but a partnership. Commissioner Weber noted the county is already in the process of coordinating acquisition planning. Alan Engstrom, Longview; spoke on Implementation 74% of population is located in urban areas. Haven t mentioned zoning and benefits. When CPA was eliminated, you might need to beef up the implementation plan with references to opportunities the land use ordinance provides for citizens for implementing restrictions or proposals for weighing what people want to do with their property while living close to their neighbors.
