1 GENERAL COUNCIL MINUTES DECEMBER 21, :00 P.M. The 1st General Council meeting of the fifty-fifth Elected Council of the Six Nations of the Grand River Territory was held on the above noted date held in the Council Chambers of the Administration Building, Ohsweken, Ontario, N0A 1M0 with Chief William K. Montour presiding and Mr. Ross Johnson opening the meeting with prayer. THOSE PRESENT: Chief William K. Montour G. Ava Hill R. Helen Miller David Hill Ross Johnson Mark B. 2 CHANGES/ADDITIONS/DELETIONS/ADOPTION OF THE GENERAL COUNCIL AGENDA FOR DECEMBER 21, 2010 Additions 1. Melba Thomas Police Commission Representative Update GC#1/12/21/2010 Moved by Carl Hill and seconded by Robert Johnson that the General Council agenda be adopted as presented, with noted addition. 1. Melba Thomas Police Commission Representative Update GUEST MARY JAMIESON NATIVE MANAGEMENT SERVICES Re: Chiefs of Ontario Structural Review (PowerPoint Presentation) In attendance to present suggested changes to the restructuring of the Chiefs of Ontario. These changes were requested to make the Chiefs of Ontario office more efficient in what the original intent of this organization was. Mary Jamieson presented her suggestions to Six Nations Council through a PowerPoint presentation. She requested feedback from Six Nations Council about how they think that COO should be operating. SNC is questioning what the mandate of the COO really is. Community issues not even being discussed no work is getting done NEW BUSINESS - GUEST JOCK HILL Re: Acceptance of the HRC Quarterly Report and Approval of Funding Release GC#2/12/21/2010 Moved by Carl Hill and seconded by Melba Thomas that Six Nations Council accept the Haudenosaunee Resource Centre 2 nd Quarter Report, as requested and that 3 rd Quarter funding may now be released in the amount of $64, SIX NATIONS LANGUAGE COMMISSION Teesha Emarthale in attendance on behalf of the Six Nations Language Commission requesting that Six Nations Council release funding in the amount of $21, to the Godiwenae Odehse program. GC#3/12/21/2010 Moved by David Hill and seconded by Robert Johnson that Six Nations Council release the second installment of the Six Nations Language Commission funds, to be released to Godiwenae Odehse in the following amounts: 2

3 From Surplus Funds $ 5, From Six Nations Language Commission $ 16, For a Total Amount of $ 21, Six Nations Language Commission also stated that they would like to begin the process of revising their Terms of Reference and need to hire a consultant to do so. The consultant is requesting that 20% of $16, be released up front. Six Nations Council was not prepared to approve that release as there was not enough information provided to them as this point. ADOPTION OF THE GENERAL COUNCIL MINUTES OF NOVEMBER 16, It is suggested that the names of reporters present be included in the minutes. Economic Development Director to have meeting with Todd Green from KVAR in January. Staff to check with Oneida First Nation regarding how they set up their Land Registry, possible meeting. Councillors request that they be copied on all letters sent out. Hiring of the Superintendent of Education has been out of until the third week in January GC#4/12/21/2010 Moved by David Hill and seconded by Wray Maracle that Six Nations Council accept the of November 16, 2010 as presented on this day. SIX NATIONS HEALTH SERVICES Recommendation 1 GC#5/12/21/2010 Moved by Melba Thomas and seconded by Carl Hill that the Six Nations Council approves the Six Nations Family Health Team Interim Funding Agreement Amendment #5 in the amount of $691, for fiscal year Further that approval be given for Chief William K. Montour to sign the agreement. Also that second reading be waived. Recommendation 2 GC#6/12/21/2010 Moved by Robert Johnson and seconded by G.Ava Hill that Six Nations Council approve for signature the Health Funding Contribution Agreement Amendment ON A15 that includes the additional funding in the amount of $199, applicable to the fiscal year program and service delivery. 3

4 MEMORANDUM FROM SIX NATIONS PUBLIC WORKS Re: Off Road Ditching throughout Six Nations Six Nations Public Works department submitted recommendation for Shovel Ready Projects. Off road ditching was recommended as the first project. It was assessed by the Miller Group that the roads at Six Nations were corroding because of drainage problems, water from under the road beds causing the surface to heave and break-up. Senior Administrative Officer, Dayle Bomberry and A/Director of Public Works Frank Montour are to put together an action plan and Class B estimate of the cost of this project and also a report on the conditions of all Roads throughout Six Nations for Council to make informed decisions. It is recommended that a special meeting be held just to discuss Six Nations Roads. GC#7/12/21/2010 Moved by Carl Hill and seconded by Robert Johnson that Six Nations Council accepts Memorandum for Six Nations Public Works re: Off Road Ditching as a Shovel Ready project. SIX NATIONS MATRIMONIAL REAL PROPRTY LAW GC#8/12/21/2010 Moved by G.Ava Hill and seconded by Lewis Staats that Six Nations Council accept Six Nations Matrimonial Real Property Final Draft as information and that it will be presented at the January 18, 2011 General Council meeting for Second Reading. RECOGNITION OF BUSINESS (i) Sunrise Trading Post, Owned by Randolph Johnson GC#9/12/21/2010 Moved by Wray Maracle and seconded by Helen Miller that Six Nations Council recognize Sunrise Trading Post owned by Randolph Johnson as a business operating on Six Nations. (ii) Shawana Jewllery, Owned by Michelle Jonathan GC#10/12/21/2010 Moved by Wray Maracle and seconded by Helen Miller that Six Nations Council recognize Shawana Jewellery owned by Michelle Jonathan as a business operating on Six Nations. 4

5 (iii) Fun Tattoos & Nails, Owned by Cheryl Davis GC#11/12/21/2010 Moved by Roger Jonathan and seconded by Ross Johnson that Six Nations Council recognize Fun Tattoos & Nails owned by Cheryl Davis as a business operating on Six Nations. (iv) Scawn Express, Owned by Scott Longboat GC#12/12/21/2010 Moved by David Hill and seconded by Lewis Staats that Six Nations Council recognize Scawn Express owned by Scott Longboat as a business operating on Six Nations. LETTER FROM THE MINISTRY OF ENERGY, BRAD DUGUID RE: Korean Consortiums proposed renewable energy project in Haldimand Minister of Energy submitted letter to Chief William Montour regarding Six Nations concerns about the Korean Consortiums proposed renewable energy project in Haldimand. The Ministry has agreed to meet with Six Nations to work toward a mutually satisfactory resolution, as well as other matters including land lease. GC#13/12/21/2010 Moved by Melba Thomas and seconded by Lewis Staats that Six Nations Council accept the letter to Six Nations from the Minister of Energy, Brad Duguid regarding the Korean Consortium s proposed Renewable Energy project, as information. VOLUNTEER SERVICE AWARDS PROGRAM Re: Ministry of Citizenship and Immigration inviting Six Nations to participate GC#14/12/21/2010 Moved by Robert Johnson and seconded by Wray Maracle that the letter from the Ministry of Citizenship and Immigration to be distributed to all Six Nations Council departments for recommendations. STATISTICS CANADA 2011 CENSUS GC#15/12/21/2010 Moved by Carl Hill and seconded by Ross Johnson that the Chiefs office invite Statistics Canada to make a presentation about the 2011 Census. 10 IN FAVOR 1 OPPOSED (DH) 5

6 Senior Administrative Officer to investigate legal obligation for Six Nations to participate in the 2011 Census. COMMUNITY PHYSICIAN RECRUITMENT COMMITTEE GC#16/12/21/2010 Moved by Ross Johnson and seconded by Carl Hill that Six Nations Councillor Robert Johnson be appointed to the Community Physician Recruitment Committee Board of Directors. UNDERAGE YOUTH WORKING AT SMOKE SHOPS Chief Montour stated his concern about the community youth dropping out of school to make easy money at a smoke shop. Also concerns that there is more than cigarettes being sold at some of the shops. Chief Montour proposes that a Six Nations By-law be made that prohibits minors from selling tobacco products. It is brought up that these products are not only being sold in smoke shops but in convenience stores as well, where a number you youth work part-time. There was also the question of who will enforce this by-law and any other by-law. Policy Analyst to research the pro s, con s and other legalities of this proposed by-law. SCHEDULING AND DELEGATIONS First Nations and Inuit Youth Employment Strategy Ontario Regional Meeting. Grand River Employment and Training is taking this meeting. Shannen s Dream Proposed Meeting More information is needed. 2 nd Bi-national Conference on Contraband. GC#17/12/21/2010 Moved by Helen Miller and seconded by Bob Johnson that Chief William Montour attend the 2 nd Annual Bi-national Conference on Contraband on February 2-3, 2011 to sit on a panel to offer Six Nations perspective. GC#18/12/21/2010 Moved by Melba Thomas and seconded by Ross Johnson that Wray Maracle attend the 2 nd Annual Bi-national Conference on Contraband on February 2-3, 2011 to observe and report. NEW BUINESS POLICE COMMISSION UPDATE Melba Thomas reports that there was discussion at the last Police commission meeting regarding reports to Six Nations Council. 6

7 The Six Nations Police are behind on compiling statistics which makes it difficult to report monthly as requested. It is stated that Six Nations Council does receive Year End Reports and it is questioned as the importance or purpose of having monthly reports. The Police Commission felt that the Safety and Security Committee was useful in addressing the concerns of both the Six Nations Police and Six Nations Council. GC#19/12/21/2010 Moved by Melba Thomas and seconded by Wray Maracle that Six Nations Council put forward concerns of safety and security and statistics to the Six Nations Police Commission at the Six Nations Council Orientation Retreat taking place on January 12-14, ADJOURNMENT of OPEN SESSION GC#20/12/21/2010 Moved by Carl Hill and seconded by David Hill that Wray Maracle that the General Council Open Session be adjourned at 8:20pm.
