1 MINUTES OF THE REGULAR JOINT MEETING OF THE MONTCLAIR CITY COUNCIL, SUCCESSOR AGENCY AND MONTCLAIR HOUSING CORPORATION BOARDS, MONTCLAIR HOUSING AUTHORITY COMMISSION, AND MONTCLAIR COMMUNITY FOUNDATION BOARD HELD ON MONDAY, OCTOBER 1, 2018, AT 7:00 P.M. IN THE CITY COUNCIL CHAMBERS, 5111 BENITO STREET, MONTCLAIR, CALIFORNIA I. CALL TO ORDER Mayor Eaton called the meeting to order at 7:00 p.m. and asked that everyone please silence their electronic devices as a courtesy to others while the meeting is in session. II. III. PRESENTATIONS VI. A. Presentation of State Assembly Certificate of Recognition to Small Business of the Year Award Recipient Rosa Rangel, Owner of the Former Montclair Florist Council Member Ruh presented a Certificate of Recognition from Assemblymember Freddie Rodriguez to Ms. Rosa Rangel and thanked her for being a part of the Montclair community. Ms. Rangel thanked everyone for their support. PUBLIC HEARINGS A. Consider Adoption of Resolution No Approving an Amendment to the Holt Boulevard Specific Plan Land Use Map and Modifying the Zoning Designation for a 0.68 Acre Parcel at 4144 Holt Boulevard from R3 (11 du/ac) to Commercial Mayor Eaton declared this the time and place set for a public hearing related to Resolution No and invited comments from the public. There being no one in the audience wishing to speak, Mayor Eaton closed the public hearing and returned the matter to the City Council for its consideration. Moved by Council Member Dutrey, seconded by Council Member Ruh, that Resolution No , entitled, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MONTCLAIR APPROVING AN AMEND- MENT TO THE HOLT BOULEVARD SPECIFIC PLAN AMENDING THE LAND USE MAP TO CHANGE THE ZONING DESIGNATION OF 0.68 ACRE PARCEL AT 4144 HOLT BOULEVARD, FROM R3 (11 DU/AC) TO COMMERCIAL (APN ), be adopted.* Mayor Pro Tem Raft asked why the property owner is requesting the property be changed back to Commercial after it was already changed from Commercial to Residential at their request. 2 City Manager Starr indicated the property owner feels the property would have more value if it could be consolidated with surrounding commercial properties by potential buyers for a larger commercial project, which would also benefit the City. Council Member Martinez thanked Upland Councilwoman Debra Dorst Porada for pursuing this issue on behalf of her father, the property owner. Council Member Ruh stated that recent real estate trends tend to include residential and commercial areas in close proximity so that residents can walk to shopping, dining, and work. *Resolution No was unanimously adopted 5 0. Approval of Minutes 1. Regular Joint City Council/Successor Agency Board/MHC Board/MHA Commission/MCF Board Meeting of September 17, 2018 The City Council, Successor Agency Board of Directors, Montclair Housing Corporation Board of Directors, Montclair Housing Authority Commissioners, and Montclair Community Foundation Board of Directors approved the minutes of the September 17, 2018 regular joint meeting. B. Administrative Reports 1. Setting a Public Hearing on Monday, October 15, 2018, at 7:00 p.m. in the City Council Chambers to Consider Ordinance No Amending Chapter of the Montclair Municipal Code to Provide Exemptions for Disabled Pedestrians Use of Mobile Electronic Devices for Safely Crossing Public Roadways The City Council set a public hearing for Monday, October 15, 2018, at 7:00 p.m. in the City Council Chambers to consider Ordinance No amending Chapter of the Montclair Municipal Code to provide exemptions for disabled pedestrians use of mobile electronic devices for safely crossing public roadways. 2. Approval of Parcel Merger No for Two Parcels Located at the Southeast Corner of State Street and Kadota Avenue The City Council approved Parcel Merger No for two parcels located at the southeast corner of State Street and Kadota Avenue. 3. Approval of Parcel Merger No for Five Parcels Generally Located on the East Side of Central Avenue South of Holt Boulevard and West of Rose Avenue The City Council approved of Parcel Merger No for five parcels generally located on the east side of Central Avenue south of Holt Boulevard and west of Rose Avenue. 4. Approval of the Plans and Specifications for the City Hall Improvement Project Phase 1 Council Chamber Remodel Authorizing Staff to Advertise for Bid Proposals for the City Hall Improvement Project Phase 1 Council Chamber Remodel The City Council took the following actions in relation to the Montclair Community Foundation Board Minutes October 1, 2018 Page 2 of 7

3 City Hall Improvement Project Phase 1 Council Chamber Remodel: (a) (b) Approved the plans and specifications for the Project. Authorized staff to advertise for bid proposals for the Project. 5. Approval of the Filing of a Notice of Completion of Contract with All American Asphalt, Inc., for the San Bernardino Street Rehabilitation Project Release of Retention of Payment Bond 30 Days After Recordation of Notice of Completion The City Council took the following actions in relation to the San Bernardino Street Rehabilitation Project: (a) (b) Approved of the filing of a Notice of Completion of Contract with All American Asphalt, Inc., for the Project. Authorized release of retention of payment bond 30 days after recordation of the Notice of Completion. 6. Filing Status Report on Emergency Contracting Procedures Related to HVAC Replacement at the Police Department Facility Declaring a Termination to the Emergency Action Authorized Under Resolution No Approval of the Filing of a Notice of Completion for the Emergency Repairs The City Council took the following actions: (a) Filed a status report on emergency contracting procedures related to the HVAC replacement at the Police Department facility. (b) Declared a termination to the Emergency Action authorized under Resolution No (c) Approved of the filing of a Notice of Completion for the emergency repairs. 7. Receiving and Filing the 2018 Local Agency Biennial Notice and Directing Staff to Amend the City s Conflict of Interest Code Pursuant to the Political Reform Act The City Council received and filed the 2018 Local Agency Biennial Notice and directed staff to amend the City s Conflict of Interest Code pursuant to the Political Reform Act. 8. Authorizing Appropriations of $20,220 from the Public Safety Grant Fund and $42,312 from the Federal Asset Forfeiture Fund to Purchase a Leica Laser Scanning Forensic Mapping System Package for Law Enforcement Operations The City Council authorized appropriations of $20,220 from the Public Safety Grant Fund and $42,312 from the Federal Asset Forfeiture Fund to purchase a Leica laser scanning forensic mapping system package for law enforcement operations. 9. Approval of City Warrant Register and Payroll Documentation The City Council approved the City Warrant Register dated October 1, 2018, totaling $1,705,601.31; and the Payroll Documentation dated September 16, 2018, amounting to $613, gross, with $430, net being the total cash disbursement. Approval of Agreement No with Pomona Valley Towing for Vehicles Towed and Stored at the City's Impound Lot Under California Vehicle Code Section , the 30 Day Impound Law The City Council approved Agreement No with Pomona Valley Towing for vehicles towed and stored at the City's impound lot under California Vehicle Code Section , the 30 day impound law. 2. Approval of Agreement No with the California Highway Patrol for Use of the Montclair Police Department Firearms Shooting Range D. Resolutions The City Council approved Agreement No with the California Highway Patrol for use of the Montclair Police Department firearms shooting range. 1. Adoption of Resolution No Authorizing Placement of Liens on Certain Properties for Delinquent Sewer and Trash Charges The City Council adopted Resolution No authorizing placement of liens on certain properties for delinquent sewer and trash charges. 2. Adoption of Resolution No Updating the Provisions of the Safety Committee for the City of Montclair The City Council adopted Resolution No updating the provisions of the Safety Committee for the City of Montclair. VIII. IX. PULLED CONSENT CALENDAR ITEMS None PUBLIC COMMENT City Attorney Robbins advised the Police Department is still investigating the incident that resulted in a pedestrian fatality on September 6, and noted that the City Council is generally prohibited from responding to public comments not related to items appearing on the agenda. A. Ms. Elizabeth Valdez invited the City Council and the community to attend El Camino Elementary School s Walk to School Day on October 10, 2018, noting this year s event is being held in memory of John Macias. She distributed flyers to the City Council with details about the event. Ms. Valdez also expressed her belief that the City could do more to ensure the safety of students including incorporating flashing yellow lights in school crosswalks and issuing severe fines for speeding and other traffic violations in school zones. She requested the City consider hiring crossing guards for the two middle schools in Montclair as there are for the elementary schools and expressed her hope that the Ontario Montclair School District, Montclair Police Department, City Council, and community can work together to make this a reality. B. Ms. Rachel Macias, a Montclair resident, introduced herself as the grandmother of John Macias and requested additional safety measures be implemented such as warning lights at the crosswalk at Vernon Avenue and San Bernardino Street, and having the School Resource Officer patrol the outside of the school during morning drop off and afternoon pick ups to discourage drivers from violating traffic laws around the school. 5 C. Mr. John Egan, President of the Ontario Montclair Teachers Association, stated he believes the City and the school district need to work together to increase traffic safety around schools. He criticized the idea that speed bumps are not installed due to the potential of speeding drivers losing control of their vehicles or damaging the cars, and asked what is more important cars or children? D. Mr. Loren Martens, 4285 Benito Street, stated that he constantly witnesses drivers along Benito Street in front of Montclair High School disregarding no stopping signs and performing illegal U turns in the middle of the street before and after dropping their children off. E. Mr. Reginald Clark, 9634 Carrillo Avenue, introduced himself as a 32 year resident of Montclair and a retired college professor. He commented regarding his concerns about the safety of the crosswalk at Vernon Avenue and San Bernardino Street and suggested hiring a school crossing guard for the intersection. He noted he also interviewed several crossing guards and noted several hazards that he does not believe a warrant study will find including extreme glare from the sun rising in the mornings when school starts, which blinds drivers and makes it difficult for crossing guards to tell whether a car is turning left or right or not at all; large vehicles parked on the street obstructing the drivers view of the stop signs; and contradictory speed limit signs posted at schools, noting he has observed a 40 MPH speed limit sign posted right in front of Vernon Middle School. Mayor Eaton thanked everyone for bringing their comments, concerns, and suggestions. X. RESPONSE None XI. COMMUNICATIONS A. City Department Reports 1. Police Department Breast & Prostate Cancer Awareness Campaigns Executive Director of Public Safety/Police Chief Avels advised that in the months of October and November, the Police Department has partnered with Loma Linda University Medical Center to help raise funds for Breast and Prostate Cancer. In October, Police Department employees will wear modified uniforms incorporating pink to raise awareness and funds for Breast Cancer research; and in November, the Department will participate in the No Shave November Prostate Cancer awareness campaign. 2. Human Services Upcoming Events Director of Human Services Richter requested everyone mark their calendars for the following upcoming events: The Community Activities Commission and the Montclair Chamber of Commerce will be sponsoring two Candidates Forums. o Mayoral Candidates Forum Wednesday, October 10 o Council Candidates Forum Wednesday, October 17 Both events will be held in the Senior Center at 7:00 p.m. Three of the four candidates for Mayor, and five of the six candidates for Council will be participating in the events. Both events will be live streamed to the City s Facebook page and can be viewed on Montclair s Community Access Channel 3, as well as being posted to the City s YouTube and Facebook pages beginning Monday, October 22nd. 6 The Montclair Community Health Fair, sponsored by the City of Montclair, Montclair Hospital Medical Center, and the Women s Club of Montclair, will be held on Tuesday, October 16, from 9:00 a.m. to noon in the Community Center. The event will include complimentary flu shots, health screenings, and over 35 health agencies will be represented. Light refreshments will be available to those in attendance. Lights On After School will be held on Thursday, October 25, at 6:30 p.m. in the Community Center. This year s theme is We are MAP (Montclair After School Program), with each of the twelve program sites representing their uniqueness that evening. The event will include dance performances by Serrano, Ramona, and Kingsley program sites. B. City Attorney No Comments C. City Manager/Executive Director City Manager/Executive Director Starr noted he feels it is important for the community to understand that traffic safety is one of the City s top priorities, and that the City complies with the California Uniform Traffic Control Devices manual. He noted all signs and traffic control devices are in compliance; however, staff would look into the concerns brought by residents this evening. D. Mayor/Chair Mayor/Chairperson Eaton stated she attended the groundbreaking ceremony for a new building at Vernon Middle School and looks forward to the building s completion E. City Council/Successor Agency Board/MHC Board/MHA Board/ MCF Board Council Member/Director Martinez commented as follows: 1. She commended staff who worked on the City s annual newsletter. 2. She announced that as of its last meeting, the Montclair Ontario Junior Women s Club has officially changed its name and is now called the Women s Club of Montclair. She noted she has been involved with the club for several years and was very happy about the change. 3. She congratulated Code Enforcement Supervisor Fondario on becoming a grandfather. Mayor Pro Tem Raft stated she has heard from some residents who say they did not receive the City newsletter. City Manager Starr advised there are plenty of additional copies and Council Members are welcome to take several to distribute to those who did not receive one. Council Member/Director Dutrey commented as follows: 1. He thanked staff for sending out the City s newsletter. 2. He noted his appreciation for those who attended tonight s meeting to speak regarding school safety and to promote the walking to school event. Council Member/Director Ruh commented as follows: 1. He stated he has confidence in the City s capable and professional staff investigating the crosswalk accident. 2. He discussed two bills, SB 905 (allowing bars to stay open until 4:00 a.m.) and SB 328 (requiring all schools start at 8:30 a.m.) that were vetoed by Governor Brown, and highlighted two that were signed AB 2274 stipulating that in divorce proceedings, pets go to the most responsible party, and SB 1249 banning the Montclair Community Foundation Board Minutes October 1, 2018 Page 6 of 7

7 XII. import of cosmetics that are tested on animals, noting he feels these two pieces of legislation will have a positive impact on the state. F. Committee Meeting Minutes 1. Minutes of Personnel Committee Meeting of September 17, 2018 ADJOURNMENT The City Council received and filed the minutes of the Personnel Committee meeting of September 17, 2018, for informational purposes.
