1 April 19, 2007 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Chairman Phyllis Hunewill, Vice-Chair Don Tibbals, Commissioners Bob Milz and LeRoy Goodman. Commissioner Larry McPherson was absent. Also present: Interim County Manager Robert Hadfield, Chief Deputy District Attorney Mark Krueger, Clerk/Treasurer Nikki Bryan and Deputy Clerk Joanne Sarkisian. 1. Review and adoption of agenda It was the consensus of the Board to approve the agenda as presented. 2. Appointed Official s report Planning Director Rob Loveberg thanked the Board for their participation in the Master Plan workshop. He mentioned that the Silver City workshop has been postponed and will be rescheduled shortly. Mr. Loveberg then mentioned that all in all there was a very good response to the forums and they have received some useful ideas and comments. His department is in the process of compiling the information and will soon be presenting a draft vision statement to the Board. Mr. Loveberg mentioned that a letter had been received from FEMA about a possible violation of national flood insurance program regulations regarding a letter of map revision at Santa Maria Ranch. Hopefully this matter will be resolved with discussion between Western Engineering and the reviewing firm hired by FEMA. Comptroller Josh Foli updated the Board on the IT problems that have affected the entire computer system including the server. He gave details of what is being done to rectify the problems. Mr. Foli spoke of the quarterly budget report through March 31, He mentioned that all of the expected revenues are coming in as anticipated with the exception of consolidated tax. Utilities Director Mike Workman distributed a map of the proposed water import project. The map detailed the expansion of the inter-tie program with Carson City. Mr. Workman and his department have been busy working on water rights related issues and ways to resolve protests. Dayton Utilities have been doing extensive monitoring of ground water quality and levels as well as effluent. Emergency Manager Jeff Page briefed the Board on a meeting with the governor s office. The group is working on a mutual aid project to incorporate the three emergency systems into one set of rules and regulations that will be accepted by all Nevada cities and counties. Human Services Director Edrie LaVoie reminded the Board that there will be a volunteer appreciation dinner in Yerington on April 24, Also, an open house will be held on Wednesday April 25, 2007 at the new Fernley offices. Human Resources Director Steve Englert distributed a packet on each of the applicants for the position of County Manager. 3. Elected Officials comments Sheriff Allen Veil was available to answer any questions about a statistics report he had distributed to the Board. He mentioned that a lockdown had occurred at a Fernley school. There was no incident, lockdowns are customary when the school performs locker searches. Sheriff Veil then mentioned that the look of the Sheriff s vehicles will be enhanced. He brought a prototype vehicle for the Board to view. 4. 2 5. County Manager report Interim County Manager Bob Hadfield gave a brief overview of the current legislative session. He gave details and status of the appropriation bill for the juvenile justice complex. Mr. Hadfield referred to a memo he had written to the Board. He asked the Board to consider endorsing a strategy plan that would address the critical needs of the County as a whole and each of its individual departments. The principles of this plan should be in two areas, core staff and facilities. He feels that in order for the County to maintain a strong core staff they need to remain competitive and technologically updated. Mr. Hadfield also feels it is in the best interest of the County to selectively invest in critical upgrades to existing facilities. He commented that any new major facilities should be put on hold and one at a time leased facilities should be replaced with County owned facilities. Interim County Manager Bob Hadfield stated that there needs to be a vision for Lyon County and this needs to be done through the master plan process. 6. Commissioner comments Comm. Goodman had no comments. Comm. Milz spoke of parking in old town Dayton. As new businesses are coming into the area parking should be addressed. Mr. Milz gave photos to Planning Director Rob Loveberg and asked Mr. Loveberg to work with County Engineer Dick Faber and the Interim County Manager on this issue. Comm. Tibbals mentioned the Master Plan workshop attended by the Board. Comm. Hunewill mentioned that water remains a large concern in Lyon County. 7. Public participation **CONSENT AGENDA** 8. Discussion and possible action to allow the Dayton Historical Society of Dayton Valley to place five (5) kiosks signs on Lyon County property at historic sites in Dayton, describing the history of those sites and buildings Dayton Valley Historical Society Secretary Mabel Masterman addressed the Board. She gave details of the grant for this project. Ms. Masterman gave the locations of each of the signs and mentioned the educational value. Comm. Milz made a motion to approve as presented. Comm. Tibbals seconded and the motion 21. Discussion and possible action to perform a Request for Qualifications for engineering services at the Silver Springs Airport, per F.A.A. requirements Silver Springs Airport Manager Kay Bennett asked for the Board s support on this item. She mentioned that this is a routine procedure that must be performed every five years. Comm. Goodman made a motion to approve as presented. Comm. Tibbals seconded and the 22. Discussion and possible action to accept Healthy Communities Coalition grant award of $140,000 for hiring of a Community Resource Deputy in the Sheriff s Office Sheriff Allen Veil presented this item. This position will focus on substance abuse prevention, underage drinking laws and enforcement. He commented that the position will only be filled as long as the grants are available to fund it. Christy McGill of Healthy Communities Coalition answered questions of the Board. Comm. Milz made a motion to approve as presented. Comm. Goodman seconded and the motion 23. Discussion and possible action on request from the Silver Springs-Stagecoach Hospital District to amend Lyon County Ordinance #285, Section 4 Silver Springs/Stagecoach Hospital District General Manager Kari Larson spoke of the difficulty of obtaining a candidate from the Stagecoach area. The district would like to amend section 4 of the ordinance which will remove the geographical boundaries. Comm. Goodman proposed the ordinance as presented. A BREAK WAS TAKEN AT THIS TIME 24. Discussion and possible action to accept the gift deed from Christo D. Bardis a Riverpark River Parcel containing /- acres of land County Engineer Dick Faber presented this item. Ed Davis of Reynen and Bardis gave a brief history of the project. Comm. Milz. noted a change to the proposed gift deed. The change is as follows: Page 1, paragraph 9, item iii. Add to the end of the sentence, other than restroom structures for public use and pumping and pipe facilities for Lyon County utilities. Comm. Discussion and possible action on request from Chase Development, LLC to extend the expiration of the April 19, 2001 Wastewater Treatment Agreement between Lyon County and Chase Development, LLC for an additional period of 2 years to April 19, 2009 Susan Dorr, Landmark Communities, presented this item. She revised the request to a sixty day extension rather than a two year extension. Comm. Tibbals made a motion to approve the request as revised. Comm. Milz seconded and the 26. Discussion and possible action to approve a loading and unloading parking space at 45 Main Street, Dayton and authorize the Lyon County Road Department to paint the curb and erect signage (Lyon County Code A & B) Comm. Milz presented this item. He mentioned the lack of parking in Old Town Dayton. Comm. Milz then mentioned that there is an ordinance allowing this action. Comm. Milz made a motion to approve as presented. Comm. Goodman seconded and the motion 27. Discussion and possible action to appoint Jeff Page, Lyon County Emergency Management Coordinator, as the single point of contact for the National Incident Management System (NIMS) compliance activities Emergency Manager Jeff Page presented this item. He mentioned that the state is requiring this action. Comm. Goodman made a motion to approve as presented. Comm. Tibbals seconded and the 28. Discussion and possible action to approve the purchase of two modular s from the City of Fernley (funding to come from Surplus Building Maintenance) and placement of the modular s at the Silver Springs Road Yard and the Yerington Sheriff s office Interim County Manager Bob Hadfield presented this item and asked for the Board s approval. County Engineer Dick Faber distributed the floor plans and proposed placement of the buildings. Comm. Goodman made a motion to approve as presented. Comm. Tibbals seconded and the 29. Discussion and possible action related to a request by the Utilities Director to accept the water, sewer and sludge lines running between Rolling A and South Dayton wastewater treatment plants, authorize the reimbursement of $2,619, as approved by the Board on January 2, 2007 and waive the requirement for Dayton Valley Investors (DVI) to post a warranty bond since the project is covered under the standard 1 year warranty period Utilities Director Mike Workman presented this item.
