1 May 18, 2017 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Vice-Chairman Joe Mortensen, Commissioners Greg Hunewill, Don Alt and Ken Gray. Absent: Chairman Bob Hastings. Also present: County Manager Jeff Page, District Attorney Steve Rye, Clerk/Treasurer Nikki Bryan and Deputy Clerk Donna MacGill. 1. Public participation 2. For Possible Action: Review and adoption of agenda Comm. Hunewill moved to adopt the agenda as presented. Comm. Alt seconded and the motion passed Presentation of awards and/or recognition of accomplishments There were no awards or recognitions. 4. Commissioners/County Manager comments Comm. Gray reminded everyone about the Memorial Day events that would be going on this weekend. Comm. Alt said he spent time at the Legislature lobbying for the diesel tax with NACO to no avail. Comm. Mortensen said he and Fernley Mayor Roy Edgington also went to the Legislature and discussed the 5 cent diesel tax with Senator Settelmeyer. He also spoke with one of the building inspectors in Fernley and he is actively inspecting 12 subdivisions in Fernley right now. Jeff Page commented on flooding and weather updates. They are predicting some possible flooding along the Carson and Walker Rivers next week. They are predicting a considerable increase in the flows. He commented on the great working relationship he has with the surrounding entities and Lyon County staff. Everyone has been working together filling sand bags to help protect our infrastructure. He commented on the FAA issues with Silver Springs Airport Lease. He will have it on the agenda in June. If we want to have FAA funding for the airport we will have to go by their guidelines. He said the county has been working on guidelines that will need to be followed on any new construction in Lyon County. They have been working on a design to replace the Fernley senior center. There may be some grant funds available for this project. The City of Fernley would like to work with the county on building a community center that could be used for multiple uses. 5. 3 1. Accept the low bid submitted by Sierra Nevada Construction (SNC) in the amount of $857, for the Base Bid, for the 2017 Pavement Maintenance Project. 2. Approve a Task Order in an amount not to exceed $90, with Lumos Engineering to perform project management, materials testing and inspection services throughout the project. 3. Authorize staff to sign project related documents. 4. Authorize Change Order authority for a not to exceed amount of $48, (5%) to cover any unanticipated issues related to the project (requested by Road Department Director) 15. For Possible Action: Award the bid for the Silver Springs Dispatch Tower to Commsite Corp. in the amount of $77,150 (requested by Comptroller) 16. For Possible Action: Approval of List of Trust Properties and Mobile Homes to be sold for delinquent taxes by Lyon County Clerk/Treasurer on May 24, For Possible Action: Acceptance of the Subgrant Amendment #1 from the State of Nevada, Division of Public and Behavioral Health in the amount of $320, to continue the Nevada Home Visiting Program in Lyon County 18. Hunewill moved to accept the consent agenda, Items #8 through #20, as presented. Comm. Gray seconded and the motion passed 4 0. **END OF CONSENT AGENDA** 9:15 A.M. Time Certain: For possible action. Discussion and direction to staff regarding legislation or legislative issues proposed by legislators or by other entities permitted by the Nevada State Legislature to submit bill draft requests, or such legislative issues that may impact Lyon County as may be deemed appropriate by the Board of County Commissioners. Jeff Page updated the board on issues in the Legislature. He said the ¼ cent sales tax passed out of committee and will be going to the floor. We no longer have any financial obligation to the V&T railroad commission. The body cams will become a reality and will be mandated by law. The 911 surcharge will be increased to help offset the cost of the body cameras. The 5 cent diesel tax has become a contentious issue and the collective bargaining bills are still being discussed. He said the biggest issues in the Legislature are the marijuana bills. There will be a number of regulations that will be coming from that issue. He is pleased with not needing to negotiate the ending fund balance. AB310 passed regarding public administrators. He publicly applauded Robin Titus for her initiative concerning this bill. He also commended Senator Settelmeyer and also thanked Assemblyman Wheeler. He said he has been phenomenal to work with on a number of other issues. He said the next Legislative session will most likely be the last for Walker and Associates since they are looking to retire. He commented on the water issues and the public guardian bill. He said we may need to look into support staff for the public guardian. Our current public guardian has been doing it all on her own since she started due to her previous experience as a paralegal. Comm. Mortensen thanked Jessica Garcia for her reporting and articles that have been in the Reno Gazette Journal. 96 May 18, 2017

4 REGULAR AGENDA 21. For Possible Action: Approve a Proclamation in Recognition of May 2017 as Older Americans Month and awards and recognition of Senior Samaritans within the Community Division Manager for Senior Services Cassandra Pearson said that May is Senior Citizens Month. She read the Proclamation into the record prior to presenting Carl Koenig and Susan Dunn of Dayton, Jean Boswell and Lucy Hoagland of Fernley and Meryle Montoya and Bob Shulman of Silver Springs Senior Samaritan awards. The Senior Samaritan awards are issued by the Governor s office and signed by Governor Sandoval. The awards can only be achieved one time in their life. Comm. Hunewill moved to approve a Proclamation commemorating Lyon County Older Americans and recognizing May 2017 as Older Americans Month. Comm. Alt seconded and the motion passed For Possible Action: Approve waiver of building fees for the Smith Valley Historical Society (501C-3 organization) for construction of their Archive Building (requested by Smith Valley Historical Society) Comm. Gray seconded and the motion passed For Possible Action: Recognition of May 2017, as Foster Care Month in Nevada and Lyon County and recommendations for increasing the number of foster care providers in Lyon County District Attorney Steve Rye presented. He presented a power point on the Expansion of Foster Care in Lyon County. He said that May is foster care month in Nevada. The power point showed the statistics and demonstrated the need for additional care providers. He introduced several state and county employees who are working with foster care concerns. He said the District Attorney s office handles child dependency cases and has an interest in trying to reduce the number of children that are placed outside of their homes. He was asking for any input to increase the number of foster care providers. Regional Manager for Division of Child and Family Services Kellie Weisaupt said the children in need of foster care providers range in age from She said there are times when children will stay in foster care until they graduate for high school. Division Manager of Lyon County Human Services Anna Coons explained they respond to level three cases, which are educational, medical and environmental neglect, lack of supervision and sometimes physical risk. They go into the homes to do assessments. She explained the other programs offered through the county to assist with the children and families. Lori Nichols of the Foster Care Recruitment and Licensing, Nevada Department of Health and Human Services, explained the need for Foster Care and homes in the rural area. They are attempting to keep children in their communities and close to their friends and siblings. As of May 1st there are over 400 children in foster care in the rural areas. The largest group is with children 0 4 years of age. Some homes only provide emergency shelter care, which is typically the first 13 days. There is a need for homes that would provide care for any children under the age of 18. The children come with a variety of challenges and trauma that need to be dealt with. They need recruitment for additional families. She explained the reimbursement for the families who take in foster children. Steve Rye thanked the presenters, members of staff and the commissioners for their time and allowing the presentation. 97 May 18, 2017

5 Comm. Hunewill moved to Recognize May 2017, as Foster Care Month in Nevada and Lyon County and recommendations for increasing the number of foster care providers in Lyon County. Comm. Mortensen seconded and the motion passed For Possible Action: Discussion and possible action to approve health, dental, vision, and life insurance plans and rates effective July 1, 2018, and authorize the Comptroller or Human Resources Director to sign associated contracts Comptroller Josh Foli said the county has been shopping for an employee insurance provider in an attempt to save the county money for FY The county budgeted for a 15% increase. The increase for the budget is actually closer to a 20% increase, which equates to approximately $60,000. He feels the county will have trouble finding a service that will beat this plan. He said the broker has done an exceptional job on keeping our rates down. He recommended approval of the single PPO insurance plans effective July 1, There was discussion addressing wellness programs. Jeff Page said there may be benefits to wellness programs in the private sector but it would require considerable changes to the personnel policy if it were done in the public sector. Comm. Alt moved to approve health, dental, vision, and life insurance plans and rates effective July 1, 2018, and authorize the Comptroller or Human Resources Director to sign associated contracts. Comm. Gray seconded and the motion passed :00 A.M. --Time Certain: For possible action. Approve budgets and establish tax rates and spending authorizations for all County departments, boards, and funds for fiscal year 2017/2018 (action will be taken) Public Comments on the tentative budget: Josh Foli explained the changes in the tentative budget and the recommended final budget. He explained the Fair and Rodeo would like to put on an event that will cost approximately $14,000. The revenues and expenses were increased by that amount to cover the cost of the monster truck event. In the Dayton Sewer fund it has been recommended to move about $35,000 in capital to start the engineering on a project that was scheduled for the subsequent year. Worker Comp rates came in for approximately a 6% decrease. The Health Insurance that was just approved was put in the budget with the new rates. The Public Defenders budget was increased by $61,000. To pay for the increase in insurance and the public defenders budget he is asking for the elimination of a part time position in the Assessor s office that is currently a vacant position. That will save $21,620. By making these changes to the general fund, they needed to decrease the ending fund balance by an additional $2,110. They are still waiting for the final word from the Legislature on a number of bills that could impact the county s budget. They will have the opportunity to make any changes to the final budget in the month of June and come back to the board for approval if needed. They received notice this morning that Child Protective Services was going to increase by $5,320; that line item has not been changed. That amount may come out of contingency when the time comes. He read a letter into the record from the Nevada Department of Taxation that they have examined the FY2018 tentative budget and it was in compliance with law and the Nevada Administrative Code. He said the county tax rate is $ The tax rate did not change from the previous year. Comm. Gray moved to approve budgets and establish tax rates of $.9287 and spending authorizations for all County departments, boards, and funds for fiscal year 2017/2018. Comm. Mortensen seconded. Comm. He has a letter from the Nevada Department of Taxation stating that the tentative budget is in compliance with law and the Nevada Administrative Code. The tax rate for this district is $ There have not been any changes to the tax rate for several years. Comm. Hunewill moved to approve the budgets and establish tax rates of $.0156 and spending authorizations for the Willowcreek General Improvement District for fiscal year 2017/2018. Comm. For Possible Action: Approve budgets and establish tax rates and spending authorizations for the Walker River Weed Control District for fiscal year 2017/2018 Comptroller Josh Foli said there were no changes in the budget from tentative to the final. He said there is no tax rate but has an assessment based on land value of $.0847 per $100 of assessed valuation for the land only. There have been no changes to the tax rate for several years. He has a letter from the Nevada Department of Taxation stating that the tentative budget is in compliance with law and the Nevada Administrative Code. Comm. Gray moved to approve budgets and establish tax rates and spending authorizations for the Walker River Weed Control District Board for fiscal year 2017/2018. Comm. Mortensen seconded. Comm. Mortensen called for the vote and the motion passed Public participation ADJOURN TO CONVENE AS CENTRAL LYON COUNTY VECTOR CONTROL DISTRICT BOARD 34. Public participation 35. For Possible Action: Approve budgets and establish tax rates and spending authorizations for the Central Lyon County Vector Control District for fiscal year 2017/2018 Comptroller Josh Foli said there were no changes in the budget from tentative to the final. The tax rate is $.045 per $100. He said this is an increase of $.01 that is currently being levied. He said it was previously higher but it was decreased due to the assessed valuations increasing. More money is being spent so the rate was put back to the $.045 per $100. He has a letter from the Nevada Department of Taxation stating that the tentative budget is in compliance with law and the Nevada Administrative Code. Comm. Hunewill moved to approve budgets and establish tax rates and spending authorizations for the Central Lyon County Vector Control District for fiscal year 2017/2018. Comm. For Possible Action: Approve budgets and establish tax rates and spending authorizations for the Silver Springs General Improvement District Board for fiscal year 2017/2018 Comptroller Josh Foli said there were no changes in the budget from tentative to the final. He has a letter from the Nevada Department of Taxation stating that the tentative budget is in compliance with law and the Nevada Administrative Code. He said there is no tax rate of the Silver Springs General Improvement District since they do sewer only and do not levy a tax rate and just collect user fees. There is an EDU assessment on the properties that will remain at the same rate that was previously adopted by the board. Comm. Gray moved to approve budgets and establish tax rates and spending authorizations for the Silver Springs General Improvement District Board for fiscal year 2017/2018. Comm. Alt seconded. Comm. Mortensen called for the vote and the motion passed Public participation ADJOURN TO RECONVENE AS THE LYON COUNTY BOARD OF COMMISSIONERS 40. Commissioner Comments Comm. Hunewill is happy to see everyone working together on the possible flooding concerns. Comm. Gray commended the county for the flood preparation and keeping the hype down. He commented on the Dayton dip that has been taken care of by NDOT. He let the commissioners know he will be attending the teleconference. He also complemented Elaine Barksdall for the new Dayton Valley Dispatch that is up and running. He also said there are two eagle scouts in the county. Comm. Mortensen thanked Edrie LaVoie for arranging the group of speakers. commented on the failing of the 5 cent diesel tax. He also Comm.
