1 April 21, 2016 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Chairman Joe Mortensen, Vice-Chairman Bob Hastings, Commissioners Greg Hunewill, Don Alt and Ray Fierro. Also present: County Manager Jeff Page, District Attorney Steve Rye, Clerk/Treasurer Nikki Bryan and Deputy Clerk Donna MacGill. 1. Public participation George Robinson said he lives on Pete Henrichs Road and called the sheriff s department last November to do a welfare check on his neighbor who lived at 614 Pete Henrichs Road. The sheriff s department showed up and found his neighbor deceased. Mr. Robinson explained that in February the temporary public administrator came out to begin the inventory of assets for the estate sale. He expressed concerns about a vehicle that was on the property and Deputy Bridges informed him it had been sold. Deputy Bridges also informed him there were 60 guns and thousands of dollars of rare coins in the house. He was later told that a no trespassing order was filed on him and not to go on the neighbor s property. He commented on the publication in the Mason Valley News regarding the estate sale and how the estate sale was handled. He said assets were sold at the estate sale that belonged to the adjoining property owner and not the deceased. He was wondering who he could talk to concerning what may have happened to the guns. County Manager Jeff Page said that he would need to speak to Mrs. Munro, the public administrator. It is an elected position and the only thing that could be done at this point is to put it on the next agenda for the commissioners to request an investigation. 2. For Possible Action: Review and adoption of agenda Comm. Fierro moved to approve the agenda as presented. Comm. Hastings seconded and the motion passed unanimously Presentation of awards and/or recognition of accomplishments There were no presentations of awards or recognitions. 4. Commissioners/County Manager comments Comm. Fierro said that he attended the Carson Water Subconservancy District meeting where they discussed water and sewer rates of the various entities in the Carson water shed. He has heard that people have complained about the high rates in Lyon County. He said our water rates are lower but our sewer rates are higher than other entities. He also discussed increases in the other districts. Comm. Alt attended a meeting in Winnemucca where there was discussion of transferring water to Walker Lake and the lake levels rising. The people involved in the conversation didn t seem to care about the farmlands and the production of food. Comm. Mortensen heard that Walker Lake is turning into quite a duck hunting area with the lower water levels. He also commented on the election; he said just because you have other people running against you, it doesn t mean you are doing a poor job. County Manager Jeff Page said he met with Nevada Association of Counties (NACO) yesterday and they asked him and Rob Hooper to brief them on the challenges of economic development and dealing with state and federal public lands management agencies. There was also discussion regarding disposable land and speeding up the process. They recommended taking a look at making it a state operation rather than each individual district. He also said there were complaints about the Silver Springs meeting not being well advertised. There is still a lot of work that needs to be done on the Silver Springs Airport Master Plan. He will be scheduling some community workshops to get their input. He also said the Pontifex compensation study is done and in draft form. He plans on presenting it to the board at the May 19 th meeting. He will be asking for their input and strategies for the implementation of the recommendations. He believes they have reached a tentative agreement with Lyon County Employees Association. He also said that Comptroller Josh Foli and Tyler Technology have been working with the facilities and fleet staff on implementing that phase of the software. 79 April 21, 2016

For Possible Action: Approve a Resolution Promoting Nevada Wildfire Awareness Month - May 2016 (requested by Community Development Director) County Manager Jeff Page said this is a resolution that is done annually. He said this area of Northwestern Nevada is subject to a great deal of wildfires. They are attempting to bring awareness to people and hopefully reduce the effects of wildfires. Comm. Fierro moved to approve a Resolution Promoting Nevada Wildfire Awareness Month - May Comm. Hastings 24. For Possible Action: Approve revised Lyon County Public Lands Policy and adopt resolution to implement the reviewd public lands policy (requested by County Manager) Virgil Arellano of Great Basin Strategies presented the final review and draft of the Lyon County Public Lands Policy. He thanked staff for their assistance with the document. He contracted with John McClain at Resource Concepts for an independent review of the policy. He made some suggestions that were implemented and approved by the public lands board. He said the goal today, after review of the document, is for the board to approve the document with the exception of the revised chapter 11. He can take chapter 11 back to the public lands board for their approval and recommendations and come back before the board next month for the board s approval. 81 April 21, 2016

4 The commissioners had extensive discussion on the document and had some recommended changes. Comm. Hunewill would like the document to read Walker Rivers instead of just Walker River since there are more than just one. Virgil Arellano suggested changing it to the Walker River system. Comm. Alt feels the document is livable but he would like to add that water should not be transferred out of the basin. Virgil Arellano said you can t separate one group of water right holders from another when it comes to selling their water rights. He feels that chapter 12.7 addresses transferring the water out of the basin. Comm. Hunewill would like to have hydro-electrical power put back into the document in chapter There was discussion on the width of an RS2477 right-of-way. Jeff Page recommended going with the current language. A more extensive review of the document will be done later. Comm. Fierro also pointed out changing rights-of-ways to rights-of-way. District Attorney Steve Rye recommended approving the document without adding new language to chapter 11. The new language could be brought back and implemented later. Comm. Fierro moved to approve the revised Lyon County Public Lands Policy and adopt resolution to implement the reviewed public lands policy as presented with the corrections mentioned today. Comm. Mortensen Tom Cartwright said that if you want to protect the water in Lyon County, the county needs to develop a water master plan. Tom Cartwright also read comments by Jim Dunlap and requested that his comments be made a part of the record. Virgil Arellano also said that the Forest Service has a new District Ranger in Bridgeport. He suggested establishing a relationship with him in the future. 25. For Possible Action: Approve implementation for Canine Handler Incentive Compensation Program for two sheriff canine handlers in the amount of $6,280 each (requested by Sheriff) Sheriff Al McNeil thanked the commissioners for approving the food service contract that was on the consent agenda. Sheriff Al McNeil also commented on heroine and methamphetamines being picked up in other counties then quickly brought into Lyon County and disbursed. He said that trafficking is selling four or more grams. It takes a number of deputies to search for the drugs. Commander Rob Hall mentioned a previous canine program that did not work out. Lyon County would own the dog. He explained the dogs can pick up on very small amounts. The handlers are entitled to one hour overtime per day for their care. Sheriff McNeil said a dog can hit on trace residue. Lyon County is the only county in this region that does not have a canine program. He feels the dogs should be brought into the schools on a regular basis. Rob Hall said there is a need to determine the service life of a canine. Sheriff McNeil said the canine program is included in the 2016/2017 budget. 82 April 21, 2016

5 Comm. Hastings said these dogs do become a part of the handlers family. Sheriff McNeil said it would be a dual purpose dog. Jeff Page, in response to Comm. Hunewill s question, said he believes the dogs could be covered by insurance. He said it would provide safety to officers. Comm. Fierro moved to approve the implementation for Canine Handler Incentive Compensation Program for two sheriff canine handlers in the amount of $6,280 each. Comm.
