1 May 18, 2006 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Chairman Bob Milz, Commissioners LeRoy Goodman, Chet Hillyard and Don Tibbals. Approve the selection of Clarion Associates for assistance in the preparation of a comprehensive countywide master plan, and authorize County staff to develop a work program and scope of services in conjunction with Clarion Associates and negotiate a contract for services with Clarion Associates Planning Director Rob Loveberg stated that the Lyon County staff unanimously chose Clarion Associates as their top choice to prepare a comprehensive countywide master plan. He then introduced Benjamin Herman from Clarion Associates to give a presentation on the firm s qualifications and past master plan development achievements. Comm Tibbals asked what experience Clarion Associates had in rural areas. Mr. Herman replied that Carson City was the first project they have done in Nevada, but they have done a lot of rural and urban planning for counties in Idaho, Colorado and Wyoming. Comm Goodman motioned to approve Clarion Associates as the County s primary Master Plan Consultant. Comm Tibbals 15. Approve grant application with USDA Rural Development to fund a preliminary engineering report (PER) for wastewater services in Mason Comptroller Josh Foli stated as part of the grant application process, a public advertisement must be done in the paper 10 days prior to approval by the Board of Commissioners. The advertisement was placed in the paper on May 5, 2006, allowing the Board to approve the application on May 18, Comm Tibbals motioned to approve the signing of the grant application with the USDA-Rural Development. Comm Goodman seconded and the motion was passed unanimously (4-0). 16. Approve a contract from Civicplus for the onsite content design and hosting of an updated Lyon County Website and accept a free website makeover package valued at $21,200 Comptroller Josh Foli reported that Civicplus s makeover package of $21,200 reduced the software licensing and annual fee to $9,200. County Manager Donna Kristaponis stated that although some of the data on the County s site is accurate, the incorrect or biased information tend to discredit the entire site. She also added that with Civicplus s software, authorized staff will have specified levels of access for making changes to the website directly from their computers. She highly recommends approval of this contract. 281 May 18, 2006

4 Comm Goodman moved to approve the signing of the contract from Civicplus. Comm Tibbals 17. Discussion and possible action for the Justices of the Peace to be able to participate under the Judicial Retirement Plan in lieu of the Public Employees Retirement System (PERS) Ms. Kristaponis stated that the approval of this item will result in approximately $6,141 in additional costs to the County in This amount has not been included in the Budget. Comm. Tibbals moved to approve the addition of the Justices of the Peace participation in the Judicial Retirement Plan in lieu of PERS effective January 1, Comm Goodman seconded and the motion was passed unanimously (4-0). 18. Discussion and possible action to enter into a purchase agreement for the assets of the Crystal Clear Water Company Keith Loomis, representing the County in the agreement, presented this issue. He stated that the system is in very bad disrepair. Utilities Director Mike Workman feels adequate water pressure is an issue, but he assures the Board that there is sufficient water to cover the service area. Comm. Goodman stated he has real problems with acquiring this water system because of the problems. Rick Hackman, a staff member of the Public Utilities Commission, stated that Dr. Donnelly transferred $10,000 to the Crystal Clear Water Company bank account to facilitate the transfer of the company to the County. Comm. Tibbals made a motion to accept the agreement as presented to be effective June 1, 2006 contingent on the promissory note for the $10,000 being received from Dr. William Donnelly. Comm. Hillyard seconded the motion and it passed unanimously (4-0). 10:00 A.M. Public Hearing Discussion and possible action to approve resolution which will increase and/or change the rates, fees, and charges for the Dayton Water Utility, Mound House Water Utility, and Dayton Sewer Utility Karyn Johnson, with Financial Consulting Solutions Group, Inc., who prepared a comprehensive rate study, gave a presentation on the current rates, the proposed rates and the funding needed to maintain the cost of the systems. Comm. Milz stated that even though the rates are very high, they would have been higher if grants had not been obtained. Comm. Tibbals made a motion to accept the resolution setting the rates for Dayton Water Utility. Comm. Goodman Comm. Tibbals made a motion to accept the resignation of Stacy Petersen and to authorize advertisement for a replacement that must live in District 6. Comm. Goodman seconded and the motion passed unanimously (4-0). 20. Approve amendment to the Dayton Regional Advisory Council by-laws Comm. Goodman made a motion to continue this issue to the next meeting. Commissioner comments Comm. Goodman said that the City of Fernley raised their tax rate at their meeting this week. He recently met with the mayors of Reno, Sparks and Las Vegas. He gave a report on the roundabout being implemented in Fernley and the new interchange for a new exit from the freeway to the industrial area. Comm. Milz reported that traffic is very chaotic in the Dayton area because of the construction on Hwy. 50. The Carson Water Subconservancy District met last night and regional water issues were discussed. 32. County Manager comments County Manager Donna Kristaponis stated that they are making progress on construction of the Silver City Community Center. She reported on the tax summit held at UNR yesterday. Ms. Kristaponis is working with NDOT to alleviate some of the traffic problems in Dayton. 33. Elected Official s report District Attorney Leon Aberasturi announced that he has filed for the open 3 rd Judicial District Court Judge seat. 34. Appointed Official s report Utilities Director Mike Workman discussed upcoming water issues. 35. Advisory Board reports There were no reports. 36.
