1 June 15, 2017 The Honorable Board of Lyon County Commissioners met this day in regular session with the following present: Chairman Bob Hastings, Vice-Chairman Joe Mortensen, Commissioners Greg Hunewill, Don Alt and Ken Gray. Also present: County Manager Jeff Page, District Attorney Steve Rye and Deputy Clerk Donna MacGill. 1. Public participation Marge Gartenberg of Stagecoach would like to know what code to follow on nuisance control complaints since Maureen Williss and Dave Snelgrove are no longer with the county. Jeff Page informed her to follow the same procedure as was previously followed. 2. For Possible Action: Review and adoption of agenda County Manager Jeff Page said the 9:15 Time Certain has been pulled from the agenda. Comm. Gray requested the Item #25 be pulled until the first meeting in July. Comm. Mortensen moved to adopt the agenda as presented, with the 9:15 A.M. Time Certain and Item #25 being removed. Comm. Gray seconded the motion. County Manager Jeff Page said there may be people present who wish to speak in behalf or Item #25. The motion was amended to leave Item #25 on the agenda. The second still stands. Comm. Hastings called for the vote and the motion passed :15 A.M. TIME CERTAIN For Possible Action: Recognition of Lyon County Employees with 5, 10, 15, 20 & 30 years of service by the Board of County Commissioners This item was pulled from the agenda. 3. Presentation of awards and/or recognition of accomplishments Sheriff Al McNeil recognized Winona Holloway for her 11 years of service. He said she has served under Sheriff Sid Smith, Sheriff Allen Veil and himself and was integral in the implementation of the Mobile Outreach Safety Team along with her partner Bob Bridges. Edrie LaVoie also honored and thanked Winona Holloway for her service. 4. Commissioners/County Manager comments County Manager Jeff Page commented on the flooding concerns in Lyon County and the increased temperatures this weekend. He commented on the Silver Springs Airport issue to hopefully get FAA s concerns resolved. He commented on ADS closing in three years. He said the state has budgeted for half the cost of the new voting machines. He said there are several applicants who will be interviewed for the position in the county manager s office. 5. Elected Official s report Sheriff Al McNeil commented on the false alarm system that should be operational by July 1, The City of Fernley will use the same vendor as the county. The sheriff s office incident command vehicle has arrived. He said staffing levels are normal. He commented on the staff that will be leaving for various reasons. He also commented on the untimely death of Gregory Flores and said he will be missed. 6. Appointed Officials comments Lyon County Human Services Director Edrie LaVoie gave an update on the Human Services Department and the possible cuts on the Federal side. They are trying to stay whole through She hopes to have additional information to present at the second meeting in July. 113 June 15, 2017

For Possible Action: Renewal of Interlocal Agreement for Forensic Pathology Services 20. Mortensen moved to approve the consent agenda, Items #8 through #21, as presented. Comm. Gray **END OF CONSENT AGENDA** REGULAR AGENDA 22. For Possible Action: Approve for early hiring of administrative office assistant due to retirement of Ellen Balaam on August 1, 2017 (requested by Juvenile Probation) Roger Sayre, Chief of Juvenile Probation, commented on Ellen Balaam s retirement and how it would impact the other workers in his office. He is trying to take a proactive approach with her retirement on August 1 st. County Manager Jeff Page said the county usually does not hire before the other person retires. The commissioners had questions. Comm. Gray moved to approve the early hiring of an administrative office assistant due to the retirement of Ellen Balaam on August 1, 2017, with a start date of no earlier than 7/17/17 and the money of come from contingency. Comm. Hunewill seconded the motion. Andy Sichak wanted to be sure that all measures were considered prior to spending the additional funds. Comm. Hastings called for the vote and the motion passed unanimously :30 A.M. TIME CERTAIN For Possible Action: Acceptance of renewal proposal from Nevada Public Agency Insurance Pool and approval for payment from FY 17/18 funds Lyon County s insurance broker, George O Keefe and Michael Rebaleati from the Nevada Public Agency Insurance Pool presented. Michael Rebaleati explained the highlights of changes and the coverage summary. Comm. Gray moved to approve the renewal proposal from the Nevada Public Agency Insurance Pool and approval for payment from FY 17/18 funds. Comm. Mortensen seconded and the motion passed unanimously June 15, 2017

For Possible Action - Approve the annual resolution of the Lyon County Board of Commissioners to designate the number of cents on each one hundred dollars of property tax levied for each fund and authorize the levy of the tax required for FY County Manager Jeff Page said there were no changes in the county s tax rate. Comm. Alt 24. For Possible Action - Adopt a resolution authorizing the transfer of funds for FY from various line items, including Contingency, within the General Fund as authorized by NRS County Manager Jeff Page said this is done every year. This is to move the money from contingency back to the various funds to balance out the budgets so we are in compliance by year end. Comm. For Possible Action: Direct staff to provide the Board of Commissioners with a monthly report of code enforcement activities (Requested by Commissioner Gray) County Manager Jeff Page said that Maureen Williss would provide a quarterly report on the number of code compliance complaints filed, the number that have been closed and what is still open. Mr. Page would like to know what the commissioners would like in the report. The report will be easily obtained once the new software is implemented. He discussed rubbish issues and public nuisance issues. Ken Gray commented on the angst in the community regarding code enforcement. Tom Cartwright commented on the definitions of public and private nuisances. These things should be spelled out in county code. Marge Gartenberg would also like to see a code to address these issues. She would also like to see follow up to the person who filed the complaint. The complaints should be done by districts. Julie Costner would also like the status of complaints. Sheriff Al McNeil said code compliance would take regulatory action and encouraged the board to fix the ordinance. Comm. Gray moved to table this item until July. Comm. Mortensen seconded and the motion passed :00 A.M. TIME CERTAIN - For Possible Action: NDEP Presentation on Anaconda Mine Site Update Greg Lovato, administrator of the Nevada Department of Environmental Protection, and Jeff Collins, Bureau Chief of the Corrective Actions Bureau, updated the board on the Anaconda Mine Site. It is proposed to be listed on the National Priorities List. By listing the site, it would make it eligible for Federal Funding. The estimated cost for the portion that Arimetco operated is $30 to $40 million. The state would also have a responsible share of the cost. They are in discussion with Atlantic Richfield on funding. He discussed reclamation of the site. He commented on naturally occurring contaminants such as copper, arsenic and uranium. He said further testing could be required. He said there are some fuel releases but nothing significant. He outlined the upcoming events on the proposed cleanup. He said they have reached out to the agricultural community. 116 June 15, 2017

5 The commissioners had questions. Jim Dunlap asked about well contamination. He feels the contamination mainly comes from the existing fault and from nature. Greg Lovato said Atlantic Richfield did some studies. He discussed drinking water standards. Tom Cartwright commented on possible cleanup solutions. Jeff Page commented on the cleanup of the mine site and coming up with funding. 10:30 A.M. TIME CERTAIN - For Possible Action: Presentation of Nevada Department of Transportation s Statewide Transportation Program, provide direction for county concerns and accept the annual work program Rudy Malfabon, P.E., of Nevada Department of Transportation, showed a power point presentation. He thanked the county for the opportunity to present their program. He introduced others from NDOT. He discussed medical costs and loss of life. He discussed USA Parkway, the Dayton dip and Dayton crosswalks. The long range plan is referred to as the One Nevada Plan. He discussed some of the challenges with NDOT. He said chip sealing is a more cost saving approach for some of the repairs. There was discussion on the maintenance issues. He discussed the zero fatalities campaign. He gave an overview of the roads and highways that NDOT maintains. He also addressed highway and pedestrian safety. There was discussion regarding the NDOT Drivers Ed program. Tom Cartwright asked about the increased truck traffic from USA Parkway. Thor Dyson of NDOT apologized for the Dayton Dip and the communication issues. Rudy Malfabon also discussed the Highway 50 widening project scheduled to begin in Sheriff Al McNeil said NDOT has done a great job of communicating with county staff. He said there are increased accidents on Highway 50 at Occidental Drive. He discussed traffic and reducing traffic flow. He said there have been significant accidents on Highway 50 around Immigrant and Red Rock. A speed reduction may be needed until the highway 50 bridge is put in. Comm. Gray moved to accept NDOT s 2018 annual work program as presented. Mortensen Comm. 26. For Possible Action: Develop a revenue source to assist funding for building living quarters for the fire station in Silver Springs, NV (Station 32) (Requested by Commissioner Alt) Comm. Alt was hoping to impose a tax or some other funding to open the Silver Springs Station #32 again. He asked about adding an impact fee or additional tax to be able to man the fire station. Comm. Mortensen commented on tax rates to fund the fire districts. Comm. Hastings commented on funding from the county. Jeff Page said that NRS does not require the county to fund fire districts and recommended not funding the Silver Springs Fire District or any district. He discussed the Central Lyon County Fire District. He said the fire districts are taxing entities and it is their responsibility under state statute. He also said that Chief Harvey was willing to come and speak but he told him he didn t think it was necessary. He recommended that the board take no action. 6 11:30 A.M. TIME CERTAIN - Presentation on the 79 th Session of the Nevada Legislature by Walker and Associates (No action will be taken) Mary Walker thanked Comm. Mortensen and Comm. Hastings for being part of the county coalition. She also thanked Jeff Page and other members of county staff for their work during legislature. She said the coalition has been active for 19 years. She thanked Comm. Alt for working with NACO during the session. She feels it was a positive session. There were challenges and there were some bills that did not pass. She said that prevailing wage is still at $250,000. She discussed various bills that were in the Legislature. She discussed the state budget. Steve Walker also thanked county staff. He said it was a good session for water. He said this year s CPI is 1.9%. He discussed various water rights issues. He also discussed SB271 regarding domestic wells. The commissioners had questions. Bob Hastings thanked Steve and Mary Walker and said their hard work was appreciated. RECESS TO CONVENE AS CENTRAL LYON COUNTY VECTOR CONTROL DISTRICT BOARD 27. Public Participation 28.
