3 Page 3 Chatta Data President s Message James Bo Bentley, CSI Source: www I once had an Economics professor quip that when the economy is down, no one looks at their 401(k) statements, but when the market is doing well people tend to keep a close eye on their investments. I guess that is human nature. While reading Dave Kimball s article in the Specifier concerning polyurethane sealers, I wondered how many of our members lose focus on continuing their education when the economic environment is not ideal. As the spring weather takes over and more projects are going out for bid, it is important that the positive momentum in our industry is also refocused in education and information. The sharing of knowledge is the foundation of our industry, and it is the cornerstone of what CSI stands for. Our Mission The mission of CSI is to advance building information management and education of project teams to improve facility performance. When was the last time you read a technical article relative to your line of work where you didn t later discuss that information with a colleague or at least use that information to make choices concerning your project? This sharing of information can take place during the construction process or well before a job makes it to the design phase. The more often we share this information the stronger it becomes. On the local level I think it is crucial that we continually discuss the future of our industry and the ongoing advancements in technology. I urge everyone to read at least one article a week if you aren t in the habit already, and see how you feel about your time spent reading after a month. Monthly meetings are a great opportunity to discuss what you have read and see where others interests are focused. Bo Bentley President-CSI Chattanooga Chapter

7 Page 7 Chatta Data The competition was fierce and the 2nd Annual Chili Cook Off was a huge success. Through the efforts of the cooks and the tasters the chapter was able to raise $2, for our Marshall Hildebrand Scholarship. It is always a pleasure to see the construction industry come out to support our fundraiser and to catch up with the Hildebrand family, who attend the cook off in Marshall s honor. The Chattanooga Chapter would like to extend a special thank you JDH Company, Jay, Beth and everyone else for coordinating this great event and allowing us to take over their space. A special thank you also goes to Chuck and Jamie Bialeschki for furnishing and tending to the beverages. Editor s Note: Jamie makes a mean bloodymary!

9 Page 9 Key Clauses of the general conditions; more means and methods In the last post, we looked at the means and methods clause in Article 3 of the A201. At the end, I concluded that the architect's responsibilities in construction documents are to show what the building should look like, identify the materials, and establish the standards for those materials. I also stated that virtually everything else - including supervising, scheduling, coordination, and deciding how materials are to be installed - is the contractor's responsibility. When I make seemingly heretical statements like that, I often am asked how I came to such a conclusion. Many architects have a hard time believing they no longer control much of what goes on during construction, contractors sometimes don't like having that much responsibility, and subcontractors often tell me they don't like it when designers use reference standards because they expect the architect to tell them how to do their jobs. As I explained, my conclusion is based on the requirements of the AIA general conditions (and general conditions from other sources, which typically have similar provisions). Not only does the A201 say the contractor is responsible for means and methods, it also says the architect is not responsible for means and methods, in Article 4 (my italics): 4.2 ADMINISTRATION OF THE CONTRACT the Architect will not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the Work. The Architect will not have control over, charge of, or responsibility for, the construction means, methods, techniques, sequences or procedures, or for the safety precautions and programs in connection with the Work, since these are solely the Contractor s rights and responsibilities Another source of information about complementarity and means and methods is the AIA Document Commentary for the A Following are a few excerpts The contractor is expected to make reasonable inferences from the contract documents. When the documents show wall partitions covered by drywall it may be inferred that some reasonable method will be used to attach the drywall to the underlying framework The contractor is responsible for performing all work shown and specified, unless it is specifically stated to be the work of others (under 4.1 Administration of the Contract) The word administration is not intended to imply that the architect either supervises or directs the construction effort (see quotation of above) Chatta Data The last sentence underscores the statement of the contractor's responsibilities in and reinforces the dividing line between the contractor's responsibilities and those of the architect. Does any of this prohibit the architect from specifying means and methods, such as telling the contractor to schedule meetings and when to schedule them, or from specifying installation methods, or from dictating when things should be done? No, but - in so doing, the architect assumes responsibility for them, at the same time relieving the contractor of responsibility. Each architect is responsible for deciding what and how much information must be included in the contract documents. Previously, we have discussed redundancies, which can be confusing and contradictory, and needlessly increase the time required to understand what is to be done. Even so, some architects - and many owners - are convinced that repetition is necessary to make sure that some requirements are read and understood. In much the same way, many architects do not trust contractors, manufacturers, or installers to know what they are doing, and try to tell them how to do their jobs. The intent is good, but in practice, it's an impossible task. If installers don't understand their own jobs, which are of limited scope in the context of the entire project, how can an architect be expected to be an expert in installation not only of that product, but of all the other hundreds of products? Remember, too, that typical owner-contractor and contractor-subcontractor agreements require the contractor and subcontractor to have read and understood the contract documents, and they sign agreements attesting to that knowledge. All of these things are tied together by agreements. 10 Page 10 Volume 46, Issue 2 Value Engineering in Construction A significant amount of potential construction projects that become reality have gone through a phase of what the industry refers to as Value Engineering (VE) and there is a myriad of ways it can be performed. The term VE is defined as the ratio of function to cost; value can be increased by improving function or reducing cost while working within the constraints of a project description, plan, and specification. In construction, VE is often used to keep a project feasible. If cost and level of quality are reduced in tandem, this is cost cutting and not VE. True VE requires close collaboration with team members to ensure that a project s integrity is not compromised while working to keep it within budget. While working through this VE process, it is critical that all aspects of options being considered are taken into account from a project lifecycle perspective. As even though construction cost is what is the key focus, it does not necessary mean that an option will deliver value to the owner and operational users over time. A team working through the VE process needs to take in feedback from multiple users at all levels in order to effectively consider and calculate the most optimal VE equation. Financial Report: Mark Walker reported that Chili Cook-Off proceeds were $2, Motion to accept Financial Report by Cindi Brooks; motion second by Jimmy Lail; motion carries. Committee Reports: Gulf States Region Annual Conference: Motion made by Jimmy Lail; motion second by Robin Vasa to Chapter to pay for six registrations and one night hotel for seven, motion carries. Awards: Jonnie Cox to prepare nominations for awards, Bo Bentley and Paul Thompson to review and provide support. Education: Robin Vasa report that the four seminars planned for the Product Show have been approved for learning credits. Planning: Jonnie Cox reported that January, 2017 will be 50 th Anniversary for CSI. Jonnie Cox recommended that a committee be appointed and lead by William Sundquist to plan special emphasis for the 50 th Anniversary. Membership: Bo Bentley submitted a written report from Mike Davis that membership increased by one member since last month; 56 professionals, 6 students, and 4 emerging professionals. Product Show: Jeff Tippens reported that Product Show is a sellout with 32 booths committed. Stratton Hall is booked and ready for April 14, :00 P.M. until 7:00 P.M. Needed is a microphone for the Product Show. Bo Bentley will be sending out a sign-up sheet for volunteers to work at the Product Show. House Committee: Mark Walker submitted three quotes for catering food to monthly meetings. Board to review. Publications: Cindi Brooks will send flyer for program CSI Chapter Monthly Meeting on March 17, Big Ass Solutions (Formerly Big Ass Fans) will present program. Technical: Paul Thompson to submit articles to Cindi Brooks to publish. Discussions: Jonnie Cox reported that the future of CSI microsites is uncertain. Jimmy Lail announced that Jonnie Cox was elected CSI Institute Treasurer. CSI annual award needs to be developed for the B.R.I.C. Other associations are developing their awards for the event.
