1 Franklin County Commissioners' Court Commissioner Court Minutes Regular Session February 13,2012 The Franklin County Commissioners' Court met in Regular Session February 13, 2012 at 9:00 AM in the District Courtroom at the Franklin County Courthouse Annex located at 208 Highway 37 Members present: Paul Lovier, County Judge Danny Chitsey, Commissioner, Precinct 1 Donnie Surratt, Commissioner, Precinct 2 Deryl Carr, Commissioner, Precinct 3 Sam Young, Commissioner, Precinct 4 Will Ramsay, County Attorney Betty Sue Allen, County Treasurer Betty Crane, County Clerk VISITORS: Shirley Maples, Willie Bane, Walter Everett, Brantin Carr, Steve Slaton, Bob Stinson, Margaret Sears, Lisa Lawrence, Saundra Dunn, Steve Slaton, Sue Ann Harper, D. K. Michaelson, Ellen Jaggers, Bryan Giguere, Jerry Cooper, Jim Alford, Gerry Allen, Paul Fletcher, and Lillie Bush-Reves Judge Lovier called the meeting to order and Commissioner Young offered prayer. APPROVE THE MINUTES FROM THE JANUARY REGULAR SESSION and JANUARY SPECIAL SESSION- COUNTY CLERK - Commissioner Surratt made a motion to approve the minutes from the January 23 Regular Session and January 30, 2012 Special Session and Commissioner Young seconded the motion. Motion carried. AUDIT CLAIMS AGAINST THE COUNTY AND AUTHORIZE THEIR PAYMENT TREASURER - Commissioner Chitsey made a motion to approve all the claims against the county including a claim from the County Judge and Commissioners Association of Texas for membership dues in the amount of $1, and Commissioner Surratt seconded the motion and the motion carried. See Vol. 1R Page MONTHLY REPORTS - TREASURER - County Treasurer Betty Sue Allen presented the January 2012 monthly reports. Commissioner Surratt made a motion to approve the January 2012 monthly reports and Commissioner Young seconded the motion. Motion carried. See Volume 1R Page CONSIDER AND TAKE ACTION ON APPROVING AMENDMENT OF COUNTY ATTORNEY'S SALARY IN ORDER TO RECOUP PAST PAYROLL ERROR TREASURER - County Treasurer Betty Sue Allen read a written statement concerning her request to amend the county attorney's salary in order to recoup a past payroll error. See Volume 1R Page to see her written statement. She reported Franklin County receives a supplemental payment for the County Attorney from the State Comptroller in the amount of $20, yearly and the County's portion of the County Attorney's salary is $47, She reported reviewing her records and believes an

2 overpayment occurred in the Treasurer's office in or about January 2009 due to a computer entry error. She reported Mr. Ramsay offered to write a check immediately and pay the County for the overpayment. She recommended to the court to deduct $1, from the county portion of his salary for the next 22 pay periods in order to satisfy the overpayment. If the court agreed, it would satisfy the overpayment before Mr. Ramsay leaves his current position. Commissioner Young made a motion to deduct $1, from the County Attorney's salary for the next 22 pay period to correct the error in the County Attorney's salary and Commissioner Surratt seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON APPROVING INTERFUND TRANSFERS FOR th QUARTER - TREASURER - Commissioner Young made a motion to approve the 4th quarter Interfund Transfers and Commissioner Chitsey seconded the motion. Motion carried. See Volume 1R Page CONSIDER AND TAKE ACTION ON APPROVING INVESTMENT COMMITTEE IN ORDER TO PURSUE A COUNTY INVESTMENT POLICY AS REQUIRED BY LGC PUBLIC FUNDS INVESTMENT ACT - TREASURER - Commissioner Young made a motion for the county judge, treasurer, auditor, and one person from each precinct be on the investment committee. It was pointed out seven people are not needed and Commissioner Young withdrew his motion after discussion. A recommendation of five people was made with the members being the county judge, treasurer, auditor, one commissioner and a banker. Commissioner Young made a motion to table this item to discuss this with a banker to see if they will serve on the Investment Committee and Commissioner Carr seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON APPROVING LINE ITEM TRANSFERS FOR TREASURER - Commissioner Young made a motion to table this item until the next meeting and Commissioner Chitsey seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON ACCEPTING REVENUE OF $1.00 PER PRESCRIPTION FOR EACH PRESCRIPTION PURCHASED THROUGH THE DISCOUNT DRUG CARD PROGRAM AND AUTHORIZE BETTY SUE ALLEN TO SIGN CONTRACT Commissioner Chitsey made a motion to approve collecting $1 in revenue through the NACO prescription drug program and authorize Betty Sue Allen to sign the contract and Commissioner Surratt seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON RECORDING COMPLETION OF 28.5 CONTINUING EDUCATION HOURS FOR 2011 BY BETTY SUE ALLEN- No action was needed on this agenda item. Treasurer Betty Sue Allen explained she wanted to acknowledge she had completed 28.5 continuing education hours in 2011 and put it on record. CONSIDER AND TAKE ACTION ON RECORDING COMPLETION OF 20 CONTINUING EDUCATION HOURS REQUIREMENTS FOR 2011 BY ELLEN JAGGERS - DISTRICT CLERK - No action was needed on this agenda item. District Clerk Ellen daggers explained she wanted to acknowledge she had completed 20 continuing education hours in 2011 and put it on record.

3 CONSIDER AND TAKE ACTION ON APPROVING FRANKLIN COUNTY'S DEDICATION OF THE RAY MAPLES MEMORIAL PARK - SHIRLEY MAPLES County Attorney Will Ramsay explained to the court that accepting the dedication of a public park would bring duties that the county will have to perform. The Commissioners asked Mrs. Maples why she wanted to dedicate the Memorial Park and she explained she would be able to take deductions on her income tax for all the work done to the park. After much discussion Commissioner Young made a motion to not accept the dedication of the Ray Maples Memorial Park to the county and Commissioner Carr seconded the motion. Motion carried. Mrs. Maples thanked the court and stated she would make it into a private park. CONSIDER AND TAKE ACTION ON APPROVING HOTEL/MOTEL TAX BOARD FUNDING REQUESTS FROM PINEY WOODS WINE FESTIVAL. FRIENDS OF THE LIBRARY AND ALAMO MISSION MUSEUM - WILLIE BANE - Mr. Bane reported the recommendations for funding of the Hotel / Motel Tax Board for the Piney Woods Wine Festival $9,000, Friends of the Library KiteFest ($4,000) and the Alamo Mission Blue Grass Festival ($4,600). Commissioner Young made a motion to approve the recommendation of funding the requests for the Piney Woods Wine Festival, Friends of the Library KiteFest, and the Alamo Mission Blue Grass Festival. Commissioner Surratt seconded the motion and the motion carried. PRESENT COMPLETED HOTEL/MOTEL TAX BOARD'S POST EVENT REPORTS WILLIE BANE - Mr. Bane gave the post event reports for Mount Vernon Key Club CountryFest, Rotary Tour de Cypress Bike Race, and Wine in the Pines and he reported these commitments were filled. CONSIDER AND TAKE ACTION ON APPROVING THE TRANSFER OF S6 PATROL TRUCK TO THE NORTH FRANKLIN VOLUNTEER FIRE DEPARTMENT - SHERIFF Commissioner Carr made a motion to approve the transfer of S6 Patrol Truck to the North Franklin Volunteer Fire Department and Commissioner Surratt seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON APPROVING THE JUSTICE OF THE PEACE DRIVER SAFETY COURSE (DSC) FUND - JUSTICE OF THE PEACE - Judge Alford requested supplementing the salaries of his clerks from the Driver Safety Course Fund. He requested splitting the fund between the two clerks. He reported collecting $2,400 in County Attorney Will Ramsay stated the Code of Criminal Procedure states the fees can be used to compensate the administration of the course. After much discussion Commissioner Young made a motion to approve supplementing the salaries of the Justice of the Peace two clerks with the Driver Safety Course Fund and Commissioner Surratt seconded the motion. Motion carried with a 3 to 2 vote. Commissioners Carr and Chitsey voted against the motion. Treasurer Betty Sue Allen asked how this was to be paid to the two clerks. Justice of the Peace requested paying each clerk half and half of the 2011 funds collected. Commissioner Surratt made a motion to reconsider the vote to allow the Driver Safety Fund to be used for salaries and Commissioner Young seconded the motion. Motion carried. After more discussion Commissioner Young requested to amend his original motion and Commissioner Surratt seconded the motion to amend the motion and the motion carried with a 3 to 2 vote. Commissioners Carr and Chitsey voted against amending the motion. Commissioner Young made a motion to amend his original motion to approve supplementing the salaries of the Justice of the Peace two clerks with the 2011 Driver Safety Course Fund fees for one year only and to reconsider subsequent years during

4 budget time and Commissioner Surratt seconded the motion and the motion carried with a 3 to 2 vote. Commissioners Carr and Chitsey voted against the motion. CONSIDER AND TAKE ACTION ON PRESENTATION OF ESTIMATE FOR RECONSTRUCTION OF NETO BUILDING - BOB STINSON - Mr. Stinson gave an overview of his recommendations on what was needed for the reconstruction of the NETO building. Commissioner Carr reported the county would not have to go out for bids since this is an emergency. He also reported proposals could be done instead of bids. Treasurer Betty Sue Allen stated bids were not required since the funds were not coming out of the budget but from insurance funds. Commissioner Carr made a motion to declare the reconstruction of the Northeast Texas Opportunities building an emergency and to accept proposals for the reconstruction of the building. Commissioner Young seconded the motion and the motion carried. CONSIDER AND TAKE ACTION ON PREPARATIONS FOR THE FRIENDS OF THE LIBRARY KITEFEST EVENT - BETTY CRANE - Betty Crane reported the Friends of the Library will have a fundraiser at the Franklin County Airport on April 21st. The airport has been declared a no-fly zone on that day. She reported huge kites will be the attraction for the day. She explained she needed some clarification on the electricity, bathrooms, shredding and parking. She reported 50 amp electricity was needed if concession trailers were going to be allowed. Commissioner Chitsey stated he had met with an electrician at the airport and there is a possibility of three fifty amps to be put in for $200 and that would include parts and labor. Ms. Crane was concerned with the bathrooms at the airport since they could get heavy usage. She reported they would get port-a-potties if that was their recommendation. She reported the person flying the kites requested the field to be shredded short in case of snakes and to make walking easier. She also had questions about parking and if there would be a problem if people parked at the sports complex if the airport parking lot was full. It was reported ball games probably would not be played on Saturdays and would not be a problem. Ms. Crane expressed volunteers were needed to assist with all the events that were planned throughout the day. ACKNOWLEDGE RECEIVING THE DEPARTMENT OF JUSTICE LETTER CONCERNING THE 2011 REDISTRICTING PLAN TO REFLECT IN THE COMMISSIONERS COURT MINUTES- COUNTY CLERK - County Clerk Betty Crane reported this was a formality to reflect the Department of Justice letter concerning the 2011 Redistricting Plan in the Minutes. See Volume 1R Page ACKNOWLEDGE RECEIVING THE DEPARTMENT OF JUSTICE LETTER CONCERNING THE CHANGE OF THE PRECINCT 201 POLLING LOCATION TO THE FRANKLIN COUNTY LIBRARY - COUNTY CLERK - County Clerk Betty Crane reported this was a formality to reflect the Department of Justice letter concerning the change of Precinct 201 polling location to the Franklin County Library in the Minutes. See Volume 1R Page

5 CONSIDER AND TAKE ACTION ON APPROVAL OF $ DONATION FROM THE FRANKLIN COUNTY YOUTH FOOTBALL TO GO TOWARDS THE FRANKLIN COUNTY SPORTS COMPLEX SCORE BOARD - BRANTIN CARR - Brantin Carr and Steve Slaton presented a $ donation from the Franklin County Youth Football to be applied towards the Franklin County Sports Complex score board at the foot ball fields. Commissioner Young made a motion to accept the $ donation from the Franklin County Youth Football Association to be applied to purchase a score board for the football fields and Commissioner Chitsey seconded the motion. Motion carried. CONSIDER AND TAKE ACTION ON APPROVAL OF $ DONATION FROM RITA LONG'S STUDENTS' FUNDRAISER TO PURCHASE TREES FOR THE FRANKLIN COUNTY SPORTS COMPLEX - TREASURER - Treasurer Betty Sue Allen presented a $ donation from Rita Long's students to purchase trees at the Franklin County Sports Complex. Commissioner Carr made a motion to accept the $ donation from Rita Long's students and to purchase trees for the sports complex. Commissioner Young seconded the motion and the motion carried. DISCUSSION ITEMS: None Commissioner Surratt made a motion to adjourn the meeting and Commissioner Carr seconded the motion. Motion carried.
