Workshop DESCRIPTION: Presentation from TxDOT on US 87 Bridge, Pavers, and Signal AGENDA DATE: January 8, 2013 DEPARTMENT Administration CONTACT PERSON Jeff Thompson SUMMARY Ben Englehardt, TxDOT Area Engineer, will be present at the meeting to discuss the upcoming Main St. projects and their timing and impact on the city. Both are major projects that will be disruptive to normal traffic flow on Main St. from January through at least August of The City Council approved allocating funds from the sale of assets last year (Houston Property & Dienger Building see attached Use of Funds from Sale document) to provide the necessary in-kind funding for these projects. The Council also approved $100,000 for additional improvements to the sidewalk widening element of the Bridge Project across the Cibolo Creek. In total $491,500 was allocated to these projects and $372,194 has been spent by the City to date including prepayments to TxDOT per the Advanced Funding Agreement we executed with them several months ago (see attached Summary of TxDOT Projects). At this point, we still have $119,306 remaining from the cost allocation to cover the estimated $100,000 in Bridge walkway improvements. COUNCIL MEMBER HABERSTROH MADE A MOTION TO ADOPT THE PROPOSED AMENDMENTS TO THE CITY OF BOERNE THOROUGHFARE PLAN DATED NOVEMBER 22, COUNCIL MEMBER CISNEROS SECONDED THE MOTION. COUNCIL VOTED 4-0.

CONSIDER AND TAKE NECESSARY ACTION TO ADOPT THE PROPOSED AMENDMENTS TO THE FUTURE LAND USE/DEVELOPMENT PLAN CONCEPT MAP DATED OCTOBER 27, Mr. Turk continued with the proposed amendments to the Future Land Use/Development Plan. He reviewed the process and the suggestions received from the Planning and Zoning Commission. Staff recommended that the revisions be approved as recommended by the Planning and Zoning Commission. MOTION WAS MADE BY COUNCIL MEMBER HABERSTROH TO ADOPT THE PROPOSED AMENDMENTS TO THE FUTURE LAND USE/DEVELOPMENT PLAN CONCEPT MAP DATED OCTOBER 27, COUNCIL MEMBER CISNEROS SECONDED THE MOTION. Mr. Mann displayed a map of the location of the proposed school zones. Mr. Mann explained that the ordinance is required to make the school zones enforceable since the property is newly annexed into the city. Discussion ensued regarding lighting the signs to make the signs more visible. Mr. Mann will communicate with the School District regarding the ordinance. Mr. Mann continued with the stop sign locations and the speed limit for the newly annexed area. Staff recommended approval of the proposed upgrade and replacement of stop signs at their existing locations on Old San Antonio Road and Scenic Loop Road at the intersection of Cascade Caverns Road. Staff also recommended approval of a 35 mile per hour speed limit on Old San Antonio Road and Cascade Caverns Road and a speed limit of 30 miles per hour on Scenic Loop Road.

Ms. Mattick reviewed the adjustments to the Dienger Fund, the 2009 G.O. Bond Construction Fund, the Water Utilities Fund and the Solid Waste Fund in the fiscal year budget. Staff recommended approval of the FY budget amendments. Mr. Woods reviewed the 3 rd quarter hotel revenues for Boerne as compared to surrounding cities. Mr. Woods discussed two new events to our area. The Thunderdash Mud Fest will be held on April 6 th. It is a 5K mud/obstacle run. The Hill Country Holler bike rally will be held at Enchanted Springs Ranch April th. Mr. Woods displayed some features of the new Boerne Convention and Visitors Bureau website. 14. COMMENTS FROM COUNCIL/LEGAL COUNSEL/STAFF No discussion or action may take place. Mr. Mike Mann, Public Works Director announced that the new wastewater treatment recycling center will be operational just after the first of the year. The pipelines are completed. Police Chief Jim Kohler stated that the Christmas parade will be re-routed next year to alleviate congestion and reallocate resources for downtown. Mr. Ron Bowman, City Manager thanked Mr. Danny Zincke, Parks and Recreation Director and Ms. Tori Bellos, Special Events & Recreation Coordinator for their efforts in organizing the Christmas parade. Mr. Bowman stated that he has received positive feedback from the Dickens on Main event. Staff will be preparing for additional Christmas lighting for next year. Mr. Bowman reminded City Council of the Employee Christmas Party which will be held on December 14 th. Mr. Zincke discussed suggested improvements for the parade next year. Ms. Linda Zartler, Administration Services Director reminded City Council of the ribbon cutting for the renovations of the Animal Services building, December 12 th at 10:30. Mr. Jeff Thompson, Assistant City Manager stated that Kendall County Commissioners approved the priority TxDOT projects list. Mayor Schultz thanked City Council and Staff for their efforts in making 2012 a productive year.

That Ordinance assumes that certain previously existing signage will be relocated and upgraded to be consistent with the applicable standards of the Manual of Uniform Traffic Control Devices. As presented previously, we had obtained the concurrence of Kendall County to alter (relocate and upgrade) the associated signage that remains outside the City Limits on Old San Antonio Road. The Council further requested that we contact BISD to determine if they are agreeable to the modifications, which has since been done. COST SOURCE OF FUNDS RECOMMENDED ACTION ADDITIONAL INFORMATION Staff recommends that the Council approve the second reading of the Ordinance establishing school speed zones in the City Limits at the two locations as described above. $600 for sign modifications Street Department Operating Fund Staff recommends that the Council approved the proposed School Speed Zones on Old San Antonio Road and Cascade Caverns Road. 44 MUNICIPAL SERVICE PLAN For Annexation of acres located at 34 Shooting Club Road (PID 14943) by City of Boerne (owner MK Investments JV) POLICE PROTECTION The Boerne Police Department will provide regular and routine patrols in the area as part of its overall patrol activities. The department will respond to any calls for assistance to the area upon annexation. Animal Control services will be available to the area upon annexation. FIRE SERVICE Fire service to the area will be provided by the Boerne Volunteer Fire Department upon annexation. Fire prevention activities will be provided by the Fire Marshal's office in the form of subdivision and building plan review and fire inspections of all commercial structures in the area. BUILDING INSPECTION - CODE ENFORCEMENT SERVICES Building inspection activities will be provided upon annexation. The Building Inspection Department will provide consultation with project developers for building code requirements, plan review for structures, issuance of building permits, and on-site inspection services for new construction. The Building Inspection Department will respond to requests for inspection of suspected City Code violations including, but not limited to, zoning, building codes, sign ordinance, and junk car ordinances. LIBRARY All residents of the newly annexed area will be eligible for library services at the Boerne Public Library. SOLID WASTE COLLECTION Solid waste collection is contracted for by the City s contracted agent upon annexation. PLANNING AND ZONING The planning and zoning jurisdiction of the City will extend to this area on the effective date of the annexation. The Planning and Zoning Commission will initiate permanent zoning of the newly annexed area as soon as possible after annexation. 45 STREET AND DRAINAGE MAINTENANCE The effects of this addition on drainage will be addressed under the provisions of the Subdivision Ordinance in effect at the time of platting. Roads, streets and drainage improvements that have been properly platted, duly dedicated, and accepted by the City of Boerne and/or Kendall County shall be maintained by the Department of Public Works. ELECTRIC SERVICE Electric service is provided by Bandera Electric Co-op, who holds the Certificate of Convenience and Necessity in the area of annexation. GAS SERVICE Natural gas service from the City of Boerne may be extended throughout the property by the petitioner according to City standards. The nearest current natural gas mains of substantial size is located along US 87 approximately 2,350 feet south of the subject property and at the intersection of Commerce Avenue and Shooting Club Road. WATER SERVICE Water service from the City of Boerne may be extended to and throughout the property by the petitioner according to City standards. The nearest current water mains of substantial size is located along US-87 and at the intersection of Market Avenue and Club Road. SEWER SERVICE Sewer service from the City of Boerne may be extended to and throughout the property by the petitioner according to City Standards. The nearest current sewer main of substantial size is located along the west side of US-87 approximately 2000 feet south of the subject property. We have visited with Mr. Kamp and he understands the process and the ramifications of annexation. He stated that he would prefer not to be annexed, but he has accepted it. From a land use perspective we would anticipate that this area would be zoned B-1 or perhaps B-2R.
