1 The Corporation of the Town of Grimsby Planning & Development Committee Meeting Minutes Town Hall Council Chambers 160 Livingston Avenue December 13, 2016 Present: Alderman N. Call to Order a) The meeting was called to order at 7:00 p.m. 2. Disclosure of Interest a) There were no disclosures of interest. 3. Public Meeting a) Aqua Zul, 10 Concord - Official Plan & Zoning Amendment b) 560 North Service Road - Phase II - Zoning & Official Plan Amendment

2 4. Delegation a) East End Waterfront Study - Waterloo Students 5. Reports Page 2 of 5 a) P.A Official Plan Amendment & Zoning Amendment Aqua Zul Prior to the Planning & Development Committee meeting there was a public meeting regarding an Official Plan and Zoning Amendment for 10 Concord Place - Aqua Zul. Committee Members stated that they were impressed by the development but expressed concerns regarding parking and traffic impact on Windward Drive. Mr. Basic noted that the formatting of the by-law to the report requires revision and that: - Section 8 of the draft by-law should be deleted and - A clause be added that permits proposed balcony encroachments into front yard Section 9: the following special provision exception to Site Specific Exception Number AAA shall apply to Areas A1, A2, and B : 77 of the minimum visitor parking space requirement shall be shared with the office uses located in Area C. PD Moved by Alderman D. Finch; Seconded by Member K. Agnew; Resolved that Report P.A , regarding Official Plan Amendment and Zoning Amendment applications by Homes by DeSantis at 8, 12 & 16 Concord Place known as Aqua Zul, be received and that the applications be approved. Further that the draft Official Plan Amendment and By-law attached to the report as Appendices "A" and "B" be forwarded to Council for approval. b) P.A Applications for Official Plan and Zoning Amendment 560 North Service Road A Public Meeting regarding the above noted applications was held prior to the Planning & Development meeting. Committee Members expressed concerns about the visual impact of the development and incremental changes to the application over time.

3 Page 3 of 5 PD Moved by Ald. D. Wilson; Seconded by Member J. Gillespie; Resolved that Report P.A , regarding applications to amend the Official Plan and Zoning By-law by LJM Developments (Grimsby) Inc., 560 North Service Road is received and that the applications are approved. Further, the zoning by-law amendment shall specify which facilities, services or matters will be given in exchange for the increase in the height of the development that is otherwise permitted by the by-law. DEFEATED c) Report P.A Grimsby East Waterfront Strategic Plan - University of Waterloo Students from the University of Waterloo gave a presentation on the potential for expanding the waterfront trail to the east end of Grimsby. They noted that signage and more accessibility to beach front were minor changes that could take place in the near future. PD Moved by Ald. D. Wilson; Seconded by Member K. Agnew; Resolved that the Grimsby East Waterfront Strategic Plan prepared by Areas Student Planning Partnership from the University of Waterloo be received; And that The Areas Student Planning Partnership Members be thanked for their work on the Grimsby East Waterfront Strategic Plan, namely: Amanda Stellings, Rebecca Koroll, Evan Sugden, Andrea Mikkila and Samantha Dunlop. d) P.A Community Improvement Plan Study for the Grimsby Gateway Employment Area Ms. Shanks outlined for the Committee the proposed study area which lies between Murray St. and the South Service Road. She noted that there is potential to expand the area in the future, but staff has identified this area as requiring immediate attention. She stated that the study could be completed internally and the final date for completion would be March of She noted that a community improvement plan allows for fiscal incentives and is a

4 Page 4 of 5 way to improve industrial lands and encourage investors. PD Moved by Member K. Agnew; Seconded by Alderman D. Wilson; Resolved that the Town of Grimsby Community Improvement Plan Study for the Grimsby Gateway Employment Area, Terms of Reference dated December 13, 2016, be received and endorsed; And that planning staff be directed to begin work on the Community Improvement Plan Study for the Grimsby Gateway Employment Area. e) P.A Removal of Holding Provisions - 8 Nelles Road Mr. Basic stated that the Holding Provision was a requirement of the Region of Niagara until an environmental site assessment could be completed. This is now completed and the Region has no further objections. PD Moved by Member M. Seaborn; Seconded by Member J. Gillespie; Resolved that Report P.A , regarding zoning amendment application by Romlee Homes/VW Manor for the removal of holding provisions, 8 Nelles Road be received and that the application be approved. Further that the draft by-law attached to the report as Appendix "A" be passed. f) P.A Planning Director Attendance at American Planning Association Conference PD Moved by Alderman M. Seaborn; Seconded by Member J. Gillespie; Resolved that Report P.A , regarding a proposal that the Planning Director attend the American Planning Association Conference be received; And that the Planning Director's request to attend the 2017 American Planning Association Conference be approved.

Wilson; Resolved that the following Public Meeting minutes be adopted as Schedule "A" to the Planning & Development Committee minutes, dated December 13, Correspondence Schedule "A" Public Meeting Minutes, dated November 22, 2016 Regarding a Draft Plan of Condominium for 8 Nelles Road 26CD a) Niagara Region - Phase 1 Interim Summary Report - Niagara GO Hub and Transit Stations Study PD Moved by Alderman D. Wilson; Seconded by Member K. Agnew; Resolved that the correspondence dated September 28, 2016, regarding PDS Phase 1 Interim Summary Report Niagara GO Hub and Transit Stations Study be received for information. b) Letter from IBI Group - Grimsby Gateway Employment Area CIP Study - Received 8.
