Approve cooperative agreements with OCTA in a form approved by the City Attorney and CSS and authorize Director of Parks and Recreation to sign the agreements. 2. Authorize Director of Parks and Recreation to sign any amendments to the agreement that do not exceed the City s budgeted amount. 5. PLACENTIA YORBA LINDA UNIFIED SCHOOL DISTRICT AFTER SCHOOL PROGRAM AGREEMENT Recommendation by the Parks and Recreation Department: 1. Authorize Director of Parks and Recreation to sign agreement between the City and the Placentia Yorba Linda Unified School District. 2. Authorize the Director of Parks and Recreation to sign any amendments to the agreement during the fiscal year. 6. ADOPT ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING A DEVELOPMENT AGREEMENT BETWEEN PACIFIC COAST HOMES AND THE CITY OF FULLERTON Recommendation by the City Clerk s Office: Adopt Ordinance No ORDINANCE NO AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING A DEVELOPMENT AGREEMENT BETWEEN PACIFIC COAST HOMES AND THE CITY OF FULLERTON PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTIONS THROUGH FOR PROPERTY LOCATED AT 2701 ROSECRANS AVENUE THAT PROVIDES PUBLIC BENEFITS TO THE CITY OF FULLERTON, INCLUDING DEDICATION OF APPROXIMATELY 283 ACRES OF OPEN SPACE, ENDOWMENT FOR HABITAT MANAGEMENT, SUPPORT GRANT FOR PERPETUAL MAINTENANCE OF RECREATION FACILITIES AND OTHER BENEFITS IN EXCHANGE FOR GRANTING THE PROPERTY OWNER A VESTED RIGHT TO BUILD THE PROJECT IN ACCORDANCE WITH APPROVED PLANS. 8. MEMORANDUM OF UNDERSTANDING C BY AND BETWEEN ORANGE COUNTY TRANSPORTATION AUTHORITY, ANAHEIM, FOUNTAIN VALLEY, FULLERTON, GARDEN GROVE, HUNTINGTON BEACH, STANTON, WESTMINSTER, THE COUNTY OF ORANGE AND THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR THE MAGNOLIA AVENUE TRAFFIC LIGHT SYNCHRONIZATION PROGRAM PROJECT 1. Approve Memorandum of Understanding (MOU) in a form approved by the City Attorney. 2. Authorize the Mayor to sign the MOU and any subsequent revisions, contingent upon a form approved by the City Attorney. 9. AGREEMENT BETWEEN ORANGE COUNTY SANITATION DISTRICT (OCSD) AND THE CITY FOR DESIGN AND CONSTRUCTION OF OCSD FACILITIES IN CONJUNCTION WITH THE STATE COLLEGE BOULEVARD GRADE SEPARATION PROJECT AND ARCADIS CHANGE ORDER 1. Approve Agreement between OCSD and the City of Fullerton for design and construction of OCSD facilities in conjunction with the State College Boulevard Grade Separation Project. 2. Authorize the Director of Engineering to sign the agreement and any minor amendments / supplements in a form approved by the City Attorney. July 19, Page 4

Authorize the Director of Engineering to process a change order to Arcadis for professional design services for OCSD facilities in conjunction with the State College Boulevard Grade Separation Project in the amount of $166, STATE COLLEGE BOULEVARD GRADE SEPARATION Recommendation by the Engineering and Maintenance Services Departments: Authorize the Director of Engineering to execute an agreement with Epic Land Solutions, Inc. for professional Right-of-Way services for State College Boulevard Grade Separation project in the amount of $657,159 in a form approved by the City Attorney. 11. FULLERTON COMMUNITY CENTER SITE CONCRETE CONSTRUCTION CONTRACT Recommendation by the Engineering, Parks and Recreation, Redevelopment and Economic Development Departments: Authorize Griffin Structures Incorporated and its Construction Manager, Swinerton Builders, to award site concrete and reinforcing construction contract for the Fullerton Community Center project to Dominguez Construction in the total amount of $695,085. PUBLIC HEARINGS (Items 12 through 13) Pursuant to California Government Code Section 65009, if you challenge a City Council / Redevelopment Agency / Public Financing Authority decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the City of Fullerton at, or prior to, the public hearing. 12. CITY OF FULLERTON 2010 URBAN WATER MANAGEMENT PLAN Staff has submitted a revised Urban Water Management Plan (UWMP) for City Council consideration and approval. The revised UWMP addresses previously stated concerns regarding the discussion of desalination while still complying with the State of California s Urban Water Management Planning Act (UWMPA). Fullerton must submit its updated UWMP to the Department of Water Resources by August 1, 2011 to comply with UWMPA. Adopt the City of Fullerton 2010 Urban Water Management Plan. 13. PROPOSED WATER RATE INCREASE Municipal & Financial Services Group (MFSG) prepared a comprehensive Water Rate Study Report that reviewed and evaluated revenue requirements for the City of Fullerton Water Utility. The Report recommends a multi-year water rate increase July 19, Page 5

8 and a single year 1.8% across the board pass-through increase based on external water supply costs. Accept Water Rate Study Ad Hoc Committee recommendation and adopt Resolution No RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, ADOPTING REVISED WATER RATES TO BE CHARGED TO USERS OF THE CITY OF FULLERTON WATER SYSTEM AND REPEALING PORTIONS OF RESOLUTION NO (SCHEDULES W-R THROUGH W-RMG) REGULAR BUSINESS (Items 14 through 17) 14. CONCORD AVENUE, LADERA VISTA DRIVE AND WILSON AVENUE PERMIT PARKING F.M.C Staff recommends approving Resident Only Permit Parking for the 1200 blocks of Concord Avenue, Ladera Vista Drive and Wilson Avenue in accordance with Fullerton Municipal Code Chapter Repeal Resolution No dated April 19, 1977 and Resolution No dated February 6, 1990, both pertaining to No Parking Anytime, in their entirety. 2. Adopt Resolution No RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, PROHIBITING PARKING ON CONCORD AVENUE, LADERA VISTA DRIVE AND WILSON AVENUE FROM 7:00 A.M. TO 7:00 P.M., MONDAY THROUGH FRIDAY, WITHOUT A VALID CITY ISSUED PARKING PERMIT 15. LEASE NEGOTIATION FOR LIBRARY CAFÉ LOCATED AT 353 WEST COMMONWEALTH AVENUE An Evaluation Committee has reviewed proposals for a library concessionaire based on a City Council approved scoring and selection process. Staff requests that City Council consider approval of the next phase of the process and authorize staff to negotiate with the highest ranking concessionaire. Recommendation by the Library Director: Authorize staff to negotiate with Greenhouse Café for Concessionaire Services to operate a café at the Fullerton Public Library. July 19, Page 6

Award construction contract to All American Asphalt for Euclid Street Reconstruction project in the amount of $646, NOTICE OF FUNDING AVAILABILITY SELECTION COMMITTEE RECOMMENDATION AND AUTHORIZATION TO BEGIN NEGOTIATIONS WITH SELECTED AFFORDABLE HOUSING PROVIDER Agency consideration of Notice of Funding Availability (NOFA) Selection Committee recommendations for affordable housing providers and authorization to negotiate draft Owner Participation Agreements with selected developers with the condition that City Council enact an ordinance to participate in and comply with the Opt-In requirements of Assembly Billx1 27. Recommendation by the Redevelopment and Economic Development Department: 1. Approve, conditioned on City Council enactment of the Opt-In Ordinance and the ordinance becoming effective, the NOFA Selection Committee s recommended development proposals with Squier Properties, Richman Group of California and Home Aid OC/Fullerton Interfaith Emergency Services and authorize staff to negotiate Owner Participation Agreements with recommended developers. 2.
