1 Buccaneer Bay Newsletter September 2018 Note from the Editor It is hard to believe that we are already into the 9 th month of the year. We will soon be getting ready for Halloween, then Thanksgiving and finally Christmas. My favorite three months of the year. October can be depressing as each year I get one more year older and this time I am moving into the big numbers. One of the boards that I set on provided each family with tickets to Vala s Pumpkin Patch. I had not been there since my granddaughters were little. So this this time I took my daughterin-law, adult grand-daughter and three great grandkids. It was a little chilly but we had a good time. I wore out before they did so I left a little before closing time. It is fun to see them get excited about the rides and the funny looking ghosts and play areas. This year will be the Presbyterian Church s 109 th year for the Chicken Pie Supper. I stepped down for a couple of years due to my work schedule, so I was able to help more last year and I am working on getting everything organized this year. We made a huge change about 10 years ago and separated everything out into committees. I just keep track of each committee and everyone gets their job done and ready for the final day. The recipe, to my knowledge, has been a big secret for years. Thank goodness we don t have to kill the chickens ourselves like the ladies had to do 100 years ago. My only concern is how long I will be able to stand on my feet that evening. I am having knee replacement surgery next Monday. But if I recover as quickly as I did when I had my other knee fixed 8 years ago, I should be able to do just fine. Be sure to check out Page 3 for the upcoming Fall Clean-Up day. This is a great plan that the Block Captains have put together. The goal is to clean up the roads of litter. They will have a table setup on Davy Jones Circle for everyone to pick up their supplies. We are having Block Captains meetings every 4-months to help keep us all informed. One of the deputies from the Sheriff s office comes down to talk to us about things that have happened in the neighborhood. This time there seemed to be several incidents, many because cars are left un-locked sitting on the street or in driveways. It is highly recommended to lock up vehicles that are setting outside. If you see something strange going on be sure to notify the Sheriff s office. Hope everyone has a great fall. It will soon be Halloween. We do get a lot of Trick-or-Treaters, many come out from town. But it is fun to see that this is still an exciting holiday for the kids. I remember the many years my three sisters and I got to go out. Back then we didn t have to worry about strangers, and every family seemed to have fun handing out the treats. This-N-That Page 2 of 26 IF YOU ARE ALONE AND HAVING A HEART ATTACK 1. Let s say it s 7.25pm and you re going home (alone of course) after an unusually hard day on the job. 2. You re really tired, upset and frustrated. 3 Suddenly you start experiencing severe pain in your chest that starts to drag out into your arm and up in to your jaw. You are only about five km from the hospital nearest your home. 4. Unfortunately you don t know if you ll be able to make it that far. 5. You have been trained in CPR, but the guy who taught the course did not tell you how to perform it on yourself. 6. HOW TO SURVIVE A HEART ATTACK WHEN ALONE? Since many people are alone when they suffer a heart attack without help, the person whose heart is beating improperly and who begins to feel faint, has only about 10 seconds left before losing consciousness. 7. However, these victims can help themselves by coughing repeatedly and very vigorously. A deep breath should be taken before each cough, and the cough must be deep and prolonged, as when producing sputum from deep inside the chest. A breath and a cough must be repeated about every two seconds without let-up until help arrives, or until the heart is felt to be beating normally again. 8. Deep breaths get oxygen into the lungs and coughing movements squeeze the heart and keep the blood circulating. The squeezing pressure on the heart also helps it regain normal rhythm. In this way, heart attack victims can get to a hospital. 9. Tell as many other people as possible about this. It could save their lives!! 10. A cardiologist says If everyone who gets this mail kindly sends it to 10 people, you can bet that we ll save at least one life. 11. Rather than sending jokes, please... contribute by forwarding this mail which can save a person s life. 12. If this message comes around you... more than once please don t get irritated... You should instead, be happy that you have many friends who care about you & keeps reminding you how to deal with a Heart attack.

15 MINUTES OF THE MEETING OF SANITARY AND IMPROVEMENT DISTRICT NO. 5, CASS COUNTY, NEBRASKA Meeting convened at 6:00 p.m. on July 18, 2018 at 3200 Buccaneer Blvd, Plattsmouth, Nebraska, inside the clubhouse of Bay Hills Golf Club. Attached hereto are: the agenda for the meeting; the Affidavit of Printer regarding publication of notice of the meeting, which communicated the availability of the agenda, in the Plattsmouth Journal, Plattsmouth, Nebraska; advance notice of the meeting as provided to the County Clerk of Cass County and all Trustees; and the Trustees acknowledgment of receipt of said notice and agenda. All proceedings were taken while convened with attendance open to the public. ITEM 1 Meeting called to by order by the Chair, David Martin, at 6:00 p.m. ITEM 2 The locations of the Open Meetings Act and the documents related to the agenda were announced. ITEM 3 On roll call, those present: Trustees David L. Martin, Carol Walker, Mark Kula, Gary Petersen and James Grotrian. Those absent: none. ITEM 4 No persons were present to address the Board who were not otherwise on the agenda. ITEM 5 Resident Erica Hike presented a verbal request that the Trustees consider offering for sale a portion of the outlot adjacent to her property to provide her an opportunity to purchase the same to increase the size of her lot and thereby construct additional improvements to her property. No action was taken following discussion and the Chair advised that the matter would be given further consideration at the next meeting. ITEM 6a Trustee Kula provided a general verbal roads report. Mr. Dolezal discussed the need to consider at the next meeting repairs to a manhole near 4004 Buccaneer Blvd and an area inlet near 2601 Fountain Cir. ITEM 6b Trustee Kula asked that discussion concerning additional speed tables on Buccaneer Bay Blvd and Fairway Drive be laid over until the end of the street reconstruction project. The Chair laid over the item. ITEM 6c Trustee Kula provided a general report concerning the road reconstruction phase of the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, Mr. Dolezal advised that concrete work would likely be completed in a week and that two weeks later the final asphalt work would be completed. Mr. Dolezal also advised that some repairs could not be made because when the streets were removed in places it was discovered that more based had failed and required repair. ITM 6d Trustee Kula provided a general report concerning the storm water reconstruction phase of the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, Mr. Dolezal advised that almost all work was completed but that three areas could not be repaired after discovering more extensive damage in work being done and that none of those areas were an emergency which could not be delayed until the next project even though the preference would have been to complete the work as part of this project. ITEM 7a Trustee Walker presented a verbal grounds report concerning the removal of sign placed on District property in excess of the time allowed by the sign policy. Mr. Dolezal advised of an erosion issue involving a storm water pipe repair near but which also involved a private property owner repair resulting from an animal den. Trustee Grotrian advised that he met with a property owner regarding an erosion repair project on private property who asked to be allowed to chip a tree onto an outlot which Trustee Grotrian allowed. ITEM 7b Trustee Grotrian advised that he continued to make contacts with other public agencies regarding the possible sale or development of the 90 acres of park ground owned by the District so that the same could be developed into walking trails and other improved park space. 16 ITEM 7c Motion by Martin, seconded by Kula, to authorize the placement of signs at the entrances to the District announcing the keep Cass County beautiful clean up project organized by the neighborhood associations throughout the District. On roll call those voting aye: Grotrian, Petersen, Walker, Kula and Martin. Voting nay: none. Absent: none. Abstaining: None. The Chair declared the resolution adopted. ITEM 8a Trustee Grotrian presented the attached finance report and noted some recovery of the general fund from the costs associated with the June 16, 2017 storm and noted that June 30 was the end of the current fiscal year. ITEM 8b Trustee Grotrian discussed generally the likely budget proposal that he and Mr. Meisinger would present in August for fiscal year July 1, June 30, The proposal as of this point in time will be to leave the levy the same and build the general fund back after storm and emergency road repairs over the last three years by taking advantage of the increased valuation and moving $0.10 from the bond levy to the general levy so that the bond levy would be $0.45 instead of $0.55 and the general levy would be $0.33 instead of $0.23. ITEM 9a Mr. and Ms. Nelson of Urban Utilities presented the attached reports for water and wastewater operations and for water billing. ITEM 9b The Chair allowed Dane Simonsen of JEO Consulting roup, engineers, to present the final report on the evaluation of the water and sanitary sewer systems together with his recommendations for improvements to each system. ITEM 9c The Chair advised that the balance due after the payment would be $500, which is scheduled for payoff on December 15, ITEM 9d Following discussion, no action was yet taken regarding the request of Urban Utilities to terminate the contract for the operation of the District s water and wastewater systems early, with a proposed date of on or about October 1, Discussion involved the need to have in place other contractors to provide the necessary services. ITEM 9e Trustee Martin advised that the two entities contacted to submit statements of qualification for the contract to operate the District s water and wastewater systems had responded and that he and Trustee Grotrian would conduct interview of both companies. 19 MINUTES OF THE MEETING OF SANITARY AND IMPROVEMENT DISTRICT NO. 5, CASS COUNTY, NEBRASKA Meeting convened at 6:00 p.m. on August 15, 2018 at 3200 Buccaneer Blvd, Plattsmouth, Nebraska, inside the clubhouse of Bay Hills Golf Club. Attached hereto are: the agenda for the meeting; the Affidavit of Printer regarding publication of notice of the meeting, which communicated the availability of the agenda, in the Plattsmouth Journal, Plattsmouth, Nebraska; advance notice of the meeting as provided to the County Clerk of Cass County and all Trustees; and the Trustees acknowledgment of receipt of said notice and agenda. All proceedings were taken while convened with attendance open to the public. ITEM 1 Meeting called to by order by the Chair, David Martin, at 6:003 p.m. ITEM 2 The locations of the Open Meetings Act and the documents related to the agenda were announced. ITEM 3 On roll call, those present: Trustees David L. Martin, Mark Kula, Gary Petersen and James Grotrian. Those absent: Carol Walker. ITEM 4 No persons were present to address the Board who were not otherwise on the agenda. ITEM 5a Trustee Kula advised that there was no general roads report. ITEM 5b Motion by Grotrian, seconded by Kula, to approve contracting for the repair of the manhole located at 4004 Buccaneer Blvd at a cost not to exceed $3,500, and to authorize the chair to execute a contract for the same. On roll call those voting aye: Grotrian, Petersen, Kula and Martin. Voting nay: none. Absent: Walker. Abstaining: None. The Chair declared the resolution adopted. ITEM 5c The Chair acknowledged receipt of a letter from the Nebraska Public Service Commission regarding train crossings. No action was necessary. ITEM 5d Mr. Dan Dolezal, engineer, reported on the status of the road reconstruction phase of the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, The contractor anticipates 2 to 3 more weeks to finish the work and the engineer is developing a punch list of items to correct. ITEM 5e Mr. Dolezal provided a general report concerning the storm water reconstruction phase of the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, 2017, and advised that the work was winding down but that certain work remained to support the road reconstruction work. ITEM 6a The Chair advised that there was no grounds report. ITEM 6b Trustee Grotrian advised that he continued to make contacts with other public agencies regarding the possible sale or development of the 90 acres of park ground owned by the District so that the same could be developed into walking trails and other improved park space. 20 ITEM 7a Trustee Grotrian presented the attached finance report and noted that the general fund remained healthy compared to the fund a year ago following the financial impact from the June 16, 2017 storm. ITEM 7b Trustee Grotrian and Kurt Meisinger, of Frankel Zacharia, certified public accountants, presented an outline for the likely budget for fiscal year July 1, June 30, Following discussion concerning advisable improvements to the water and sanitary sewer systems and regarding additional road reconstruction that would be necessary, Mr. Meisinger advised that he would revise the projected expenditures for the budget meeting in September. In addition to the remaining costs to complete the 2017 Road and Storm Water Management Reconstruction Project adopted September 27, 2017, Mr. Meisinger advised that the would budget for additional resolution of necessity type projects for roads and for the water and sanitary sewer systems. ITEM 8a Mr. and Ms. Nelson of Urban Utilities presented the attached reports for water and wastewater operations and for water billing. ITEM 8b The Chair advised that there was no committee report other than the intention to consider the improvements to the water and sanitary sewer systems resulting from the JEO engineering study. ITEM 8c The Chair advised that the balance due after the payment would be $500, which is scheduled for payoff on December 15, ITEM 8d Mr. Johnson presented the proposed contract for water and wastewater operations by PeopleService, Inc. if the contract with Urban Utilities, Inc. was terminated early as requested. Discussion followed concerning no increase in cost and in regard to bill payment options offered that are not currently available through the bank, along with the need for a provision to negotiate a price reduction or terminate the contract if system improvements reduced the effort required to operate the systems. Trustee Petersen requested a discussion concerning insurance and the tort claims act after which Mr. Johnson read the applicable statute. Motion by Grotrian, seconded by Kula, to approve and authorize the Chair to execute a contract with PeopleService Inc. to operate the District s water and wastewater systems effective October 1, 2018 if accepted by PeopleService; and to modify the contract proposal to specifically allow for negotiations to reduce the monthly fee if improvements were made to the systems which would reduce the labor required for the operations. On roll call those voting aye: Grotrian, Petersen, Kula and Martin. Voting nay: none. Absent: Walker. Abstaining: None. The Chair declared the resolution adopted. ITEM 8e Following discussion and notation that there would be no increase in contract price, motion by Grotrian, seconded by Martin, to approve the request of Urban Utilities, Inc. for early termination of the contract for the operation of the District s water and wastewater systems effective October 1, On roll call those voting aye: Grotrian, Petersen, Kula and Martin. Voting nay: none. Absent: Walker. Abstaining: None. The Chair declared the resolution adopted. ITEM 8f No action was taken regarding a contract for consulting services with Urban Utilities for a transition in services to PeopleService for the operation of the District s water and wastewater systems. ITEM 8g The Chair laid over to the next meeting consideration of a contract to seal the manhole located near Wedgewood and Windward. Page 20 of 26
