1 Village of Princeville Minutes of the Regular Board Meeting Tuesday September 3, :30 pm Princeville Village Hall The Village Board Meeting was held at the above time and place. The meeting was called to order by President Stahl at 7:30 pm with the following Trustees answering present: Sutherland, Troutman, Koller, Gilroy, Carton, and Haley. A quorum was present for the meeting. Notice of the meeting and agenda were sent and received in a timely manner. Others present were Treasurer Hofer, Superintendent of Public Works Gardner, MCO Dan Sullivan and Clerk Mercer. Police Report: There was a disturbance reported outside the Princeville Tap. Alarm in Ostrom Meadows. Ticket issued for driving without a license. Neighbor of the canning company giving obscene hand gestures to employees of the canning company. Village resident was building a still in his garage. The still was disassembled. Vehicles are starting to slow down on North Santa Fe Ave. and an officer has been watching traffic in the mornings. Sue Hofer reported that PAWS called and a resident had been bitten by a black Germanshepherd mix breed around 11:00 PM in the vicinity of the Princeville State Bank. Approval of Minutes as Published: Approve minutes as published with a correction. Motion by Gilroy to approve after correction. Second by Carton. Voice vote. All ayes. No nays. Motion passed. Approve Treasurers Report: Report given and distributed by Treasurer Sue Hofer. Treasurer reported the Village received the $7, bond bid payment from Fischer Excavation, Inc. Motion by Trustee Sutherland to accept Treasurer s report. Second by Haley. Voice vote. All ayes. No nays. Motion passed. Paying of August Bills and Additional Bills: Motion by Carton to pay August bills along with August additional bills. Second by Koller. Roll Call vote, President Stahl. Trustee Sutherland, Troutman, Koller, Gilroy, Carton and Haley voting aye. No nays. Motion passed. PCA Report: No Report Report from the Municipal Code Officer: Derek Wright was arrested for a code violation of the City. His bond money will be coming back to the Village for payment of his fines. Liens will be placed on the properties for mowing cost that are in foreclosure. The MCO is currently researching grants to hold another recycle day.

2 Consider and Vote on curfew ordinance that will replace the present ordinance: Motion by Trustee Koller to approve the new ordinance, second by Carton. President Stahl requested a roll call. Trustee Sutherland, Troutman, Koller, Gilroy, Carton and Haley voting aye. No nays, motion passed. The Following is the Curfew Ordinance and will be posted at the Village Hall for 10 Days. The ordinance goes into effect on September 16, 2013 at 12:01 AM. AN ORDINANCE WHICH SUPERCEDES ALL PREVIOUS ORDINANCES OF THE VILLAGE OF PRINCEVILLE WITH RESPECT TO CURFEW WITHIN THE VILLAGE LIMITS, THIS ORDINANCE HEREBY AMENDS THE SECTIONS & CURFEW HOURS & PARENT RESPONSIBILITY AND THE ADDITION OF NEW SECTION PENALTY. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PRINCEVILLE, PEORIA COUNTY, ILLINOIS, AS FOLLOWS: HOURS (CURFEW) (A) It is unlawful for a person less than 17 years of age to be present, loiter, wander, stroll or play in or upon any street, alley, sidewalk, parkway, park, playground or public place within the Village limits, or in or on any public building, place of amusement or entertainment, or any vacant lot, at any time during the set curfew hours set by the Village of Princeville. (B) The hours are as follows: (1). Between eleven o clock (11:00) P.M. Friday and six o clock (6:00) A.M. Saturday (2) Between eleven o clock (11:00) P.M. Saturday and six o clock (6:00) A.M. Sunday (3) Between eleven o clock (11:00) P.M. Sunday and six o clock (6:00) A.M. Monday (4) Between eleven o clock (11:00) P.M. Monday and six o clock (6:00) A.M Tuesday (5) Between eleven o clock (11:00) P.M. Tuesday and six o clock (6:00) A.M. Wednesday (6) Between eleven o clock (11:00) P.M. Wednesday and six o clock (6:00) A.M. Thursday (7) Between eleven o clock (11:00) P.M. Thursday and six o clock (6:00) A.M. Friday (C) It is a defense to a violation under this chapter that the child engaged in the prohibited conduct while: (1). Accompanied by the child s parent, legal guardian, custodian, sibling, stepbrother, Or stepsister at least 18 years of age. (2) Accompanied by an adult at least 21 years of age approved by the child s parent, guardian or custodian. (3) Participating in, going to, or returning from: (a) Employment which the laws of this state authorize a person less than 17 years of age to perform: (b) A school recreational activity; (c) A religious event;

3 (d) An emergency involving the protection of a person or property from an Imminent threat of serious bodily injury or substantial damage; (e) An activity involving the exercise of the child s rights protected under the First Amendment to the United States Constitution or Article 1, Sections 3, 4 And 5 of the Constitution of the State of Illinois, or both; (f) An activity conducted by a non-profit or governmental entity that provides Recreation, education, training, or other care under supervision of one (1) or More adult. 9:20.20 PARENT RESPONSIBILITIES It is unlawful for the parent or other person having lawful custody of persons less than seventeen (17) years of age to permit such minor to loiter, wander, stroll or play in or upon any street, alley, sidewalk, parkway, park, playground or other public place within the Village limits, or in or on any public building, place of amusement or entertainment, or any vacant lot, at any time in which violates village curfew hours stated in the above section; provided that this section shall not apply when such minor is in or on such place in the performance of a lawful errand or business with the consent of the parent or other person having lawful custody of such minor. Parents are subject to fines for violations Of Village of Princeville Curfew Ordinance PENALTY A citation for violation of subsection (a & b) of this Section may be issued by a police officer or village representative only if he reasonably believes that a violation has occurred and none of the defenses enumerated in subsection (c) apply. The officer or representative shall not issue a citation without first investigating the possibility that such defense exists. Any person violating the provisions of this Section shall be subject to fine and face possible prosecution. The following fee schedule shall be used in concordance with the violations. First offense fine will be $50.00 for any violation issued. Second offense fine will be $ for any violation issued. Third offense fine will be $ for any violation issued. Any further offense shall increase by $ for any violation issued.

4 This Ordinance shall be in full force and effect from and after its passage and publication as required by law. Committee reports: Pool Committee met last week. Water use was down from previous year; this was a benefit from the repair work performed on the pool. The pool committee discussed repairs to the building, security camera installation and purchasing more chairs. Consider and vote on extending gas franchise agreement with Ameren: Trustee Koller made motion to extend the gas franchise with Ameren. Troutman second. President Stahl roll call vote. Trustee Sutherland, Troutman, Koller, Gilroy, Carton, and Haley voting aye. No nays. Motion passed. Discuss a solution to keep semi-truck traffic from entering Lincoln Street from Santa Fe Avenue: This was tabled until the Plant Manager from Seneca Foods could attend the Board meeting. Building Permits: LLC Law of Rosemont, Illinois Temporary Dish on Cell Tower Dean Troutman Brick Entrance to Troutman Park Discuss 4-way stop at High Street and Town Avenue: School trying to re-route child pickup. Working on trying not to block the fire house. Tabled for further review and options. Report from Superintendent of Public Works: Water use increased due to the start up of canning company. One of the lagoons of the sewer system is plugged and Walker Excavating will be working on it Wednesday September 4, Justin is off work due to a personal injury. Dwayne Pridemore is filling in for him, reading the water meters. Ditch was reshaped in the Brockway subdivision. It will be late October before work begins on the Aten Acres Subdivision expansion. Other business brought before board: Dollar General needs 50 more feet. City will be moving forward with the water main for the store. There will be an Open House at the library September 11, Remodel of the Library is complete.
