5 A-39 Presented by the Administration Upon Recommendation of the Planning Commission CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AUTHORIZING AND APPROVING THE WOODLAND VILLAS FINAL SUBDIVISION PLAT AND IMPROVEMENT PLANS FOR PARCELS AND , AND DECLARING AN EMERGENCY. WHEREAS, the Charter of the City of Cuyahoga Falls requires that all decisions made by the Planning Commission be submitted to Council; and WHEREAS, the Planning Commission is required to review and provide a recommendation for all Subdivision Plats/Improvement Plans in the City of Cuyahoga Falls, Ohio; and WHEREAS, on May 1, 2018, the Planning Commission approved the Woodland Villas Final Subdivision Plat and Improvement Plans on parcels and , within the City of Cuyahoga Falls, Ohio. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit, and State of Ohio, that: Section 1. The City Council approves the Woodland Villas Final Subdivision Plat and Improvement Plans for Parcels and in Cuyahoga Falls, Ohio, in accordance with all Cuyahoga Falls General Development Code regulations and as stipulated in the Codified Ordinances of the City of Cuyahoga Falls as approved by the Planning Commission as per all plans and stipulations contained in Project File FMP Section 2. Any other ordinances or resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed, but any ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, to the extent applicable, including Chapter 107 of the Codified Ordinances. Section 4. This ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety, convenience and welfare of the City of Cuyahoga Falls and the inhabitants thereof, for the reason that it is immediately necessary to permit timely and appropriate development of this property, and provided it receives the affirmative vote of two thirds of the members elected or appointed to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force at the earliest period allowed by law. 7 A-40 Presented by the Administration CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE COUNTY OF SUMMIT AND CITIES OF AKRON, FAIRLAWN, GREEN AND STOW ( PARTIES ) FOR THE ACQUISITION, INSTALLATION AND OPERATION OF A CONSOLIDATED COMPUTER AIDED DISPATCH SYSTEM, AND DECLARING AN EMERGENCY. WHEREAS, each of the Parties operate a Public Safety Answering Point ( PSAP ) through which they dispatch emergency calls to public safety forces, both within their individual communities and for other political subdivisions for which they have contracts to provide dispatch services; and WHEREAS, the City of Cuyahoga Falls ( Cuyahoga Falls ) and the Parties desire to procure a consolidated Computer Aided Dispatch System ( Consolidated CAD System ) for their collective use in each of their PSAP operations and the dispatch operations of their public safety forces and the safety forces of the Contracted Dispatch Communities ( PSAP and Dispatch Operations ); and WHEREAS, Cuyahoga Falls and the Parties desire to procure a Consolidated CAD System for their collective use in order to maintain full interoperability and redundancy, replace aging systems, reduce their costs from replacing multiple systems, and improve the safety of their residents; and WHEREAS, Cuyahoga Falls and the Parties and their consultant have identified Tyler Technologies ( Tyler ) New World Computer Aided Dispatch Platform ( Tyler CAD System ) as the most comprehensive system for their use as a Consolidated CAD System, and the same can be procured by the County through their procurement processes; and WHEREAS, Cuyahoga Falls and the Parties intend for the County to purchase the Tyler CAD System to serve as the Consolidated CAD System for their PSAP and Dispatch Operations, and the Parties intend to share in the cost of the purchase of the Tyler CAD System, as set forth in the Intergovernmental Agreement ( Agreement ); and WHEREAS, Cuyahoga Falls and the Parties further intend for the Consolidated CAD system to be owned by the County and to be shared by the Parties for their individual and collective use in their PSAP and Dispatch Operations, as set forth in the Agreement; and WHEREAS, Cuyahoga Falls and the Parties have set forth in the Agreement the terms whereby the Consolidated CAD System shall be used, operated and maintained and whereby the Parties shall share in the costs for the ongoing use, operation and maintenance; and WHEREAS, through collaboration, the Parties are able to provide their communities with an efficient, updated Consolidated CAD System at a cost savings to the residents. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit, and State of Ohio, that:

8 Section 1. The Mayor is hereby authorized to enter into an Intergovernmental Agreement with the County of Summit and Cities of Akron, Fairlawn, Green and Stow for the acquisition, installation and operation of a consolidated Computer Aided Dispatch system pursuant to the terms set forth in Exhibit A attached hereto and incorporated into this ordinance, together with such revisions, additions or amendments as are approved by the Director of Law as being consistent with the objectives and requirements of this ordinance; and the Mayor, Director of Law, Director of Finance and other necessary City officials are authorized to provide such other information and to execute such other documents and amendments to the Intergovernmental Agreement and do all other actions as are necessary for and incidental to carrying out the requirements of this ordinance and the terms of the Intergovernmental Agreement. Section 2. The Director of Finance is hereby authorized to increase appropriations in the Capital Projects Fund, line item Capital Outlay in the amount of $199,734 and to make payment from the same. Section 3. Any ordinances or resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed, but any ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements including Chapter 107 of the Codified Ordinances. 9 A-41 Presented by the Administration CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE TO ENTER INTO A CONTRACT OR CONTRACTS, WITHOUT COMPETITIVE BIDDING, WITH OMEGA JV5 FOR THE AS IS PURCHASE OF JV5 ASSETS OF THREE DIESEL GENERATORS AND RELATED EQUIPMENT, AND DECLARING AN EMERGENCY. BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit and State of Ohio, that: Section 1. The Director of Public Service is hereby authorized to enter into a contract or contracts, without competitive bidding, with OMEGA JV5 for the purchase of JV5 assets of three diesel generators and related equipment in an amount not to exceed $125,000. Section 2. The Director of Finance is hereby authorized and directed to make payment for same from the Electric Fund, line item Capital Outlay. Section 3. BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit and State of Ohio, that: Section 1. The Director of Public Service is hereby authorized to enter into a contract or contracts, according to law, for the repair and/or replacement of concrete pavement on Smokerise Drive and Pleasant Meadow Boulevard and such other streets as determined necessary by the Director of Public Service. Section 2. The Director of Finance is hereby authorized and directed to make payment for same from the Capital Projects Fund, Line Item Capital Outlay. Section 3. 11 A-43 Presented by the Administration CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A LEASE AGREEMENT WITH RIVERSIDE COMMUNITY URBAN REDEVELOPMENT CORPORATION, AND DECLARING AN EMERGENCY. WHEREAS, there is need for additional public parking on South Front Street to support recent economic development; and WHEREAS, a Lease Agreement between the City and Riverside Community Urban Redevelopment Corporation provides a cost effective way to obtain additional parking spaces; and WHEREAS, the additional parking spaces will increase accessibility to entertainment, retail and recreational facilities, including the High Bridge Glens Park. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit and State of Ohio, that: Section 1. The Mayor is hereby authorized to enter into a lease agreement or agreements with Riverside Community Urban Redevelopment Corporation for the mutual lease of property as set forth in Exhibit A, attached hereto and made a part of this ordinance. Section 2. Any other ordinances or resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed, but any ordinances and resolutions or portions of ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 3. 13 A-44 Presented by the Administration CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH FALLS RIVER PHASE II, LLC FOR DEVELOPMENT OF 1816 FRONT STREET, CUYAHOGA FALLS, OHIO; AUTHORIZING A LOAN IN AN AMOUNT NOT TO EXCEED $300,000 FOR THE PURPOSE OF PROVIDING PUBLIC PARKING AND INCREASE APPROPRIATIONS THEREOF, AND DECLARING AN EMERGENCY. WHEREAS, Falls River Phase II, LLC has made a significant investment in the development of South Front Street thereby adding economic growth and opportunities to the community; and WHEREAS, Falls River Phase II, LLC desires to expand economic development in the South Front Street area and needs financial assistance to secure additional parking to ensure the success of its new business ventures; and WHEREAS, the Cuyahoga River Corridor Brownfield Master Plan encourages the City to provide parking in strategic locations; and WHEREAS, on-street parking is limited throughout South Front Street and in most cases, driveway entrances dominate limiting the potential for parking; and WHEREAS, parking is essential to the economic growth of downtown as potential customers are more likely to avoid visiting businesses without convenient parking; and WHEREAS, the City desires to encourage continued housing and economic opportunities on South Front Street; and WHEREAS, funding acquisition of land for parking on South Front Street was identified and approved by the U.S. Department of Housing and Urban Development in the City s 2017 Action Plan; and WHEREAS, an Agreement between the City and Falls River Phase II, LLC provides a cost effective way to obtain these additional parking spaces. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit and State of Ohio, that: Section 1. The Mayor is hereby authorized to enter into an agreement or agreements with Falls River Phase II, LLC for the development of property located at 1816 Front Street, Cuyahoga Falls, as set forth in Exhibit A, attached hereto and made a part of this ordinance, which includes a loan in an amount not to exceed $300,000 for the purpose of providing public parking. Section 2. The Director of Finance is hereby authorized to increase appropriations in the Community Development Block Grant Fund, Line Item Other Operations and make payment from same. Section 3. Any other ordinances or resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed, but any ordinances and resolutions or portions of ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 4. 17 A-45 Presented by the Administration CITY OF CUYAHOGA FALLS, OHIO ORDINANCE NO AN ORDINANCE AMENDING CHAPTER 353 OF THE CODIFIED ORDINANCES, RELATING TO PARKING METERS IN THE CITY OF CUYAHOGA FALLS, AND DECLARING AN EMERGENCY. WHEREAS, parking meters have recently been installed in the newly revitalized Downtown Cuyahoga Falls area; and WHEREAS, existing sections of Chapter 353 involving parking meters are antiquated and need updated to reflect current practices. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Cuyahoga Falls, County of Summit, and State of Ohio, that: Section 1. Chapter 353, Parking Meters of the Codified Ordinances of the City of Cuyahoga Falls is hereby amended and/or supplemented to read in full as follows (new text double underlined; deleted text in strikethrough): CHAPTER REGULATION OF PARKING IN INDIVIDUAL PARKING SPACES. Whenever a vehicle shall be parked in an individual parking space where a parking meter has been installed, the person parking such vehicle shall deposit a coin or combination of coins of United States moneymake payment in such parking meter, if such meter displays the signal showing that legal parking is only permitted on such deposit. The Safety Director, in accordance with the provisions of this chapter, shall determine the length of time that parking is permitted in an individual parking space for which a meter is installed, upon the deposit of a coin or combination of coinspayment in the parking meter as hereinbefore provided. Notice to the public shall be given by appropriate signs setting forth the length of time for which parking is permitted and conditions thereof. These may be upon the parking meter stand or in the immediate vicinity. Any vehicle which remains in an individual parking space after the prescribed time for parking is hereby determined to be illegally parked, but in no event shall it be considered illegal parking if the meter display signal shows that a proper deposit has been made for such parking. The provisions of this chapter shall not apply to vehicles parked or standing upon the streets of the City in parking meter zones when such vehicles are parked or standing upon such streets between the hours of 5:00 p.m. in the evening until 8:00 a.m. the following morning of each week day. The provisions of this chapter shall not apply between 5:00 p.m. Saturday evening and 8:00 a.m. the following Monday. The provisions of this chapter shall not apply on Sundays and holidays; but for the purpose of this chapter, the afternoon of Election Day in each November shall not be considered as a holiday or part holiday EVIDENCE. After the installation of such parking meters, all parking is prohibited in any parking space where a meter is installed which displays a signal showing that parking is not permitted unless a deposit of a coin or combination of coinspayment is made as herein provided. Any vehicle parked in violation of this provision shall be deemed to be an illegal parking under the provisions of this chapter. The fact that a vehicle is in an individual parking space when the tine signal on the parking meter of the same shows no parking permitted, unless a deposit of a proper coinpayment

18 is made as herein provided, shall be deemed prima-facie evidence of the unlawful parking of such motor vehicle by its operator or owner OFFICERS TO REPORT; TICKETS. (a) It shall be the duty of the police officers of the City, acting in accordance with instructions issued by the Safety Director, to report: (1) The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of any of the provisions of this chapter; (2) The state license number of such vehicle; (3) The time during which such vehicle is parking in violation of any of the provisions of this chapter; (4) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. (b) Each such police officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in violation of a provision of this chapter and instructing such owner or operator where to report at the Violations Bureau of the City, in regard to such violation. Such owner or operator may within the time specified on such notice, pay the amount specified to the Violations Bureauas a penalty for such violation. The failure of such owner or operator subject to the penalties hereinafter provided for violation of the provisions of this chapter. The owner or operator will be subjected to penalties set forth in this chapter if he or she fails to pay the required amount. Section 2. Any other ordinances and resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed but any ordinances and resolutions or portions of ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 3. WHEREAS, the City of Cuyahoga Falls wishes to enable economic development, facilitate the integration of immigrant populations into the City, retain talent, attract international investment, educate and inform the existing community about their immigrant neighbors, and support the immigrant community in reaching its full potential; and WHEREAS, immigrants add civic, cultural, and economic value to communities they adopt as their new homes, and are also prospective entrepreneurs who start businesses, create jobs, complement the skills of the workforce, produce greater demand for existing businesses and services, and help revitalize neighborhoods; and WHEREAS, the City recognizes that a welcoming community is more likely to thrive, and wishes to unite with a cohort of cities and counties around the country that have pledged to become more immigrant-friendly by joining the Welcoming Cities and Counties Project and the WE Global Network for the Great Lakes region; and WHEREAS the City desire to join other municipalities and the County of Summit in their endeavor by declaring the City of Cuyahoga Falls as Welcoming City; and WHEREAS the City has already taken action to integrate the immigrant population through various City-sponsored activities and programs and believes that participation in the Welcoming Cities and Counties Project and WE Global Network will further enhance the City s efforts as a Welcoming Community; and WHEREAS under the Fair Housing Act of 1968 the City has an obligation to affirmatively further fair housing and has taken meaningful actions to overcome national patterns of segregation, promote fair housing choice, and foster inclusive communities that are free from discrimination; and WHEREAS, affirmatively furthering fair housing means taking meaningful actions relating to housing and urban development, that, taken together, address disparities in housing needs; WHEREAS, this Council finds and determines, after reviewin g all perti nent information, that it is necessary and in the best interest of the City to declare Cuyahoga Falls to be an immigrant-friendly, welcoming City, support the City's participation in the

20 Welcoming Cities and Counties Project and WE Global Network and authorize the Mayor to execute all necessary documents to participate in said project. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Cuyahoga Falls, County of Summit, and State of Ohio, that: Section 1. Council hereby declares the City of Cuyahoga Falls to be an immigrantfriendly, welcoming City, and announces its support of the City's participation in the Welcoming Cities and Counties Project and WE Global Network. Section 2. The Mayor is hereby authorized to execute all necessary documents to participate in said project. Section 3. Any other ordinances or resolutions or portions of ordinances and resolutions inconsistent herewith are hereby repealed, but any ordinances and resolutions not inconsistent herewith and which have not previously been repealed are hereby ratified and confirmed. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements, to the extent applicable, including Chapter 107 of the Codified Ordinances. Section 5. This resolution is hereby declared to be an emergency measure necessary for the preservation of the public peace, health, safety, convenience and welfare of the City of Cuyahoga Falls, and for the further purpose of immediately applying for said project before the beginning of the project s Welcoming Week 2018 to be held the week of September 14-23, 2018, and provided it receives the affirmative vote of two thirds of the members elected or appointed to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor; otherwise it shall take effect and be in force at the earliest period allowed by law.
