1 Buccaneer Bay Newsletter March, 2012 Note from the Editor If the old saying In Like a Lion, Out Like a Lamb really rings true, the storms throughout the country on March 1 should be a sign that the end of March will be quite calm. Let s hope so. The early tornados on March 1 made me think that we really should review some of the safety rules for stormy weather. See Page 3 for the article on severe storms. April not only brings Spring Showers but for our area of Cass County it will bring Construction and Progress. The Nebraska Department of Roads plans to begin the Hwy 75 work on April 2. Work will begin on the Webster Blvd. and Bay Rd., with plans of having the new Bay Rd. going over the railroad tracks by April of The North bound bridge over the Platte River will be demolished and replaced, which will require northbound traffic to cross over and use the southbound bridge. The entire project of replacing the Platte, current railroad bridge, adding the new railroad bridge over Bay Rd., rerouting Webster Blvd. and the four-lanes heading south to Avenue B in Plattsmouth is expected to be completed by early This project requires a lot of utility work with all of the utility companies. There will be a lot of construction going on which will require flagmen controlling traffic. It will be an inconvenience, but just keep thinking once the project is completed we will have a much safer access to Hwy 75 than we do today. At the same time that the Hwy 75 project is started the county will be working on paving 18 th St. This work is to begin by the end of April and be completed by the end of June. So for a while no matter which way you head to town there will be construction. 18 th St. will be paved one side at a time, keeping traffic open at all times. For those of you not familiar with the county roads around Buccaneer Bay, you can head west on Bay Rd. and follow it to 48 th St. which comes out on Hwy 66. From there you can get back on Hwy 75 or head west to Louisville. See sample map to the right. 2 This-N-That Tracking Ruby Throated Hummingbirds The Ruby-throated Hummingbirds travel south for warmer weather during the winter months. They begin their migration north beginning in January. Unlike other birds they do not migrate in flocks, they are independent birds. While we see the hummingbirds around flowers for nectar they are really carnivores. They feed on insects and use the nectar from flowers for fuel power to catch the insects. There is a website where you can find out more information on the Ruby-throated Hummingbird, as well as a map showing where the birds have been seen. You can report the sightings of the male Ruby-throated hummingbird, seen above, at Link submitted by Gregg Owen Buccaneer Bay Phone Directory It is that time of year to print up the new Buccaneer Bay Phone Directory. I keep this updated with any changes current residents give me, as well as from new neighbors who return their Data Sheet that they receive in their Welcome Package when they move to Buccaneer Bay. If you are new and have not returned your Data Sheet or you have changed your phone number and would like to have it corrected in the BB phone directory, please fill out the Data Sheet located on the last page of this directory and return to Janet McCartney by April 15. The new directories will be ready for delivery by the end of April. Speeding in Buccaneer Bay By Janet McCartney I have received several calls and s on speeders in Buccaneer Bay. The speed limit is posted throughout Buccaneer Bay. Since it is a residential area the posted speed is 25 mph. Please remember that even though you may be in a hurry to leave for work or get home we do have a lot of children in the neighborhood and they may not always be watching for cars while they are out playing. If you see a car driving over the speed-limit or driving dangerously the Sheriff s Office has requested that you call them at with the date, time, street they were speeding on and their license plate number. The Sheriff s Office does not want anyone to take it upon themselves to follow or confront a speeder. Cass County Historical Society Museum Events 646 Main St. Plattsmouth, NE Tuesday Sunday: 12:00 t0 4:00 PM Exhibits Mini Exhibit Edgar Allan Poe March 6 April 1 In conjunction with Plattsmouth Public Library s Big Read for The Stories and Poems of Edgar Allen Poe, the museum will exhibit a 1904, 7-volume set of Poe s works, donated to the museum by Mary Braatz. Grand Army of the Republic Badges March 6 June 3 The Historical Society owns a large collection of G.A.R. badges. Most of them were collected by Col. H. C. McMaken, a Civil War veteran who joined the G.A.R. in 1881 and traveled to encampments all over the country for the next twenty years. Brown Bag Programs, 12:00 Noon The programs are free and open to the public. Coffee and cookies will be served. Tuesday, March 13 The Big Read: Edgar Allan Poe Plattsmouth Librarian, Kirsten Wood will talk about Edgar Allan Poe and the Library s events for this year s Big Read. Tuesday, March 27 Pioneer Cemeteries, Part 2 Roy Smith will present Part 2 about the pioneer cemeteries in Cass County. Annual Buccaneer Bay Garage Sale By Janet McCartney The Annual Buccaneer Bay Garage Sale is always held on the first Friday and Saturday in June. This year those dates fall on June 1 and June 2. I have organized the Garage Sales for the past 15 years and while it is not a lot of work, it does take some time to put the lists together and get the ads to the newspapers. I really need to have someone else in the neighborhood take this project on. If you are interested please give me a call at I can easily send you the documents that I use for tracking. I would still run the signup sheet in the April and May newsletters to be returned to the person who will be tracking them. We also might want to consider skipping the organized garage sale this year due to the expected construction. Page 2

3 Severe Storms A Guide to Survival The following information was published by the Nebraska Emergency Management Agency Severe storms strike quickly! Thunderstorms can produce heavy rain, strong winds, lightning, hail and tornadoes. You may need to respond promptly to one of these threats posed by a storm in your area. The National Weather Service, in cooperation with the broadcast media and your local spotter system, will provide you with the warnings you need to quickly respond. If you listen to the media, you will know when a storm is approaching your area and you will know if you need to take protective action. Watch or Warning: A Severe thunderstorm Watch means conditions are right for the development of storms. Stay tuned to the media for further advisories. A Severe Thunderstorm Warning means a storm is probable in the warned area and residents there should be prepared to take cover. Don t wait until an emergency siren sounds to start looking for flashlights and other things. Plan ahead. Editorial Note: Buccaneer Bay does not have sirens that can be sounded to alert you of severe weather. There are very inexpensive weather radios that can be purchased and the newer ones can be tuned to only look for severe weather in your immediate area. When severe storms threaten, keep alert. Stay tuned to the media for current information. Know where to find shelter. Pick the safest spot. Make sure the entire family knows where to go at home, at work, in school, at the mall anywhere they might be when the storms strike. Avoid traveling. DURING STORM WARNINGS, you should seek more secure cover and have a plan that includes abandoning your mobile home. Flash Flooding: Floods kill more people on average than tornadoes and lightning combined! Most flood deaths are due to flash floods. Flash floods are often the result of heavy rains associated with severe thunderstorms. You will not always have a warning that these deadly, sudden floods are coming. When a flash flood WATCH is issued, be alert and be ready to evacuate on a moment s notice. When a flash flood WARNING is issued, or the moment you realize a flash flood is imminent, act quickly to save yourself. You may only have SECONDS! Nearly half of all flash flood fatalities are auto related. In your automobile, look out for flooding at highway dips, bridges and low areas. Do not drive through flowing water. A mere two feet of water will carry away most automobiles. Lighting: Lightning kills between 75 and 100 people nationwide annually. During thunderstorms, stay inside. If you are outdoors, an automobile is a safe place to be. Indoors, keep away from doors, windows, stoves, sinks, metal pipes or other conductors. Don t use the telephone. Disconnect electrical appliances such as TVs and radios. Page 3 Outdoors, minimize your height but don t lie flat. Do not take shelter under a tree. Stay away from wire fences or other metallic conductors. Avoid standing in small sheds in open areas. Tornados: The most destructive and devastating product of a thunderstorm, these violent twisters, are characterized by a twisting, funnel-shaped cloud, which forms from the bottom of a wall cloud and touches the ground. Tornadoes are often accompanied by lightning, heavy rain and hail. In an average year, the United States reports 800 tornadoes resulting in 80 deaths and 1,500 injuries. While they can occur all year, they are most common during the spring in the Great Plains, where they develop along drylines, which separate very warm, moist air to the east from hot, dry air to the west. Tornado-producing thunderstorms may form as the dryline moves east during the afternoon hours. Nebraska is in the middle of tornado alley and each year the stat averages 35 tornadoes. Knowing tornado safety is your best hope for surviving. You must have a PLAN. Stay tuned to the media when the watches are sounded and be prepared to seek shelter if a tornado warning is issued in your area. The safest place to be when a tornado strikes is in a basement under something sturdy like a workbench. If your house doesn t have a basement, seek shelter in a small room in the middle of the house. A closet or a bathroom is best. The more walls between you and the approaching storm, the better. Have a portable radio and flashlight handy to take with you. If you live in a mobile, home, even those with tie downs, seek more permanent shelter. Go to a prearranged shelter. Go to a friend s house or a nearby structure with a basement. As a last resort, go outside and lie flat on the ground with your hands over your head and neck. In an automobile, never try to outrun a tornado. Tornadoes can toss cars, and even large trucks, around like toys. Get out of your vehicle and seek a safe structure or lie down in a low area with your hands covering the back of your head and neck; keep alert for flash floods. If at work or school know the emergency shelter plans. If no specific plans exist, go to an interior hallway or small room on the building s lowest level. Avoid areas with glass and wide, free-span roofs. In a store or shopping mall, if you can t get to a basement or designated shelter, go to the center of the lowest level of the building. Avoid windows and lie flat. Cover yourself with any handy object. A TORNADO WATCH is issued when conditions are favorable for them to develop. Be prepared to take action. A TORNADO WARNING is issued when radar indicates a tornado, or if a funnel cloud has been sighted. Seek shelter immediately. HAVE A PLAN!

Several residents do not want them, and it can be a sign that the resident may be out of town, if the packet stays in the driveway for an extended length of time. In the last flyers we received there was a note from the World-Hearld that gives the option to opt out of receiving the Food Express. All you have to do is call or them at foodexpress@owh.com and request that the delivery stops. Clever Ideas - Hull strawberries by pushing a straw up through the bottom of the strawberry. - Keep matching bed linen together by placing them inside of one of the pillow cases. - Stop cut apples from browning in a lunch box by securing the cut pieces together with a rubber band. - Use a muffin pan, with plastic cups held in place with a sticky magnet to hold craft supplies. - When you travel and stay in hotels, save the shower caps they provide and then next time you travel store shoes inside the shower caps to stop dirty soles rubbing on your clothes. - Use those plastic bread tabs to make labels to be placed on your computer cords. - Make cookie bowls for ice-cream by spreading cookie dough over the bottom of muffin pan cups and then bake.

10 MINUTES OF THE MEETING OF FEBRUARY 21, 2012 SANITARY AND IMPROVEMENT DISTRICT NO. 5, CASS COUNTY, NEBRASKA Meeting convened at 6:00 p.m. on February 21, 2012 at the Community Room of Plattsmouth State Bank, 446 Main Street, Plattsmouth, Cass County, Nebraska. Attached hereto are: the agenda for the meeting; the Affidavit of Printer regarding publication of notice of the meeting, which communicated the availability of the agenda, in the Plattsmouth Journal, Plattsmouth, Nebraska; advance notice of the meeting as provided to the County Clerk of Cass County and all Trustees; and the Trustees acknowledgment of receipt of said notice and agenda. All proceedings were taken while convened with attendance open to the public. ITEM 2 The Chair announced the location of the Open Meetings Act and documents related to the agenda. ITEM 10 Motion by Meisinger, seconded by Morrison: Be It Resolved by the Board of Trustees of Sanitary and Improvement District No. 5 of Cass County, Nebraska to approve Pay Application No. 4 from Gen-Mech Contractors for work related to the 2011 Water Well Improvements Project (Resolution of Necessity approved April 19, 2011). RESOLUTION BE IT RESOLVED BY THE BOARD OF TRUSTEES OF SANITARY AND IMPROVEMENT DISTRICT NO. 5 OF CASS COUNTY, NEBRASKA (THE "DISTRICT") AS FOLLOWS: Section 1: The Board of Trustees of the District hereby finds and determines: (a) that the District was duly formed and remains in existence pursuant to the Constitution and applicable laws of the State of Nebraska; (b) that the District has heretofore issued and there are now outstanding bonds and/or warrants of the District (collectively, the Outstanding Tax-Exempt Obligation ); and (c) that it is necessary and advisable for the District to adopt certain procedures to promote compliance with certain federal tax and securities laws relating to the Outstanding Tax-Exempt Obligation. Harrold, Clerk EXHIBIT A Procedures Federal Tax Law and Disclosure Requirements for Outstanding Bonds and Warrants POLICY It is the policy of Sanitary and Improvement No. 5 of Cass County, Nebraska, (the District ) to comply with all Federal tax requirements and securities law continuing disclosure obligations for its outstanding tax-exempt bonds and warrants (the Tax- Exempt Obligations ) to ensure (a) that interest on its Tax-Exempt Obligations remains exempt from Federal income tax and (b) compliance with any continuing disclosure obligations of the District with respect to its outstanding Tax-Exempt Obligations. PROCEDURES Compliance Officer. Review of compliance with Federal tax requirements and securities law continuing disclosure obligations as generally outlined below shall be conducted by the Clerk of the District (the Compliance Officer ) or other member of the board of trustees as determined on an annual basis. Training. The Compliance Officer shall consider the need to evaluate and review educational resources regarding post-issuance compliance with Federal tax and securities laws, including periodic review of resources published for Districts of tax-exempt obligations by the Internal Revenue Service (either on its website at or elsewhere) and the Municipal Securities Rulemaking Board (either on its Electronic Municipal Market Access website [ EMMA ] at or elsewhere) based upon the outstanding warrant and bond issues. Compliance Review. A compliance review shall be conducted at least annually at the direction of the Compliance Officer. The review shall occur at the time the District s annual audit takes place, unless the Compliance Officer otherwise specifically determines a different time period or frequency of review would be more appropriate. Scope of Review. Document Review. At the compliance review, the compliance officer will inquire of the District s fiscal agent and bond counsel if they are aware of any concerns regarding general compliance with covenants and agreements and applicable regulations with respect to each outstanding Tax-Exempt Obligation including the following documents (the Bond Documents ): (a) the resolution(s) adopted by the governing body of the District authorizing the issuance of its outstanding Tax- Exempt Obligations, together with any documents setting the final rates and terms of such Tax-Exempt Obligations (the Authorizing Proceedings ), (b) the tax documentation associated with each Tax-Exempt Obligation (the Tax Documents ), (c) the District s continuing disclosure obligations, if any, contained in the Authorizing Proceedings or in a separate agreement, as the case may be (the Continuing Disclosure Obligations ), and Page 11

12 (d) any communications or other materials received by the District or its counsel, from bond counsel, the underwriter or placement agent or its counsel, the Internal Revenue Service (the IRS ), or any other material correspondence relating to the tax-exempt status of the District s Tax-Exempt Obligations, or relating to the District s Continuing Disclosure Obligations. Use and Timely Expenditure of Bond Proceeds. As the obligation of most all proceeds occurs prior to expenditure, it is assumed that proceeds have been timely expended. However, should the District issues Bonds in excess of prior obligations, the expenditure of proceeds of outstanding Tax-Exempt Obligations shall be reviewed by the Compliance Officer to ensure (a) such proceeds are spent for the purpose stated in the Authorizing Proceedings and as described in the Tax Documents and (b) that the proceeds, together with investment earnings on such proceeds, are spent within the timeframes described in the Tax Documents and (c) that any mandatory redemptions from excess proceeds of Tax-Exempt Obligations are timely made if required under the Authorizing Proceedings and the Tax Documents. Arbitrage Yield Restrictions and Rebate Matters. As the obligation of most all proceeds occurs prior to expenditure, it is assumed that the arbitrage yield restrictions would be moot as the bond proceeds will be used prior to all other resources available. However, should the bond proceeds exceed the prior obligations, the Tax Documents shall be reviewed by the Compliance Officer with the assistance of outside counsel to ensure compliance with any applicable yield restriction requirements under Section 148(a) of the Internal Revenue Code (the Code ) and timely calculation and payment of any rebate and the filing of any associated returns pursuant to Section 148(f) of the Code. A qualified rebate analyst shall be engaged as appropriate or as may be required under the Tax Documents. Use of Bond Financed Property. All bond financed property is currently of a general infrastructure nature and accordingly is held for the general benefit of the taxpayers of the District. Should any future bond financed property be of any other nature, the findings, expectations, representations, warranties, covenants and agreements contained in the Bond Documents regarding private use shall be reviewed by the Compliance Officer to ensure compliance. Property financed with Tax-Exempt Obligations shall be clearly identified (by mapping or other reasonable means). Prior to execution, the Compliance Officer (and the District s counsel, if deemed appropriate by the Compliance Officer) shall review (a) all proposed leases, contracts related to operation or management of property financed with Tax-Exempt Obligations, take-or-pay contracts or other agreements or arrangements or proposed uses which have the potential to give any entity any special legal entitlement to the property financed with Tax-Exempt Obligations, (b) all proposed agreements which would result in disposal of any property financed with Tax-Exempt Obligations, and (c) all proposed uses of property financed with Tax-Exempt Obligations which were not anticipated at the time the Tax-Exempt Obligations were issued. Such actions could be prohibited by the Authorizing Proceedings, the Tax Documents or Federal tax law. Continuing Disclosure. Compliance with the Continuing Disclosure Obligations with respect to each Tax-Exempt Obligation issue shall be evaluated (a) to ensure timely compliance with any annual disclosure requirement, and (b) to ensure that any material events have been properly disclosed as required by the Continuing Disclosure Obligation. Record Keeping. If not otherwise specified in the Bond Documents, all records related to each Tax-Exempt Obligation shall be kept for the life of the indebtedness associated with such Tax-Exempt Obligation (including all tax-exempt refundings) plus six (6) years. Incorporation of Tax Documents. The requirements, agreements and procedures set forth in the Tax Documents, now or hereafter in existence, are hereby incorporated into these procedures by this reference and are adopted as procedures of the District with respect to the series of Tax-Exempt Obligations to which such Tax Documents relate. Consultation Regarding Questions or Concerns. Any questions or concerns which arise as a result of any review by the Compliance Officer shall be raised by the Compliance Officer with the District s counsel or with bond counsel to determine whether non-compliance exists and what measures should be taken with respect to any non-compliance. VCAP and Remedial Actions. The District is aware of (a) the Voluntary Closing Agreement Program (known as VCAP ) operated by the IRS which allows Districts under certain circumstances to voluntarily enter into a closing agreement in the event of certain non-compliance with Federal tax requirements and (b) the remedial actions available to Districts of certain obligations under Section of the Income Tax Regulations for private use of property financed with Tax-Exempt Obligations which was not expected at the time the Tax-Exempt Obligations were issued. He looks like a small, old man (about 2 feet tall), often dressed like a shoemaker, with a cocked hat and a leather apron. According to legend, leprechauns are aloof and unfriendly, live alone, and pass the time making shoes. They also possess a hidden pot of gold. Treasure hunters can often track down a leprechaun by the sound of his shoemaker's hammer. If caught, he can be forced (with the threat of bodily violence) to reveal the whereabouts of his treasure, but the captor must keep their eyes on him every second. Place the softened ice cream in a large mixing bowl. 2. Pour the limeade in with the ice cream. 3. Add the food coloring using more if you want a darker green color. 4.
