1 April 14, 2014 Audio CALL MEETING TO ORDER At 9:06 a.m., Chair John Justman called to order a regular Administration meeting of the Board of Mesa County Commissioners at the Mesa County Courthouse, Commissioners Public Hearing Room, 544 Rood Avenue, Grand Junction, Colorado. Those present included Commissioner Steve Acquafresca, Commissioner Rose Pugliese, Tom Fisher, County Administrator; Angela Barnes, Assistant County Attorney; and Lori Westermire, Clerk to the Board. Note: David Frankel, Acting County Attorney, joined the Public Hearing at 9:50 a.m. PRESENTATIONS (0:31) Proclamation National Health Care Decision Day, April 16, 2014 Commissioner Pugliese read the Proclamation into the record proclaiming April 16, 2014 as National Health Care Decision Day. She presented the Proclamation to Katherine Branham, Mesa County Library and Dyann Walt, Department of Human Service's Adult Protection Program. ROSE PUGLIESE MOVED, STEVE ACQUAFRESCA SECONDED AND MOTION UNANIMOUSLY CARRIED TO ADOPT A PROCLAMATION PROCLAIMING APRIL 16, 2014 AS NATIONAL HEALTH CARE DECISION DAY. COMMISSIONERS' REPORTS (:08:00) Commissioner Acquafresca stated he participated in the first of a series of selection processes for the new Extension Horticultural Agent position, he attended a Museum of the West Board Committee meeting and the Grand Junction Chamber Energy briefing. He was part of a welcoming group for about 20 visitors from Arizona that were looking at the Colorado River Front Trail, and he attended the first Manufacturer s Summit hosted by the Mesa County Manufacturing Alliance. Commissioner Pugliese reported she attended the monthly Board of Human Services meeting, a County Leadership meeting, and the Manufacturer s Summit. Chair Justman stated he traveled to Montrose for the Gunnison Basin Roundtable, and attended the Health and Human Services meeting and the Manufacturing Summit. Page 1 of 5
2 ADMINISTRATION CONSENT AGENDA (0:13:38) 1. RATIFY THE SELECTION OF FIVE (5) FINALIST APPLICANTS UNDER CONSIDERATION FOR THE POSITION OF MESA COUNTY ATTORNEY (Report on file at the Mesa County Clerk s Office; Report File No. BOCC ). 2. APPROVE A CONTRACT BETWEEN MESA COUNTY AND STATE OF COLORADO DEPARTMENT OF LOCAL AFFAIRS (DOLA) FOR GRAND VALLEY TRANSIT (GVT) COMPRESSED NATRUAL GASS (CNG) BUS PURCHASE IN THE AMOUNT OF $145,000 AND AUTHORIZE THE CHAIR TO SIGN (Contract on file at the Mesa County Clerk s Office; Contract and Agreement File No. BOCC ). 3. APPROVE A CONTRACT BETWEEN MESA COUNTY AND M.A. CONCRETE CONSTRUCTION, INC. FOR CLIFTON CURVES PHASE II AT 32 1/2 AND D ROAD IN THE AMOUNT NOT TO EXCEED $480, AND AUTHORIZE THE CHAIR TO SIGN (Contract on file at the Mesa County Clerk s Office; Contract and Agreement File No. BOCC ). DISCUSSION ON CONSTENT AGENDA ITEMS Concerning Item #1 Rose Pugliese stated the Board met on April 7, 2014 in Executive Session to go over the applications and determine the finalists. Concerning Item #2 Steve Acquafresca asked how many buses will the DOLA Grant contribute to, and what percentage of the fleet will be CNG. Todd Hollenbeck, Manager, Regional Transportation Planning Office, stated the Grant will go toward five new buses at $29,000 per bus, and the goal is to have the entire fleet of 26 buses changed out to CNG by STEVE ACQUAFRESCA MOVED, ROSE PUGLIESE SECONDED, AND MOTION UNANIMOUSLY CARRIED TO APPROVE CONSENT AGENDA ITEMS ONE THROUGH THREE AS DISCUSSED. INDIVIDUAL CONSIDERATION (0:18:28) CONSIDER AMENDMENT TO THE COUNTRY JAM PUD (PRO CP, RESOLUTION) TO AMEND CONDITIONS OF APPROVAL CONTAINED IN RESOLUTION MCM , IN RESPONSE TO THE 2013 ANNUAL REPORT (Report on file at the Mesa County Clerk s Office; Contract and Agreement File No ). 3 CP COUNTRY JAM PUD AMENDMENT Property Owner(s): Northern Crossarm Co., Inc. Representative(s): Sally Mazzocchi, Townsquare Media Group Location: 1065 Highway 6 & 50, Mack Zoning: PUD Planner: Kaye Simonson, Senior Planner Request Amendment to the Country Jam PUD (PRO CP, Resolution) to amend conditions of approval contained in Resolution MCM , in response to the 2013 Annual Report. Staff recommends approval with Conditions. MCPC recommended approval with Conditions, 7-0. The project can meet or has met the applicable criteria of the code with conditions of approval. No written public comments were received. Kaye Simonson, Planning, entered into record the Project File, Project Report, the Country Jam PUD Amendment, Mesa County Land Development Code, Mesa County Master Plan, and a Power Point presentation as Exhibit A. Kaye Simonson provided a summary of the history of Country Jam in Mesa County, the Official Development Plan for the Mack property, the addition of Rock Jam in 2003, and a summary of the 2013 County Jam Annual Report. The proposed PUD Amendment is a result of the findings from the 2013 Annual Report. The 2013 Report found that conditions exist that require correction with regard to adequacy of public health and safety. Therefore, the proposal includes seven conditions of the PUD that will be revised, six new conditions, and one condition that will be deleted. Townsquare Media purchased County Jam in 2013 and is the new operator. Applicant representatives, Sally Mazzocchi, Townsquare Media, 240 Greenwich Avenue, Greenwich, Connecticut, and Brent Jagger, Owner and Vice President of Citadel Security, 496 Mountain Drive, Grand Junction; provided additional information and discussed planned changes to increase public safety. Ms. Mazzocchi explained Townsquare Media's history in event management and conducting festivals across the country. She stated she is concerned with the fee that will be required to pay the Sheriff's Office. She said up until 2011 a fee was paid by County Jam and Rock Jam for law enforcement coverage, but the fee was not required in 2012 and 2013 and noted the number of incidents went down. She stated security was previously supplemented by private security and the new owners are planning additional security for the 2014 festivals. Ms. Mazzocchi stated the fee jump from $0 in 2013 to $50,000 for 2014 was not expected. She suggested an economic impact study to determine the economic impact the event has on Mesa County. Rose Pugliese commented on the Country Jam statistics that in 2009 DUI's were 56 and in 2013 there were 8; Minor in Possession/Alcohol Offenses were 187 in 2010 and 120 in 2013; and for Contributing Alcohol to a Minor there were 24 Page 3 of 5
4 in 2010 and 17 in She asked for clarification on the fee amount and Sheriff Stan Hilkey stated the fee will be $50,000 for the four-day County Jam, and $25,000 for the two-day Rock Jam event. Rose Pugliese asked what the Sheriff's Officers will do differently than private security and Sheriff Hilkey stated there is cooperation with the private security but that certain violations require the authority of a State of Colorado Certified Peace Officer. She stated she would like to wait one more year without putting the fee provision in the Amendment in order to give the new owner's time to prepare an economic impact study, and to give the Sheriff's Office time to determine the cost of the event with the new owners. Sheriff Hilkey stated the Sheriff's Office previously received about $75,000 per event, but has spent over $100,000 on some of the years that have bigger statistics. He stated the downturn in the statistics is due to the number of resources that had been added to the event in 2009, 2010 and 2011, and since then, only a skeleton crew is available to work. He noted private security has increased at the event. John Justman asked what constitutes a skeleton crew and Sheriff Hilkey stated it varies during the day and evening, but the staff works overtime so that they are not taken from serving the citizens in the rest of Mesa County. John Justman asked how much security will be increased and Brent Jagger stated they plan to increase by about two-thirds at the gates and in the festival area. Steve Acquafresca asked Sheriff Hilkey to explain why the reported reduced violations in the last couple of years are a result of fewer law enforcement officers. Sheriff Hilkey stated it is a function of how many officers are present at the event. Steve Acquafresca asked if private security is in uniform at the event, and if the private security staff is trained to deal with the use of marijuana. Mr. Jagger confirmed all security has some form of uniform with shoulder patches, badges and a hat, and that staff is trained to deal with violations involving marijuana. Steve Acquafresca stated that during the County's budget process the Sheriff's Office does not budget for the extra costs of providing law enforcement at the festivals and stated he would like to see the owner's conduct an economic study. STEVE ACQUAFRESCA MOVED, JOHN JUSTMAN SECONDED, AND MOTION CARRIED 2-1 TO APPROVE ITEM CP COUNTRY JAM PUD AMENDMENT TO AMEND CONDITIONS OF APPROVAL CONTAINED IN RESOLUTION MCM , IN RESPONSE TO THE 2013 ANNUAL REPORT.
